George Stephanopoulos apparently won the media competition to interview officer Darren Wilson. In a preview of the interview, Stephanopoulos says Wilson told him that although he was sorry for the loss of Michael Brown’s life, he “would not do anything different that day” and has a clean conscience about what happened.

And by the way, ABC News says they did not pay for the interview.

Even if Wilson turned his head to face Brown directly, you’d get at most a glancing blow. And it still doesn’t explain the reach into the car, the alleged struggle for the gun in the car, or Wilson’s actions thereafter.

And Gawker points out how the WaPo piece takes Wilson’s position for granted and makes Brown appear to be aggressor throughout, ignoring other witnesses indicating that his hands were up.

I read the Hospital report and it said the the left side of Wilson’s face suffered from minimal pain, while the right side suffered mild pain. Sounds like he was struck on the right side of his face. How is that done by someone punching through an open window to hit the driver?

As I read more and more, I reach two conclusions: The GJ was a joke and it did what McCullough wanted, namely it’s providing a smokescreen to say “All the evidence was looked at and they saw no reason for a trial!”

Except a GJ isn’t about looking at all the evidence, it’s about looking at enough to establish probable cause, a very easy hurdle to clear. Hence why prosecutors don’t bring exculpatory evidence, like witnesses with contradictory statements, experts to interpret physical evidence as supporting the defendant, or evidence about the victim that makes them unsympathetic.

When Corey brought charges against Zimmerman, it mollified the populace. When the trial ended in acquittal, it was on her and on the police department for screw-ups in the investigation and prosecution. Here? Here it was a con-job from Day One, a cover-up that leaves us without a verdict, just a prosecutor siding with the defendant and taking every step he can to assure that this never goes to trial. You’re not going to mollify people who believe the system corrupt and unanswerable to them by making a show of protecting your own.

I should also add that it’s an amazing contrast between the cases of Zimmerman and Wilson in the actions of the governor.

In the former, when it became apparent that the prosecutor was dragging his feet and making excuses for not going to trial, the Republican governor stepped in and replaced him.

Here, when it became apparent that the prosecutor was making a hash of the whole deal and looking for reasons not to go to trial, the Democrat governor sat on his hands and made excuses for why he couldn’t get involved.

This wasn’t the entire city of Ferguson going up in flames, or even a significant portion. A handful of businesses and two corridors affected. One damaged business is one too many. But the media and the right wing want this to be worse than LA.

Don’t read anything much into that. ABC/Disney itself owns fewer than a dozen ABC stations around the country, mostly in big markets like LA, NY, Chicago, Philly, San Francisco, etc. Fox/Murdoch itself owns only about 20 Fox network affiliates around the country, again mostly in big markets.

Each network has another 200 or so affiliates around the country, owned by other companies that pay ABC or Fox (or CBS or NBC) to carry their programming. (Back in the day, the networks paid the stations, but that’s a digression.) In all but the biggest markets, it’s common for one company to operate multiple stations carrying multiple affiliations in every combination available. In Fort Wayne, it’s ABC and NBC. In Erie, it’s NBC and CBS. In Wheeling it’s CBS and Fox.

Don’t read anything much into that. ABC/Disney itself owns fewer than a dozen ABC stations around the country, mostly in big markets like LA, NY, Chicago, Philly, San Francisco, etc. Fox/Murdoch itself owns only about 20 Fox network affiliates around the country, again mostly in big markets.

Each network has another 200 or so affiliates around the country, owned by other companies that pay ABC or Fox (or CBS or NBC) to carry their programming. (Back in the day, the networks paid the stations, but that’s a digression.) In all but the biggest markets, it’s common for one company to operate multiple stations carrying multiple affiliations in every combination available. In Fort Wayne, it’s ABC and NBC. In Erie, it’s NBC and CBS. In Wheeling it’s CBS and Fox.

Since the grand jury results came out, I’ve seen an explosion of comments comparing the victim to a variety of large animals with superhuman powers (Wilson knew what he was doing when he and the attorney(s) advising him selected hulking demon imagery for his descriptions of Brown). People have not only accepted Wilson’s account as gospel truth, they’re further embellishing on the testimony or twisting it around to make Michael Brown even more super-powerful in the scenario (while Wilson looks utterly child-like and helpless). The willful ignorance and malice is staggering.

Drifting slightly back to topic: my FB feed has been relatively free of smug “Well, justice has been served” horseshit.

The once exception is my cousin, who posted a photo of a car getting overturned (quite possibly from another incident, knowing him) and did a read-between-the-lines complaint of “What’s wrong with these damn black people?”

