Breaking: NAF Will Move to Hold Chuck C. Johnson in Contempt if He Skips Out on Deposition

Big trouble for a horrible person

Chuck C. Johnson poses with Center for Medical Progress head David Daleiden, October 25, 2015

In the ongoing saga of right wing troll Chuck C. Johnson’s very bad decision to publish leaked copies of the Center for Medical Progress “sting” videos targeting Planned Parenthood and the National Abortion Federation, the NAF’s lawyers (mofo.com) are not pleased with our boy Chuck; they’ve now produced an opposition to Johnson’s motion to quash the subpoena he was served last week.

The NAF says they will file a motion to hold Johnson in contempt unless he honors the subpoena and shows up for a deposition in Fresno this Friday, and demand that he pay attorneys’ fees and costs. Which could be a hefty sum of money; and if Johnson still refuses to appear or pay these costs and sanctions, he could very well get the Kim Davis treatment and end up in jail.

When Johnson posted the photo at the top of this article on his Facebook page, I knew it would come back and bite him; and now it has. The NAF’s lawyers included it in this opposition.

UPDATE at 11/4/15 5:08:23 pm by Charles Johnson

Earlier today, Chuck Johnson posted this to his Facebook page:

But as usual, he’s mistaken; Judge William Orrick’s wife is not a “Planned Parenthood board member,” she’s just a supporter of women’s reproductive rights. She was attacked by many right wing sites when the temporary restraining order against the Center for Medical Progress was granted.

I would not be surprised if Chucky flips NAF the finger, figuring like Mississippi that they won’t do anything about his refusal to appear, and will end up being found in contempt until his lawyer gets it through his thick skull that nobody is coming to his rescue.

While, I wouldn’t put it past him, the difference is Mississippi is a long way from California (where Chuck lives)… since this is a federal court in California, the cost of sending US Marshals to pick up Chuck and bring him to the courthouse are much lower. Which is a bet I wouldn’t take - and I’m a gambling man.

Dipshits like Chucky are creatures of habit, prone to continuing to do something until they get negative stimulus. In this case, he’ll insist on continuing to piss courts off until one throws his ass behind bars. So yeah, I don’t expect him to do anything besides play to form by declaring the court doesn’t have the authority to do anything to him because he’s a journalist.

Scene: Int Federal Prison, a few months from now. CHUCK C. JOHNSON is seated next to a gigantic, dangerous looking dark-skinned inmate.

CHUCK: “Soo… uh… uh what are you in for?”

BTW, I wouldn’t say plans to hold, but rather seeks to hold. They are asking the court to hold him in contempt. MoFo, for all of their fearsome reputation, can’t hold anyone in contempt. Note that there are four attorneys on the motion. And there’s probably going to be a similar number attending the deposition (sr and jr attorneys) since they’re going to want to parse every word and make sure that all the areas of contention are covered (back up for the back up attorneys) - think depositions in The Social Network involving Zuckerberg and Saverin for a similar type of situation.

Fun fact: Modern Christian interpretations have noted that David actually had the advantage in that fight, not Goliath. Biblical slingers were deadly opponents, and Goliath’s giantism led to several disabilities (poor eyesight, etc.) that left him at a severe disadvantage to the young, healthy, well-trained and experienced David.

Projectile weapons deliver energy to the target. The energy delivered depends on the mass and velocity of the projectile. A small bullet traveling very fast delivers a lot of energy to a small area. A larger projectile can deliver equivalent energy (over a little larger area) at a much slower speed. The point being that a sling thrown stone could deliver the same energy as a bullet.

So the sniper analogy is apt. We aren’t talking slingshots here; slings are deadly weapons, especially in the hands of an expert. But the story is just so much less inspirational if you think of it as a big guy with a spear versus a guy with a gun.

It’s an error without doubt.

The difference depends on which machine is being referenced. If I send information from my machine to another, I’m uploading information. If I pull information from another machine to mine, I’m downloading information, from the perspective of my machine.

In olden days when PCs were basic and main frame machines ruled, their description might have been true of the majority of data transfers. But not all, so the “answer” is just stupid.

