Shortish version:

Caitlin MacKenna’s parents got divorced when she was two. She saw her dad once a month until she was five, after her step-dad adopted her. She finds out it was mom that cut off visits.

Her bio-dad dies when she’s an adult. Mom says it was alcohol. Bio-dad had wanted to see Caitlin, but mom doesn’t tell her until after the death. It it wasn’t alcohol, but cancer, which would have been useful information since Caitlin has had to deal with cancer herself more than once.

Fucking hell.

My mom tried to do similar to me when she and my dad split. I eventually had to put my foot down and basically say “fuck you mom, I know you hate dads guts but it’s still my right to have a relationship with him.”

Fortunately she backed off and I now have reasonably good relationships with both my parents again.

Not that it accomplishes anything since I am not a resident of Missouri — but yesterday I sent Hawley an email calling him a seditious weasel and attacking him for trying to help Trump overturn the results of an election he lost. Unfortunately, even if a large number of his constituents expressed those sentiments to him, it would have no impact since he obviously cares only about Republican voters.

Gillibrand’s crime was exploiting the moment for what she thought would be an opportunity to position herself well for a run at the nomination in 2020. If anything, the party loved her for it because they believed it would help them weaponize the surging “MeToo” movement against the Repubs. It was actually seen as a boon at the time for him to resign, because then a woman could (and was) named as his replacement which would (supposedly) help the party with female voters in the midterms.

It doesn’t work like that, Donny. If you throw out votes in every state that changed rules and regs in the last weeks of the election, then you’ll be throwing out virtually every state including the states you carried.

Yup. Funny how he doesn’t want to toss Nebraska’s vote, when our Republican secretary of state “changed the rules” (allowed no excuse mail voting in areas which do not have mail voting by default).

Trump earned 4EVs here and Biden earned 1EV. Curious why he wouldn’t want to toss our state’s vote.

He’s a letter-opener due to the ECA.

Now imagine both the Senate and the House having the Gohmert majorities.

They can safely ignore the ECA (due to the separation of powers nobody can enforce it).

The cultist VP either throws away the envelopes during the opening phase or hands the tellers the alternative slate envelopes.

Dems object. Are immediately overridden by the Gohmert majorities.

Is the ECA the “Electoral College Amendment” (the XII Amendment)?

Relevant clause:

The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted;

Nothing there about setting aside votes or substituting votes.

The holiday season came early for Deadwood, after the South Dakota Commission of Gaming reported November’s gaming handle increased by more than 13% over the same time period in 2019 despite ongoing concerns with COVID-19 exposure risks.

According to statistics released just before Christmas, the South Dakota Commission on Gaming handle for Deadwood showed a 13.3% increase, with slot machine handle increasing by 15.13% when compared to November 2019.

Although those were record numbers, not all was good for table games at Deadwood’s casinos. The report showed table game handle slipped by 11.81%.

53
Nyet  Jan 2, 2021 • 5:22:17am

The Congress cannot ignore the 12th amendment (unlike the ECA), because the SCOTUS can then jump in. But the amendment is so shittily worded that it leaves a large gap for democracy-destroying manipulations.

Good lord.
“Alternate” EC ballots will not be produced for counting during the Joint Session.
The VP will not discard the legal EC ballots.
We can expect republican members to raise an objection for a number of states ballots
We can expect the debate on those objections to extend the process of counting of the EC ballots possibly a day of more.
No objection will meet the requirement of having the objection approved by a simple majority in each separate house of congress.

Yes, these collections of assholes will painfully prolong what should have been a boring pro forma procedure.

Hmm. I’m reading the Wikipedia explanation of that act now.

Electoral Count Act of 1887

(The article has a flag saying it may be too technical)

I’m not sure of any legal solution you could enact to prevent those who do not want to compete in an election in good faith from circumventing the law. Laws only matter if people actually care about them; if there is a whole political party whose sole goal is power at any cost, the laws will not matter to them.

Very much like President Andrew Jackson in Worcester v Georgia: “John Marshall has made his decision; now let him enforce it.”

