This was from March of this year, but it has an interesting take what the next step will be for Governor Cuomo.

Although sitting presidents are immune from criminal prosecution, the same is not true for sitting state governors. Certainly, if any of the allegations against Cuomo result in criminal charges, that prosecution would likely take precedence over an impeachment in order to preserve Cuomo’s due process rights.

This prosecution-versus-impeachment joust is exactly what’s going on with South Dakota’s Republican Attorney General Jason Ravnsborg. Ravnsborg is charged with multiple misdemeanors for his role in the death of Joseph Boever. Ravnsborg had been driving on U.S. Highway 14 in Sept. 2020 when he hit and killed 55-year-old Boever; Ravnsborg told police he believed he had run into a deer until returning the next day and finding Boever’s body in a roadside ditch.

So he can probably stick around long enough to run for reelection, and it gets Speaker Heastie off the hook for punishment until after he is convicted.

Probably not.

Class actions have fairly specific requirements to certify the class, and saying “the American people” or even the people of a specific state is probably too broad.

Beyond that, articulating a cause of action against an elected (or even appointed) official when they are executing the duties of their office is near impossible. The courts aren’t (typically) the place to argue over policy.

Meanwhile, in the They’re Really Going to Fuck This Up File… latest polling in the Newsom recall (all standard disclaimers: snap shot in time; one poll is not a trend; the campaign really hasn’t started; etc etc etc), is not looking terribly great.

The latest Emerson College/Nexstar poll of the California gubernatorial recall election finds voters remain split, with 46% in favor and 48% against the recall of Gov. Newsom. Six percent (6%) of likely voters are still undecided. Since earlier in July, when the recall was at 43% in favor and 48% against, the number of undecided voters has fallen 3%, while 3% more have reported that they are in favor of the recall.

That’s dangerously close in what could be a low turn out election.

And on the replacement question, Larry Elder is leading with 23% of the vote, 14% saying someone other than the candidates listed, and 40% undecided. We might actually end up with Governor Elder because no prominent Democrat was smart enough to get on the ballot as a safe guard.

Why wouldn’t they get away with it?

There’s a giant system that guarantees that most people with power get away with abusing it. The specific misdeeds of the Cheneys are identical to abuses of power by other powerful people. The Cheneys have always been hooked into that via wealth; that’s been their primary power, and as political figures they made maximal use of America’s ability to evade consequences by virtue of being a superpower. Attributing their evasion of consequences to some native ability that the rest of us lack is just self flagellation.

And I say that because…chances are very good that most of the people currently destroying this country will experience zero consequences unless radical effort is made to create consequences. And it’s not going to happen because they’re doing something right, it’s going to happen because there’s always been a safety net for this kind of monster.

I’m choosing my language precisely because I refuse to accept the premise that power reflects intelligence, and thus successful abuse of power is some kind of meaningful skillset that the rest of us lack. I do this precisely because the shitheads with power want everyone else to accept that their parasite-like entrenchment is some kind of hierarchical trait, a thing they have more of and thus win and we have less of and thus lose.

They have two tricks: they do what is unconscionable, even by the standards of the culture they claim to uphold, and they feel no shame.

I saw a go fund me page for them was set up last night I guess. It hasn’t even reached a quarter of the amount asked for (10K I think was the goal). I guess his wife changed her mind about vaccines, but again, someone had to die in her face before it sunk in.

I have been doing some research for my own mental health into being raised by emotionally distant parents. It fucks a kid’s sense of connection and empathy up to a huge degree. The only thing that saved me on the empathy side of things was my paternal grandmother, Edith. She was a great mentor, I even have her o video telling the world I was her favorite grandchild. Without her, I don’t know what would have happened to me. What did happen was awful enough and I miss her as much as the day she died 25 yrs ago. I still don’t feel like I truly belong anywhere. I’ve never had a best friend(I had people I thought were, but the feeling was never mutual) except a few doggos in my life. Hubby and I are friends, but even after 28 yrs of marriage(as of two days ago) that connection is based mostly on parenting our son. Sigh, it’s just hard to sort it all out after a lifetime of wondering wtaf.

