I wish Democratic candidates would stop this nonsense. Hillary had tons of policy details and talked about them nonstop. So too, do many of the current Dem candidates. The problem is not them, it is a media who give them no time. Stop being part of the problem. https://t.co/nORregsmTv

Yes, that is his one blind spot (and not his alone). The other problem with this is that we have a candidate who is (arguably) better at policy out there in Elizabeth Warren who is doing this work constantly and on the ground in places like Mississippi this weekend. Point that out. We have to make this a huge issue this time. No more empty podiums on CNN—we want substantive discussions!

Good luck making that happen. The more we try and get anything of CNN, the more they seem deadset on allowing the GOP to set the stage, especially when anything Dem is involved. Thus unless you’re obsessive pol junkies like us, you’ll never get the actual Dem narrative. Just the GOP narrative of what the Dems are about. All actual policy talk may as well be spitting in the wind, who has time for that when juicy ‘Dems obsessed with identity politics!’ red meat is staring you in the face! I mean, forget that the red meat is just dyed rubber and foam, it looks tasty, right?!
Well!

A slew of Trump administration officials were found to have used private email to conduct official business, according to a publicly released letter from House Oversight and Government Reform Chairman Elijah Cummings (D-MD), and one of those officials was Stephen Bannon.
According to the letter, Bannon — President Donald Trump’s former chief strategist — and former deputy national security adviser K.T. McFarland discussed the transfer of sensitive nuclear technology to Saudi Arabia, both using private email accounts.

The Democrats have to be loud and demonstrative. They have to make some noise.
It has to be good noise, but they have to command attention from the media. That is apparently the new way, but if that is the way, then that is the way.
They have to use the internet way more to take on all the Trump stuff and the media. They have to show the media up to a degree - challenge them.
They have to make so much noise the media has to cover why those old softy Democrats are getting all noisy and raising a ruckus.
Rally’s everywhere around making America clean again…both politically and environmentally. The media loves color, noise and a good show. Then they are guaranteed to cover you.
But it has to be substantive and held to.

re: #26 jaunte
Remember when Presidents read?
I pity the fool that has to draw the Dick and Jane diagrams for the President’s Daily Briefing…
From Popehat at the Atlantic:
Why would Mueller spend so much time investigating obstruction of justice but not reach a conclusion? We won’t know until we read his report. But Mueller, a career G-man, is fundamentally legally conservative. That means he has a narrow view of his own role and a healthy respect for the authority of the other branches of government. He might believe that the evaluation is so inherently political that no conclusion he could offer would ever be seen as legitimate, and that the matter is better resolved through Congress’s constitutional authority to impeach (or not) the president. Even if Mueller didn’t make an explicit recommendation, we’ll probably be able to infer his conclusions by reviewing how he marshaled the evidence for and against guilt. Prosecutors, as a rule, are not good at neutral renditions of facts.
The attorney general showed no such circumspection. In less than 48 hours, he and Deputy Attorney General Rod Rosenstein—who supervised Mueller for most of his investigation—“concluded that the evidence developed during the Special Counsel’s investigation is not sufficient to establish that the President committed an obstruction-of-justice offence.” Though Barr emphasized that he and Rosenstein had been involved in evaluating the status of the investigation for months, and that they consulted the Office of Legal Counsel and other Department of Justice experts, this conclusion reflects startling and unseemly haste for such a historic matter.
Crucially, we don’t know whether Barr concluded that the president didn’t obstruct justice or whether he couldn’t obstruct justice. Well before his appointment, Barr wrote an unsolicited memo to Rosenstein arguing that Mueller’s investigation was “fatally misconceived,” to the extent it was premised on Trump firing former FBI Director James Comey or trying to persuade Comey to drop the investigation of Michael Flynn, Trump’s first national-security adviser. Barr’s memo was a forceful exposition of the legal argument that the president cannot obstruct justice by exercising certain core powers such as hiring or firing staff or directing the course of executive-branch investigations. So although Barr’s letter to Congress says that he and Rosenstein found no actions that constituted “obstructive conduct” undertaken with the requisite corrupt intent, we don’t know whether he means that Trump didn’t try to interfere with an investigation, or that even if he did, it wasn’t obstruction for a president to do so. Democrats in Congress will want to probe that distinction—as they should.
Mueller’s report was initially confidential under Department of Justice regulations governing the special counsel. In Sunday’s letter, Barr said his goal was to release as much of it as possible consistent with the law. In particular, he noted that the report includes information about matters occurring before the grand jury that are secret as a matter of federal law, and that some other references in the report might reveal the status of ongoing investigations. Barr must abide by his promise to resolve those questions promptly and in favor of as much disclosure as the law permits. It’s impossible to evaluate the results of Mueller’s investigation—and their legal, political, and historical significance—without the details.
And we know Barr doesn’t believe a sitting president can be indicted. It just all means that we shouldn’t accept anything until the report is released.

