LGF reader Keith G. has been working on an updated version of the list of LGF questions about health care reform originally proposed in this thread. He’s added a section for each question for any answers that become available.

This is a great resource; thanks to everyone for submitting your questions. Have a look and post any further criticisms or questions in this thread.

Great job Keith.
BTW - even the ones that are answered still lead to more questions.
For example question 2.3 regarding paying for illegal aliens. Even though the answer is no, I doubt this highly. First of all, most of our agencies are prohibited from asking about ones legal residence status. And I don’t see that changing anytime soon. Bottom line is I think they will be paid for, which, with all the other costs will be a back breaker since we will in effect have the potential of paying for the entire world - as long as it can get here.

1) I agree that answers can lead to more questions. That is (one) point of this document.
2) I’d love a reference to anyone that has numbers on the cost of health care for illegals. As I understand it — they are a small issue.

Answer 2.3: H.R. 3200: Sec 246 — NO FEDERAL PAYMENT FOR UNDOCUMENTED ALIENS (Nothing in this subtitle shall allow Federal payments for affordability credits on behalf of individuals who are not lawfully present in the United States.)

Status 2.3: ANSWERED

EMTALA (Emergency Medical Treatment and Active Labor Act) is the current law that requires ERs to accept all patients, and how many get medical care including illegal aliens.

Although “individuals who are not lawfully present in the United States” are not covered in health care, there is “coverage” under EMTALA. I think the follow up is how the current bill and EMTALA interact.

Simple compassion and public health say that “undocumented” people will receive treatment, and the American people will pay for it.

I don’t have a problem with charity and public health, but I do have a problem with being forced to provide the money that provides the charity.

Here it goes.

EMTALA already mandates coverage for anyone who shows up at an ER seeking medical care. The 46 million uninsured figures include illegal aliens. Even though the HR3200 has no provisions for coverage of these individuals, they will still be receiving treatments. How will these costs be covered and accounted for?

I think the list of questions is great, but it is a distraction from the real point. This bill should be opposed simply because its purpose is to establish a massive bureaucracy with the legal authority to regulate all aspects of health insurance and health-care spending. It simply creates more federal regulations where less are needed.

Fundamentally, even if you DO think that people have a right to health care then the proper place to address this is at the state and local levels. That’s what our founding fathers intended - limited federal government with the majority of powers reserved for the states.

We should look at states like Massachusetts, Maine and Hawaii as examples. each of these states proposed plans that would ‘cut costs’ and make health care ‘more affordable’, but in every case they went way over budget, did it must faster than predicted and failed to make any significant improvements.

The only way it works at the Federal level is because they have the power to take an unlimited amount from each of us to make us feel like we are getting more than we are paying for.

Well, with the public option gasping its last, that’s basically what it’s turning into.

This is far from over. HB 3200 is only one of the many bills or possible bills. There are 4 in the Senate which we don’t have access to yet. And they will hack these over and over until they send all the house and senate proposals to committee.

So, we need to keep pushing, keep reading, keep trying to understand, but not give up until we see and can debate the actual final bill that will be voted on (if that happens).

I’m not at all advocating cutting people off, I just want to know how the costs will be covered and how much it costs up front. It’s a bit disingenuous for HR3200 to say they won’t be covered when they are covered.

Personally I think foreign aid payments should be cut to cover citizens from other countries here illegally.

When I was suffering from unmedicated clinical depression, I had lots of ideas, but didn’t get any writing done because I was so damn depressed all trhe time.

Now I take my daily dose of Paxil, and I can actually sit down and work for a couple hours without bursting into tears and wandering off to take a nap.

Of course, the geniuses who drowned themselves in the Seine because Paxil wasn’t available to them never get mentioned. Because they didn’t actually create anything.

Here is another question: If you believe strongly that private / public competition benefits all, then why are you opposed to school choice initiatives such as vouchers? If you oppose them on religious grounds (eg - it would have public money paying for education and church owned schools) then will you oppose reimbursements for medical services performed in church owned hospitals and teaching hospitals?

I’m glad it’s working for you. I’d be divorced and unemployed if it weren’t for Wellbutrin. (Paxil made me fat.)

That is an interesting idea.

I could see a market based reform effort where vouchers could go to those identified as “in need” as a form of public assistance. Redeemable only for medical services. Able to be deposited as cash by licensed practitioners.

Many doctors extend significant cash discounts because insurance companies can take forever to pay and often come back and quibble about procedures. I used to have an MSA (medical savings account) and would ask for and get cash discounts all of the time. Still do on non-covered services like braces for the kids.

I’d support it if some degree of fraud protection were in place. If the practitioner is board certified and licensed I don’t care if s/he works for St. John’s Hospital or Greedy Bastard Hospital.

