I saw this quote on Reddit - the poster claims to be a lawyer.

Lawyer here.

This agreement is not invalid simply because Trump didn’t sign it. The terms are clear, and she was paid the money as contemplated by the agreement. The fact that Trump didn’t sign it is irrelevant because it was signed by his agent.

However, and this is the good part, all Trump needs to do to soundly beat this lawsuit is adopt the contract. If his lawyer had Trump’s authority to execute the agreement, then all Trump has to do is acknowledge and adopt the contract, and it is 100% binding.

Stormy Daniels’ lawyer knows this. But they also know that politically Trump cannot acknowledge or adopt this contract. This is win-win-win for them. Either (1) Trump refuses to adopt the contract, in which case she gets out of it and gets to sell her story to the networks, (2) Trump adopts the contract, and that in itself is a news story, or (3) she gets more money from Trump to drop the suit.

Edit: A few people are correctly pointing out that another issue for Trump is that asserting the contract was for his benefit may also have implications for an FEC violation.

Now, I know……..it’s Reddit. But if any of our lawyerly types can post an opinion, it’d be greatly appreciated.

It’s also shown how the rule of law is meaningless as long as people like Paul Ryan and Mitchel McConnell continue to ignore those laws to the benefit of their own party. There should be clear cut means to immediately remove people from office for the behavior they’ve exhibited, as well as unpardonable jail time. Trump was never qualified to be sworn into office. They chose to ignore the details and every other disqualifier afterwards.

The New Yorker has a fascinating read about one of my least favorite insects, the brown marmorated stinkbug. But I’ve only had to deal with having one or two in my apartment at any one time. Some people in the States have discovered them by the thousands in their homes when it gets cold outside.

And they are spreading west and south from their original immigration point, which more than likely New York Harbor.

Slightly less noxious but vastly more pervasive, the smell of the brown marmorated stinkbug is often likened to that of cilantro, chiefly because the same chemical is present in both. In reality, stinkbugs smell like cilantro only in the way that rancid cilantro-mutton stew smells like cilantro, which is to say, they do not. Pam Stone compared their actual smell to the ammonia-and-sulfur stench that suffuses the air outside paper mills. Others have likened it to everything from rotten fruit to filthy socks. A for effort. In fact, the smell produced by a stinkbug is dusty, fetid, lingering, and analogy-proof. A stinkbug smells, unhappily for us all, like a stinkbug.

Along with cheap yoga pants, mass layoffs, and the recent surge in nationalism, the brown marmorated stinkbug is a product of globalization. It is native to East Asia—mainly China, Taiwan, Japan, and North and South Korea—where, kept in check by various natural predators, it has coexisted with the rest of nature in relative tranquillity for millions of years. But then, on September 21, 1998, a gentleman from Allentown, Pennsylvania, deposited several specimens of a mystery insect in the office of Karen Bernhard, an entomologist who works at Pennsylvania State University’s Extension Service.

Bernhard could not immediately identify the specimens, which was not in itself surprising. In both number and variety, insects dwarf all other animals; worldwide, there are some nine hundred thousand known species, while between two million and thirty million more have yet to be catalogued. (By comparison, there are just over five thousand species of mammal.) Since the United States boasts ninety-one thousand of those named insect species, some of them quite rare, plus almost as many unknown ones, it isn’t that unusual to come across a stumper. Eagle-eyed 4-H’ers have been known to go bug collecting and come home with an insect that no one in the county has seen before.

It is unusual, however, to find an insect that no one in the country has seen before. At first, when Bernhard sent her specimens off for identification, she was told that they were a native stinkbug, Euschistus servus, but something seemed off. Although those bugs do sometimes make their way indoors, they are not normally household pests, yet all the people calling Bernhard were asking about insects they had found in their homes. In the fall of 2001, armed with a new batch of identical specimens, she contacted Richard Hoebeke, an entomologist specializing in invasive species, who was then at Cornell and is now at the University of Georgia. Within weeks, Hoebeke had determined that the specimens were brown marmorated stinkbugs, the first ever identified in the Western Hemisphere.