Barr’s just doing what Barr was hired to do, protect the President. The media is doing what they’re finding profitable to do, which is to support this fascist administration no matter the thin sheer fabric of constitutionality that is in place. Based on Barr’s history alone with Iran-Contra, any self respecting news organization would assume the fix was in and based on the rapid fire findings of exoneration of the President issued by Barr less than 48 hours of the receipt of the report should be telling. Not to even mention the fact that the President hiumself, admitted obstruction of justice, live, on TV in an interview with Lester Holt, should be anything that any prosecutor would ever need to prove obstruction.
Barr letter says “The Special Counsel’s decision to describe the facts of his obstruction investigation without reaching any legal conclusions leaves it to the Attorney General”

But she’s getting the same content as the average viewer who is not wired into more in depth discussions and broader sources. Her refrain is that “Trump will get away with it all and be reelected in 2020”. We have to see that doesn’t happen but it’s often hard to be optimistic when the MSM repeatedly demonstrated its incompetence and its bias against Hillary throughout the 2016 campaign and it seems to be prepared to repeat the same behavior.

I just made a comment over at B-J after being absent from there for ages, about that exact problem: we might see something behind the veil that we can try and dig in on, but we’re the junkies, consuming the minutiae over things like this. Those who are only casual observers or don’t have the regular investment to track politics obsessively are going to be beholden to what the press and the media put out. And we’ve seen that the press has almost universally latched on to the ‘TRUMP TOTALLY INNOCENT’ narrative.
That’s going to be nigh impenetrable to get through without some major shakeup.

He got 62,000,000 votes in 2016, in rather lackluster turnout for an open Presidential election. Only his base were enthusiastic, and that’s not all of the 62,000,000. Does anybody actually think he’s gained any support in the last two years? I don’t. And whoever’s running against him will have had less than two years of raging, slobbering bullshit heaped on them, instead of 35 like Hillary. Plus the Democratic base is riled up like I’ve never seen them. It’s going to take some real chicanery for him to win in 2020. (And yes, I count the “Electoral College” as chicanery.)

The problem is Trump’s brilliance at turning everything against his opponents. He will claim that the reason for any failure in his administration is due to the “witch hunt” and that he is a totally innocent man, exonerated of all crimes. He and his minions will use that as a cudgel to attack his opponents. The Democrats did win the House in 2018 because of their success in promoting policies, not in attacks on Trump. But the Barr report will discredit all those who challenge him. Hopefully the full report will be released some way or other and will prove to undermine everything that toady Barr asserted in his “summary”.

The reason Beto is so well known is his race got nationalized, in 2018. Had it not been 2018, and not been Ted Cruz, it would have been the 2014 race against Cornyn all over again (remember who he ran against, because I don’t and I live in Texas). Doug Jones’s run became a national race.
And a number of races in 2008 and 2012 became nationalized. It’s going to happen, and we’re going to win them.

