Our medieval pals are about to execute a woman for witchcraft.

A leading human rights group appealed to Saudi Arabia’s King Abdullah on Thursday to stop the execution of a woman accused of witchcraft and performing supernatural acts.

The New York-based Human Rights Watch said in a statement that the kingdom’s religious police who arrested and interrogated Fawza Falih, and the judges who tried her in the northern town of Quraiyat never gave her the opportunity to prove her innocence in the face of “absurd charges that have no basis in law.”

Falih’s case underscores shortcomings in Saudi Arabia’s Islamic legal system in which rules of evidence are shaky, lawyers are not always present and sentences often depend on the whim of judges.

The woman was convicted of using jinns to do her nefarious work, and the religious police of our friends the Saudis beat her badly enough to put her in the hospital.

Falih had “retracted her confession in court, claiming it was extracted under duress, and that as an illiterate woman she did not understand the document she was forced to fingerprint”, said HRW.

“At one point, she had to be hospitalised as a result of beatings” at the hands of the religious police, called the “mutaween” in the ultra-conservative Sunni Muslim kingdom, it said.

HRW said: “The judges never investigated whether her confession was voluntary or reliable, or investigated her allegations of torture. They never even made an inquiry as to whether she could have been responsible for allegedly supernatural occurrences, such as the sudden impotence of a man she is said to have ‘bewitched’.”

HRW said that an appeals court had ruled Falih could not be sentenced to death for “witchcraft” as a crime against God because she had retracted her confession.

She had been condemned to death in April 2006 for “witchcraft, recourse to jinn (supernatural beings), and slaughter” of animals, it said. But lower court judges then sentenced her to death “on a ‘discretionary’ basis, for the benefit of ‘public interest’ and to ‘protect the creed, souls and property of this country’”, it said.

One of Brian McNamee's lawyers predicted that Roger Clemens will be pardoned by President Bush, saying some Republicans treated his client harshly because of the pitcher's friendship with the Bush family.

Lawyer Richard Emery made the claims Thursday, a day after a congressional hearing broke down along party lines. Many Democrats were skeptical of Clemens' denials that he used performance-enhancing drugs and Republicans questioned the character of McNamee, the personal trainer who made the accusations against the seven-time Cy Young Award winner.

"It would be the easiest thing in the world for George W. Bush given the corrupt proclivities of his administration to say Roger Clemens is an American hero, Roger Clemens helped children," Emery said in a telephone interview. "It's my belief they have some reason to believe they can get a pardon."

During Wednesday's session before the House Committee on Oversight and Government Reform, Clemens repeated his denials under oath, which could lead to criminal charges if federal prosecutors conclude he made false statements or obstructed Congress.

"I'm not aware of Mr. Clemens having been charged with anything," White House deputy press secretary Tony Fratto said after being told of Emery's remarks.

Emery cited Bush's decision last year to commute the 2 1/2-year prison sentence of I. Lewis "Scooter" Libby, his vice president's former top aide. Libby was convicted in the case of the leaked identity of a CIA operative.

During the hearing, Clemens cited his friendship with Bush's father, President George H.W. Bush, a baseball fan who regularly attends Houston Astros' games. Clemens said he was on a recent hunting trip when the elder Bush called with words of support.

"They have some belief that even if he's prosecuted, he will never have to serve jail time or face a trail (thank goodnes for that. "Trails" are danegerous things-ed.)," Emery said. "This is a charade we're going through."

Wouldn't there, ah, still be something of a problem here?

Comical, a bit, up until you realize that they fully intend to carry out that execution they're talking about. I can see this kind of society working out for small bands of people out in the desert, but when they get territory, and access to modern weapons, and unlimited funding...

But despite it being unfashionable to think one society better than another, there are societies whose laws are worth anything, and others, generally in the backwaters of the world, where this kind of thing is not surprising. When one of more aggressive of those backwater societies gets acces to unlimited funding, it is as much fun for the rest of us as an ape that likes Quentin Torentino movies, and all of a sudden gets its paws on a loaded pistol.

The djinns are an old Arabic belief. They are the kind that comes out the lamp of Aladine and grants him wishes. That was a djinn. Muslims took that belief and incorporated into their cult. I agree, there's no such image that I know of.

That said, here's a link to info on someone who hardly fits the pattern: Rabia al-Adawiyya, a.k.a. Rabia Basri, a woman who lived in Basra about a century after Mohammad's day. She's a Sufi saint. I don't know much about her. (Ignore the "magical" things in the Wikipedia entry. Much of what's "known" about her, aside from her poetry, appears to be legend.)

NOTE THIS: She held that love of God was the only valid reason for worship of God. Fear of punishment or hope for reward were NOT valid reasons. This flies smack in the face of radical (or call it, conventional) Islam.

This is just meant as food for thought, to raise a "hmmm" in the mind, as it has with me.

(Personally, I have a hunch that Islam got seriously corrupted very early on, probably about the time Mohammad got run out of Mecca. Just sayin'.)

The Catholic Church and the Inquisition get all the bad press regarding witches while the myth of the Islamic golden age of Andalusian tolerance is still with us. Yet the Spanish Inquisition itself put an end to this sort of madness with the "Edict of Silence" some 400 years ago .

As neo-Pagan historian Jenny Gibbons writes

in Spain the Inquisition worked diligently to keep witch trials to a minimum. Around 1609, a French witch-craze triggered a panic in the Basque regions of Spain. Gustav Henningsen (The Witches' Advocate) documented the Inquisition's work in brilliant detail. Although several inquisitors believed the charges, one skeptic convinced La Suprema (the ruling body of the Spanish Inquisition) that this was groundless hysteria. La Suprema responded by issuing an "Edict of Silence" forbidding all discussion of witchcraft. For, as the skeptical inquisitor noted, "There were neither witches nor bewitched until they were talked and written about."


The Edict worked, quickly dissipating the panic and accusations. And until the end of the Great Hunt, the Spanish Inquisition insisted that it alone had the right to condemn witches -- which it refused to do. Another craze broke out in Vizcaya, in 1616. When the Inquisition re-issued the Edict of Silence, the secular authorities went over their head and petitioned the king for the right to try witches themselves. The king granted the request, and 289 people were quickly sentenced. Fortunately the Inquisition managed to re-assert its monopoly on trials and dismissed all the charges. The "witches" of Cataluna were not so lucky. Secular authorities managed to execute 300 people before the Inquisition could stop the trials.