Not long afterward, Hoebeke travelled to Pennsylvania to see the new species in situ. “It’s kind of burned into my memory,” he said. Hoebeke had seen plenty of stinkbugs in his time, but never in such quantities. “They were flying everywhere—in the air, around people’s window screens, everywhere. I had my windows open, and so many were getting in my car that I had to be really careful that I wasn’t going to transport them back with me. I was utterly amazed at the numbers.” By their sheer quantity, it was clear to him that brown marmorated stinkbugs had been in the area longer than scientists knew. Together with some colleagues, he began scouring records like those kept by Bernhard and eventually determined that the first verifiable specimen appeared in Allentown in 1996, most likely via a shipping pallet from China.

Worse than their tendency to shelter inside during the winter, stinkbugs also will eat just about anything — trees, flowers, crops — during spring, summer and fall. As an invasive species, there are no natural predators here to control them. They seem resistant to most insecticides. And global warming only makes them more active and prolific.

I hope none of you suffer from stinkbug infestations. One or two bugs at a time was enough for me.

UK to Roll Out Pilot Voter ID Programme (goes to the BBC)

The government in the UK is rolling out a “pilot” programme to require photo ID in five locations for the upcoming election.

Conservatives there are making the same arguments they do here: It is to protect the integrity of the vote.

A vast coalition of orgnaisations are calling on the government to scrap the plan, noting it will marginalise those least likely to have ID (minorities, the poor, &c)

A group of Republican lawmakers want a Catholic Church official reprimanded for calling them racist for their opposition to funding programs for poor children.

Allen Sanchez, executive director of the New Mexico Conference of Catholic Bishops, took part Feb. 14 in a candlelight vigil outside the state Capitol in support of a proposed constitutional amendment to increase funding for early childhood programs, reported the Santa Fe New Mexican.

“We feel there’s an element of racism here,” Sanchez said at the demonstration. “If you look at the footage of the hearings around this proposal, the opposition came from people with power and wealth. They don’t understand what is going on in our communities with poverty.”

The Catholic Church officially backed the proposed measure, but a group of 33 GOP lawmakers sent a letter of complaint asking for action against Sanchez, the newspaper reported.

“The political debate is divisive enough in this country and this state without unwarranted accusations of racism being thrown about without evidence,” said the letter addressed to Santa Fe Archbishop John Wester. “The fact that this accusation was levied [sic] by a representative of the Catholic Church only makes it more troubling.”

“As leader of the Archdiocese of Santa Fe do you condone this type of political debate?” lawmakers asked Wester. “Are you comfortable with the Catholic Church being represented in this manner? Does the Church wish to set the example that the political ends justify the rhetorical means?”

Lawyers representing white supremacist Richard Spencer have dropped a lawsuit filed against Ohio State for denying multiple requests to use campus space for a speaking event.

According to the Associated Press, Spencer’s new attorney — his previous attorney Kyle Bristow resigned last week amid surfacing of his insensitive comments about transgender people — plans to drop the suit against Ohio State.

Bristow filed the lawsuit against Ohio State on Oct. 22 for Cameron Padgett, a Georgia State University student who made the requests for Spencer to speak on campus.

Spencer, who has been touring college campuses this year for hosting racist speaking events, was denied three times from speaking at Ohio State.

The university denied the requests to allot Spencer space on the grounds of its University Space Rules, according to court documents.

Ohio State asserted the “use of University property must not, in any form, disrupt University business,” and “the University may limit access to or use of its space as may be necessary to provide for the orderly conduct of the University’s teaching, research, and service missions, the University’s administrative functions, and students’ campus-life activities.”

Additionally, the university stated in the court document that allowing Spencer to speak on campus could pose a “substantial risk to public safety, as well as material and substantial disruption to the work and discipline of the University.”

The university said the concerns are rooted in objective evidence stemming from previous speaking events Spencer has participated in, such as the white supremacist rally “Unite the Right,” which took place in Charlottesville, Virginia, in August and left a counter protester dead.

Additionally, the document lists the myriad resources required for the University of Florida to host Spencer in October, including a governor-declared state of emergency, 800 armed law enforcement officers on campus, and a security price tag of over $500,000.

Padgett, who has also sought to have Spencer speak at multiple educational institutions, was quoted in the Miami Herald as saying “I don’t want to get killed on campus” as the reason he has not invited Spencer to his own campus, a fact highlighted in a court document Ohio State filed in December in response to the suit.

