Wingnut creationist governor Rick Perry is having a bad day. A very bad day: Texas Governor Rick Perry Indicted by Grand Jury.

AUSTIN (KXAN) - A grand jury has handed up an indictment against Gov. Rick Perry in connection with the investigation into an effort to force Travis County District Attorney Rosemary Lehmberg to resign.

At the center of the issue is a complaint about intimidation stemming from Perry’s threat to veto of $7.5 million in state funding to the Public Integrity Unit run by Lehmberg’s office. The threat came after she pleaded guilty to drunk driving and served a 45-day sentence; Perry called on her to step down but she refused to resign her position. Perry then vetoed the funding for the PIU.

A grand jury was called to determine whether or not Perry broke the law when he threatened to veto the funding. As a result they issued indictments on two felony charges: abuse of official capacity and coercion of public servant. If found guilty on the charges, Perry could be sentenced to a maximum 109 years in prison.

Think it depends on how seriously he takes the possibility of jail time. He seemed to think it pretty serious, as he tried to avoid being seen entering the court house, only to find out the only way through was the door to the office of the very DA he tried to run out of office. So he’ll try to cut a backroom deal that he can quickly bury before next fall.

“The veto in question was made in accordance with the veto authority afforded to every governor under the Texas Constitution. We will continue to aggressively defend the governor’s lawful and constitutional action, and believe we will ultimately prevail.

I have mixed feelings about this indictment (which fits all of two pages). The governor of Texas has a tremendous amount of power and discretion, including line item veto of legislation (it’s a state with a weak legislature). He’s arguably within his rights to deny this agency funding over what he views corruption/malfeasance by an official in the agency.

The stronger of the two counts is coersion of a public official to force them to bend to his will (in other words force a resignation) by withholding the funding for the agency.

As a strong governor state, Texas puts a whole lot of power in the office. There isn’t a whole lot of recourse to decisions made. This case would break new ground in that respect, and if he’s prosecuted and convicted, it would set precedent on the limits of the position.

I’m not sure people would be comfortable with that outcome, since it would open up pretty much any governor in Texas to similar charges on decisions that deny funding. You can argue that this is a one-off case, because of the spat between him and the DA, but the repercussions will be felt for a long time (and not just in TX - other states and other prosecutors will be looking at decisions made that are political but questionable, and prosecute on that basis).

The Travis County Commissioners Court agreed on Tuesday to restore some money to the Travis County district attorney’s Public Integrity Unit after Gov. Rick Perry in June eliminated state funding for the office. The five-member commissioners court voted 4-1 on the proposal, which will cost Travis County taxpayers about $1.8 million next year.

The funding fight was the latest in a series of struggles for embattled Travis County District Attorney Rosemary Lehmberg, who was arrested for and convicted of drunken driving in April. Despite pressure from lawmakers and Perry, Lehmberg refused to resign. Perry cut funding for the integrity unit — which investigates public corruption, insurance fraud and motor fuels tax fraud — for the next two years, arguing in his veto explanation that “the person charged with ultimate responsibility of that unit has lost the public’s confidence.”

After the hearing, Lehmberg declined to answer questions about the personal fallout from her April conviction, but said she was working “steadfastly” to regain voters’ confidence.

“It is not Rick Perry’s job to fire me or to relieve me,” Lehmberg said. “He did not elect me, Travis County voters elected me, and I answer to them.”

But the thing is the judicial process played out, she served her time and won a civil lawsuit seeking to remover her from office. My guess though is that Perry only sought to remove her because she’s a lesbian and ran as a democrat. Because otherwise alcoholism and DUI convictions aren’t that big a deal in Texas politics. Texas didn’t even have an open container law until 2001, and only acquiesced to avoid losing federal highway funds.

A Travis County grand jury has indicted Jerry Cobbs, a former high-ranking official with the Cancer Prevention and Research Institute of Texas, on charges that he unlawfully secured the execution of an $11 million grant for Peloton Therapeutics, a Dallas-based biotechnology firm.

The Travis County Public Integrity Unit opened an investigation into former CPRIT officials shortly after the CPRIT Oversight Committee disclosed in November 2012 that the institute had awarded that grant without proper scientific review.

In December, a former CPRIT director was indicted for steering an $11 million award past normal vetting procedures. The funding went to Peloton Therapeutics, whose big investor also was a large donor to Perry.

If Perry is asked about this while he’s on his early campaign for POTUS, I won’t be surprised if he blames his indictment on the president or democrats and accuses us of trying to derail his presidential campaign. True, but I think the complaint here is not that he used the veto, it is that he said “If you don’t resign I will veto your departments funding” and then he did it. He implicated himself in coercion by publicly making the threat previous to his subsequent action.

Not that I think that this will go anywhere, but technically it does seem to fit the statutory requirement for the charge.

I want the position of Crafts and Recreation Czar in the Gulag. I’ll have them making broochs with sea-shells and little macaroni letters…. trivets from popsicle sticks, tiles and plaster, and of course, the ever popular boondoggling.

For the ones that earn it… maybe some metal rubbing art and possibly even soap carving.

I’ll make them suffer…

OT: I bought the couch of my dreams today…

I’ve been looking for more than a month, I wanted an odd size and I haven’t liked any of what I’ve seen at various stores. But on my way to dinner, had a few minutes to spare and noticed a charming window display at Pottery Barn, stopped in and… there it was. The perfect color, the perfect fabric, the perfect firmness, the perfect shaped arms… an enormous sectional that 2/3 is the perfect size for the spot I want it in, the other 1/3 is the perfect housewarming gift for my cousin’s kid who just got his first apartment. And miracle of miracles, it was a floor sample. Marked down by 75% from original retail price (which price was already within the range I was willing to pay). When I finish my happy dance, I can start looking for the perfect rug to go with it.
