I know this was mentioned in the previous thread, but I just saw it, and, WOW, is the STLPOA full of shit or what?
Roorda warned, “I know that there are those that will say that these players are simply exercising their First Amendment rights. Well I’ve got news for people who think that way, cops have first amendment rights too, and we plan to exercise ours. I’d remind the NFL and their players that it is not the violent thugs burning down buildings that buy their advertiser’s products. It’s cops and the good people of St. Louis and other NFL towns that do. Somebody needs to throw a flag on this play. If it’s not the NFL and the Rams, then it’ll be cops and their supporters.”
(emphasis added)
St. Louis Cops Declare Rams’ “Hands Up Don’t Shoot” To Be “Offensive”
As a commenter mentioned at Deadspin, if the cops stuck to the first amendment rights, instead of moving on to the 2nd, maybe there wouldn’t be a problem. Hmmmm.

I’d like the response to this shit to be “Go fuck yourselves,” but I know that won’t be the case. The Rams management will release some mealy-mouthed apology and the players with be chastised for making a public display. Why? Because the NFL is a business and anything that hurts profits is to be punished.

Morning Lizards.
He’s also against body cams. Claims they will be used to nickle and dime officers over minor offenses.
Oh, and he’s a lying sack of shit as well.
According to court filings from a later appeal, Roorda was accused in 1997 of trying to cover for another officer by filing a report containing false statements about a suspect’s apprehension and arrest. That incident earned him a reprimand.
Four years later the department fired him after a dispute with his police chief over paternity leave grew heated. Roorda claimed that the chief verbally intimated him, but an audio recording proved that this claim, too, was a “false report.”
29 | Rev_Arthur_Ebolaing Dec 1, 2014 5:09:51am |
And Roorda has a history of his own that is gobsmacking:
Though Roorda is, by all accounts, a friend to the police, his own history as a cop isn’t all that flattering. He spent eleven years as a police officer in Arnold before the department terminated him 2001.
Roorda went on to become Chief of Police for Kimmswick, a tiny city in Jefferson County with a current population listed at 157. He was elected to the Missouri House of Representatives in 2004. Now, he’s got his eye on the Senate.
STL is fucked. :(
Edit: I see Bubblehead II beat me to it. The charges of “false reports” are particularly ironic in the situation.

In any case, Roorda sees the push for body cameras as a way of harassing officers who commit minor infractions, like rolling a stop sign or not buckling their seat belt. He opposes the use of body cameras for the same reason.
He means “minor infractions” in which the an average Joe would get ticketed but not his gestapo.

Uh…how exactly would a cop get in trouble for rolling a stop sign or not wearing their seat belt because of body cameras? Is there someone out waiting for a cop to do that so they can FOIA the video footage and go get a warrant from the local magistrate/judge against the cop (if that’s even possible in Missouri)?

You know what’s offensive? That police officers shoot first.
There’s no asking questions later, because prosecutors are loathe to investigate law enforcement. They don’t want to bite the hand that feeds them a steady stream of defendants, and if a cop is on the docket, then that leads to questions about their actions and all the cases they’ve brought before.
McCullough didn’t want to bring the case to the grand jury, and his unique way of presenting the evidence to the grand jury speaks volumes to how he tried to pass off responsibility to the GJ, even though it was his office’s job to suss out whether Wilson committed crimes with his shooting of an unarmed black man.
It’s offensive that Rep Roorda is all over the Rams’ act of solidarity with the community that they play for. Roorda’s tone deafness speaks volumes - they’d rather complain about sports figures showing sympathy for the community in Ferguson than doing anything to clean up the race profiling and discrimination by law enforcement in the greater STL area (and which problems extend well beyond STL to the rest of the nation).

I’ve stopped watching football. After the concussion and brain injury business, there’s no reason to support the sport - if I want to watch, it’s with the knowledge that any single play can result in a lasting brain injury to any of the players on the field. Cumulative hits will relegate players to suffering from CTE or other ailments, aside from the rigors of assorted physical injuries that leave players maimed and hobbled.
That takes the fun out of watching. Now, it’s about watching highlights and hoping that the players for my favorite team aren’t getting hurt.

I’m in the same boat. For the last few years, I’ve been in a fantasy football league. We play for a few bucks. But for the past two years, I haven’t really watched any of the games. I still love the athleticism of the running backs and receivers, and the field command of good quarterbacks, but the violence of the game has put me off it.
This will likely be my last fantasy football season.