Kolenich told the AP that litigation will continue against the University of Cincinnati to allow Spencer to speak on campus.

The evil too big to fail bank (Wells Fargo) just sent an internal memo from Tim Sloan to employees, basically saying that we are not going to do anything about guns, because this is something the legislatures should handle. Oh and some of our clients are gun shops, manufacturers, etc.

The song is translated by Google as Night Incense by the Japanese singer Yamaguchi Suzuko.

Tobacco beetles and drugstore beetles just lurve themselves spices made from pepper varieties (which includes paprika, but also cayenne, red pepper flakes, &c).

HP interviewed a woman from the University of Nebraska at Lincoln who is a bit too excited about bugs in spices, how they get there (usually from inside your home, and the beetles in question can chew through sheet steel to get to the spices), and how to store them to avoid infestation. (Hint #1: Don’t buy in bulk, Hint #2: Put your spices in the freezer for four days at 0F or below).

What may matter more is what Carter was able to accomplish when he was in office. Even his most ardent admirers would be hard put to place him in the top echelon of presidents. But when it comes to gay rights, Carter deserves a fair amount of credit. He was really the first president to take positive (and concrete) steps to acknowledge the importance of gay rights.

During his administration, the Foreign Service lifted its ban on gay and lesbian personnel and the Internal Revenue Service lifted its requirement that any LGBT nonprofit state that homosexuality was “a diseased pathology.”

His administration was also the first to invite gay activists to the White House, at the height of the Anita Bryant fear-mongering. The move was controversial and ultimately contributed to Midge Constanza, the official who issued the invitation, deciding to step down. But Carter didn’t quash the meeting either, which would have been the politically easy thing to do.

The evil too big to fail bank (Wells Fargo) just sent an internal memo from Tim Sloan to employees, basically saying that we are not going to do anything about guns, because this is something the legislatures should handle. Oh and some of our clients are gun shops, manufacturers, etc.

I’m tempted to shoot back an email to Sloan pointing out that Republican-dominated legislatures are bought and paid-for subsidiaries of the NRA, but I like my job. I would like this news to get out somehow.

He opposed the Briggs Initiative, a California ballot measure that would have banned gays and supporters of gay rights from being public school teachers. His administration was the first to meet with a group of gay rights activists. Ultra-pasteurized milk is still via heat treatment and as such, engenders less paranoia.

The food safety organization of countries in SE Asia and China and Japan have patchwork laws permitting food irradiation. They are working on getting more standards in place and are trying to determine if they can harmonize with US laws and how the US approaches the safety and suitability of food irradiation.

Bottom line is, every country (especially the disparate rules and law in the EU) has their own little peccadilloes, fears, and qualms about food irradiation. But, the WTO makes is nudging governments and their food safety laws generally towards a similar endpoint over the long term.

He was arty and into literature, etc. I learned a lot about the business and I did all the stocking, and much of the creative stuff like lettering and gold foil embossing invitations and napkins for big dinners, etc. I was already on my path as an artist.

It was the best education. It showed me how much of the whole “scary homosexuals” was bullshit and they were just regular people too.

Then in 1972 I went to the Columbus College of Art & Design and some of my best friends that first year were gay. Not a one ever was more than a friend and that too taught me so much.

The point isn’t to convince us. Conservatism is a religion. It is taken on faith. When faith waivers, you must feed the faithful with something that will help them shore up their faith, whether it is true or no.

This is for the consumption of conservatives, to convince them that there is something shady about the investigation.

Many studies have shown that people will dig in when challenged with information that opposes their opinions. This is part of that: It is to give the conservative religious another argument (whether true or no) to oppose what is in opposition to their religious faith (the FBI is working on Clinton’s behalf to tear up Trump and the GOP in general).

That could be done. Candidates run from all parties, and they get statewide seats based on the percentages of votes each party gets. The biggest vote-getters of each party gets the seats awarded proportionally. (In my state, that would likely yield at least one Democratic representative.)

I’m not sure how that would work re: the Constitution. States determine their districts; I presume the state in question could just declare the whole state to be all the districts and the winners the ones who get the most votes. (That would certainly break the red state lock on so many states, and would likely improve GOP representation in blue states.)