What about a separate thread to discuss alternative solutions to health care - i.e anything other than a government takeover of the system. I can start with a few:

1.) Tort reform
2.) More consumer choices - let me choose what coverage I want, what deductible I want for my family and what I want covered. If I don’t need / want counseling services or coverage for hair plugs then let me make that decision.
3.) Portability - equalize the tax treatment between private and employer plans and move towards a model where employers can choose to contribute to coverage the employee purchased, rather than being the provider of the insurance.

Other ideas???

Reduction of mandates for elective procedures.

Control abuse of no pre-existing condition clauses. Those who buy insurance when they get sick under a pre-existing condition clause then drop the insurance when they no longer need it, in WA that part alone did more to kill the individual insurance market.

It is interesting that they can’t seem to abide critical views, or any contrary views for that matter. When I lived in Saudi Arabia, the mere mention of any other religion would cause trouble and any attempt to advance it could have fatal consequences. Talk about not having a sense of humor.
But it also told me at least, that their faith must be weak if it can’t stand even the mention of any other. I spent 5 years there, away from my own religion but my faith was never shaken or changed.

I think it’s very likely. Or it could mutate, rendering the vaccine useless. I got the H1N1 email from my daughter’s school as well. I’ll make sure she’s carrying hand sanitizer, but there’s not much else you can do.

What I’m a little more worried about is the big sci-fi convention we’re attending on Labor Day weekend. Mr. Doppel is the director of media relations - he’s responsible for clearing applicants for press badges. One of our staff members pointed out that those members of the press are likely to ask if we have a plan to prevent or minimize the spread of H1N1 among the roughly 35,000 attendees. I’m not prone to panic, but I may make a face mask part of my costume.

BTW - even the ones that are answered still lead to more questions.
For example question 2.3 regarding paying for illegal aliens. Even though the answer is no, I doubt this highly. First of all, most of our agencies are prohibited from asking about ones legal residence status. And I don’t see that changing anytime soon. Bottom line is I think they will be paid for, which, with all the other costs will be a back breaker since we will in effect have the potential of paying for the entire world - as long as it can get here.

I think 2.3 remains unanswered. The bill says no subsidy will go to an illegal alien, but there is no provision for determining an applicant’s status before a subsidy is granted. Democrats have specifically rejected that kind of provision.

Also, when the bill says illegal aliens are not eligible for affordability credits, that’s only assistance paying for insurance. The system still has to pay for their care, which (as it is now) is absorbed by the taxpayer.

I have an alternate solution to the Trillion Dollar Health Care Debacle.

Give those who have no health care a voucher to be used with the doctor of their choice. Couple that with a tax credit and problem solved. For a lot less than a trillion dollars.

Next enact tort reform. Quit giving millions of dollars to people just because the doctor (while trying to save your life) did not do his job perfectly. You get free medical care for the rest of your life. Period. No lottery for you.

Provide low cost loans and grants for American kids to go to school to become doctors - real ones not plastic surgeons.

Improve the incentives for quality affordable health care. Competition is a good thing.

Now health care for everyone becomes more affordable.

I think 2.3 remains unanswered. The bill says no subsidy will go to an illegal alien, but there is no provision for determining an applicant’s status before a subsidy is granted. Democrats have specifically rejected that kind of provision.

I think it’s very likely. Or it could mutate, rendering the vaccine useless. I got the H1N1 email from my daughter’s school as well. I’ll make sure she’s carrying hand sanitizer, but there’s not much else you can do.

What I’m a little more worried about is the big sci-fi convention we’re attending on Labor Day weekend. Mr. Doppel is the director of media relations - he’s responsible for clearing applicants for press badges. One of our staff members pointed out that those members of the press are likely to ask if we have a plan to prevent or minimize the spread of H1N1 among the roughly 35,000 attendees. I’m not prone to panic, but I may make a face mask part of my costume.

I’m not sure anti-bacterial hand sanitizers kill the flu virus. I just know I’ll be keeping my hands so washed, people are going to think I have some sort of obsessive-compulsive disorder.

I probably have reason to be a bit more nervous than most, because I have a glitchy immune system. Monthly gamma-globulin keeps me going, but I’m subject to complications just from catching a simple cold. If I get panicky here on the threads, ya’ll will have to hit me upside the head and tell me to get ahold of myself!

Speaking of the Ron Paul - Glenn Beck - Alex Jones axis, I just went over to Alex Jones’ site. I was curious to see what he had to say about the new Swine Flu announcement, but I then was distracted by his story about the Lockerbie issue.

Here’s Jones story: All of the evidence against Al-Megrahi was fake. Actually, Pan Am Flight 103 was actually brought down by the CIA, and the Mossad helped them cover it up. You see, a CIA unit led by Oliver North had been flying heroin into the USA from Lebanon, on Pan Am flights. Then another team of CIA agents discovered this, and thought it was bad, so they decided to fly back to CIA headquarters and tell everyone. But the CIA didn’t want the word to get out and blow the cover on the heroin operation that they had with the Mossad. So they blew up the plane that the team was traveling on, which was Pan Am Flight 103, over Lockerbie. And therefore, the CIA was able to continue its international heroin smuggling ring, and it used the profits to commit the 9/11 attacks.

