I’m no expert on this, but i think that Thomas has a pretty consistent philosophy. Sadly, it involves rolling back society to the 1840’s.
But it has lead him to some surprising conclusions, like the one a few years ago when he stated that he could not imagine the founding fathers having any law against the growing, possession, or smoking of pot.
Scalia is just a political hack. His sarcasm and pugnacious stances are no substitute for reason, and his reputation as an intellectual is founded on the same idiotic view that Newt’s is.
From what I hear, his opinions are badly written. He’s probably right about that by the way. since hell from what I understand Mount Vernon was the nation’s biggest private seller of hemp. not a fan of Scalia either but he too is capable of a legal surprise. Neither guy is my ideal justice though. I am an admirer of Warren Court era justices I make no secret about that.