“How many divisions does the Pope have?”, indeed. However, if the judicial branch were to decide that the legislative branch went against the Constitution then the executive branch would have the means to enforce this - but this only concerns the Constitutional violations; the “internal” procedural matters, like the ECA, would be outside of the SCOTUS purview due to Article I, section 5: “Each House may determine the Rules of its Proceedings…”.

Rapid City Trump Shop closes (Scottsbluff, Nebr. Star-Herald)

A Rapid City flag store has folded.

The Trump Shop is no more and someone has vandalized the empty store with a communist symbol and anti-police message.

The small store at the Baken Park Shopping Center was closed by Tuesday after opening alongside other temporary shops in July 2019 ahead of that year’s Sturgis Motorcycle Rally.

The store was empty Wednesday morning but the outside had some remnants of its past life. There are a few flags on the top of the building, surveillance cameras set up to ward off repeated vandalism, and 50% off signs from when the store briefly rebranded as the USA Shop after the election.

The building was also vandalized with a heart, anti-police graffiti and several hammer and sickles, a communist symbol depicted on the flag of the Soviet Union. The graffiti images appear very similar to the ones sprayed onto the Trump Store and its flags in August 2019.

The 2019 graffiti incident was just one of about two dozen incidents since the store opened, according to a June 2020 story by KEVN.

thedopefishlives  Jan 2, 2021 • 6:32:56am

I see there was some debate overnight about the ECA and the 12th Amendment. Yes, if the Republicans held both houses, they could effectively dismiss the electoral votes from the contested states. What they can’t do, however, is approve the alternate votes from the purported electors that would elect Trump; those electors were not officially appointed by the procedures set forth by their state legislatures, nor were they officially certified by their states’ Secretaries of State. So in this case, the worst that could happen is that they could spoil votes from contested states, but Biden still wins unless they can somehow magic up enough alternate reality to challenge uncontested states. In that case, yes, Trump could theoretically become President* again, but at that point rules are out the window anyway and re: #71 Belafon has the right of it.

Any medical professional of any type who is found to hold anti vaccine views needs to be fired and lose whatever license they have to hold to work in their field. Same with anti maskers. re: #72 thedopefishlives

In that case, yes, Trump could theoretically become President* again, but at that point rules are out the window anyway and has the right of it.

Today’s electoral-vote.com explains it well in their first answer

re: #77 Yeah Sure WhatEVs

This Zach Davisson quote is driving me nuts. It’s not in the article he linked to and I haven’t seen that anywhere other than his quote.

In the Chicago Tribune article is this:

His motive remains unclear. Police said that detectives believe he knew the spoiled doses would be useless and people who received them would mistakenly think they’d been vaccinated when they hadn’t.

chicagotribune.com

I think it’s a fair assertion that an anti-vaxxer would do this, since someone who follows reality would not be interested in sowing doubt about the vaccine.

And if any if this happened were not looking at either a legal or congressional solution that will hold the country together and allow it to move forward

My guess though is its with this part
“There’s nothing a court can annul; Congress’s power over the counting of electoral votes is supreme”

If congress tosses the electoral votes sent by the states and delivered by the archivist, then congress is not in fact ‘counting the electoral votes.’

anyway, the first step if there’s an objection is to request the state(s) to resend/recertify

This cycle no alt-slates, as no legislature-certified alt-slates exist, but they could exist in the future and have existed in the past.

Notably also, the Constitution says nothing about rejecting any EVs, yet the ECA provides for this which means, unless the ECA is unconstitutional, the counting process is indeed not defined in the Constitution itself; which further means that if ECA is rejected, this opens up new vistas (not necessarily determined by common sense).

And there’s no notion of a contested or an uncontested state in the Constitution, it’s up to the Congress to decide, so ultimately it could, without formally contradicting the text of the Constitution, reject as many slates as it needs to reach a certain result.

This has been recognized by classic commentators:

With reference to those cases in which there has been received by Congress but one return of the votes of electors whose appointment has been lawfully certified according to Section 3 of the act, Section 4 provides that no vote or votes so cast shall be rejected, but the two Houses concurrently may reject the vote or votes when they agree that such vote or votes have not been so regularly given by electors whose appointment has been so certified.” To this Senator Sherman objected. “That,” he declared, “is a dangerous power. It allows the two Houses of Congress, which are not armed with any constitutional power whatever over the electoral system, to reject the vote of every elector from every State, with or without cause, provided they are in harmony in that matter.”