It’s not just the professional players that are suffering from the side effects of concussions.
High school head injury lawsuit filed
CHICAGO (AP) - A former high school quarterback followed in the steps of one-time pro and college players Saturday by suing a sports governing body - in this case the Illinois High School Association - saying it didn’t do enough to protect him from concussions when he played and still doesn’t do enough to protect current players.
*snip*
Eight high school students died directly from playing football in 2013 - six from head and two from neck injuries - while there were none last year in college, professional or semi-professional football, according to a 2014 report by National Center for Catastrophic Sport Injury Research.
and
Ohio State player dead of self-inflicted gunshot
Karageorge’s parents filed a missing-person report Wednesday evening, and his mother, Susan Karageorge, told police he has had several concussions and a few spells of being extremely confused, according to the report. She said that at about 1:30 a.m. Wednesday he texted a message that cited the concussions and said, “I am sorry if I am an embarrassment.”

Nope. Two much ego and resources invested into the mind set to initiate a re-evaluation and then possibly admit being wrong. Once you start down the slippery slope of possibly admitting an error it leads to internal conflict, and then dissension within the group. Which can not be allowed!

Roorda is such a freaking asshole.
He’s a bully is what he is, and that’s what seems to be acceptable now in the eyes of cops. They’re bullies with the protection of the law, the thin blue line, such that they can shoot you and if you survive, you’ll be the one going to jail for “threatening” them. Hell, there’s a fellow down in Florida who’s facing a first degree murder charge because the cops shot somebody in the process of arresting him for being drunk and belligerent. Yes, the law is so fucked in Florida that the cops shot and killed a bystander, but it’s automatically the fault of the guy was being arrested for being drunk and dumb.

The difference of course being that the killer of the white kid was almost always in jail for the crime. I guess to some people the real outrage is that that story didn’t get coverage or outrage because we are supposed to be angry about interracial killings and not that the law basically allows certain people to kill certain other people and then receive an award.

This comparison makes zero sense for so many reasons. First, the Obama girls were not doing anything classless or disgraceful or embarrassing….like being part of a drunken brawl at a house party. The Obama girls were merely standing next to their father enduring a cheesy tradition [that was started by a GOP president] and yet some GOP hack wanted to create yet another non-scandal. Second, what Democratic staffer or politician posted anything to a social media account smearing the Palin girls for their drunken brawl at a house party? Dave Weigel can go fuck himself.

One thing we have learned from events like Ferguson is that we are not just dealing with a few bad apples, the rot is systemic and goes right the top and even beyond.
Has anyone read through some of the Grand Jury testimony. I have only got through the first two witness and am just amazed by the bullshit involved.
A Sergeant who appears to be Wilsons supervisor, testifies that Wilson told him that Mike Brown charged with his hands up. Was asked by one of the assistant prosecutors: “Did he(Wilson) indicate how Mike Brown raised his arms?” A: “It was like this…he was going to charge at him.” He apparently demonstrated to the Grand Jury. I’d like to see what he did.
This sequence got to me:
Q: Did he say at that time he shot him?
A: He told me when he took the step forward.
Q: He shot him?
A: He knew he couldn’t fight this man.
Another sequence that just pissed me off: Q for prosecutor A for Sergeant even if not really questions:
Q: Did Officer Wilson have any blood on his hands?
A: I did not see any blood
Q: Okay, in the written recorded statement, we learned that he washed his hands because there was blood on them and he was checking for an injury or spread of infection.
A: Whose recorded statement.
Q: Your recorded statement.
A: It had to be something I learned after that day.
Q: All right, thank you.
Inconsistency in this statement and the prosecutor just says thank you. No Indictment=No Justice.

See, that’s the sort of inconsistency that a defense attorney jumps all over. The sort of shit that would have them visibly salivating. And here, it’s just glossed over, nothing to worry about. As you read through the transcript, you begin to understand that they had absolutely no desire to see this go to trial. Because even if they got Wilson acquitted, they’d do irreparable damage to the department. Any cases presently on appeal for improper procedures would be hurt and future cases would have to deal with the very public airing of how sloppy things are done when they think nobody is watching.

The Ferguson Decision Was Not a ‘Miscarriage of Justice.’ Liberals Need to Accept That
[…]
What liberals and the left are doing can be characterized by the term “synecdoche,” a figure of speech in which a part is used to represent a whole. America is termed “Washington” or William Jennings Bryan as “the great commoner.” Liberals took the decision by the grand jury to symbolize, or stand in for, the greater injustice of the Ferguson and of the American criminal justice department. But in fact the reverse occurred. They projected the larger injustice of the system onto the grand jury’s ruling. In doing so, they suggested that in evaluating the grand jury’s decision, one should ignore the gray, and focus only on the black and white.
I don’t agree with the need to use labels, e.g., “liberal”, as I think these kind of terms are way short and now out of date.
To me, the killing of Brown is more like a flashpoint, or in the terminology of complex systems, a “tipping point” (and how that phrase has been misused over the past couple of years, too) in the discussion of justice and race in this country.