I just meant to point out that the GOP has won the popular vote in a Presidential election only once since 1988, and that was by activating the last reservoir of previously apathetic voters they could. They’re all in now.
The most important way to prevent this from happening again is to stop voter disenfranchisement and get voters to the polls. Florida voters tried to restore voting rights and the Republicans are working overtime to overturn the will of the population. Our only way to top the tyranny of the minority is to succeed in voting them out but this is very problematical given their concerted efforts to sabotage every effort to expand the vote.
My brother was contemptuous toward allowing felons to vote; Fox News and other right wing media continue to poison American minds and there seems to be no way to stop that.
To say Mueller didn’t conclude that the Trump campaign “colluded with the Russian govt” is a level of lawyerly parsing akin to “depends what the meaning of is is”.
Roger Stone wasn’t officially part of the campaign, he was a “friend” who “did favors” and “gave advice.”
Cambridge Analytica wasn’t officially the campaign, they were a vendor owned by a donor.
Butina and the NRA weren’t officially the campaign.
Wikileaks, Assange, Deripaska et al aren’t officially “the Russian govt”.
And of course, ongoing counter-intelligence operations haven’t “concluded” anything.

If the election fraud in Ohio had worked as poorly in 2004 as it did in 2012, John Kerry would have won an Electoral victory from 3,000,000 votes behind, just like tRump in 2016…except that would not have been allowed to stand, and the “Electoral College” would be history now.

I agree 100% with this evaluation. The only reason the GOP and Prager University and Republican voters are so fond of the electoral college is that in the 21st Century, it has favored them. My one disagreement is with the contention that a Kerry victory would not have been allowed to stand. Kerry would have become President, and there would have been a new Constitutional amendment in place for the 2008 election

Revelations like these are why we desperately need to get Mueller in an open session of Congress to answer questions. He is the best source for answers on the decision-making process for critical parts of this investigation, either because he made them or he knows who did and can point us to them.
This is the REAL conversation we need to have as a country.
As horrific as this president is, he is a symptom of much deeper problems.
Even foreign influence plays on nat’l wounds that we refuse to address: income inequality, racism, corruption,a willingness to excuse bigotry. https://t.co/wtebX4Tfld— Alexandria Ocasio-Cortez (@AOC) March 24, 2019

re: #98 Belafon
my biggest issue with that take is that I fear that we can’t return to any semblance of sanity until they are removed. Those folks streamline hatred and bigotry and misogyny into the American conversation hourly preventing any attempt to deal with those issues.
My suggestion for any wingnuts you meet, either online or in-person, who insist that Mueller has exonerated Donny and the whole matter was a “hoax”: Ask them if they’ve seen the actual report. Not Barr’s editorial, but the actual report the Mueller submitted with the relevant evidence that Barr says must now be redacted by law.
Guarantee you they will immediately start trying to make excuses for why Barr giving his personal opinion is good enough, but James Comey doing the same about the Clinton investigation was a “miscarriage of justice.”
re: #98 Belafon
The answer to Takei’s question we have answered many times.
Trump got elected because:
1) he appeals to a lot of latent racism and bigotry that exists in the electorate;
2) his opponent was a woman;
3) a non-trivial portion of the electorate are suffering from a worldview crisis as their religion is being battered about by modernity and they are desperate for a leader who will reify their wacky beliefs.
I’m waiting for a Democratic candidate who will be courageous enough to state the above publicly.
This is the same thing I told a number of interviewers tonight on the obstruction issue (i.e. this is what I said I *surmised* was Mueller’s thinking, while acknowledging we really can’t know for sure). Glad to see that this is in fact the news that’s coming from Mueller’s orbit. https://t.co/1V2vRlNO4W

- Barr’s report on Mueller’s report isn’t the end of the story. It is merely the start of the second act.
- pretty much all reporting is no ‘collusion’ and no exoneration for obstruction
- multiple [serious] investigations of Trump are going to continue for years and some of them may strike paydirt
- if mueller couldnt conclude there was collusion its either cause the standard is very high, or he couldnt find evidence. these people werent machievellianly brilliant in planning and covering their tracks. Because it’s almost like the entire discourse is only designed to take things seriously when criminality is suggested on one side. Almost like the entire discourse is designed to treat one party with kid gloves and constantly think the best of it. Maybe because they were just looking for an excuse to hail praises on said same party so they can rule (not govern) the country like the ‘real America’ wants them to.

