This is a lie. The Court in Boston issued a TRO, then refused to extend it. This isn’t in conflict with Judge Robarts’ decision to issue his own TRO.
Segal responded, “If your honor’s question is, ‘Does the word ‘Muslim’ make a profound presence in this executive order?,’ my answer is that it doesn’t. But the president described what he was going to do as a Muslim ban and then he proceeded to carry it out.”
“Am I to take the words of an executive at any point before or after election as a part of that executive order?”
This is where the Court in Boston clearly erred. Yes, you are definitely supposed to look at clear, contemporaneous statements of motivation by the executive about the design and intent behind an EO. The EO itself carves out exemptions for minority religions, that is itself prima facie evidence of an intent to discriminate against the majority religion (Islam) of the targeted countries. Giuliani’s statements also betray that bigoted and illegal intent.

(Cat saw me getting ready and went to hide under the desk — afraid I was going to take her to the vet a second time on the same day, I expect. Dumb animal.) The crowd was pretty good. I left after about an hour and a half (oh, for the stamina of my youth…), along with some other olds, but the second shift was still arriving, even more than an hour into the rally.
(It was alleged that there would be some Calexit people there with a petition to sign, but I didn’t see any. And none of the signs I saw even implied that they’d be interested.)
Terrible ratings. Sad! If I were the producer, the ratings would be tremendous!

On one level I feel like I failed to do enough to wake people up to what was happening. But on another level I know I did try my best. I know it sounds naive and silly to say, but I absolutely take the point of the person who posted the other day “Why is Trump so angry?”. I can’t recall who wrote the post - I’m thinking of a short article by a guy who observed that Trump has a lot to be happy about, and the author was baffled by how angry Trump seems to be, despite having lived a long, wealthy life.
