the *why* of the law, the logic, does not matter.
it doesnt have to be logical, scientific or make sense.
it does not have to stand up to scrutiny.

those in power make laws and they made this law.
cart before the horse doesnt matter. why doesn’t matter
especially in this case because they did not have to persuade any sens/reps from the other side to vote. that’s when why matters.

they’ve done it. they passed the law.

when it’s inevitably fought about later, the *justification* for it still wont matter.
only the so called constitutionality of it

But before I go, if there are people here who enjoy African music, you might enjoy what the Voice of America has done: Digitally-archived their longest-running music programme to Africa from when it was first broadcast on shortwave.

A journey from international shortwave to digital broadcast, the Music Time in Africa Archive takes audiences through an on-line experience of vintage Voice of America radio programs broadcast from 1966. The collaborative project with the University of Michigan digitized nearly 900 audio recordings and associated scripts of the weekly radio program. The archive now features 691 radio programs with a combination of program script and broadcast audio, with an additional 120 radio programs coming soon.

The broadcasts feature show hosts playing a variety of African music and original field recordings by VOA ‘s “Music Man for Africa,” ethnomusicologist Leo Sarkisian. Sarkisian recorded and collected music from the early 1960s through the late 1980s throughout the entire African continent, including pre-independence regions and states such as Balundo, Upper Volta, and Rhodesia. Visitors can play digitized broadcasts with original sounds and scripts, searchable by location or performer. The portraits displayed for each show are Sarkisian’s original artwork, painted and sketched over the years. Listeners can listen to music ranging from iconic urban artists Fela Kuti or Franco to traditional performances by Karanga “Gawo” of Zimbabwe or griot music by kora master Sidiki Diabaté of the Republic of Mali. The site will soon allow the audience to explore 361 reels of Sarkisian’s original field recordings and engage with the music and scripts in a comment section.

Launched in 1965 by Sarkisian, Music Time in Africa is VOA’s longest running radio broadcast to the African continent. The program continues to feature traditional and contemporary music from musicians throughout Africa.

Since the Texas shadow docket decision, I’ve been thinking about something when it comes to our system of government and constitutional protections…

First, the idea that Congress can, in any meaningful way, codify constitutional rights short of an amendment - the problem with passing a law to codify Roe, as is being suggested, is that the next Republican Congress and Republican president can simply repeal that law, because it would only be a statute. It returns us to the idea that constitutional rights are subject to the whims of congressional majorities (majorities that may often, at least in the Senate, but potentially in the House, represent a minority of Americans).

Second thought: Supreme Court term limits don’t help matters much either. All term limits do is give legislatures a chance to time when they will do their fuckery based on when terms come up. In fact, the consistency of having life tenure probably actually helps keep the fuckery at bay in most instances.

Third, the fact that 3 (or 5*) of the Supreme Court Justices were appointed by someone who did not win a majority of the vote for president is another reminder that the Electoral College is incredibly stupid. *Bush’s two appointments were in his second term, where he won an actual majority, so I’m less annoyed by that outcome.

Idea number four: the theme of these first two (and now into our third) decade of the 21st century seems to be the failing of institutions. It happened a bit at the end of the Bush administration, thought it seemed like Obama was turning the tide, but after Trump it seems like Obama may be an anomaly rather than a course correction. The problem with this is that the modern American system is built on institutions, and if they fail, we fail… which is, not good.

I don’t know, maybe I’m just down a bit today, but this is the first time I’ve really been skeptical of the wider system holding, and I don’t really know why that is

I like sports, generally and to varying degrees, but I have little time/need/desire for analytics or advanced stats or whatever new name they are giving them these days. Sports are for entertainment, not calculus.

The whole key to understanding the anti-vax pro-horse dewormer mentality is that it’s not just this one thing for these people. Admitting that they’ve been wrong about this isn’t like admitting you were wrong about thinking that Willie Mays hit 700 home runs or that Detroit is the capital of Michigan. To admit you were wrong about this thing in particular would be to pull on a thread that could unravel your entire social and political identity. For those in the right wing bubble/base, admitting error on this point basically requires a literal conversion experience. It would be like a former Christian fundamentalist coming to the view that the Bible isn’t actually the inerrant word of God. In other words, that’s not just some random fact, but THE fact, that holds every other part of the person’s world view together.