Pathetic, not even pyrrhic
Hybrid regimes are nations where consequential[clarification needed] irregularities exist in elections, regularly preventing them from being fair and free. These nations commonly have governments that apply pressure on political opponents, non-independent judiciaries, widespread corruption, harassment and pressure placed on the media, anemic[vague] rule of law, and more pronounced faults than flawed democracies in the realms of underdeveloped political culture, low levels of participation in politics, and issues in the functioning of governance.[6]
By definition US must be downgraded from Flawed Democracy to “hybrid regime” status. …aka Threatened Democracy.

Manafort May Be Trying to Salvage Some of his Forfeited Money
In addition to the 7.5 years of prison former Trump campaign manager Paul Manafort got for bank fraud and various other crimes, he also forfeited $11 million to the federal government. Ever the wheeler-dealer, Manafort may have come up with a scheme to hang onto some of the cash, despite the forfeiture. The core idea here is that if Manafort had valid debts outstanding, they will be paid out of the forfeited funds, to prevent the creditors from being punished for crimes they didn’t commit. A mysterious shell company, Woodlawn LLC, with unknown owners, is claiming in court that Manafort owes it $1 million on a mortgage and wants to be paid out of the forfeited funds. Prosecutors suspect Manafort may own Woodlawn, so if they pay the company, Manafort would de facto get to keep the money.

Greets and saluts from the NYC metro area. Mueller’s report was delivered to the AG, and the AG issued a terse summation, which should satisfy absolutely no one.
It’s all political theater now from Barr and the Admin, because the actual record of indictments and actions suggests something entirely different from what Barr and Trump claim.
The only way to know for sure is to get the entire report. As I’ve been posting on Twitter, Mueller may have had enough to make the case for obstruction or indicting Trump, but couldn’t due to the DOJ memo and therefore his conclusions may reflect this - and the precise wording matters (that’s what the legal folks do). Barr is pushing a political agenda here, and he doesn’t have clean hands by any stretch.
All the people claiming vindication - from Trump to Hannity to Hume, and other right wingers, all seem to ignore that Mueller got 37 indictments, a bunch of convictions/plea deals, and that includes Trump’s campaign manager, his first NSA, another campaign manager, a foreign policy adviser, and host of Russians.

So Apple is launching their streaming tv service today. So now we have:
Netflix
Hulu
Amazon Prime
CBS All Access
Disney
Apple
Britbox
All of the premium channels(HBO,Showtime,Starz,Epix)Pretty soon we are going to need some sort of umbrella service to bundle all of these together…
Is it going to be like those you list or is it going to be more like YouTube TV, Directv Now, Sling and others that are complete TV providers?

The obvious conclusion is that the New Zealand massacre served as a (no horrid pun intended) trigger - I believe it wasn’t just that, but the agonizing contrast between Jacinda Ardern’s response and that of America’s sorry excuse for a government.

The Parkland survivors’ suicides were the first thing I thought of. To a lot of people, they showed a way out. We must take extra care of those people (which means take care of everybody; we have each been witness to trauma at some level) at this time. No conclusions are obvious, even when there’s a note.

The problem with comparing it to Clinton is that the Clinton investigation started with looking at Whitewater and ending with exposing an affair. The two had zero to do with each other and was obviously a fishing expidition to find something wrong. The Trump investigation started with Trump’s relationship with Russia and ends with Trump’s relationship with Russia.

Trump/Pence are touting that Trump proclaimed that the US backs Israeli sovereignty over the Golan.
Wonderful. Let’s study this a bit closer, shall we?
1) Israel captured in 1967. UN SCR 242/338 etc all indicate final status of the (ed: this is not in all translated versions of the SCRs) lands captured in the war will be determined by the parties. The US has considered itself to be the honest broker/mediator between parties to get to a deal.
Trump ends that.
What does the US get in return for making this position public? Does this improve our security? Does it improve our connections to other nations in the region besides Israel, with whom we already have a close relationship (going back to 1973)?
2) Trump just put a bullseye on the back of the US (more than usual). He’s giving Bibi a talking point to crow about, but doesn’t improve our national security with this move. He’s just made it more dangerous for Americans in the region.
3) Israel long treated the Golan as its own, and Israel is generally safer being in control of the high ground than when Syria used it to regularly bombard Israel before the war in 1967. Syria’s in less position to act against Israel directly, but Hizbullah remains a threat with thousands of missiles that it could fire at Israel.
4) Some group in Gaza decided to lob rockets into Israel and the IDF decided to respond against Hamas and others. Hamas and Gaza remains a threat, even if Syria’s Assad is still busy trying to engage in democide and rid his country of anyone who thinks of toppling him. IS continues to be a threat - regardless of what Trump says - and they’re not tied to territory, which makes it more difficult to track.
5) There’s no actual strategy here other than get some talking points and brownie points among the pro-Israel set, even though this does damage our national security. There’s nothing strategic or tactical to gain by Trump’s decision for the US natsec position.

