There is no scenario in which this is plausible. There are not enough Democrats who will go along with this, and the Electoral Count Act (still in force, and GOHMERT!’s stupid lawsuit is not going to change that) ensures that only the officially certified slate of electors can be chosen in the event of a dispute in Congress. Hell, as pointed out in the House amicus brief to said lawsuit, in Arizona there isn’t even the pretense of an “alternate slate” - by casting their votes for Trump, the putative Republican electors disqualified themselves from being electors at all. Arizona has a faithless-electors law that revokes their status as electors if they fail to vote for the candidate who received the most popular votes.

Every year for the last 30, my company has sent New Year champagne out to clients. This year the wrapper design fell to me. Had to think for a bit about what message would be appropriate after the hellyear of 2020 without getting too political. Since we’re a pretty varied group of people from around the world, I based the design on a collection of toasts to good health from around the world, incorporated into a ‘champagne bubbles’ pattern. Managed to fit in about 79 different languages before running out of design time…

My wife and I would ordinarily celebrate 2020 as personally being tied with 2019 as the best years of our lives in many ways. The list of good things that happened to us and the things we got done is long. Our family, out to each kid, their kid, and their spouse also had a good year. We are financially stronger and we avoided the bad things, like getting the plague.

This is something I would ordinarily post to my 2,200 Facebook friends about on New Year’s Day but we’ve decided that there is too much bad happening to people to share our good fortune with people who really know us.

So, since y’all don’t really know me I’m probably not going to hurt your feelings by sharing it here.

I hope we are all in a better place next January 1, and I don’t mean Heaven.

I’m pretty sure the Pfizer and Moderna folks evaluated what would happen with a spoiled batch of vaccine due to incorrect handling wrt temperatures. It’s not likely the lipid capsule carrying the mRNA in the vaccine would become poisonous or toxic in any way, after all it warms up to body temperature pretty much as soon as it’s injected into the patient. The big downside is that the spoiled vaccine wouldn’t work properly as a vaccine rather than it makes everyone burst out in green spots because it was warmed up incorrectly.

DENVER (AP) — Public health restrictions for places like restaurants and gyms are set to be eased in the much of Colorado starting next week.

Gov. Jared Polis announced the change on social media late Wednesday, citing sustained improvement in the state’s COVID-19 data, including intensive care units operating below capacity. He said he is asking the state health department to move counties with level red restrictions, including Denver and the rest of the populated Front Range region, to level orange starting on Monday.

“This is a direct result of Coloradans stepping up and taking the steps to protect themselves and others,” he said, noting that the state has tried to balance dealing with the pandemic and the resulting economic crisis.

The announcement came a day after Colorado said it had confirmed the United States’ first case of a new and apparently more contagious variant of the coronavirus.

Level red, Colorado’s second-highest level of restrictions, limits public gatherings and bans indoor dining. In counties rated as orange, restaurants can have in-person dining limited to 25% capacity or 50 people and gyms can increase their capacity to 25% or 25 people. Gatherings of up to 10 people from no more than two households are also allowed.

I’m pretty sure the Pfizer and Moderna folks evaluated what would happen with a spoiled batch of vaccine due to incorrect handling wrt temperatures. It’s not likely the lipid capsule carrying the mRNA in the vaccine would become poisonous or toxic in any way, after all it warms up to body temperature pretty much as soon as it’s injected into the patient. The big downside is that the spoiled vaccine wouldn’t work properly as a vaccine rather than it makes everyone burst out in green spots because it was warmed up incorrectly.

Which is all well and good, but this is a litigious nation where people are quick to jump onto any admission of fault (direct or otherwise). Hence why the clinic is going out of its way to assure folks that the spoiled vials are not dangerous, as there’s virtually no doubt whatsoever that if one of those injected with such should develop any sort of medical malady in the coming days, they will be skimming the yellow pages for a lawyer soon after.