I can’t see a way forward for the US without breaking the power of right wing propaganda, and I can’t see a way to do that.

IMO the central problem is that the right doesn’t have to get to a 50% crazification factor to ‘win’. If they needed to do that, we’d be pretty safe, since that number is unreachable.

But if they are a persistently substantial and crazy minority, they can ‘win’ by making the nation ungovernable until fatigue sets in and some stupid deal gets made, like the deal that got Hitler into power in Germany.

Frigate Birds - one of my favorites…usually only see them hovering on the air about 500 feet above me. These were close enough to hit with a rock (not that I would do that). 7 foot wingspan (big ass blackbirds). Pic of my wife near one for scale. The Mercedes-Benz GLS sport utility vehicle driven by prominent South Carolina attorney R. Alexander “Alex” Murdaugh on Saturday - the day he sustained a “superficial” gunshot wound to the head while purportedly changing a tire on the side of a rural Hampton county road - was equipped with run-flat tires, sources familiar with the situation have confirmed to this news outlet.

These tires - also known as “extended mobility tires” - allow a vehicle to travel approximately fifty miles with little to no tire pressure due to the presence of a reinforced sidewall.

“Alex was changing a tire when a car passed him,” WCIV TV 4 (ABC - Charleston, S.C.) reported on Saturday, quoting Griffin. “The vehicle turned around and someone in the car shot him.”

Most Mercedes SUVs equipped with run-flat tires do not include spare tires - which would mean there would have been no reason for Murdaugh to pull over to the side of the road to try and change a flat tire.

(He was 7 miles from home when this tragic flat tire incident happened)

So my cousin, the one who likes to post memes about how the vaccinated are sheep, and how everyone wants Trump back, and has the “I don’t care about your shot” ring around her Facebook picture, caught the virus. She has a headache and has lost the ability to taste. If you get into choice, difficulty, “good circumstances” or “bad circumstances”, you’re accepting the Republican framing, and you’ve conceded the argument before you even started! I see that over and over on this site, and it annoys me.

I talked about vegans. Vegan Twitter likes to nag Disabled Twitter, saying that we would be less disabled if we took a vegan diet. Many disabled people, including autistics and others, gave very detailed explanations why they cannot be vegans.

I said “fuck that shit”. I don’t want to be vegan. I don’t need to justify it.

Likewise, giving someone a justification for having or not having an abortion is just giving power to some random asshole, probably male, but still definitely unjustified and incompetent to decide for you in any case.

At dinner tonight, I learned about a non-vaxxer — and it came as a surprise. Was this mentioned here? Both Jesse Jackson and his wife were hospitalized for Covid on August 21. He was vaccinated but she was not! Apparently they have now both been released from the hospital.

Talked with a girl friend who moved to Texas pre-Covid to be near to her children who all reside there. There is something about these Republican states that can cause intelligent educated people to lose their sense of reason. OTOH, most Republicans, regardless of their place of residence, also seem to have lost any semblance of logic and understanding when it comes to issues driven by the GOP culture wars, attacks on science, and Trump idolization.

At dinner tonight, I learned about a non-vaxxer — and it came as a surprise. Was this mentioned here? Both Jesse Jackson and his wife were hospitalized for Covid on August 21. He was vaccinated but she was not! Apparently they have now both been released from the hospital.

Good news they’re out of the hospital. IIRC, she has a medical condition that prevented vaccination.

First, the idea that Congress can, in any meaningful way, codify constitutional rights short of an amendment - the problem with passing a law to codify Roe, as is being suggested, is that the next Republican Congress and Republican president can simply repeal that law, because it would only be a statute. It returns us to the idea that constitutional rights are subject to the whims of congressional majorities (majorities that may often, at least in the Senate, but potentially in the House, represent a minority of Americans).

Second thought: Supreme Court term limits don’t help matters much either. All term limits do is give legislatures a chance to time when they will do their fuckery based on when terms come up. In fact, the consistency of having life tenure probably actually helps keep the fuckery at bay in most instances.