David Corn: “Barr’s note is clear that Mueller did not uncover evidence Trump and his gang were in direct cahoots with Russia’s covert operation to interfere with the US election and boost Trump’s odds. But the hyper-focus on this sort of collusion—as if Trump instructed Russian hackers on how to penetrate the computer network of the Democratic National Committee—has always diverted attention from a basic and important element of the scandal that was proven long before Mueller drafted his final report: Trump and his lieutenants interacted with Russia while Putin was attacking the 2016 election and provided encouraging signals to the Kremlin as it sought to subvert American democracy. They aided and abetted Moscow’s attempt to cover up its assault on the United States (which aimed to help Trump win the White House). And they lied about all this.”
“And, yes, there were instances of collusion—not on the specifics of the attack, but secret scheming between Trumpworld and Russia.”
“None of the evidence underlying this is in dispute. No matter what Mueller report contains, a harsh verdict remains: Trump and his gang betrayed the United States in the greatest scandal in American history.”

WaPo, Margaret Sullivan
I reckon that reporting by The Washington Post, the New York Times, the Wall Street Journal, BuzzFeed, CNN, Bloomberg News, the Daily Beast, Mother Jones, ProPublica and others drove forward a national conversation that needed to happen. As Americans saw with their own eyes Trump’s bizarre efforts to ingratiate himself with Russian President Vladimir Putin, that reporting mattered and provided context.

the 18+(?) investigations are just beginningyes, we learned some things since Friday, and yet we don’t know very much more than we did before
take Barr’s letter with a barrel of salt.

Serious journalists should be proud of — not bullied over — their Russia reporting
WaPo, Margaret Sullivan
Americans saw with their own eyes Trump’s bizarre efforts to ingratiate himself with Russian President Vladimir Putin, that reporting mattered and provided context.
yes. and that context is
1. he/they did it
2. mueller couldnt satisfactorily prove it, yet

My two cents on the Mueller Report/Barr Summary, as an attorney:
Never trust a summary when you don’t have access to the thing it is summarizing.

charles,
in poking around the net, many people read it that way
Somewhat OT, but … holy shit. Sarah Sanders seems to have just called for the death penalty against members of the media..
I think Charles was right. Because a President as an agent would be treason. A citizen is the equivalent afaik.
So, would someone spending 3 YEARS accusing the President of the United States of being born in Kenya qualify as a “Treasonous Thing”? Asking for a friend. #TheResistance https://t.co/z8WaadZaT4

The Trump campaign is sending this memo to TV producers:
Man, the leak of Mueller’s report can’t come soon enough.
Someone’s gonna get killed because of this shit.
this one’s fun:
- Republican Cruz campaign initiates dossier.
- Republican McCain somehow gets dossier.
- Republican Graham advises Republican McCain to give dossier to FBI.
- Republican Comey begins investigation.
- Republican Trump fires Republican Comey.
- Republcian Trump says he fired Republican Comey over “Russia thing.”
- Republican AG Sessions appointed by Republican Trump recuses self from probe.
- Republican Deputy AG, appointed by Republican Trump, tasks Republican Mueller with Special Counsel investigation. How is this a “Dem plot” again?
By the way, maybe this context for Sarah Sanders’ statement about the death penalty is also relevant? pic.twitter.com/3r7WegKOJw

And I’m sure the TV producers are going to follow this to the T and give in to every whim in this shockingly despotic letter.
…and I say that with as much bitter, resigned sincerity as possible. We’ve seen how many outlets are willing to drop trou and worship this fuck.