If you hear a Repub tell you that they don’t support Trump’s efforts, what they’re really telling you is they’re only against such because they don’t believe he can succeed. I was lucky to have a brother 8 years my elder who was a DJ at his college radio station. He brought home dairy crates full of promo albums and duplicates. He got me into Fairport Convention, Richard and Linda, Nick Drake, etc. when I was in high school.

I’m jealous. I had a sister one year older who’s boyfriend was a few years older and hung out with the local hip musicians. I’d been kind of singles oriented, but then she came home with Best of Cream, Led Zeppelin 1, and CCR’s Bayou Country. It was as game changing as the Beatles’ appearances on Ed Sullivan.

A South Dakota federal judge harshly criticized Gov. Kristi Noem and the state court system’s response to the COVID-19 pandemic in an order that also strongly condemned a state judge and prosecutor for violating a defendant’s Sixth Amendment right to a speedy trial.

South Dakota can’t “‘take advantage’ of its own failures to follow scientific facts and safeguards in entering blanket denials of the rights of speedy trials,” Judge Charles Kornmann wrote in a Dec 28 document.

Kornmann sided with Matthew Kurtenbach, a defendant who represented himself, over arguments written by lawyers for Brad Howell, the Codington County sheriff that’s detaining Kurtenbach pre-trial.

“South Dakota has done little, if anything, to curtail the spread of the virus” Kornmann wrote in his opinion and order.

Federal judge slams Noem, state court’s response to pandemic in speedy trial order (Rapid City, SD Journal)

TL;DR, he was arrested for a bad cheque and for allegedly violating a no-contact order with his ex-girlfriend, claming he attacked her (from that second allegation, they tacked on 120 other charges).

The man has sat in jail for over a year. South Dakota has a law which says a case must be heard within 180 days.

After multiple dozens of complaints to the state courts, he has taken his case to federal court, alleging violation of his VI Amendment rights to a speedy trial.

The ex-girlfriend sent an affidavit to the federal judge saying the assault never happened, therefore the man is arguing that charge and the 120 charges stemming from it should be dropped.

The governor’s office says the judge is politicising the case, and after all he would since he’s a Bill Clinton appointee and used to work for the SD Democratic Party.

Some good news:

We had to sit down with the Kid and help him pick out new insurance, since the temp agency he’s working for/through offers total crap passing for health/dental insurance. Dental is important for him, because even though he rarely has a cavity, he has a 5K bridge in his mouth from an accident where his two front teeth were broken off at school (which makes me think it wasn’t an”accident” but I digress). So we found a plan with a higher than normal deductible-the bridge is about 14 yrs old, that will cover 80 percent of the cost if he’s in network, etc. It’s a lot more expensive, but still under 50 bucks a month. Last night he told me that they wanted 104 bucks from him for February’s premium. I told him we’d get after it today and see what’s what. He did it himself without any help, chatted with someone live on line and they fixed it for him. This may not seem like much, but for a young man who struggles with executive functioning, it’s a BFD. He said his goal for the year is to be more financially responsible and pay off his car. He also hugged me and thanked me for trying to teach him all this stuff. I cried a little. It’s been such a long road to here, OMG.