Third, the fact that 3 (or 5*) of the Supreme Court Justices were appointed by someone who did not win a majority of the vote for president is another reminder that the Electoral College is incredibly stupid. *Bush’s two appointments were in his second term, where he won an actual majority, so I’m less annoyed by that outcome.

Idea number four: the theme of these first two (and now into our third) decade of the 21st century seems to be the failing of institutions. It happened a bit at the end of the Bush administration, thought it seemed like Obama was turning the tide, but after Trump it seems like Obama may be an anomaly rather than a course correction. The problem with this is that the modern American system is built on institutions, and if they fail, we fail… which is, not good.
T skeptical of the wider system holding, and I don’t really know why that is

Some comments here —
1. Yes — a law can be undone with the next administration but it can be very challenging once it’s woven into the fabric of our society. As much as the GOP would like to eliminate them, too many programs are now part of our culture — you think anyone would dare (though they have tried) to eliminate Social Security or Medicare? Courtesy of gerrymandering and voter suppression, we already have the problem that the House majority can represent a minority of Americans.

2-3 In general, it’s the president that’s responsible to what happens to the Supreme Court, not Congress (Garland not withstanding). Right now, we are stuck for at least a generation due to the inability to dislodge the SC 6 GOP majority. And once the Federalist Society reared its ugly head, the court became subject to a malevolent ideology. It was the Bush v Gore decision that has led us down a very dark path.

Our institutions are definitely failing us, with the assistance of a RW propaganda media and a corrupt MSM — and there seems no help in sight.

The man who started the movement to recall Gov. Gavin Newsom has COVID-19 (Sacramento Bee)

The lead proponent of the effort to recall California Gov. Gavin Newsom has COVID-19.

Orrin Heatlie, the retired Yolo County sheriff’s sergeant who started the recall movement last year, confirmed to The Sacramento Bee that he tested positive for the virus and has been isolating while recovering.

Heatlie said he did not receive the COVID-19 vaccine prior to his infection, and his case was not severe enough to warrant a hospital stay or any extreme measures.

“I was given some medication for a cough, but that was it,” he said.

Heatlie’s infection highlights what has been perhaps the most divisive issue in the recall campaign.

When Mr. Heatlie started the recall effort, it was over alleged misconduct by Gov. Newsom over crime and immigration. As the pandemic took hold and Newsom instituted a series of measures to slow its progress, Mr. Heatlie seized on that to drive people to sign petitions.

“I am not anti-vaccine. My daughter and my wife are both fully vaccinated, and I’m not against people getting vaccinated, but I am all for personal choice and people’s right to make an informed decision,” he said.

With one week left until the recall election, Newsom and allies are pushing the message that recall proponents will stall California’s progress in fighting the virus.

I made tacos. Yeah, yeah. Big deal. Well not really. I just made them using homemade tortillas for the first time. Yes, I know they are brown. I used whole wheat flour instead of white and I added a teaspoon of (homemade) taco seasoning for a bit of flavor. They are also a bit thicker than commercially made/pressed. I am working on that. Anyhow, here’s some pics.

The bottom line is that Newsom looks awfully safe. The only real hopes for the pro-recall forces: (1) a huge number of people who said they planned to support Newsom were either lying or changed their minds after talking to the pollster, or (2) a huge number of people who said they planned to support Newsom and were likely to vote were too optimistic, and ultimately prove unable to find the 30 seconds it requires to fill out a ballot and drop it in the mail. That sounds like “slim” and “none” to us, with slim about to leave town. Indeed, at this point, it appears more likely that Newsom is sustained by 10+ points than that he is recalled. Heck, it’s possible that he comes out on top by closer to 20; our back-of-the-envelope math above has him up 26 points among the ballots that have been received (63%-37%).

One of my friends with long Covid has been sitting in a waiting room at a Northern Virginia ER for 10 hours. (One guy has been there for 15 hours.) She went in because she was swelling, had chest pain and joint pain. The nurses did get her an ECG which indicates long QT interval but she has yet to be seen by a doctor, because sick unvaccinated Covid patients are taking priority at the moment. She thought about going home and trying to get in at her doctor, but knows her ECG numbers mean she’d be back in that waiting room. As you can imagine, she’s fairly bitter at the unvaxxed.