It’s getting genuinely chaotic. Here’s live coverage of the ongoing Brexit trainwreck:
Interesting culture reference: the Twitter account name of that Tweet is a reference to the final moments of series 2 episode 5 of anarchic BBC2 sitcom “The Young Ones”. This episode was first broadcast in 1984.

So then, he’d be on board with outlawing dividend payouts?
“Although we did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information, there is evidence that they were extremely careless in their handling of very sensitive, highly classified information,” Comey said in July.
so careless while not reaching the level of criminality
if there’s a parallel in this case, i’d go for ‘reckless’ not careless

In other words, par for the course for these fucks. And again, the networks will probably go right along with it, because they want to appease their Golden God.

Legally, “reckless” is basically the same as intentional. “Reckless disregard” basically means deliberately and unjustifiably taking a course of action while consciously disregarding any risks flowing from such action. The law does not look favorably upon those who act recklessly.
So when does Trump start pardoning everyone?

1/ The @nytimes just had a v. credulous story saying restaurant workers are *against* getting higher minimum wage
The workers say they’re upset that celebs like Amy Poehler are pushing for a higher min wage
I was curious: Who *are* these workers? https://t.co/VeFauNN8jX— Eric Umansky (@ericuman) March 25, 2019
3/ The “Restaurant Workers of America” is a *dark money group* — aka a 501(c)4—meaning it doesn’t have to disclose its funding.
Also, despite the name: It’s not just workers.
How do I know all that? It’s on their website! https://t.co/JTdMKVjnM1 pic.twitter.com/mYQvLg96Nb— Eric Umansky (@ericuman) March 25, 2019
5/ Here’s a good @cjr story digging into the “Restaurant Workers of America,” including how it “regularly appears with restaurant industry trade groups and Republican politicians.” https://t.co/GtqdN4FtTv
— Eric Umansky (@ericuman) March 25, 2019
6/ It’s too bad the @nytimes didn’t include any of that context. (And too bad they don’t have a public editor)
Meanwhile, I’ve reached out to Raczynski and the group for details about their funding.
I haven’t gotten a response. I’ll post it if I get one.

So now that Trump claims he is “TOTALLY EXONERATED” even though his own AG says he is “NOT EXONERATED” will he stop calling another person, who was TOTALLY EXONERATED IN MULTIPLE INVESTIGATIONS “Crooked”?

re: #294 GlutenFreeJesus
So when does Trump start pardoning everyone?
Here’s how it’s going to play out:
1. Trump starts up the “let’s prosecute Hillary and Obama” thing with Republican Congress assholes who let him fan it up to plasma levels with Tweets, “investigations” and panels and then the Congress assholes inform him of actually prosecuting in a legal manner would mean entering the Discovery phase.
2. Trump’s army of lawyers straps on his insane asylum jacket then informs him that any legal recourse ends there as no Republican on the Hill wants any of the evidence released to the public for reasons. many many reasons.
3. Trump then Pardons his “great guys” under the toddler -esque pretense of “if Democrats can get away with crimes we can too.”
4. Trump’s cult of White Supremacist voters (35% of the country, 65% of white people, 55% of white women, and over 75% of white men) give him a pass at worst. The percentage amongst this demographic will be about evenly split between those that hold some semblance of doubt with the decision to Pardon, and those that enthusiastically support it to further the cause of White Entitlement.
5. The USA’s decline from fully-fledged Western Democracy to a Hybrid Regime “competitive authoritairan” status is complete putting us on the same world standing as Albania or El Salvador.

Charles, I think that I was probably mistaken and you were correct in your initial response to her comments. Of course, it’s not as though Sarah is a wordsmith so her intentions are unclear. But this context would support the most dire interpretation of her words.

She pulled the classic “plausible deniability” trick - deliberately worded it in a manner that could be interpreted both ways, so if anyone calls her on it as Charles did, she can claim she meant the other version all the while doing the wink-wink-nod to stochastic terrorists in waiting.