“The language,” comments Dougherty, “is none too strong. If a Congress, protected by an adequate vote in each chamber, wished to destroy the government, this provision would enable it to do so. It permits a majority, upon technical grounds, to defeat the popular will, to nullify constitutional government and prevent the inauguration of a new President.”

Belafon  Jan 2, 2021 • 7:32:43am

the self-therapy app Bloom recently asked 28 historians from Yale, Oxford, Stanford and other major universities to choose the worst year in history — or, as they put it, the most stressful. British historian Philip Parker led the effort. Following a depressing dive down the rabbit hole of historical misery, Parker compiled a list of the top worst/most stressful years in world, British and U.S. history. Then the historians made their picks.

The worst year in world history wasn’t even a close contest.

It was 1348, the height of the Black Death, during which as many as 200 million people died. That would be like wiping out about 65 percent of the U.S. population. The Holocaust in 1944 ranked second, followed by 1816, when a volcano eruption in Indonesia blocked out the sun, starving millions. 2020 ranked sixth.

In U.S. history, 2020 was well down the list at No. 8, just behind the 2001 terrorist attacks on Sept. 11, the Cuban missile crisis of 1962, the tumult of 1968’s riots and assassinations, the 1918 flu pandemic, the Trail of Tears of 1838, the 1929 stock market crash marking the beginning of the Great Depression, and at the very, very top, 1862.

That was, most historians say, the grimmest year of the Civil War, when the country’s total collapse seemed imminent…

I had a short conversation with a man at the gas station this morning as I was getting breakfast and eggs and bread. He said, “Imagine how badly everyone would poop themselves if we got a 5% [pandemic].” He mentioned the Black Plague, which was 40-60%. And he’s right; it would be bad. Even the anti-science Republicans would be forced to do something, even if that “something” was outright declare themselves as genocidal. We got “lucky”, with my apologies to the unfortunate dead, that the pandemic of our time was only 1-2%.

1-2 percent SO FAR. The vaccines will help, but we’re still pretty far out on getting anywhere close to even half the population vaccinated. Meanwhile we have flocks of assholes running through stores coughing and yelling at people about masks, having big parties and gatherings, still forcing themselves upon school boards to stay open, insisting on sporting events continuing and all the other crap we see daily. We’re lucky we haven’t hit ten percent yet. We also don’t have accurate information about deaths, infection rates(think of all the people staying home fighting this that are doing it alone at home and haven’t been tested)and pretty much no contact tracing. I wonder about the “excess deaths” figures when looking at 2020 compared to the last 5 years too.

Operation Enduring Clusterfuck is going to be with us for years to come via all kinds of ways. And the worst part is it never had to be this bad or worse, and that those responsible for this will never pay a consequence for it. There will be no genocide/democide trials, no federal charges regarding negligence or depraved indifference, nothing. To me, that leaves the door wide open for this to happen again, and there are other pandemics coming. It’s just a matter of time.

Here’s a way of dealing w/QAnon — make money off them. There’s an Atlantic article about a PredictIt Market player who found a profitable pattern:

… But as he kept betting, he noticed bet after bet with odds that seemed completely off. According to Cage, in the spring of 2019, for example, the PredictIt market gave former FBI Director James Comey a 1-in-4 chance of being indicted in the next six months.
[…]
All of a sudden, the bets made sense: QAnon followers believed that Q had special inside information about the future, and they bet accordingly.

“There were people who were so convicted in these beliefs that they were willing to put hundreds or thousands on the line,” Cage said. “So I started shoveling more and more money in.”
[…]
When he couldn’t find any legitimate news on the bet, he’d dive into QAnon YouTube channels or message boards. If he determined that people were following a QAnon theory, he’d bet against them. Cage has made money every time QAnon has been wrong—which they have been on every bet he’s made so far, he told me. He’s put about $800 in and made around $400 in profits.
[…]

Too late.

