Sandusky lawyer impregnated a teen

Defense attorney Joe Amendola, 63, representing Sandusky in the sexual molestation case roiling Penn State and Joe Paterno’s legendary football program, impregnated a teenager and later married her, The Daily has learned.

According to documents filed with Centre County Courthouse, Amendola served as the attorney for Mary Iavasile’s emancipation petition on Sept. 3, 1996, just weeks before her 17th birthday.

The emancipation request said Mary graduated from high school in two years with a 3.69 grade point average and maintained a full-time job — but makes no mention of any special relationship between her and her lawyer.

The mac itself or the browser? You can empty cache by Safari -> empty cache. You can also reset the browser under the same menu if that doesn't improve things.

I don't think Sandusky has many supporters other than his lawyer (and apparently the bail judge). The mouth-breathing fanboys in my neck of the woods (most of whom didn't even go to PSU) are using most of their energy defending Paterno.

40 makeitstop  Tue, Nov 15, 2011 6:39:50pm

Since this is a music thread...

I've been catching up on some threads over on the Telecaster forum TDPRI, and this is a story for the ages. Every guitar player has heard stories about 'case queens' - vintage guitars that have ended up spending most of their lives sitting unplayed.

A guy comes on the Tele board and asks how much a guitar he inherited from his grandfather is worth. After some discussion with a few of the well-informed posters on the board, he takes it to be appraised.

It turns out that it's a 100% original, virtually unplayed, original-owner 1956 Fender Telecaster - which in itself is pretty amazing, but on top of that it's a custom finish which makes it even more valuable.

What a gorgeous guitar. That's one lucky guy - he could put a kid through college on what that guitar is worth. Gotta love it.

If there's anybody out on the web defending Sandusky, I haven't seen them. Perhaps his family and some of the folks connected to his charity, but most I've viewed or talked to wish him consigned to the deepest, darkest, hottest circle of Hell possible.

Meanwhile, the level of stupid that is being displayed in the defense of "JoePa" is nauseating. One of the popular themes is that he's a "scapegoat" in all this, that he was just "following orders" and that it's the school who's entirely at fault. As though the man who was god of Penn State football, who ruled with an iron fist, had no control where Sandusky was involved.

One-third of the United States Supreme Court attends Federalist Society fund raiser for opponents of health care law.

This kind of activity by members of our highest court undercuts any claim of impartiality in the health care litigation by the justices involved. Worse yet, it clearly violates the Code of Conduct for U.S. Judges, a set of ethical standards the Supreme Court helps enforce on lower federal courts but has refused to impose on itself.

The Code warns judges to abstain from speaking or serving as the guest of honor at any fundraising event.

On the Today's Show yesterday (I think), they had a taped interview with a "Penn State sports historian" (who says there aren't jobs in this economy?) in a segment on Sandusky. The "historian" was apparently a former friend of Sandusky's, and the interviewer asked him what he thought of him now. His answer was somewhere along the lines of "I can't say on TV what I'd do to him blah blah blah." When asked why, the guy teared up and croaked "Because he ruined Penn State!" Not because he, you know, raped and molested an undetermined number of children over the years, but because he made the guy's favorite football team look bad.

That asshole needs a serious look in the mirror.

As an interesting side note, today, if you went to the Drudge Report, you’d see the screamer headline “JUDGE NOT: KAGAN CHEERED OBAMACARE PASSAGE.” That link goes to a story about the nefarious emailing activities of now-Justice Elena Kagan, who, back when Obamacare passed, expressed a certain amount of excitement about it to a fellow Harvard Law elitist. Of course she wasn’t even a justice then, and as far as we know Supreme Court justices are at least allowed to have opinions (right?), but all the same the wingnut blog post helpfully points out that “a Supreme Court justice must recuse from ‘any proceeding in which his impartiality might reasonably be questioned.’”

And now the latest twist in the Sandusky case:

AP: Email, TV talk add new twists to Penn State case

STATE COLLEGE, Pa. (AP) — A former Penn State graduate assistant cited by a grand jury report as claiming he saw an ex-assistant football coach sexually abusing a young boy in a campus locker room shower says in an email he made sure the act was stopped and then went to police — contradicting what the report says.

Mike McQueary's comments, in an email made available to The Associated Press on Tuesday, appeared to add more confusion to a scandal that has enveloped the university and resulted in the firing of head coach Joe Paterno, the ousting of president Graham Spanier and charges of perjury against the athletic director and a senior vice president.

McQueary, now the football team's wide receivers coach, told a friend from Penn State that he made sure the 2002 shower assault he witnessed was stopped and went to the police about it. The friend made McQueary's email, written Nov. 8, available to the AP on Tuesday on the condition he not be identified.

McQueary, who has been placed on administrative leave and did not coach in Saturday's 17-14 loss to Nebraska, wrote: "I did stop it, not physically ... but made sure it was stopped when I left that locker room ... I did have discussions with police and with the official at the university in charge of police .... no one can imagine my thoughts or wants to be in my shoes for those 30-45 seconds ... trust me."