J.R.R. Tolkien, The Lord of the Rings (The Lord of the Rings, #1-3)
It will maddening, if not predictable, when Trump supporters on the various news shows toe the company line of “Totally Exonerated”, despite Barr quoting from the Muller report that he wasn’t, in any way, let off the hook.
British Airways flight mistakenly lands in Scotland instead of Germany
\
Passengers on a British Airways flight from London’s City Airport to Dusseldorf in Germany were met with a surprise Monday morning when their plane touched down — in the Scottish capital, Edinburgh.
The error was down to an incorrectly filed flight plan, leading both the pilot and cabin crew to believe the flight was bound for Edinburgh.
The flight was operated by German leasing company WDL Aviation on behalf of the British Airways subsidiary airline BA CityFlyer. The incorrect flight plan was filed at WDL Aviation’s offices in Germany.
re: #287 Man, DangerMan
Apparently you are one of the millions of people that don’t know that Comey admitted
to Elijah Cummings that not a one of those emails was designated as classified.
2 days after his announcement of no prosecution the GOP hauled his ass into a hearing
to explain himself.
Elijah Cummings
DIRECTOR, THANK YOU FOR YOUR PATIENCE. I WANT TO CLEAR UP SOME THINGS. I WANT TO MAKE SURE I UNDERSTAND EXACTLY WHAT YOU TESTIFIED TO ON THE ISSUE OF WHETHER SECRETARY CLINTON SENT OR RECEIVED E-MAILS THAT WERE MARKED AS CLASSIFIED. ON TUESDAY YOU STATED ONLY A VERY SMALL NUMBER OF THE E-MAILS CONTAINING CLASSIFIED INFORMATION OR MARKINGS, I EMPHASIZE OR MARKINGS, INDICATING PRESENCE OF CLASSIFIED INFORMATION. REPUBLICANS HAVE POUNCED ON THIS STATEMENT AS EVIDENCE THAT SECRETARY CLINTON LIED. BUT TODAY WE LEARNED SOME SIGNIFICANT NEW FACTS. I HOPE THE PRESS LISTENS TO THIS. FIRST, YOU CLARIFY THAT YOU WERE TALKING ABOUT ONLY THREE E-MAILS OUT OF 30,000. YOUR OFFICE REVIEWED. IS THAT RIGHT? THREE, YES. 3 OUT OF 30,000, IS THAT RIGHT? YES. AT LEAST 30,000. AT LEAST 30,000. SECOND, YOU CONFIRM THAT THESE THREE E-MAILS WERE NOT PROPERLY MARKED AS CLASSIFIED AT THE TIME BASED ON FEDERAL GUIDELINES AND MANUALS. THEY DID NOT HAVE A CLASSIFICATION HEADERS. THEY DID NOT LIST THE ORIGINAL CLASSIFIER, THE AGENCY, OFFICE OF ORIGIN, REASON FOR CLASSIFICATION OR DATE FOR DE-CLASSIFICATION. THESE E-MAILS INCLUDED ONLY A SINGLE QUOTE, C AND THEN END OF QUOTATION MARK FOR CONFIDENTIAL ONE PARAGRAPH LOWER DOWN IN THE TEXT, IS THAT RIGHT? CORRECT. THIRD, YOU TESTIFIED THAT BASED ON THESE FACTS IT WOULD HAVE BEEN A, QUOTE, REASONABLE INFERENCE FOR SECRETARY CLINTON TO, QUOTE, IMMEDIATELY CONCLUDE THAT THE E-MAILS WERE NOT CLASSIFIED. SO THAT WAS ALSO CRITICAL NEW INFORMATION. BUT THERE IS ONE MORE CRITICAL FACT THAT THESE E-MAILS WERE NOT — TO THE PRESS THESE E-MAILS WERE NOT CLASSIFIED. THE STATE DEPARTMENT EXPLAINED TO US YESTERDAY THEY REPORTED THAT THESE E-MAILS ARE NOT CLASSIFIED AND THAT INCLUDING THIS LITTLE C ON THESE E-MAILS WAS RESULT OF HUMAN ERROR. THE BOTTOM LINE IS THAT THOSE LITTLE Cs SHOULD NOT HAVE BEEN ON THOSE DOCUMENTS BECAUSE THEY WERE NOT, IN FACT, CLASSIFIED.