Got a mild scare yesterday on the interstate while driving back south from visiting my brother.

Semi a bit ahead of me had a tire on the trailer break up and suddenly there was a large strip of moving rubber and steel bouncing along my lane at speed. Had to go onto the shoulder to dodge it. (Luckily it had essentially stopped moving by the time I got to it.)

Car ahead of me had to do a much more drastic dodge since he was closer when things happened.

I recall the blowup over Mad Max: Fury Road being too “feminized”, which makes you realize what a bunch of dateless wonders some of these Men’s Rights Activists are.

Mad Max was just trying to get more women into to see the release: they already had enough cool chopped up monster trucks, explosions and flaming guitars to draw all the male crowd, so they were looking to broaden their appeal.

similar happened to me once on an electra glide with a passenger-du-jour
(years before mrsdm and i reincarnated)

truck in front of us drove over a whole tire lying in the road so i didnt see it till i did
and there was no time. it was I-95 lots of traffic and maybe i was a tad too close
no time to swerve and stay in the lane, and couldnt change lanes
i yelled hold on (cause that’s what you yell after you mutter “shit”)
i thought we were definitely going to hit it and fall

we rode right over it

it was a toy run or a poker run or something
we did some serious thankful drinking that day

He said he came about 6 inches from hitting a friend with his foot peg, at 60 mph, as the guy rolled down the pavement like a loose sausage. The guy’s OK, thankfully, but as you note, you never really know what’s coming, no matter what you’re riding or driving.

and we think we know what it’s going to be - child and ball, left turn in front of me, etc.

in truth there is barely time to automatically react
and even that assumes some level of honed skill and situational awareness
in a car it’s steering, gas, brake - not much else.
most people swerve and brake cause they dont practice anything else (like gun owners)
and they’re reading their phones or eating or talking or….

90 percent of people think they’re an above average driver

mostly they are just competent enough steerers, some of the time

I’ve been pretty good about it, but I’m sure I’ve angered a few. I know I’ve made a few semi drivers mad. Not intentionally, mind you, but sometimes you misjudge the downhill slope and you can’t always tell how much the guy is carrying. Needless to say, I give a wiiiiiiiiide berth to all semis when I pass them on the freeway these days, to the point where I frequently get passed on the right by impatient assholes because I’m not comfortable merging back in front of a big rig with only a couple of car lengths’ worth of clear space.

I lost control of my car on the freeway in a rainstorm (rear tires were too bald) and did a 360 across 3 lanes of traffic, stopped between an exit ramp to my left and I-94 to my right. we were in the left lane. there’s a car on our side (the wrong side) coming at us.
i’m 19 and having trouble processing what im disbelieving. they never taught us this.

The cost to change the name of Robert E. Lee High School came in at $366,000. That includes the signage, stationary, band and athletic uniforms, &c. Three-quarters of the cost was paid by donations to the school district.

Back in the day, Sept. 8, 1964: First day of school for Omaha’s first Black woman principal (Omaha World-Herald)

Edmae Swain started her first day as the first Black woman principal in the Omaha Public Schools 57 years ago today.

In 1964, the Omaha Public School district was still segregated. She was appointed by then-school superintendent Harry Burke, an arch-segregationist. (There is a fight on now to rename a school recently built in North Omaha named after him.) The school she was placed in charge of was fully resegregated in 1965.

The schools were not desegregated until 1976.

In 1969, she was made principal of an all-white elementary school

We should have dealt with them such that they would look at how the English treated the Highlanders and begged for that much mercy. At the minimum, Lee should have been frog marched to the nearest oak tree from the surrender to hang and his army forced to do a legionary decimation.

That is for the storms we had on July 9 and 10.

The only county in the Panhandle approved was Box Butte (seat Alliance, next county to my north).

Winds were in excess of ninety miles per hours at the height of the storm. We had six-inch hail. FEMA estimated over $30 million in damages.

