It’s cavilling, because Islamic jurisprudence can bend and stretch in ways similar to how fundie Christians bend and stretch the Bible. Take the same small set of documents—in order of importance…Quran, Sharia, hadith, preexisting interpretations of the former three by approved scholars of the sect—and you can arrive at any number of readings.

The Taliban have previously pitched and shifted in their theology and religious law, but their general position has been…extremely stentorian readings of all available documents, giving force of law to stuff that’s closer to “advice” (like Hadith) and reading formal religious law in the least charitable most punitive manner. Culturally, the Taliban are tribal Pashtun, and there are a lot of weird hinks in Pashtun understanding of Islam that I don’t know how to explain either. I know they favor the jirga—a sort of consensus counsel of men to act as judge and jury…and jirga tend to be absolutely savage to women. There’s also a baseline misogyny and gender segregation that goes beyond normal Islam and leads to shit like pederasty.

(Sorry, lot of decent Pashtun out there but in the tribal regions people can do horrible shit because that’s what patriarchial totalitarian systems do wherever they are: hack the culture to turn it into license to do what they want…which invariably involves fucking. Ignore the aesthetic of brown people in a barely-developed region and they function exactly like the fundie organizations full of molesters, or the New York nonces that imported all those teenage “models” from Eastern Europe. )

For women, that probably means extreme modesty with harsh penalties, but maybe some property and inheritance rights. It probably doesn’t mean formal education, but I get the feeling these guys aren’t for educating people beyond their madrasas. It likely means that what rights and protections they do have are through their natal or marital family, and the most likely “crime” they’ll commit is violation of their expected role as daughter or wife. Basically…Old Testament shit (literally) where cultural rules and criminal rules are both enforced by the state.

The question will become how formal they make rules—an Islamic law enforcement and legal system would at least have some kind of standard of operation, a chance to challenge claims and a formal process of accusation and arrest. If they stick to the jigra—the local good ole’ boys given life and death power—shit will be worse.

i thought i read that they wrote this using the roberts/scotus opinion in shelby.
that it was up to congress to update the rules and formulas

and that the idea was to use the framework of the opinion so whatever new law congress made, scotus couldnt arbitrarily reverse on itself

from electoral-vote.com, the basic argument seems to be:

so maybe

…some arguments that are not likely to impress the general public, but that judges will sit up and listen to. This recall suit appears to be in the latter category. The plaintiffs are California voters, so it is hard to argue they don’t have standing to bring suit. And while courts are loath to get involved in elections, particularly at the last minute, there’s a real constitutional issue here, so there may be no choice.

and the proposed solutions are not that straightforward because they’d invalidate the state law

There is a Taliban govt. quote. “the rights of women will be protected within the framework of Islam.” Let’s say for a moment this is genuine. (I know but still). Women have to consent to a marriage and can divorce.

However, women’s testimony worth less than that of a man.

Even the theory varies a lot based on the specific school of Islamic law.

Then, there’s practice, which varies _widely_ and often falls way short of even theory. Perpetrators of “honor killings” are punished lightly, women who bring rape allegations are themselves prosecuted for adultery, forced marriage, and female genital mutilation are common in _some_ Muslim countries. FGM is unknown in other Muslim countries though.

I’d argue we’ve already seen thirsty chud Islam manifest with ISIS.

Like, I’ll put money a bunch of those international folks that suddenly signed up or converted were in it for a system that promises beheadings and slave-wives.

Whether of not we’ll see that here…well, chuds everywhere want the same thing—libertinism minus the acknowledgement of radical personal choice, backed by authority so no one can assert their autonomy versus your antisocial choices. To get this end, they take existing moral and cultural frameworks and hollow them out, removing and reinterpreting all the bits that constrain their choices, but leaving in all the punitive bits that constrain other people that don’t want to participate in an re-enactment of 120 Days of Sodom.

So most US chuds are going to lean into Christianity and capitalism, because on the ground those are the best camouflage for their sadism, since both those ideologies in the US context have whole centuries-long stratigraphy of excuse making for hurting people and creepy nonconsensual fucking.

But…there definitely is a kind of chud that finds the rigidity and absolutism of patriarchy in fundamentalist Islam appealing, they’re just not the majority.

The doc at Seton Medical center in Moss Beach looks like a weathered bearded old hippie. Long gray hair but bald on top. Big scar down the middle of his chest from open heart surgery he had years ago. Nice guy.

I told the nurse I was worried they were going to close that hospital. She said, “Don’t listen to the rumors…this is the only hospital on the coast between San Francisco and Santa Cruz. The state will never let it close.”

Bolton did nothing to shore up the Afghan government. Nothing. They did the opposite by kneecapping the regime to the point that when US forces began withdrawal, the Afghan leader fled and the security forces melted away.

Bolton did nothing to shore up the Afghan government. Nothing. They did the opposite by kneecapping the regime to the point that when US forces began withdrawal, the Afghan leader fled and the security forces melted away.

Why? Because Trump cut a deal with the Taliban and made it impossible for the regime to continue. Trump gave the Taliban what it wanted, and Trump got what he wanted - the ability to try and smear Biden who was left trying to clean up the mess.

Didn’t Trump’s withdrawal of American forces occur when Bolton was not in office? I didn’t think that Bolton was involved in any Trump actions designed to weaken the Afghan regime.

Well, the two largest hospitals near me are no longer accepting ICU/CCU or psych patients. There are no beds left and both hospitals are not allowing visitors anywhere inside any hospital building. The largest of those two hospitals just built a huge new ER department and have said they can’t take any patient coming in by ambulance. This is one of the largest ERs in the SE USA and they are at capacity. Go Georgia. Yay.
