You are not discussing a court case, because you earlier said there was no court case.
What she is saying now directly conflicts with what she said under oath in her deposition, which is indeed part of the court case file.
You are trying to make this apples and oranges, when it is no such thing.

While the accusation in the depositions may influence the settlement, unless it is presented to the court IN THE PROCESS OF FINDING FACT, it is not material. (I check with my sister in law to see if I had that right). In other words, there is no perjury until the testimony is actually used in court to determine what really happened.