After applying some mental floss, I followed their rathole of successive links which led to an actual respectable site, Science Direct.

The wingnuts’ claim is flu vaccines cause a nearly 40% more risk in contracting Covid-19.

The study you eventually get to reported in Science Direct is a US DOD study from 2017-2018 which has nothing to do with Covid-19 (obviously).

Influenza vaccination and respiratory virus interference among Department of Defense personnel during the 2017-2018 influenza season

Highlights

• We examined virus interference in a Department of Defense dependent population.
• Vaccinated personnel did not have significant odds of respiratory illnesses.
• Vaccinated personnel were protected against influenza.

That NESARA crap is all over that Gesara Club Website. I didn’t understand what I was looking at until Nyet provided the link to Wikipedia to explain what NESARA actually is (a proposed set of laws never introduced to Congress to impose hard silver and gold currency, repeal the income tax, and impose a sales tax—the conspiracy being it was actually passed, GW Bush and the Supreme Court are suppressing them, and that suppression goes on today).

In the “Brexit is starting off swimmingly” department, the Royal Navy has dispatched four gunboats from Portsmouth into the English Channel to ward French fishing trawlers away from British territorial waters. The last time the Royal Navy picked a fight over fish, they lost… badly. They might want to rethink this grand strategy.

1-2 percent SO FAR. …. I wonder about the “excess deaths” figures when looking at 2020 compared to the last 5 years too.

The death rate from this disease is probably less than 1%, even if you include excess deaths. A large portion of those who had the disease are not counted because they were never officially tested, so the official death rate is overstated. But the next pandemic may very well turn out to be much more lethal and, given how easily and quickly a disease can spread with modern travel, the results will be more catastrophic than what we are facing now.

Less than meets the eye, here, I think: according to most reports, the Brits and the EU reached a deal over fishing rights as part of the “deal” announced last week. AFAICT, little is actually going to change as regards the actual boats-in-the-water-netting-fish part of things: I think the main difference will be in “quotas”, which I believe are mostly assigned away for cash. SO it looks like the RN are just “showing the flag” for PR purposes (and chasing off the occasional “poacher”). I mean, I guess they’ve got to pay their swabbies anyway, might as well let them get some sea time in - though the Channel in January can’t be easy duty…..

I wonder how excess deaths and unreported positives correlate. If they’re at all close, then the current death percentage (which is somewhere around 1.5% of positive cases in the US right now) would end up being surprisingly accurate.

My guess is that at least half (if not more) of the cases here have never been officially recorded, especially given a reasonable percentage are asymptomatic. Certainly there have been articles suggesting a much higher case count. So the death rate is very overstated.

We’ll never know for 100% certain, but I’m still going with my gut that the overall death rate is around 1%. I agree that it is plausible that the death rate is overstated, but I don’t think it’s by quite as much as you think. That’s literally just a gut feeling and not based on any evidence, and I’d be happy to be proven wrong.

I’m really not sure about that. I don’t think it’s fear - I think it’s an honest desire to have a dictatorship. They would love to install Trump as dictator. It’s not playacting, or throwing the rubes a bone. If they thought it would succeed, they would try even harder. If they thought they could have their dictatorship without a military coup, they would do it in a second. They’re just afraid of going forward with military action.

Ted Cruz wants a dictatorship — but not with Trump in power. He and Hawley are now engaging in a brawl to see who gets the coveted Trump base endorsement in 2024. Everyone supporting this coup should be forced to resign from Congress and never permitted to hold an elective office again — or, indeed, any government position. Too bad that will never happen.

That works both ways: People who died of Covid-related complications not reported as such because they weren’t tested either, as well as collateral damage of people who could not get care for other maladies when a hospital is full of Covid cases or patients are afraid of going to a hospital and getting that disease.

In order to be really leading in Georgia, the polls would have to show them 5 points ahead — and I still wouldn’t believe it. Since I don’t believe in the accuracy of polls anyway.

McConnell may be smart enough to know that this is a losing strategy. I wonder if Chuck could get a few Republicans to jump ship — such as Mitt or Lisa or even (gag) Susan — in order to install a set of Senators who believe (somewhat) in the Constitution.
