1st, not sure if it was a professional photographer or just someone waiting for the train with an I-Phone
2nd, iirc, if it was a pro and he works for the paper they ‘own” any images he takes
3rd, whoever submitted it, it still comes down to an editorial decision
4th, from the distance of the train (and it’s approach speed) I doubt anyone, unless they were right in front of the poor guy, could have done anything for him

1) They’re describing him as a freelancer. Granted, it’s a broad description, but his employment status is immaterial to the ethics questions involved.

2) This is true. He could have also deleted the photo without anyone knowing.

3) Not questioning that.

4) As I said, there’s some question. IIRC, the photog was quoted as saying he was trying to use the flash to somehow alert the engineer that something was up. That comes off as a weak excuse for snapping photos of a man about to be run over by a subway train.
