Early this week I got 2 scuba regulators from Ebay, well, I’ve tested them out, 1 is in pretty good shape and the other one is going to need some serious attention. Good news, a rebuild kit is only 30 bucks, all the ‘hard parts’ that don’t get replaced look good, so a new set of O-rings and soft parts should have it working good. Worst case, if I can’t save it I’m out 100 bucks (for a reg. worth about 400-500 if I can salvage it). If I get it working I’ll be 7 for 7 on ebay regs, worst case 6 for 7. (and more gear than I can actually use at the moment.)

If he is having money issues now, what is it going to be like when he is soundly beaten in two of the first three contests? He has ZERO chance for a good result in Iowa, and a only slightly better chance in South Carolina. You’d assume he could manage in New Hampshire, but that is not really a given either.
Again, it might happen and obviously the establishment is behind him. The reason has to do with the fact the the Chicago Transit Authority (CTA)’s Red Line and Purple Line Express trains run less than a block from the east side of Wrigley Field. The ‘W’ and ‘L’ flags are flown to let people riding the trains know the outcome of that day or night’s game.
Note: These are light-rail size trains, with the Red Line being by far the more numerous. The State Street Subway is part of the Red Line.

First Amended Complaint
John C. Burns shouldn’t be a lawyer. No, really. The judge just struck Plaintiff’s opposition to the motion to dismiss, in part because the lengthy fact section was “excessive and inappropriate.” The judge (very generously) gave Burns a few days to fix the problems with his filing. Copying and pasting the bulk of the fact section into a First Amended Complaint that he needs the judge’s approval to file is a really bad idea.
The fact section continues to show that Burns has no clue what is relevant to his client’s claims. This is about what Gawker and its purported agents said about Chuck Johnson. The First Amended Complaint doesn’t start discussing the defamatory statements until page 21 (of 54) - almost half of the pleading is irrelevant crap. It doesn’t matter what Gawker said about Tim Geithner, James Franco, Louis C.K., or Jason Whitlock. Nobody cares about the detailed procedural history of Johnson’s litigation for records about Michael Brown. Greg Howard’s article about Charles Barkley and Eric Garner is worthless to the discussion. The fact section of a complaint should tell a coherent story, and the only story the First Amended Complaint tells is that John C. Burns is a terrible lawyer.
Worst of all, Burns added a cause of action alleging that Gawker is the government because it benefits from a federal statute: “Defendants are state actors by virtue of their use of CDA § 230, in that they use that statute as a shield to enable them to take otherwise illegal and unconstitutional actions.” (FAC, p. 49, para. 271). That’s possibly the dumbest thing I’ve ever seen a lawyer write on behalf of a client.
Opposition to Motion to Dismiss
So, John C. Burns is a stunningly bad lawyer. The motion to dismiss was based on the original complaint, which is still the operative pleading in the case. For a motion to dismiss, the Court generally can’t consider anything outside the pleadings. Burns needed to cite to facts alleged in the original complaint. But Burns supports his opposition by citing exclusively to the facts alleged in the proposed First Amended Complaint.
There are a lot of other problems with the opposition, but they all pale in comparison to the fact that he doesn’t know which complaint he’s defending.
There’s more but those are two most damning observations.

I piled up his mountain of goofy ties and “uglies” and invited our guests to chose one to keep in his memory. Food, booze, stories, memories… all befitting the way he wanted to be remembered.
Well I will point out here that my Republican state senator once wrote Bashar Al-Assad praising him. So yeah I don’t exactly think too highly of your party DF and for good reason. Not to mention they continue to drag women through the mud who want to be able to do what they want to with their own bodies and demonize people for their sexuality. No, they’re not terrorists but they’re assholes who have encouraged xenophobia at his president simply because it got votes.

Amazingly so. My dad was almost 90. He came to the US from Poland, lived through WWI, WW2, being called a like (and fighting kids over it), working in a Tannery from a very young age, as the older brother, so my uncle could be the first to go to college.
I loved my dad with all my heart. I couldn’t have asked for a single thing more when he died. His memorial will be with me for the rest of my life.

Patricia is hitting Mexico pretty much exactly at this resort———halfway between Puerto Vallarta and Manzanillo. At least they are high above the surf. The wind is just going to tear that thatch roof right off.
A friend of mine from elementary school works for this resort (and environmental foundation———development is very restricted to maintain the natural paradise surrounding the abodes). It was always a fantasy of mine to go there——-they have less expensive bungalows as well. This particular place tended to be rented by rock stars and the like. Sure, the bigger tragedy are all the poor families facing the destruction of their homes but it is also a shame that such architectural gems could be destroyed. Just look through their website’s photos and enjoy the beauty they have created.
How is it possible to get to the bottom of this thread and not see photos of Rick Perry and Gov. Bridgegate being all scowly?

DF is the ultimate purveyor of the attitude that ‘Both Sides Are Wrong So Vote Republican’ - you see it with him on an almost daily basis. He’ll throw a token bone here or there to a Progressive cause and / or politician - but Hillary Clinton could literally cure cancer and he’d still wind up voting Republican. In fact, in reading his posts for the last several years now I’m convinced that even if Trump is the GOP nominee - even with all his anti-Trump talk, he would wind up voting for him over the Democratic nominee.
That type of party loyalty, honestly, scares me - if there’s a Democrat that I just can’t stand personally or politically (for whatever reason), they’re not getting my vote just because they have a (D) next to their name.
At some point, you would hope he would realize how much of an utter clusterf*** his party is and that they don’t even let their moderates speak up anymore, lest they get shut down by the right wing noise and media machine - but I honestly think he really, deep down, doesn’t care. He’s shown (up to this point) an unwillingness to change or flex on these things… I really think he DOES know how screwed up his party is, but he doesn’t care enough to vote for the other party to entice some actual change.
My parents were both hardcore Republicans, so is my Father-in-Law .. and practically every day I point out to him how wrong he is on issues and cite the facts and figures to prove it - I don’t feel some whacked out sense of ‘party loyalty’ because the people who raised me or I love in my life have different political ideals than I do. To me, that’s loyalty for all the wrong reasons - and it doesn’t make for a better world.. it just makes for more automatons who cling to tradition for tradition’s sake when there’s a whole bigger, better world out there if they just open their eyes.

