You can't tempt god like that. We were supposed to go to the fair last night with my SiL and her new boyfriend but he and I both worked later than planned so we put it off until later this week. We wouldn't have been caught dead at a Sugarland concert but I'm glad I wasn't there anyway. The storm that came through here was a pretty big one.

FORT WAYNE, Ind. -- An Indiana school district violated the First Amendment rights of two teenage girls who were punished for posting sexually suggestive photos on MySpace during their summer vacation, a federal judge ruled.

Wednesday's ruling stemmed from a lawsuit the American Civil Liberties Union of Indiana filed on the teens' behalf in October 2009. The lawsuit claimed the district improperly banned the girls, who were sophomores at the time, from extracurricular activities for expression that didn't involve the school, then humiliated the girls by requiring them to apologize to an all-male coaches' board and undergo counseling after the photographs were circulated at school.The U.S. Supreme Court has ruled that students can be disciplined for activities that happen outside of school, so long as the school can prove the activities were disruptive or posed a danger and that it was foreseeable the activities would find their way to campus.
The ACLU argued that the school violated the girls' First Amendment rights by punishing them for photos never intended for public dissemination.
Now the fight moves on to whether the school has immunity from damage awards. I certainly hope not.

They're liable. I would imagine their insurance requirements are outrageous. I do work a few times a year for a concert production company, making massive baseplates for their rigging. They're a local company but they travel all over the world. Their specs are pretty detailed, not only do they have to be structurally sound but it has to be able to be packed in a certain manner. I'm wondering if they were involved since the fair supposedly uses a local crew.

They weren't. They use their own company to put stuff up. I'm wondering if it was inspected by the state/city before it was opened. I have never had my steel inspected by anyone official in this state. The only times it was ever done it was inspected by outside contractors hired by the client.

They check the ADA stuff pretty tight around here. It's weird, they check everything (the walls, plumbing, electrical, roofing, etc..) but the steel. One of the McDonalds I did last year had all their counters 2" too high for the ADA rules. It took a week to cut everything down to the right height. The job I did in Michigan a couple weeks ago had a handrail that was 1/2" too narrow. It had to be cut out, extended an inch and put back in.
A couple years ago someone went through every restaurant on Washington street in Indy with a measuring tape and then filed a lawsuit against everyone that wasn't exactly within compliance. I made a good amount re-doing handrail for about a dozen different restaurants.

That kind of mistreatment is the purpose of these Voter-ID bills; to disenfranchise as many as possible. If they're too poor or can't drive to get a different ID, too bad.
Just like when they passed the disenfranchisement bill here in Wisconsin and then cut the DMV hours to make it harder for people to get in to get the newly mandated ID's.

I don't see the intent of a proper voter ID bill as that. But its a law that can be abused in that way. The good news is that the Texas bill will likely be changed to add the VA IDs. "It's very naive to look at these riots without the context," says one journalist, who says the reason the violence kicked off in the London suburb of Tottenham is because "that area is getting 75 per cent cuts [in public services]". Others have said the political context for the rioting is youth unemployment or working-class anger at Prime Minister David Cameron's cuts agenda.
"There is a context to London's riots that can't be ignored," says a writer for The Guardian, and it is the "backdrop of brutal cuts and enforced austerity measures". The "mass unrest" is a protest against unhinged capitalism, apparently.
These observers are right that there is a political context to the riots. While the police shooting of young black man Mark Duggan may ostensibly have been the trigger for the street violence, there is a broader context to the disturbances. But they are wrong about what the political context is. Painting these riots as some kind of action replay of historic political streetfights against capitalist bosses or racist cops might allow armchair radicals to get their intellectual rocks off, as they lift their noses from dusty tomes about the Levellers or the suffragettes and fantasise that a political upheaval of equal worth is occurring outside their windows. But such shameless projection misses what is new and deeply worrying about these riots. The political context is not the cuts or racist policing, it is the welfare state, which has nurtured a generation that has no sense of community spirit or social solidarity.
What we have on the streets of London and elsewhere are welfare-state mobs. The youth who are shattering their own communities represent a generation that has been suckled by the state more than any generation before it. They live in urban territories where the sharp-elbowed intrusion of the welfare state during the past 30 years has pushed aside older ideals of self-reliance and community spirit. The march of the welfare state into every aspect of urban, less well-off people's existences, from their financial wellbeing to their child-rearing habits and even into their emotional lives, with the rise of therapeutic welfarism designed to ensure that the poor remain "mentally fit", has undermined individual resourcefulness and social bonding. The antisocial youthful rioters are the end-product of this antisocial system of state intervention.
The most striking thing about the rioters is how little they care for their own communities. You don't have to be a right-winger with helmet hair and a niggling discomfort with black or chavvy yoof (I am the opposite of that) to recognise that this violence is not political, just criminal. It is entertaining to watch the political contortions of commentators who claim the riots are an uprising against the evils of capitalism, as they struggle to explain why the targets have been Foot Locker sports shops and why the only "gains" made by the rioters have been to get a new pair of trainers or an Apple laptop. In the Brixton race riots of 1981, looting and the destruction of local infrastructure were largely incidental to the broader expression of political anger, by-products of the main show, which was a clash between a community and the forces of the state. But in these riots, looting and smashing stuff up is all there is. It is childish nihilism.

That aside I can only say, using his phrase, some of the rioters are from a "welfare state" culture however not everyone from the "welfare state" culture are rioters. There's a problem with passive law enforcement in quelling the riots for sure but it wouldn't prevent the systemic problems that create such criminal behavior.

Whether or not his is a conservative, his OpEd was a simple indictment of socialism dressed up in conjecture that is supposed to be intellectual reasoning. But it's not. He's just another rioter, but instead of a Molotov cocktail he has a gin/tonic and a laptop.

Well my point in asking is that DF posted a blanket statement saying this guy is no conservative. I have respect for DF but he has a habit of posting stuff like this and not defending it, once challenged.

So I was listening to NPR this morning, and heard an interesting statistic about the London riots. Seventy five percent of those arrested for rioting rioted outside of their local area. If this is true (and I heard it right), that would substantially change how I think about the riots because it would no longer be people shitting where they eat so to speak.

Yah, I think that's either an error or an irrelevant factoid that, if he's not a conservative, he's a glibertarian making a standard anti-big gov stump speech that would get conservatives aroused. But as Obdi pointed out, it's not based in any fact but entirely conjecture yet confidently posited as fact.

Umm? The whole idea is to find a way forward. More of the same is not workable. Bratton has done good work several times before. We should listen.
What was it Deng Xio Ping said? Right. It doesn't matter what color the cat is, as long as it catches mice. It doesn't matter what "side" Bratton's on, or what philosophy seems to gain standing because of what he says. What matters is to restore peace and order. If that can be done by negotiations, all the better. If only force will serve, force will have to be applied. But as a last resort, not as Plan A.
