Ajit Pai’s ex-broadband advisor arrested on charge of forging fiber contracts
The former head of FCC Chairman Ajit Pai’s Broadband Deployment Advisory Committee (BDAC) has been arrested on a charge of wire fraud for allegedly tricking investors into pouring money into a fiber-optic network.
Elizabeth Pierce is accused of “forg[ing] guaranteed revenue contracts to fraudulently induce investors to invest more than $250 million in a fiber optic cable network in Alaska,” according to a press release issued last week by the US Attorney for the Southern District of New York.
Pierce was the first chair of the Federal Communications Commission’s 29-member broadband committee, which has seen defections from municipal officials who say it has prioritized the interests of private Internet providers over those of cities and towns.

So far as I know, that is the first passenger fatality SW has ever had. One car passenger was killed in the Midway over-run several years ago.
Also, I grabbed the flight log. The engine shelled twenty minutes after takeoff at an altitude of 32,500’ for 38,000’, so it *was* still in climb phase.

I think someone mentioned Debbie in regards to the Cohen-Hannity connection, but I like this from the Atlantic because it brings all the names together:
On May 25, 2017, KFAQ, a radio station based in Tulsa, Oklahoma, received a cease-and-desist letter signed by two lawyers for Hannity: Victoria Toensing and Jay Alan Sekulow. Toensing’s signature sits above her name and that of her husband Joseph E. diGenova, the members of diGenova and Toensing LLP, who are identified as “Counsel for Sean Hannity,” according to a copy of the letter obtained by The Atlantic. Sekulow is also identified in the letter page as a “Counsel for Sean Hannity.”
The letter was sent in response to accusations against Hannity made by the controversial conservative activist Debbie Schlussel. During an appearance on the Pat Campbell show on KFAQ last April, Schlussel said Hannity had been “creepy” towards her and had invited her to his hotel room.Hannity responded at the time by calling the allegations “100 percent false and a complete fabrication,” and said that he had hired lawyers to plan a response. “This letter provides notice that Ms. Schlussel’s statements are false and defamatory,” the letter read. “Continued publication will result in further exposure to liability because of continued harm to Mr. Hannity’s impeccable reputation.”

I have to say, I’m pleasantly surprised by Gorsuch on this case, from SCOTUSBlog’s recap:
Gorsuch concurred in part and concurred in the judgment. He emphasized at the outset that “[v]ague laws invite arbitrary power.” He defended the originalist foundations for vagueness challenges that Justice Clarence Thomas questioned at length in his dissent, tracing the history of those challenges back to Blackstone’s condemnation of vague statutes and the “tradition of courts refusing to apply vague statutes.” He further noted that the concern with vague statutes was not “confined to the most serious offenses like capital crimes.” Addressing the government’s argument that a more lenient standard of review should apply in civil cases, Gorsuch would have gone even further than the plurality. He suggested that provisions of civil laws should be scrutinized closely for vagueness even outside the deportation context: “Why, for example, would due process require Congress to speak more clearly when it seeks to deport a lawfully resident alien than when it wishes to subject a citizen to indefinite civil commitment, strip him of a business license essential to his family’s living, or confiscate his home?”
Vaguely written law makes it very easy to prosecute people who were acting in good faith. Granted, that’s not the case with Dimaya, where he had two burglary convictions, but that’s typical of cases involving due process.

There would be new sanctions, and they would be tough ones. The government of the United States had had all it could stand, and it couldn’t stands no more. From CNN:
These people still haven’t figured what Trump is? Not even the guy who’s going to forgo a promotion to become VA head, with a job life expectancy of around 12 months?

Eh, I’m still somewhat skeptical of Chevron deference. In part because I’ve seen some cases where the administrative agencies have gone much too far (on example was that the defined “waters of the United States” to include puddles on private property), and in part because I do worry about the balance of power between the branches of government shifting too much to the executive (and not just because Trump is president). I don’t believe administrative agencies can’t pass/update regulations, but I do think the Courts sometimes give too much deference.

Depends on when Trump leaves office (and how). Assuming he serves out his term, there will be someone, eventually, confirmed by the Senate. But that person won’t be a traditional Secretary of State overseeing the implementation of foreign policy.

But what is the alternative to Chevron deference if the statute is vague? Is it that the court will decide for itself what is reasonable? Or, and this is the scary part where Gorsuch may be going, do we simply throw out all our laws mandating that the EPA create clean air and water standards because the statute has to be specific and Congress can’t defer the drafting of specific laws to administrative agencies?

“The suddenness of this development has taken many of us by surprise, and, in light of the concerns being raised on social media, it bears repeating that we believe public education must always be a nonpartisan issue,” said Kentucky School Boards Association Executive Director Kerri Schelling.
House Democratic Leader Rocky Adkins said that it was “a sad day for public education and the children of Kentucky. This is just another attempt by Governor Bevin to weaken and dismantle Kentucky’s education system and implement his agenda of charter schools.
“Commissioner Pruitt has done a great job of keeping our schools on course academically and building the type of relationships we expect this office to have with our local school officials,” he added. “This backhanded move appears to undermine that work, all in the name of moving public-education dollars from the public classrooms to the for-profit classrooms of charter schools.”

I would say something more akin to intermediate scrutiny would be better. Something like the regulation must advance a clear intent of the law by means that are substantially related to the statutory framework. I understand why statues end up being vague - you want them to be applicable if conditions change, and you might need vague language to win votes - and I understand why Chevron deference exists. But I remain skeptical of the administrative state because of the way agencies are constructed and able to promulgate, interpret, and enforce regulations without any sort of separation of power.

See, that’s where I was smart - I had a perfect double major for making lots and lots of money - Philosophy and English Literature.
My mother was a double major in art and anthropology. Worked out pretty well for her.
Art was how she was able to support her and dad while he was in medical school (she worked at an ad agency, drawing the full-page Sunday ads for department stores and the five and dime); anthro is what got her into law school and made her an expert litigator and settlement mediator (she understood ritual, how to storify fairness for a jury, how to identify what the parties would find emotionally satisfying), then back to art for how to wisely invest her lawyer money and dad’s doctor money.