A few of his friends took the cue and started making asshole comments about rioting over sneakers and the such. My surprise, etc…

What’s funny/irritating is that he got pulled over last week and received a ticket for, according to him, having too many things hanging off of his rear view mirror. Holy fuck, did he bitch about that. The whole “Some of my friends are cops and I thank them for their service but this is unfair wah wah wah.”

I’m willing to bet that not once has it fucking occurred to him to picture that having to deal with that every. Goddam. Day. For driving while minority. There are hard working innocent people who have to endure that shit all the fucking time, and often wind up on the business end of a taser, baton, or bullet for being the wrong skin color.

And the icing on the cake is that he lived for a while in a part of the country that has a large homosexual population, so he’s often posting pro-gay stuff. I guarantee you, in his mind, he can’t be racist because he’s not homophobic, so there.

Of course, they only see the violence and assume that this is about an isolated incident. That the people are reacting to failure to indict a white cop, rather than the display that has been put on for the people of the community. About how this whole incident proved that there’s two sets of laws: One for the white cops who police the community and the other for everybody else. Wilson likely has never been pulled over for being a couple miles over the limit, never had to sit in a courtroom to pay a ticket that was less than $100, or dealt with being arrested for “failure to appear” because the doors to the courtroom closed at 10 til rather than on the posted time.

That the people are reacting to failure to indict a white cop, rather than the display that has been put on for the people of the community. About how this whole incident proved that there’s two sets of laws: One for the white cops who police the community and the other for everybody else. Wilson likely has never been pulled over for being a couple miles over the limit, never had to sit in a courtroom to pay a ticket that was less than $100, or dealt with being arrested for “failure to appear” because the doors to the courtroom closed at 10 til rather than on the posted time.

My “Insult with intent to humiliate” mode can get out of control pretty quickly, and as much as I detest some of the viewpoints, an Xmas party probably isn’t the best venue for that kind of confrontation.

Also, most of my cousins’s kids are in their 20’s now and are usually drinking pretty heavily at these events. Taking on three generations of institutional racism is fucking suicidal, to be honest.

I read a really disgusting diatribe today that basically said “You engage with the police, you run the risk of being shot.” and that Micheal Brown essentially deserved what he got. I didn’t respond, but frankly that tells me that the right of the police to shoot you is supreme to your right to personal safety, even if your safety is what you’re paying the police to protect.

Oh, there are people who will tell you with a straight face that the 12 year old that was killed by a cop for brandishing a toy gun deserved to die because he was a threat to the cop’s life.

Maybe if his client wasn’t a sociopath and had feelings of remorse for killing Brown, we might just…. no, I wont say believe him, because there’s nothing to believe. He made statements that are preposterous and will not be held to account in a criminal court of law because the system worked exactly as it should. It shielded a cop from criminal liability for killing someone - all because Wilson said the magic words - he feared for his life.

Every cop knows, or has reason to know what to say if they shoot someone dead - an unarmed person. They can say they feared for their own life. And in many states, that’s a bar to prosecution, or at least an affirmative defense.

Combined with a prosecutor who never indicts a cop for criminality - excessive force, let alone officer involved shootings, and Wilson wasn’t going to get indicted like a ham sandwich.

In the state where we live the law says specifically an attack with fists is not a lethal attack. that means you don’t get to beat/stab/shoot anyone to death over a bloody nose or black eye. Please note that once again, it is impossible that the shooting victim was a flawed person, or damaged, or that this was a tragedy of human nature wherein he made bad choices on the last day or the last minute of his life.

What is flooding the internet is that Michael Brown has to be a horrible person that deserved to die. His violence had to be malefic and mad, not the violence of a teenage boy. His flaws have to be great and terrible, not small and stupid.

I’ve said before, if everything went as the officer said, this shooting would have been necessary. But we have a society that doesn’t want to reflect on the implicit sadness of grim utilitarian decisions. We want heroes and villains; we want bold righteous action.

This cannot be a sad event from any perspective. It is not enough that he died—it must be deserved.

And there will be no thoughts about how his guilt is derived. The entire point is to *not* think. Feel sad about people who didn’t fuck up. Feel outrage about “real” victims who can’t be criticized.

And never, ever, think about how damnable guilt—the guilt that evaporates the life of dead, leaving only the moment of their death—is discerned only in the disenfranchised.

My dear fellow white science-fiction fans, let me use an analogy to try to explain one reason why people are so angry about what’s happening in Ferguson.