1. It’s uncertain whether acupuncture is complete woo. (At least regarding pain relief. The healing promotion claims are almost certainly BS) The results of studies have been mixed. Some show relief of pain, some show no statistical improvement over the use of a sham technique. The major issue is that that study cohorts have been too small.
2. The military has a massive drug addiction problem which stems from stuffing injured and recovering soldiers full of opiates. This is shitty both for the soldiers who become addicts and for national security.
3. Worst case: A few years down the line we establish it doesn’t actually work beyond the placebo effect and we end the program. Most soldiers ended up just taking the drugs because it didn’t work and a handful of soldiers miss out on a lifetime battling opioid addiction courtesy of the placebo effect. The US tax payer is out the equivalent of the detailing on the latest military procurement fuckup.
Best Case: We establish that acupuncture does work, at least for some segment of the population and we have a tool to keep some soldiers off opiates.

Yup. Military and police, that’s sort of the job. You expect that you might get shot at in the course of your duties, and you train every day for that eventuality.

The point of a military force and a police force is so the rest of the populace doesn’t have to do those things.

While I was never in real danger in the Navy (except a couple of potential issues), I volunteered for that, and part of that is so that others can go about their business secure in the knowledge there were professionals to keep them safe.

Are the way the police and military employed always beneficial for our society? No. But we have politicians who are elected to fix that, to employ protocols and procedures and diplomacy so they are not misused in the future. Society is a learning curve.

Sorry to have to join the pile-on, ‘mouse, but acupuncture - if (like any form of medicine) properly administered by a careful and competent professional, is far from being mere “quackery”. Of course, its benefits have been overhyped, and it’s far from the cure-all its more-enthusiastic proponents like to claim, but if used correctly, CAN be of use in many situations: pain-management among them. It all depends on the individual case. And of course, the abilities (and ethics) of the practitioner.

Comments from personal experience: my wife is chronic-pain patient; and, many years ago, sought help from an acupuncturist acquaintance - a very well-regarded pro - for her various pains. She (my wife) had many sessions with the practitioner - without much success, whereupon she (the acupuncturist) suggested that seeking “regular” medical advice would be more productive. It wasn’t, but that wasn’t anybody’s fault.

Yeah, there has been a great deal of woo-woo about acupuncture bandied about, but if it helps even a few vets deal with pain issues without the use of serious drugs, it’s well worth the VA covering it.
However, FWIW, I think Rep. Chu’s griping about “discrimination” is overdone.

Of course my experience is anecdotal, ignorable.
At the time, with discussion with my real MD guy the theory in my case was this. The warm needles reduced my pain, and a body responds quite well to a reduction in pain. That is to say the effects of chronic or high level pain is pretty well documented. Straight empirical. Real world medicine. Science? Nope. worthwhile and in my case acupuncture was less costly than what an MD would charge for a visit and perhaps injection. BTW none of my injuries were more than contusions, sprains etc. If I suspected anything like that I saw an MD first of course.

Might be a warm bath and careful massage would have been as good for me after a tough fight. I tried it all short of Percocet etc. But I still go after doing all the reading.

How many millions of dollars do you wish to spend to help “a few vets” as opposed to methods already proven to work in multiple studies over decades? The government already put $20M into this to see if acupuncture could be administered in VA hospitals (not to actually give acupuncture) back in 2014.

And no amount of anecdotal evidence amounts to “data.” Controlled scientific studies amount to data. Put those results up against already-used methods, then see if that procedure is worth taking money away from veteran health care for.

When I was stationed in Virginia Beach, chiropractors convinced conservatives in the government to spend millions of dollars to push their quack theories on active duty. An entire wing of the Portsmouth Naval Hospital was given over to a chiropractic clinic to operate for years. It was finally shut down after it was shown to be quackery (but only after we got rid of the people in Congress pushing for the idea).

Lastly, I’d point out that a lot of people use acupuncture as a method of last resort, because they have a lot of pain, and don’t want to use heavy duty pain meds or even OTC stuff or maybe don’t want surgery, and want a non drug-related way to manage pain. So even if it’s only 50% of people that see results, it’s still worth it.

I am sorry, no amount of anecdotes amounts to evidence. Properly-contrived studies amount to evidence. The evidence is not there, no matter if “acupuncture helped my mother-in-law’s sister’s dog.”