Andrew Johnson wanted to execute Lee for treason. Grant begged Johnson to show mercy because he feared there would be a severe backlash in the south.

Most of the statues were put up by the Daughters of the Confederacy in two waves: After Reconstruction ended, and during the Civil Rights Era.

The point of the statues was to intimidate African-Americans. Most were put up in places which were very public and they had to pass every day.

The same goes for naming buildings, like my son’s high school. Every day a student passing through the doors had to pass several signs honouring who fought for their enslavement. Every paper. Every school event such as a football game or cheerleaders.

It is also why conservatives are whinging so hard now about removing these things (including the Nazi Unite the Right rally in Charlottesville, VA, which was allegedly about removing a Lee statute there).

They still want slaves and they still want to keep African-Americans in their place.

It is also why the Republican Party is whinging about it: They are today’s conservatives and they want the same thing.

Man wanted for two East Coast murders (one in New Jersey, one in DC) was just arrested yesterday a few miles east of me, near Llewellen at Lake McConaughy.

Man suspected in East Coast homicides arrested at Lake McConaughy (North Platte, Nebr. Telegraph)

STERLING, Colo. — Authorities from Colorado and Nebraska joined last week in arresting a suspect in two East Coast homicides near the northwest end of Lake McConaughy.

Luis Carranza-Andrade was arrested without incident at Lake Mac’s Marina Landing based on a tip from federal authorities, the Logan County Sheriff’s Office in Sterling said on its Facebook page.

Marina Landing, five miles east of Lewellen, is a Keith County development along Nebraska Highway 92 near the Nebraska Game and Parks Commission’s Omaha Beach area.

The U.S. Marshals Service in New Jersey told the department Sept. 1 that Carranza-Andrade was in the Lewellen area and wanted in connection with separate homicides in New Jersey and Washington, D.C.

Some Logan County sheriff’s deputies are assigned to the Marshals Service’s Colorado Violent Offenders Task Force, according to the Colorado department’s Facebook post.

Task force members arrested Carranza-Andrade at a residence he was working on at Marina Landing, the post said.

Except that is not how any of that works. If you miss a flight, you usually just get the next one (even on a purchased non-refundable ticket, it is highly unlikely you have to buy a new ticket) nor do you just get to board the plane if it happens to come back (especially if it was due to a bomb threat. You’d likely be able to walk home faster coz they’re gonna deplane all the folks and take the plan apart. They may attempt to get a new plane to put you on, but, that shit caused a ton of unhappiness and delays for a lot of people. Because she’s dumb and vindictive.

As a veteran of many sports talk communities and sports message boards, I can tell you yes. Men hate women announcers. And women sports talk shows (There’s only one national sports talk show host that’s a woman.) They hate the women sideline reporters, unless they’re good looking and then they say all sorts of trash around that. Any woman who dares step on football turf as anything other than a cheerleader is treated like ass.

I will say this too. Men hate men announcers, reporters, talk show hosts, etc. also. But they hate the men because they know they could do a better job. Really. Every guy that posts thinks they could do a better job than any media guy.

Sports “culture” is trash. The only good news is that some of the national sports talk guys aren’t nearly as sexist as they used to be. Some. But none of them cover women’s sports and there is zero respect for women’s sports period.

My state senator, wanting to disenfranchise people in the area where the population grew (the cities).

That would be done by splitting Douglas County’s rural area (seat Omaha) off, so it can be added as an “urban” district. The law limits Nebraska to the smallest legislature in the nation (forty-nine senators in the Unicameral), so growth in the cities means making smaller city districts and periodically combining rural districts.

They would also split part of NE-2 (Omaha) and add it to NE-1 (Lincoln), diluting the liberal district here.

The argument for that bit of fuquery is “I don’t know why Omaha wouldn’t want to be represented by two House members.” (Seriously)

All we really know is that it looks different. We don’t actually have a lot of data on how it acts under various conditions. For now, it really just means wear your mask and keep your enemies far away.

Doesn’t Beta look like it also has issues? Is it that Beta was not as contagious so that it wasn’t as problematic that vaccines/treatments were less effective?
