The short answer is this is not really a possibility in any practical sense. Technically, a state legislature could issue a slate of Trump electors (although remember, this would have to be passed by the legislature and signed by the governor, which is a bit of a lift). Of course, the Sec State and/or Governor would probably issue another slate of Biden electors in accordance with applicable State law, therefore meeting ā€œsafe harborā€ deadlines. This goes to the incoming Congress joint session, with the Democrats in charge of the House. If there is a dispute between slates of electors, and even if a Republican Senate goes all in for Trump, the worst situation you will get is a deadlock between them over which slate to accept, which defaults by Federal law to the safe harbor slate of electors (the Biden one). So no, the system is creaky and stupid but not that stupid.

If you ignore the mountain of stupid bullshit designed to confuse and scare people, so far the election machinery has done exactly what it was supposed to do when it was supposed to do it. All the stupid court cases were thrown out, counties have certified their votes on schedule, and now states are certifying their votes on schedule. Trump is trying to panic and scare everybody because THATS WHAT HE DOES.

Another reminder of why these state level races are so important. IIRC the governors of MI, WI and PA all recently switched from R to D. Had that not happened, these state legislatures stealing the election for Trump would have been a much greater threat.

The Trump argument that the state legislators can pick their own electors is a farce.

Itā€™s like arguing that majority members of a state legislature can commit murder with impunity because they could (theoretically) pass a law to make murder done in their state by majority members of the legislature legal.

Anything the state legislatures do with electors without first taking that power back into their own hands legally is null and void.

From Article 2 of the Constitution:

Yes, this is the problem.

All too many Americans are so wanting life to be different than it is that when a salesman like Trump comes along and gets them to buy in, they are deeply bought in.

And it is very difficult to change people once they are deeply invested in something.

This is the heart of all things like this with humans: cults, destructive relationships, etc.

Whoever is the dominant party ends up shaping the very mind of those who are consuming.

And this is the kicker - even if the influenced know something is wrong, they have lost the ability to change.

Deprogramming cults is one of the specialties of a sub-division of therapists. Itā€™s a tough business.

Now I still believe that there are Americans out there who identify as Republicans who are very put off by Trump. Yet somehow, other than some high profile types (e.g. Lincoln Project), they feel trapped.

And this gets me back to my lament - the worldview collapse keeps many voters frozen. They canā€™t internally accept a world that is different than what they were taught as a child, yet they also know that what is going on is in some fundamental way wrong.

Yes, well, so far Trump-appointed Federalist Society hacks have been tossing out Trump lawsuits because they donā€™t want to touch this shit. I suppose theoretically the Supreme Court could sua sponte declare Trump King of the United States tomorrow: where does this speculation stop?

Again, if you donā€™t get distracted by the insane sideshow, everything in the election has been proceeding according to process and law. The votes were counted; the mail-in votes were counted; the lawsuits were filed and almost all dismissed; the counties have certified their counts on schedule; and states are certifying their counts on schedule. Weā€™re well out of the zone where you can manufacture a dispute over the vote totals and now it would be a blatant coup, so weā€™ve passed the most vulnerable part and it gets harder by the day. You can worry and panic all you want, but thatā€™s what Trump wants.

The last impeachment taught me that Nancy and company had to get their ducks marshalled and lined up well in advance. If they havenā€™t done this now (for round two), it wonā€™t happen.

Itā€™ll be hard for Pelosi to fit this in with everything else that Twitter is screaming at her and Schumer to do. (Restocking her freezer with ice cream should be her priority, butā€¦ ///)

I am also feeling that another impeachment is in order. Trumpā€™s election fraud antics are a dangerous affront to rule of law. The sentiment is getting more voices.
Why not impeach? The House can make quick work of it and not spend the time and effort that was taken to document and argue the case of Trumpā€™s crimes in the Ukraine case.
