Right, the question is how SCOTUS rules on a blanket Ford to Nixon style pardon for “all crimes” committed in a given time frame. If they do strike down separate sovereigns they’re going to have to explicitly say what happens when there’s some degree of statutory overlap. Like, is State tax evasion substantially different enough from Federal tax evasion that double jeopardy can never possibly attach? I’d say yes because false certification of State taxes is a separate criminal act and while the statues may use similar terms but describe distinct offenses. My point is just that the court is going to have to get pretty explicit in its ruling.
