Shortly after the Daily Beast brought out their story about Ivana Trump last night, I tweeted…

… because, well, I could see this one coming: Donald Trump’s Ex-Wife Ivana Disavows Old ‘Rape’ Allegation.

“I have recently read some comments attributed to me from nearly 30 years ago at a time of very high tension during my divorce from Donald,” she said in the statement today. “The story is totally without merit. Donald and I are the best of friends and together have raised 3 children that we love and are very proud of.”

I’ll just put this here.

Although the settlement remains sealed by the courts it is rumored that Ivana received $20 million, the $14 million family estate in Connecticut, a $5 million housing allowance, $350,000 annual alimony, all of her jewelry and 49% of Mar-A-Lago, the family home in Palm Beach which also serves as a private club for the Palm Beach elite.

In Clinton’s case, it was a testimony for a case that was never heard in court, so it wasn’t actually perjury in the strictest legal definition (From what I remember after all these years). I think the same would apply for Ivana Trump’s deposition. The divorce was settled out of court, so I guess it wound up having no bearing on the case.

Just to amplify on the way I see the difference between Trump and Cosby, Cosby had an accuser who pushed back and forced him to testify, and later other people made charges and didn’t back off of them. In Trump’s case, the accusation was made originally and pressed no farther. I just compared the cases, and did not judge the accusers.

However, If the court accepts the settlement, it would seem to me that both parties have accepted the testimony supplied and are not contesting anything. That would make the accusations immaterial to the result of the case, and not perjury.
Besides, there is no way to determine whether she is lying now, or if she was lying then.

actually, the testimony likely did have some influence on the outcome of the case. most litigation goes through the discovery process, which includes depositions. once depositions are taken, cases tend to get settled - attorneys see how witnesses will be on the stand, they have testimony that is under oath, basically you have the best idea of what happened and what will happen at trial and you explain to your client why a settlement is a good idea and on what terms.

Material, but sadly will remain in the category of unsubstantiated allegation, disavowed by the accuser. That will give those who don’t want to believe it wiggle room to deny it, and worse, to accuse anyone who posted the story of trying to libel Trump - even though the allegations are not based on hearsay or ‘anonymous sources’, but rather pulled together from older sources.

My personal feeling? It’s of a piece with his personality. He’s about owning things and people, getting his own way, bullying, threatening. I don’t need this to find him a loathsome excuse for a man, because the rest of his personality points to this, including the way his lawyer responded to the reporters.

By the way…had an awesome paddleboard session in the harbor with my wife this morning. There are tons of mackerel and pinhead sardines in the harbor right now, so pretty much every brown pelican, tern, and seagull on the west coast is hanging out. We were paddling through a constant show of pelicans and terns diving into the water around us, popping up with a sardine in its mouth, and then chomping it down as it flew away (they do the funniest shudder as they try to swallow in flight…makes them look almost drunk). Of course there were the local harbor seals rolling and lolling about, but then I saw something new (and wish I’d brought the camera). I thought it was a bloated dead sea lion or maybe a large dog floating in the water…but as I paddled closer and got about twenty feet away from it, it lifted its head and looked at me as if to say, “What the fuck? Can’t you see I’m sunbathing here?” - friggin Sea Otter…I’d never seen one in Half Moon Bay before and didn’t realize how YOOOGE they are. Seriously, you could cover a recliner with one of those suckers. So yeah, I changed direction…I’m not going to have some big ass otter come knock me off my board. Beautiful creatures though.

While the accusation in the depositions may influence the settlement, unless it is presented to the court IN THE PROCESS OF FINDING FACT, it is not material. (I check with my sister in law to see if I had that right). In other words, there is no perjury until the testimony is actually used in court to determine what really happened.

(I check with my sister in law to see if I had that right). In other words, there is no perjury until the testimony is actually used in court to determine what really happened.

Depositions (again, taken under oath) are also used for finding merits of a case. Even if it doesn’t go to a full blown trial with witnesses testifying on the stand (this may be where your “talking heads” familiarity with perjury is inadequate), it’s STILL perjury.

It’s that (2) part that I’m talking about. The problem is that there are no “ands” or “ors”. SIL says that perjury isn’t often prosecuted because of that. You really need an airtight case. For example, Ivana could conceivably walk back her testimony if it went into open court and she had to testify, and she could (or might not) clarify (or reinforce) what she said in the deposition. But the fact is there was no further fact finding, and the accusation was ultimately not material to the case. Nobody is going to bring a perjury case now, especially because in most cases the statute of limitations has expired (It varies from state to state, even criminal and civil cases).

I suspect the only one who really could bring this back to the attention of a court, and get her charged with Perjury, would be the party allegedly injured by the alleged perjury, and he’s absolutely the last person who’s gonna go there. Not speaking as a matter of law here, but rather as a practical matter.

So, whether it’s legally perjury or not, whether there was further inquiry or not, the practical effect is that it doesn’t matter.

What the court may think or do in a specific case has no bearing on whether one committed perjury or not. If she lied under oath it is by definition perjury.

I remember an episode of some Lawyer show back in the 1960s, where a wife was on trial for murder, and her husband confessed, so she was acquitted. Then he recanted his confession and provided an unimpeachable alibi, so he was also acquitted of murder, though he was to be tried for perjury as the episode ended, with the defense team all standing around with a bad taste in their mouths for their role in helping the two of them get away with murder.
