If she is seeking to have the contract declared void (and that seems to be the remedy she’s seeking from my quick read of the complaint) then any such ruling would have to include an order for repayment of the money. More likely, the argument that the defendants would make is that she’s trying to get out of the contract because she think she can make more by writing a book, producing a parody adult film (ew), or giving interviews. They’ll try to argue that the agreement was valid because even though Trump (or whomever) didn’t sign the document, the parties substantially performed all their duties under the agreement and thus there’s no reason to rule that the contract is void.

I notice that not only did Trump not sign the Agreement, but that Cohen crossed out DD in his “Attorney for” signature and wrote in Essential Consultants LLC. Additionally the other “Attorney for DD” line was left unsigned. So since Cohen and Trump’s claim is that the work was done without Trump’s involvement and Cohen paid for the agreement out of pocket then what duties did he perform exactly? And if he didn’t perform any duties, didn’t sign the document and no attorney working officially on his behalf signed the document then is he technically even a party to the Agreement at all?
