Well, it depends on the goal of the legislation. It sure doesn’t seem like we legislate to prevent in this country but legislate, instead, to punish. So I’m not sure folks even expect a law to stop behavior, they just want a way to punish you. Penance model.

I was under the impression that the point of the punishment itself was to act as a deterrent. You are discouraged from murdering someone because you know that if you do, you will end up in prison.