I sometimes wonder if that early emotional distancing has run rampant in our society and we’re seeing the end result of that now.

There’s no official recommendation by the British medical health services on whether it’s generally safe for G-B sufferers to get a COVID-19 vaccine, in part because it’s a rare enough affliction that there’s no track record of people getting vaccinated and being OK or not afterwards. Basically he’s playing it safe (for him) and, I hope, talking to the medical people who have been keeping him alive for the past few years rather than taking the advice of rando commentators on the interweb-thingies.

His bandmate having a Ph. D. in molecular biology does not make him a virologist or epidemiologist and definitely not a qualified medical professional. But it’s a good story.

Got called in for jury duty this morning. Really was hoping for four days off work to recharge my batteries…while I was waiting in line to check in, I saw the defendant and his lawyer come in. Suit was obviously not his own…looked a bit like Tom Hanks in Big. Lawyer was twice his size…real Better Call Saul vibe…gunmetal blue suit, white shirt, whiter tie.

They found enough jurors before they got to me…so I miss out on three days of entertainment.

windows 7 to linux mint is moving along.

hit a snag the last few days - wont recognize my scanner

learned some of the file system, the file manager and a good substitute for windows file libraries.

my hand eye coordination has always sucked
i hate mice - have to be so accurate and to move all over the place on the screen
i use a left handed trackball so that helps. configuring that was easy.

because i hate mice i do *a lot* of windows button, then type a command, or windows button then type a file location…

i got a lot of that to work today.

i investigated linux 12 years ago. a lot has changed. there are good interfaces and a lot of front ends and apps that make it look very familiar to a windows user.

having a long history in software development and support, and computers in general sure, a lot is intuitive. still, after all this time, there are a few things that are much harder than they should be for someone not familiar.

in any event in a little more than a week there is a lot to recommend and i think i see where things are going. i wont have to compromise too much mostly because my needs are way less than they used to be.

My wife runs a home for developmentally disabled adults. The staff and residents have all been vaccinated. Two days ago, one of her staff called out after learning that his close friend has Covid, so he’s isolating and testing. Problem is, he had contact with a bunch of other people, including all the residents and, in personal importance to me, my wife. Yesterday she developed a sore throat, fever, and naseua. Of course, this was after I went to work and interacted with a bunch of people. This being rural Arizona, she can’t get a test until tomorrow, and there won’t be any official contact tracing. Our county is at less than 50% vaccinated, for all the reasons you might expect. I’m furious at all these dickholes who refuse to vaccinate, and decline to wear masks. This is why we can’t have nice things.

A new paper published today in Cell describes the results of doing DNA sequencing of over a 100 people from various groups in southwest Asia. It’s interesting and perhaps late at night I’ll write one of my long missives on it.

But more succinctly - be careful of popular writers and press releases when it comes to real science. The authors of easy-to-read stories and the authors of press releases tend to make claims and statements that are not in the actual research paper.

This is a long running problem, and again I lament that we just do not educate our youth well enough. By “educate” I do not mean indoctrinate (much), but to train in the ability to reason and communicate.

I am here assuming we don’t have to worry about actual malice and deceit.

My employer has been giving us all extra paid time for Covid quarantine if needed, which is nice, but I’m hoping my wife and I don’t have it. I can mostly do my job from home, but it’s a hassle.

We all got a small stipend last year as kind of a blanket acknowledgement of the extra costs of maintaining a home office during the pandemic. When I think about it, they’ve done a good job on covid, it’s some of the restructuring behind the scenes while we’re all away that is concerning.

The small city I work for is a great employer. The county I worked for before that, not so much. I’m glad I left there a few months before covid. Everyone in my old office got it before vaccines were available. One spent time in the ICU.
