Georgia Judge Says Birther Orly Taitz Can Question President, Orders Obama to Appear in Court

Today’s ridiculous news is not finished yet; now a Georgia judge has ordered President Obama to appear in court for a Birther hearing.

ATLANTA - A judge has ordered President Barack Obama to appear in court in Atlanta for a hearing on a complaint that says Obama isn’t a citizen and can’t be president. …

An Obama campaign aide says any attempt to involve the president personally will fail and such complaints around the country have no merit.

The hearing is set for Thursday before an administrative judge. Deputy Chief Judge Michael Malihi on Friday denied a motion by the president’s lawyer to quash a subpoena that requires Obama to show up.

Not mentioned in this AP article — the attorney for the plaintiff is the queen bee of the crackpot Birthers, Orly Taitz: Orly Taitz and David Farrar: Hold on for the ride, Birthers at it again - Atlanta 11th Circuit Court.

The Office of State Administrative Hearings Docket, in short, states that Dr. Taitz, Esquire of California, will conduct a Direct Examination of President Obama based on the following questions:

  1. Is the candidate’s birth certificate an authentic one issued by the State of Hawaii?;
  2. Is the candidate an Article II natural-born citizen of the United States as established in Minor v. Happersett, 88 U. S. 162 (1874); and
  3. A challenge on O.C.G.A. (Official Code of Georgia) regarding the ‘making of false statements generally,’ i.e., is the candidate’s social security number authentic?

I was defamed, viciously maligned by so many Obots (Obama bots), pro-Obama media thugs, by a few corrupt officials and judges. Recently even people, who claimed to be on my side turned sides and viciously defamed me and attacked me. Among them were Arlen Williams, Dean Haskins, owner of a blog Birther Summit, Bob Nelson-owner of a blog Birther Report or ObamaReleaseYourRecords, Helen Tansey -owner of a blog art2superpac and even attorneys, who should’ve had some professional ethics. Attorneys Gary Kreep and Philip Berg filed insane pleadings, saying that I tried to hire a hit man to kill Lisa Liberi, legal assistant of attorney Berg and kidnap children of a web master Lisa Ostella. It has been 3 years of total nightmare, these people were like a pack of wild dogs attacking me and coming up with each and every accusation in the book. Now I am vindicated.

Reading what he wrote, as long as Obama's lawyer provides a legal precedent or authority for not appearing, he won't have to. I think this is just him being a dick for political effect, and probably they'll just cite something to make it go away. Or maybe they'll just ignore it, we'll see.

While I have always believed in the noone-is-above-the-law philosophy, and believe that even the President of the United States has no more legal standing before the law than a bum on the street (theoretically, at least), nobody, not the president nor the bum, should be called into court repeatedly on pointless charges.

I fail to see why this is even in court. A legal document from the state of Hawaii has been released that answers all charges.

That was my first thought as well. This woman has had this crazy shit tossed out of courtroom after courtroom, with judges even threatening to have her disbarred if she continue to pursue it. Yet she continues to fight on.

That she finally managed to find a judge willing to put up with this crazy BS shows that even a blind squirrel can find a nut on occasion.

These (and a couple of others) represent the vast majority of the Atlanta poulation

Let me make a couple points to try to put this into context. First, because the first response to “birthers” by many in this country is simply to blow us off as conspiracy theorists, Michael Jablonski submitted a sloppy, weak Motion to Quash. I’m sure he thought it would suffice with the judge—since the opposition were birthers; however, Judge Malihi obviously regards his role and the legal process much more seriously than that. And, because I’m sure he wants to make certain that, at the end of these HEARINGS (not trials), there is nothing that could be viewed as procedurally improper, he’s not going to grant the professional attorney involved any special favors. He will hold somebody accountable to understand the law, and I’ll leave it up to you to figure out whom that might be.

Here’s what will probably happen: after Jablonski recovers from his blanket party, he will likely file an amended Motion to Quash; and it will probably be one of the most thorough Motions to Quash in the history of Motions to Quash, and Judge Malihi will probably grant that motion.

In the unlikelihood that Judge Malihi does not grant his amended Motion to Quash, there is something that is virtually guaranteed to happen: Obama not showing up to an administrative law hearing in the state of Georgia. Jablonski would appear on his behalf, and present a certified “birth certificate” and proof of residency for the past 14 years. As the certified “birth certificate” will be considered self-verifying by the court, nothing Orly will say will sway it. And remember, the end result of this hearing is a non-binding recommendation to the Secretary of State. So, no, Obama will not be handcuffed in Atlanta next week (he won’t even be there).

This judge may actually be acting wisely and well. This may just be an administrative hearing, but it may be that the motion to quash was legally insufficient. It's possible the fault lies entirely with the lawyer who presented it.

I'd rather see the President's lawyers run circles around Taitz while Obama was off doing his job. She's not worth his time or effort.

There wouldn't be this level of effort or obsession from birthers if Barack Obama was a white guy named Barry O'Shea. It's racism, pure and simple. The POTUS deserves better than dignifying any of that shit in court.

I just don't find it relevant. It's stupid. Even when I was semi-ultra-right-wing in the 90's, I thought hounding Clinton over past pot use was stupid.

People who abuse drugs to a harmful degree do not graduate big name colleges, nor wind up with successful careers in law or politics.

I believe that not only should the President show up, but when the case is dismissed in favour of the President at a later date, costs should be awarded against Orly. I would imagine that the President and his plane, and his security detail and everything else should come to a tidy $500,000 or so pretty easily. Put her out of business permanently. Jablonski, lulled into a false sense of security by the unparalleled string of legal defeats suffered by the birther movement, filed a badly-written and legally inept motion to quash.

The judge, who is neither a birther nor a tool, quite rightly handed it back and told him no.

And this is not a trial, although the birthers keep claiming that it is; it's an administrative hearing. Also, the President has not been directed to appear, although the birthers keep claiming that, as well.

The American judiciary in this whole mess has proved itself to be scrupulously fair, bending over backwards in fact to avoid any appearance of favoritism. I have a feeling that this forbearance has about exhausted itself. Several birthers have had their asses handed to them recently and the batshit queen Taitz is on the verge of being declared a vexatious litigant at the request of the state of Hawaii.