Of note, a researcher in Missouri developed a “fake acupuncture needle” which simulates a real needle but does nothing, to use in controlled trials of acupuncture.

You would be amazed that no one who promotes acupuncture wishes to submit to such a trial.

I’m going to bail on this. They make me use acupuncture, I’ll sue. We’ll see what happens.

And that doesn’t include some of the practical testing that is also required to be licensed.

‘mouse, you are certainly allowed your own thinking regarding acupuncture, but just like your stance on religion, you get into this big having to prove it thing and it just gets to be too much. I have no problem with criticism and references to prove a point. But when it becomes a mission to prove others wrong it can be self defeating.

And I have never had acupuncture. Probably never will.

Education is fine, but if someone is going to hold to their own thoughts on an issue trying to prove them wrong is going to close a door and stop all further thoughts. At that point you change nothing.

Moderation in debate is always a good thing. Having a feel for when you are getting close to crossing the line of turning them off is an important thing.

personal experience informs what some think they know - they have gotten relief and that’s fine. and it is real and true.

even with all its history, acupuncture has not achieved the status of double blind scientific efficacy necessary to be called medicine or (loosely) science. whether it could, or might, it hasn’t.

the (ahem) danger, if there is one is a governmental body - say the VA, granting it a position it does not currently merit. and with that, either diverting funds and attention from known protocols and/or possibly directing and sanctioning its widerspread use where there is no medical or scientific basis to do so

i do not disbelieve or dispute any one’s individual experience

imo, to make policy, it must first meet the same standards as the rest of medical science

While everybody was complaining how the current school safety situation was deplorable, overtime I brought up banning AR-15s and other assault weapons, I was told to change the subject, or that it can’t be done.

Absolutely amazing. My brother-in-law, while far from a slobbering right winger, unconsciously kept parroting Marco Rubio: too many guns out there to do anything; or the ol’ “If we ban that one, this other gun can be modified like the former, so therefore do nothing.”

It’s incredible how even people like my sis, who is horrified by every idiot GOP proposal, just shuts down when it comes to banning weapons. At one point, she mentioned some schools either proposed having or actually have a bucket of tennis balls for the kids to chuck at a potential gunman.

Yet when I propose reinstating the Assault Weapon Ban, I’m the one who’s nuts. Un-fucking-believable.

Listening to a piece on NPR last Sunday; a solar energy expert was talking about the cost difference between US and Australia. The US permitting process is so outdated it treats home solar as a large power generation facility, with all the red tape appropriate for such, adding $10,000 or so to what (in Australia) is $6000 cost to power a residence. This deliberate foot-dragging by our fossil-fuel-paid politicians will keep us trailing the rest of the world.

So that Parkland high school, in addition to their excellent theater, debate and AP govt students… also has an award-winning band. They played Carnegie Hall yesterday (their trombone player was one of those killed.

They got a standing ovation, the other high school bands on the program printed up t-shirts for them that said “we band together”… but for their free day in NYC today, it’s near freezing and there’s slush falling from the sky and filling the streets. They probably didn’t get a good view of the banner put up for them in Times Square.

Isn’t that what some of the drugs are attempting to do anyway? They disconnect the pathways of the pain to the brain. The pain is still there, the brain is no longer receiving it.

Ok, found the immigration complaint, this is incredibly interesting: there are two provisions of the California law that basically say that employers cannot allow access to non-public areas of the workplace or to employment records to immigration officials without a valid warrant. On employment records, that makes obvious sense - there are privacy rights at stake. I’m less sure about the non-public areas bit, but as a general rule you really shouldn’t give access to any law enforcement agency without a warrant. The DOJ claims that employers voluntarily comply with inspections but provide no actual information on how many do and how many don’t and if there is any threat of legal action if employers don’t (which means it’s not really voluntary).

They also apparently don’t like the fact that the new law allows the state AG to inspect detention facilities housing undocumented immigrants.

This is going to be a fascinating case regarding federalism.

I would think companies would be in control of who accesses their private property, but then IANAL. I can see protecting them from demands to let ICE do things, and I can’t imagine a company wanting to let them poke around in the back room, but making it illegal seems problematic.