Bad news:
My inlaws just did something incredibly stupid.
They live in the Ft Lauderdale area and have been really good about quarantine and taking precautions. One of their beloved doggos died earlier this year and they decided to get a new puppy, who is freaking so cute it hurts. However what’s not so cool is that they took the new pup up to central FL whew FIL’s sister lives. The same sister whose younger daughter, husband and two kids, age almost 1 and 7 are all in isolation because they ALL have covid. As of now, they are all ok, just a bit fevery and tired, but none of the other symptoms. BUT, FIL’s sister and husband are serious right wing loons, and how does anyone know if they’ve been masking up and all that? Because we don’t know. And they want The Husband to come down and visit next month. NO. Husband told them not til they’ve isolated for 21 days. He visited them over the summer, but everyone was doing all the right stuff and Husband only stopped for gas, I packed food for him to take and he had multiple masks, hand sanitizer, etc with him for the trip down and back. My mother in law is diabetic, has minor heart issues and is suffering from serious memory problems, all of these things make her susceptible to Covid. Why in the hell would they do this crap? The family was rocked by the death of Husband’s only brother almost a year ago, he had been sick with COPD and the effects of being an opiate addict for at least 10 yrs (suboxone is only supposed to be a temporary thing, he was on it for at least 7 yrs). He also refused to quit smoking and set himself on fire three fucking times for smoking with live oxygen on his face. He was not a good person, but you’d think losing a family member would kinda ring some bells. Damn it. Yours truly won’t be visiting Florida any time soon. If husband goes, I’m not sure how to deal, but he won’t be sleeping with me and Cleo that’s for starters. Sigh. I cannot anymore.

My involvement with conservative politics dates back to 1964, when I was a teenage volunteer for the Goldwater campaign. A few years later, my yellow-dog Democrat parents took me along when my mom was a delegate to the 1968 Democratic convention. They hoped I would witness the process in all its populist glory and be converted from my wayward Republican ways. What I witnessed instead was the Chicago convention riots and the establishment muscling Hubert Humphrey into the nomination. This confirmed to me that I had been on the right track. My parents were deeply disillusioned themselves.

A lot of water flowed under the bridge in the meantime, but I stayed with the conservative cause until fairly recently. In retrospect, I had been growing uncomfortable with what passed for conservatism for many years. I opposed the Clinton impeachment, for example, regarding it as a facetious witch-hunt.

With the benefit of hindsight, it seems that the rot really started in 1980, when the Reagan campaign made a conscious effort to recruit the nascent religious right as a GOP voting bloc. This involved the kind of compromise that everyone condemns but that all politicians practice. As with so many things that turn out badly, it seemed like a good idea at the time. It would scarcely have seemed possible that a bunch of Bible beating nuts could actually take over the party of Teddy Roosevelt, Nelson Rockefeller, and Barry Goldwater. They could help at the polls, though, and with grassroots activism (a traditional weakness of the GOP) so compromise we did.

Our creation has devoured us now, and Republican conservatism as I knew it has not so much changed as ceased to exist. This process has accelerated with astonishing speed since the 2008 election, with the nuts now fully in charge and the adults either marginalized or driven completely out of the party.

I persisted as long as I did because I thought the nuts would fall flat on their faces and the rest of us could re-build the movement along rational lines. That is impossible now, we are past the point of no return.

The other day, when Robert Gibbs denounced the “professional left,” I suggested that Obama might be trying to construct and define a new right wing to replace the one that has gone over the cliff. I wasn’t joking at all.
Obama is pretty much center-right by global standards anyway. Perhaps we are just catching up with the rest of the world in defining the terms. The self-declared conservatives who attack him are off the scale entirely, a xenophobic mob of quacks and charlatans who have no awareness of, or concern about, what goes on in the rest of the world. (emphasis added)

WIfe Unit is mad at me. The Beef Wellington Experience is in full swing. The puff pastry is giving me fits: the Butter Block is has me freaked out but now it’s in the dough. But my dough is too sticky. First roll, I have an air bubble. It happens. I go to grab a knife, there’s a stack of shit on my preferred knife, I get a little angry grabby and cut myself. There is blood. While I’m at the sink letting it bleed under cold water she’s standing there staring at me. I tell her ‘Baby, I need you to put the puff back in the fridge.’

She holds The Stare.

Luckily I was able to reach over and get the parchment paper over the puff dough so she didn’t see the little blood spot on it.

We were going to steal a menu just because it was so weird, but we had already had a different restaurant call the cops on us for stealing a napkin holder. It was in my bar-band days (mid-70’s) and the cop made us take our equipment out of the truck to search for the fucking napkin holder, which we had actually placed on another table in the restaurant so we could have room for all of our food.