Dr Eckert told Scottish police that distinctive marks on Captain MacQuarrie’s thumb suggested he had been hanging onto the yoke of the plane as it descended, and may have been alive when the plane crashed.

The explosion blew the entire freaking nose off of a 747… it snapped around, collided with engine #3 as it fell 31,000 feet. A two minute free fall. And the whole way down, the Captain has his hands on the controls, he knows his plane is shattered and he’s probably going to die, but he’s trying everything he can think of, hoping that he can get some control back and maybe save some lives.

How to make a lefty’s head explode:

The Democrats now claim health care is a right, therefore taxpayers must pay for all citizens’ healthcare. No such explicit right is granted in the Constitution or the amendments. However, the second admendment grants the right to bear arms. Ask your lefty friends if a tax payer purchased gun should be provided to every American who can’t afford to purchase one. After all, don’t we all have the right to be safe, control our own safety (like bodies in the abortion debate) regardless of the ability to pay.

BTW - I’m not a gun owner or fan, but respect the right of American’s to own firearms.

Also note to Democrats - if you are unable to pass the healthcareless bill, it will be because your own people aren’t on board, you own the government. Stop claiming the Republicans are blocking this legislation. Put on your big-boy (girl) pants and deal with the fact you don’t have enough Democrat votes because your plan sucks (whatever the plan is) and Americans hate it and are sick of seeing you spend trillions with no idea where the money is going.

In section One of the questions - should we dare ask about what the reconciliation process will be? This is probably far more important than the texts of either the House or Senate bills, they can potentially take the worst of both worlds and throw out the unwanted GOP insertions during that process.

I cannot honestly tell whether watching Beck’s meltdown lets us know the enemy, or simply makes one dumber? He used to occasionally make sense - at least as an antidote to Amy Goodman and the drum-beat of ‘Bush is Evil”, but now its like there is no escape, I can either listen to lunatic fringe NPR programming, or lunatic fringe Clear Channel (KVOR here in Colorado Springs).

I’ve taken to only listening to CDs now…

The first green “answer”, question 2.3 links to a section in the bill that outlaws funding for illegal aliens.

Apparently there is a loophole: it won’t be enforced. The GOP tried to close the loophole, but the DEMs refused.

I have been looking into that myself. True that there is no enfourcement or penalty provision. There will be tons of paperwork that the healthcare provider will be required to supply for payment & reimbursement including proof of services rendered, and proof of citizenship/qualification of the patient.

What would likely end up happening is that the hospital or Doctor would end up eating the cost by not getting reimbursed. So I am not convinced that this is something to be worried about. What worries me is that it will be harder for healthcare providers to get paid at all! Burden of proof is on them. Now there is an area to be concerned about.

In regards to illegal aliens, Page 143, section 246, lines 3 through 7 specifically state that there will be no Federal Payments for affordability credits for individuals who are not lawfully present in the U.S. A lot of things can happen here. States can pick up the tabs, individual status can easily be changed from unlawful to “pending” or some other new invented status in order to cover illegal aliens. But that is speculation at best.

The non-dsicrimination provisions in the bill could possibily superceded section 246. I am currently working through that to see if there really is a loophole.

I read to the first answered question, 2.3. I thought the questions were good ones by the way. I got to 2.3 and read the answer, and realized that the intent was to answer these questions uncritically. Now that is a pretty serious charge, but consider what we know: The legislation does not use language routinely included in entitlement legislation to exclude illegals or those unqualified for the benefit from using it. We also know that multiple attempts to include language of this type were defeated.

Now I’m no conspiracy theorist, but if someone at the table says “hey, we should include this boiler-plate exclusionary language to ensure that illegals and ineligibles aren’t covered”, I would assume the response would be “sure”. If the suggestion were slanted and partisan in its form, the natural reaction would be to disagree but then include the standard version. We know how governments deal with power folks. Even if everyone in the legislation has no intention of seeing abuse and misuse occur, it will occur, and to the absolute extent that any bill enables it. We know this. To assume that, because the language is innocent on its face, that horses will not exit the barn door it leaves open is to be intentionally obtuse.

Of course, this is all before congress’s own reality detectives drew up their report and called BS on the no-illegal-coverage meme. Now it’s a transparent figleaf. If you go back and change that answer and consider the possibility that factcheck.org is no substitute for critical analysis in the future, your list will be better. But you already knew that, and chose to ignore it, which tells me all I need to know about the list. Good luck.

How many distinct Boards (review boards, review panels, policy groups, etc.) are created by the Act, and how are they co-ordinated so as to avoid duplication, conflict, etc.?