DFW is getting metronomic passing downpours. This afternoon was strange though. Near my job we had a thunderstorm squall pass through that stopped traffic, tore down highway signs, and reduced visibility to zero. Wind gusts were somewhere around 60mph and it came out of nowhere. I took video from my office window that looks like some of the hurricane footage; It was through and gone in two minutes and it left a 15-foot highway sign bent and discarded on the lawn across the ramp from my building. It was lucky that nobody was hit with debris, it could have killed someone.
Flooding may be worse further south. The F1 race at COTA has been affected too, I believe they cancelled practice today and may compress qualifying and the race into a one-day Sunday schedule.

Texas is witchfinding through PP’s paperwork for *something* that looks guilty—including patient files—right now, and since the legitimate and shady wings of the anti-abortion movement are completely sympatico about doing shady shit (and cheering on the occasional murder), there is a perfectly rational fear that people’s names will be leaked.
I repeat, perfectly rational, because even the most reasonable members of your party—people with actual political power—kiss the ass of crazy people who care a great deal about souls and not a bit about actual human beings. Perfectly rational because James O’Keefe videos still result in “concern” and hearings. Frankly, I can’t tell those families how to respond to a tragedy like that but I also firmly believe the DP is anything but justice.
We don’t punish criminals to make victims or their families feel good, or feel better.
My car was broken into once. Very neat job. When I discovered it, and got over the initial shock, I was so angry at the feeling of violation that I fantasized about catching the thief in the act, and what I’d do to him. You don’t base a system of justice on angry animal feelings, and the overwhelming anger that can come with loss is one of the worst.

American women skiers have become favorites this winter due to the unfortunate season-ending injury that Anna Fenninger of Austria endured during a practice run a week ago. Lindsey Vonn, who traveled to Sweden this week for the first World Cup race, dropped out of the race and cited a broken ankle she was nursing (she broke her ankle 10 weeks ago training in New Zealand).
That leaves local (for me, anyways) hero Mikaela Shiffrin, who’ll be competing in the technical events (Giant Slalom and Slalom).
Lindsey went skiing, despite her not competing.

I should append this. There are two types of ski races, speed and technical. The speed events are called Downhill and Super G. The technical events are called Giant Slalom and Slalom. It’s all about how many turns there are in a course, Downhill being the very least amount of turns and Slalom being the most amount of turns.

The Kid started his new job today. He was so excited he was up at FOUR AM , he started at 7,lol. Haven’t seen him this happy in a long time. This company better treat him well or they will not like who they end up dealing with. (me)
I survived the driving anxiety/fear thing for a total of 300 miles in 3 days. It’s exhausting fighting through that. I got nowhere near a car yesterday and was a hermit. But I navigated through horrendous traffic, around some pretty gnarly accidents and spent a total of 17 hours driving The Kid back and forth without incident. It sounds like a small thing, but for me it’s a Big Effing Deal. I still am not ready for I-75 or 285 around Atlanta, but there’s a lot of other ways to get places without them. I’m kinda proud of myself. Anxiety and Panic Disorders suck, it’s really hard to get through it without help and support, of which I have little if any. I did it! Suck on that, Anxiety.

I observed this last night but the R’s have had it out for the Clintons since I was in Kindergarten even though Bill probably offered the most Republican friendly policies since John Davis (who? I’m still flabbergasted by this. I mean I get that some fringy nut-burgers would think that that was reasonable but for lawmakers to indulge such dangerous policy initiatives is outlandish.
What would be their policy justification? That gays are sinners (in their view, not mine)? Well so are rapists and murderers but we don’t deny them healthcare. How can they think that gays are worse sinners than murderers? The bigger problem is the nature of the inquiry. Boehner said this, as he announced the committee and the Inquisitors who’d be on it:
“At my request, three House committees have been investigating the abortion business, but we still don’t have the full truth.”
Once again, an open-ended “investigation”, with no list of questions it is tasked to answer. Once again, the declaration that there is TRUTH! that has yet to be uncovered. That’s not how you conduct a serious investigation. That’s how you conduct a witchhunt.
A serious investigation has a set of well-defined questions it has to answer. If the answer to one of those questions leads deeper, then the investigation goes deeper. If it answers all the questions and none of them leads deeper, the investigation ends.
A witchhunt starts with the presumption of a crime even if none is evident. It digs until it finds that crime and the guilty party, even if it has to invent both. If it can’t find any, the witch hunter becomes more extreme in his investigation, because clearly the TRUTH! is too well hidden. Torture becomes acceptable, because there MUST BE a crime to uncover, and the deeper one goes without finding it, the bigger the crime must be.
ETA: This is why there’s a 4th Amendment requiring probable cause for search warrants, to protect citizens from open-ended investigations.

She had some kind of medical issue that left her with a choice between “terminate now” or “continue to carry what’s sure to be a stillborn, if it doesn’t die in the womb and give her sepsis before even getting that far.” She had the D&E (aka “partial-birth abortion”) because it was the method most likely to retain her fertility so she could try again; she did later have another pregnancy that ended with a healthy baby she could take home.
She described the situation, and the procedure, in great detail on the floor of Congress. It was very emotional.