I think I just caught Jeopardy in an error.

They said, if I heard right, that an upload is going from a smaller machine to a larger machine & download is from larger to smaller.

I’ve been in the business for 30 yrs. I’ve never heard it defined like that.

I’d define all uploads as outgoing, and all downloads as incoming. They’re both transfers with the only difference being the user’s perspective.

Interesting/ironic/odd/typically lazy how Western journalists haven’t been all that interested that this year Belarusian writer Svetlana Alexievich was the first journalist to be awarded the Nobel Prize in Literature. Maybe they had their money on Bob Woodward?

Quick dinner tonight.

1/2 pound mild Italian sausage.
1 bottle Classico Italian Sausage (with peppers & Onion) Spaghetti sauce.
1 2.5 oz can of sliced Olives.
1 4.0 can of pieces & stems mushrooms.
Penne pasta (scaled for 2)
Texas Toast

Brown sausage and boil pasta.
Once both are done, drain pasta & sausage.

Mix meat, pasta, spaghetti sauce, shrooms & olives into pan used to boil pasta. Let simmer.

In the mean time, cook the T-Toast according to directions.

Once the T-toast is done. Chow down.

Why not a single-payer system? That’s a good question. I am for it, but I’ll admit that I don’t see anything like it operating successfully in a nation of this size and complexity.

Pros: in theory a populace that goes regularly to the doctor means a healthier population=less money going into critical care. Takes the greed and obfuscation of costs factor (again, theoretically) out of medical care. Reduces the impulse for pointless tests…

Cons: takes the incentive out of lucrative research for Big Pharma; takes incentives for innovation in care (all of this is theoretical); huge bureaucracy necessary (but big Insurance, if all companies and plans combined, would probably outsize necessary government bureaucracy)….

I have no idea what I’m talking about. But there’s no action here, and I wanted to bloviate before going to bed. Good night!

re: #147 Barefoot Grin

Ultimately, we as a country need to be honest with ourselves. Do we consider access to medical care a human right, such that doctors are required to treat patients without regard to their ability to pay? We currently have a schizophrenic attitude towards this: if it is an immediate trauma, we say yes. As long as they make it to the ER, doctors will do everything they can - even if the end result will be survival with medical bills that require bankruptcy to clear. If it is cancer, we say no. No ability to pay for treatment means tough cookies, take the time you can to put your affairs in order and say goodbye.

Until we really resolve that (and I suspect a number of people are quite willing to say that no, people should not be treated unless they are able to pay), we’re not really going to make progress on this conversation as a nation.

Well said. I really am going to bed now, but I clicked one more time and caught your comment. I fully agree that we should consider access to health care a basic human right. Until recently I have thought a fully-nationalized system to be the best way to meet that test. Now I ask myself: if Bernie says yes and Hillary says no, is this a defining question for me? It may be, but I’m not sure yet. This problem matters a lot to me, uneducated on it as I am.

I am not against the concept of capitalism. I like our system all the way up to a point. The problem is with something like healthcare capitalism itself becomes an issue.

The costs are going to be high because if you have a system that is based on price judged by demand and value, then health care costs are going to be the highest.

Without any form of regulation on pricing and the whole value placed on the system in healthcare, it is wide open for costs to be high to unreasonable.

And that is also why single payer will struggle too. Set pricing, no room for the doctors to set their own, or they are held within a range based on experience, etc. Drug prices set too. Medical Equipment…on and on. Lots of issues that just don’t fit “the American way.”

I was hoping the ACA would be a step to fix some of that too. At least point the country in a direction without shocking the whole system.

Before college, I hated hip-hop. Gang-bangin’ wit da bitchez and big screen TVs and Cadillacs wit my gats was what the white kids around me were listening to in high school and I knew even in my young age that that shit was whack. I hated hip-hop in high school, but I secretly loved Wu-Tang. I know it may sound like a lofty comparison, but when I was 19 living in a dorm in college, my good friend and skiing buddy who’s from outside of Philly burned me a copy of “Liquid Swords” and I felt like Springsteen the first time he heard “Like A Rolling Stone” the first time I gave that album a spin. The album blew my mind.
