I don’t think that distinction is going to fly when it hits the courts. I have $20 that says they backtrack and find a compromise position. Everyone is talking about the “Hawaii exemption” as the model but we’ll see.

Unfortunately, I think you are right.

This is already being spun as an “assault on religion”, when it overall debate ignores the fact that nobody is telling Catholics that they have to approve of abortion, they just have to make it accessible: it is up to the individual employees to choose.

And Democrats are already panicking and backtracking, so Obama will probably be forced to draw back on this issue.
