The argument being made is “legacy students are the same as white AA” and that’s not the case.
No, the argument is being made that legacy students have an advantage, and that policies banning quotas and preferences have specifically sanctioned privledging legacies.
If you disallow a university to consider whether a family has previously supported the school out of a mistaken sense of fairness, you’re punishing both the student and the university.
How is that a punishment? I understand you’re asserting it— now show how it’s a punishment?
Why should that student get picked over another student who has an equal or better academic record?
