“It’s not real. It’s not happening.”

Someone has to just repeat this. Over and over again.

Then start making fun of the dimwits who believe Trump’s fantasies.

“The fantastical thing we saw the other day .. that did not happen either. Neither one had modems. Very hard to hack things without modems.”

Reality is just slapping the right wing across the face.

“Claim after claim after claim with zero proof. Zero.”

Cuomo’s insisting that hospitals use their allotments of vaccines or else face fines. NYC hospitals, most of which are operated by NYC HHC, are doing a crappy job. Going forward, Cuomo insists that providers use up their allotments within 7 days or else face fines.

That’s potentially problematic since the hospitals are supposedly following federal protocols and vaccinating based on the highest risk factors first, but if getting people doses before the doses are rendered useless then this strategy has merit.

Funny, how before the infamous phone call, so many on the GOP side were happy to ride this out, see if Trump could pull it off. They were silent and they were complicit in this going as far as it has. Not to mention, they already cast their votes for the MF. In light of his COVID response and all the horrible illegal things he’s done, they still voted for him.

One bombshell phone call recording was all it took for them to suddenly become “defenders of the Constitution” because they realized their ship was the Titanic.

OT: I am beyond happy right now.

My parents had a rather messy divorce back in 2004 and somewhere along the line virtually all of our family photo albums disappeared which meant I lost countless precious memories from my childhood.

I was doing some housecleaning today and found an old box that contains roughly 200 family photos spanning the late 1980s to the late 1990s, many of which I thought had been lost in those albums. They include one of the only photos I had of my paternal grandfather in his later life (died 1994).

It’s not quite the same as having all the old albums back, but this is much more than I thought I still had and I am so thrilled to have stumbled upon them.

you dont need an inauguration ceremony

virtually anyone can administer the oath of office - anywhere
doesnt have to be the chief justice of scotus
doesnt have to be a judge at all
can, and has been a notary public

the constitution doesnt mandate anyone in particular - or any kind of ‘ceremony’ at all.

and… on 1/20/21 at 12:00pm trump will have no powers at all - ‘emergency’ or otherwise

I came to that conclusion whilst getting a haircut earlier: This presser is not happening because Raffensperger wishes to “correct the record” or any such noble endeavor. He did it because Trump tried to use him as the fall guy and he wasn’t having any of it. The effort to also try to neutralize some of the damage done to the GA GOP’s hopes for tomorrow also had a lot to do with it, an 11th hour attempt to try to get Repub voters to the polls by assuring them that it’s all “legit.”

More nice people have died of cancer. It rarely takes assholes. Off the top of my head, recently Alex Trebek succumbed to cancer. Countless fathers, mothers, sisters, brothers, children, and anonymous people that have never done anything remarkably awful in their life, have died of cancer.

When an asshole dies, I’m not particularly interested in why or how. I’m just thankful they’re finally gone.

Chadwick Boseman died of cancer last summer and he didn’t really even tell anyone about it. He just kept working until he couldn’t.

you dont need an inauguration ceremony

virtually anyone can administer the oath of office - anywhere
doesnt have to be the chief justice of scotus
doesnt have to be a judge at all
can, and has been a notary public

the constitution doesnt mandate anyone in particular - or any kind of ‘ceremony’ at all.

and… on 1/20/21 at 12:00pm trump will have no powers at all - ‘emergency’ or otherwise

re: #165 Nyet

I feel, for example, that Gohmert’s statement should have legal consequences (it absolutely does not according to the current interpretation of the law).

Gohmert’s statement is an interesting case because read literally, since “antifa” is not a thing and “BLM” is historically non-violent, he wasn’t literally inciting people to violence. Now, you know and I know that he was definitely metaphorically inciting to violence - or at least, it would be construed as such in the minds of his alternate-reality believers who think that antifa and BLM are the cause of all the rioting and destruction in the United States since the history of ever - and maybe that’s where the change needs to come in. Instead of the test being, “would a reasonable person interpret it this way,” maybe it should be more along the lines of, “would a person who reasonably believes these facts interpret it this way”.

One immediate objection is the slippery slope. But given that restrictions on free speech already exist (it is by no means absolute), that’s a weak objection and it cuts both ways.

I’ve always felt anyone with positions of authority or working for any organization that uses the term “news” should lose 1st amendment protections if they knowingly lie or intentionally present opinion as fact in broadcasts, official statements, press conferences… tweets… whatever.

Doesn’t necessarily mean they should be locked up for every instance of this, but they should be open to more consequences besides the court of public opinion and hoping that voters will take care of it next election day. As we have seen, that particular set of remedies have been rendered useless in the era of Clownstick.

A lot of what the GOP and Al Qaren has been doing this past year would qualify as “Shouting fire in a crowded theater” as far as I’m concerned anyway, regardless of any theoretical changes to how the 1A works.

With the advent of “news media” which aggressively lie to incite fear and hate in their audience, we have a real problem. Restrictions on hate speech are badly needed, IMO.

Since bad news and sensationalism are the way to clicks, ratings, influence in media the money follows. Of course, we can fine-tune the 1st A or what we consider incitement. Yet it’s our own failure to monetarily reward straight news and considered opinion ahead of what we have funded. Human nature speedbump.

EDIT-This whole conspiracy thing-case in point.

re: #160 Nyet

I must say, and this may be controversial even here, that I don’t really support the extent of your 1st Amdt., esp. as understood by Brandenburg v. Ohio, whose understanding of incitement is too restrictive.

I definitely don’t support the interpretation of the 1st Amendment, just as I don’t support the interpretation of the 2nd Amendment. Both appear to have been intended for very different purposes than their interpretation, as both are currently interpreted (just as everything else in America is) as concepts to put white people above the law.

Whereas I do not, interestingly. I feel that if these comments were made by a person in authority (technical term to be defined by law or federal government rules), then they should face consequences beginning with dismissal from their post. I do not think that people should be jailed for expressing general violent sentiments, though that should certainly land them on somebody’s watch list radar.

Well, the “whining” part is certainly accurate: AFAICT, the “mainstream” media has basically gone out of its way to depict the “ordinary Trump voter” in as uncritical and normative light as possible. I mean, the port side blogosphere (present company unexcepted) routinely slags them for bigoted, neo-fascist yokels, but as far as most “general” media outlets go, they get afforded (IMHO) a lot more “respect” than they deserve. Though I’m sure Meghan McCain (like most GOPers) would simply categorize the proper level of “ respect” as being “ uncritical and unquestioning approval”….
