As far as I could understand Schoen’s formalistic argument. It is based on playing around with this:

1. The Senate shall have the sole Power to try all Impeachments. When sitting for that Purpose, they shall be on Oath or Affirmation. When the President of the United States is tried, the Chief Justice shall preside: And no Person shall be convicted without the Concurrence of two thirds of the Members present.

2. The President, Vice President and all Civil Officers of the United States, shall be removed from Office on Impeachment for, and Conviction of, Treason, Bribery, or other high Crimes and Misdemeanors.

There’s also this:

3. The House of Representatives shall chuse their Speaker and other Officers; and shall have the sole Power of Impeachment.

4. Judgment in Cases of Impeachment shall not extend further than to removal from Office, and disqualification to hold and enjoy any Office of honor, Trust or Profit under the United States

He argues that removal is a necessary part of an impeachment as per (2). Hence, since Trump can no longer be removed, an impeachment is impossible, hence the Senate lacks jurisdiction.

2 problems here. First, the impeachment has already happened, as per (3). So what he should be arguing is that a conviction is impossible, which is a harder task, and he can’t argue no jurisdiction since per (1) the Senate can try *all* impeachments, so automatic jurisdiction. Second problem is that (2) is inapplicable here exactly since Trump is no longer an official, so Schoen has it exactly backwards: if he were, he would have to be removed, but he isn’t, so he doesn’t have to be removed, but that doesn’t mean the other punishment cannot apply.

He tried to argue about the meaning of “and” in (4), but this “and” is holding together a limitation on the punishment “shall not extend further than to removal from Office, and disqualification…”. The punishment can NOT be greater than (removal AND disqualification). It can, however, be smaller than this maximum (i.e. it can consist of disqualification).

So AFAIC his case fails textually and logically.

Soon after the segment aired, CNN president Jeff Zucker, who is always watching, emailed me and a few other producers demanding that we not cover Trump or Palin, explaining that both Republicans were carnival acts, attention-seekers, two unserious distractions from the real presidential race to come. At the time, few in politics would have disagreed. I think about that moment from time to time, and not just because CNN’s position on covering Trump so famously changed once he actually became a candidate, delivering ratings galore. But the Iowa story is worth remembering, too, because of the way Trump and Palin were lumped together by the smart set as little more than a sad and desperate right-wing sideshow, when in truth, they were two of the most consequential political figures in American history.

Not as big a deal as quite a few MAGA types including the female faction believe that women should not hold positions of power over men, mostly for hard-right religious reasons.

The purpose of an upper house, a Senate or a House of Lords, has always been for a parliamentary body to represent the interest of the upper classes, the wealthy, the powerful, and thus serve as a check and balance to a lower house that in theory represents the plebs. The US Senate is explicitly anti-democratic, much more so than most. I am ambivalent about the value of any upper house in a parliamentary system (there should be a check on a parliamentary body, even a democratically elected one), but the US Senate is a vile institution and should be ended.

I’m on record as saying that we still need some ability to check the majority’s power, to ensure that the Constitutional rights of the minority are protected and that a straight majority can never run roughshod over the entire country (see: Exactly what would happen if the Republicans took over). However, the mechanisms the Senate wields to accomplish this purpose are far too powerful to accomplish such a delicate task - like using a sledgehammer to swat a fly.

For a while now I’ve been pushing that what we need instead of the Senate was a single House (enlarged a bit.)

Combine the enlarged House with a true Board of Governors (made up obviously of the governors of the states) whose powers are limited to true oversight. For example, IG’s would report to them, the CBO would report to them. This Board of Governors could be empowered to have limited pardoning ability, for example, to protect some over reach by the majority. Said Board could also call for national referendums on Constitutional issues, etc. But it would not have the power to legislate, or stand in the way of normal funding bills or Executive acts to carry out laws.

So when it comes to say an impeachment, such board could only pardon the guilty party, not stop or undo the impeachment.

Hence during the Great Depression, Nebraska abolished its senate. The house became the sole legislative body (though members of the Unicameral are called senators).

The wealthy and powerful keep their grasp on state politics here though by holding down the pay of state senators so only the wealthy or retirees can run for office. People like former senator Ernie Chambers or current senator Megan Hunt are very rare in our state government.

I’d been finding it impossible to watch most of the videos until now. I paid attention for that whole house video. It was horrifying, but the way they put everything in chronological order made it incredibly compelling to me today. They could have made it a lot more damning than they did. I was wishing there would have been stuff about Trump watching it with glee in the white house, but there are no videos of that so it was probably seen as too much of a conjecture. They did a great job of presenting the stuff that came out of Trump’s mouth in the context of what was happening in real time.

The AF had a similar policy when anyone went anywhere near a Nuke, which was called “No Lone”.

Anytime a weapon was inspected, moved, installed, or removed, two people watched the entire process so no one fucked with the Nuke.

Which just makes damn good sense.

There were failures, though. I remember a while back (12, 15 years?), a B-52H (I think out of Minot AFB in ND) flew a training mission that ended in Barksdale AFB in Shreveport. It was scheduled to carry two external sticks of six cruise missiles all without warheads, one under each wing.

When it landed at Barksdale, it was immediately noticed by the local Weapons Maintenance Squadron that one stick carried six missiles with live nukes, not blanks.

Big brouhaha. After an investigation, pretty much the entire Command Structure got replaced at Minot.

Navy was the same when it came to nukes as well as crypto. TPI. Two Person Integrity. You had to have to two people present when it was removed from the safe to load and when it was destroyed (Thanks John Walker). My current employer has the same when it comes to controlled keys that give actual access to cash or processor boards that have JPs of $100.00K or more.