If you only watch one episode of Star Trek (original series), the fact that a guy in a red shirt dies is tragic, but eh— that’s television. But when you watch the entire series, you realize that a disproportionately high percentage of people wearing red shirts die.

It’s not that Captain Kirk has it out for people in red shirts. Heck, one of his best friends wears a red shirt. And Scotty never gets killed, so clearly not all red shirts die. And bad things happen to Kirk, too. But still— when you start paying attention, it’s pretty clear that wearing a red shirt in Star Trek is a death sentence.

That’s the thing that I see a lot of white people failing to understand about the anger surrounding the Mike Brown case. It’s not just one teenager and one cop. It’s a long series. When you start looking at the statistics, you can’t ignore that a disproportionately high number of African-Americans have been killed by cops every year for decades upon decades.

A couple of folks in the ski shop today made some snide remarks about Ferguson. “Riots are awesome!” “Burn down your town to make a point, fucking stupid.” “Maybe he [Michael Brown] shouldn’t have been such a thug.” (all actual quotes I heard today).

I bit my tongue and tried to change the subject. It made me sad.

Dozens of children died at Sandy Hook and nothing changed. What makes you think a white cop murdering a black kid is going to change anything?

Today I have no interest in arguing details of distances and the letter of the law. Those facts failed us. This fact is what matters. It was an unarmed kid again. Fuck. How much else needs to be known. Police got all this training all this gear. It Was An Unarmed Kid. Repeat.

He wasn’t an unarmed kid. He was a violent black demon and wanted felon who deserved to die.

He’s no better than the young thug who got killed pointing a toy gun at a police officer. They both deserve what they got. Obey the cops or die. It’s that simple.

I am the epitome of white privilege. I regularly participate in one of the most wasteful sports imaginable, not to mention the steep price of admission (skiing). The only time I’ve been hassled by the cops is because I deserved it. I’ve attained some employment that has ample opportunity for advancement. When I can I travel. I’ve always lived in safe neighborhoods.

White guilt. 100%. Not ashamed, just the facts.

Apparently we’re to treat our cops like soldiers. They’re to be obeyed without question, as failure to do so is itself a crime. If they feel we present a danger to them, no matter how non-threatening our actions are, then they’ve the legal authority to execute us. Even if we run away, they can shoot us in the back and claim self-defense. After all, who’s going to believe a dead man?

Obama was right last night, it’s not just a Ferguson, MO problem, it’s an American problem.

It’s not cynicism when the evidence is on your side.

The simple fact in this country is that minority lives don’t matter, and cops can kill with impunity because the badge turns them into modern day saints who do no wrong.

Wright knows how to push wingnut buttons better than just about anybody.

Ugh. I’m dreading the holidays this year. Between immigration, Darren Wilson getting away with murder, and the general idiocy of the GOP these days, I really don’t want to deal with any of my RW relatives. It’s bad enough seeing people I know pull some variation of the Mike Brown was a felon that deserved to die! card. Being around people I’m related to and hearing that would be depressing as shit.

My mother and my aunt haven’t been on speaking terms for close to two decades. It’s weird, really. They both shut each other out pretty much equally. My aunt lives in Missouri and is a devout Catholic. My mother lives in Colorado and likes to smoke pot and go to rock concerts.

Because of this, our side of the family is largely immune to crazy holiday seasons. The past few years especially have been very nice, now that my nieces and nephews can form coherent thoughts on their own.

The law needs to be adjusted.

The first thing that needs to be done is to get cameras for all police. That way we would at least know for a fact whether it was hands up or not. We would know whether Brown ran at Wilson or walked. We would know all sorts of things.

As it is, the grand jury had to try and sort out the conflicting testimony of witnesses. It is now beyond question that some witnesses say they saw things that didn’t happen. Some of the testimony is just flat wrong and we know it’s wrong. Some of it is wrong because it directly contradicts other testimony to the same part of the story, but without footage, we just don’t know which testimony is wrong. Everybody has his own opinion as to which account makes more sense, but those opinions are all over the map as well. And we didn’t get to hear the testimony in person and gauge credibility.

With the law as it is now, and with the conflicting testimony, if an indictment had been brought, a conviction would still have been improbable.

Man, it’s really funny, but we have this mechanism that is supposed to sort out what evidence to weigh more, etc.

It’s called a trial.

The folks who are supposed to sort out the conflicting testimony? That’s supposed to be the jury, having had both a prosecuting attorney and a defense attorney presenting their case and point out inconsistencies. Not a ‘prosecuting attorney’ acting as a defense attorney and torpedoing the entire case before it gets to that point.