In the narrow sense, they are right, there was not enough incontrovertible evidence to warrant an indictment. But the lack of evidence and witness testimony was the result of a conscious policy on the part of the FPD to see that the case did not come to trial.

Perhaps the New Republic staff can answer me this: If grand juries can so ably handle the nuances of our justice system and their decisions on whether or not to indict decide the legality of the defendant’s actions, then why do we bother with trials? Hell, why do we even have trials when they do indict? The argument made time and again since last Monday has been that if a grand jury fails to indict, then there was no case there and thus no chance of a conviction. If so, then why don’t we just treat an indictment as proof of guilt and move straight to the sentencing? We’d save so much time and we’d put defense attorneys out of business since the only person who may present evidence and question witnesses is the prosecutor.

re: #107 freetoken
They didn’t need incontrovertible evidence to proceed with an indictment. That’s not the standard for a grand jury to hand down an indictment.
It’s only that there needs to be probable cause to believe that Wilson committed a crime.
It’s a much lower standard than incontrovertible evidence (which sounds a lot more like beyond a reasonable doubt, which is the standard that jurors in a criminal trial must utilize).
Given the lower standard of probable cause, there was sufficient evidence to find for an indictment, if the prosecutor had seen fit to present the same evidence in a manner consistent with all other grand juries that he had seated. The unique method he concocted for this grand jury meant that he was treating this as both grand jury and as a trial, even though that’s not how it’s done, and that the one-sided nature of the presentment of evidence meant that he could subtly and not-so-subtly treat some witness statements as not trustworthy while giving all benefits of doubt to Wilson and those that supported his version of events.

I accept the onus really falls on the prosecutor and the DA’s office.
As noted by so many, there is a symbiotic relationship between DAs and police departments, and this leads to the back-scratching arrangements that very well may thwart the concept of “justice” as we desire that to mean.

Co-worker was sort of surprised when I offered up the concept that that a DA might enter the proceedings not wanting a non-indictment. Just not something he had thought of occurring outside of a DA being “bought”.

That’s correct.
When the defendant who doesn’t enter a plea deal goes to trial, the issues of fact or law are to be addressed before the judge and jury. A competent defense will be able to question witnesses, evidence gathering, and other procedural matters. The judge may rule to exclude certain evidence from being heard as prejudicial, improperly gathered, hearsay, etc. They could rule that the jury is supposed to disregard certain information, witness statements, etc., and the judge will also identify the rule of law that applies to the case and present jury instructions.

But that only kicks in if the process goes down the “indictment” side of the processing chain. Per my comment #158 that leaves an obvious point of failure in the case of a underzealous or biased prosecuting attorney.

In some jurisdictions, a single officer/deputy will come to the grand jury and just read off other officers’/deputies’ incident reports to the grand jury for all the charges.
Boom, true bills, and done.

It’s prosecutorial discretion to go for an indictment, or to file charges (without a GJ indictment). So, when a prosecutor decides to look the other way and not prosecute, there’s nothing that can be done other than somehow getting a special prosecutor appointed (as was done in the Zimmerman case in FL), or hope here that the feds take up the case as a civil rights violation.

Larry Klayman reacts to #Ferguson by calling Obama an “bigoted anti-white” racist as bad as KKK http://t.co/YuCAh5oKig
— Right Wing Watch (@RightWingWatch) December 1, 2014
Klayman: “…The scary saga of black mob violence in Ferguson, Missouri, this week, where a cop was not indicted for the killing of Michael Brown - a young thug who robbed a convenience store and then attacked the arresting officer - unmasks in greater detail the frightening racial divide and criminal reverse racism among many black Americans incited by the Obamas, Holders, Sharptons and Jacksons of the world. This lot, and their minions, has triggered a racial war - only one that is one-sided. White Americans and others of non-color have been slow to react and fight back, for fear of being branded racists and ostracized from their social and political communities.* Indeed, if white Americans and their ilk would again act in this fashion - as they did to an extent in the old South and elsewhere in the middle years of the 20th century, by burning and looting stores, setting afire buildings and mugging innocent people based on their race - then they would be branded as modern-day versions of the Ku Klux Klan and prosecuted by Obama’s Justice Department, among other law enforcement agencies under his direction and control. “
