There’s a section of sidewalk like that in Minneapolis, with no handrails and a steep uphill incline. I tried in vain to get up it one freezing winter day, until I decided it’d be easier to just go all the way around the block.

They chickened out of making any judgment on the case itself - but, to be fair, that is expected. They shouldn’t make comments on the merits of the case if the case hasn’t actually been brought to the consideration of the Court.

While I agree, I feel that the terse and summary dismissal is EXACTLY what was needed. I’ve mentioned before that judges have been taking two approaches, either this or a full-length clinical takedown. That would have taken the justices a while, and I feel they wanted to just yeet this out the door and shut it down quickly before it inspires further sedition.

It’s not that they think the case itself deserved a hearing on its own; they don’t believe the Supreme Court has the discretion to decline any case brought before them in its original jurisdiction. Basically, that the Supreme Court should operate as any other court - if you file your paperwork and pay your fees, and the Supreme Court is the only court that can hear your case, you should get it heard no matter how stupid the case is. I am personally on the fence regarding this opinion; in my view, it would lead to most of the cases that are declined instead being reviewed and rejected on the merits, which might be a worthwhile change. However, it would take more time than a summary rejection and does open the door for some strange and crazy precedent.