McQueary has to live with the guilt of not doing nearly enough, and probably now trying to revise history of his inaction/acts. But that revision may put him in trouble too. If he's making statements that contradict prior statements made to law enforcement, he's got a chance of facing perjury/obstruction of justice charges himself. And any kinds of contradictory statements could undermine his credibility as a witness against Sandusky.

Is McQueary engaging in CYA? Most likely - but he still didn't do nearly enough to protect the kid he saw being abused. And everyone else he talked to did nothing. It's on them to explain their complete and utter inaction; up to and including the university PD (who in cases like this would have authority to arrest and investigate matters - but may have been more worried about protecting Penn State reputation than carrying out a full and thorough investigation).

Who have as much power as mall cops most of the time.

Hello? A sexual assault of a child and the Penn State cops don't immediately turn it over to the local police? I don't buy it.

I don't know what it's like in the more westerly regions of the country, but around the north east, campus police (as opposed to campus security) are treated almost exactly like municipal cops. Their standards of professionalism aren't always the best, and they occasionally cover for their institutions (the famous example around here being Harvard PD unwillingness to use the word marijuana in relation to stuff they find students smoking).

Actually, it's a good school. There's a big emphasis on ethics and critical thought. My undergrad thesis here required me to look at an issue from an ethical point of view and make a moral argument about it. As a business major, I did mine on outsourcing and off-shoring of labor.

All well and good. Phlegming and the Rockfishies are not only antisemites but white supremacists and it's worth knowing if Trifkovic is one of them. But as long as we're considering the source, let's consider all the sources here. Like Political Research Associates whom you quote. I think it's worth knowing that they are a hard-left group led by an actual, not a metaphorical, Stalinist, one Chip Berlet who was formerly the head of something called Chicago Friends of Albania. He's a northern version of Morris Dees only (perhaps) without the grifting.

Anyway, if Trifkovic is writing books warnig against Islamism, he may not be in quite as good standing among the paleocons as that; it's no big secret that Phlegming, Dennis Raimondo, and Llewellyn Lincoln Rockwell are not so closeted UBL fans. For now I'm comfortable giving Trifkovic the benefit of a doubt.

Newt Gingrich made between $1.6 million and $1.8 million in consulting fees from two contracts with mortgage company Freddie Mac.

The total amount is significantly larger than the $300,000 payment from Freddie Mac that Gingrich was asked about during a Republican presidential debate on Nov. 9 sponsored by CNBC, and more than was disclosed in the middle of congressional investigations into the housing industry collapse.

It's called a lack of options on the part of the GOP base. Bachmann and Perry have pretty much dropped off the radar, Cain is foundering, and the only other option besides Newt for the title of "Not-Romney" is Luap Nor. And while there are more a few nuts within the base's ranks, even they don't really think he could win the presidency. Or, if they do, it's only because they've totally lost grip with reality.

And I am sick to death of the revolving door and this latest scam with the stock trading. See, it's clear - Freddie Mac got into trouble after they stopped paying Gingrich for his advice. Ergo, if only they had kept Newt and taken his advice they wouldn't have gotten into trouble.

Isn't it obvious?

This part was interesting, too:

His primary contact inside the organization was Mitchell Delk, Freddie Mac’s chief lobbyist, and he was paid a self- renewing, monthly retainer of $25,000 to $30,000 between May 1999 until 2002, according to three people familiar with aspects of the business agreement.

During that period, Gingrich consulted with Freddie Mac executives on a program to expand home ownership, an idea Delk said he pitched to President George W. Bush’s White House.
.....
None of the former Freddie Mac officials who spoke on condition of anonymity said Gingrich raised the issue of the housing bubble or was critical of Freddie Mac’s business model.

Bullet hits White House Window

The Secret Service is investigating how a bullet hit an exterior window of the White House. A round was stopped by ballistic glass behind the historic exterior glass. The Secret Service also tells News4 that one additional round was also found on the exterior of the White House.

The investigation started after an incident on Friday night where gunshots were heard near the White House. Police have since been searching for a suspect in that case, 21 year old Oscar Ortega Hernandez . The Secret Service has not yet conclusively connected Friday's incident with the bullets found on White House grounds.

The rounds were discovered Tuesday morning, and the investigation is ongoing.

They need a person's rights to speech, though, given that they have the right to own property. The right to speak is crucial to being able to defend your right to property, and that goes for corporations as well.

Among Newt's many poor qualities, few seem to mention the fact that he is every bit the quitter that Sarah Palin is. His constituents voted to return him to the House in 1998, but when it became clear that he was being held responsible for the GOP's bad showing that year and would face a challenge to his leadership position, he QUIT THE HOUSE ALTOGETHER rather than face the horrible prospect of merely representing the interests of his district as a back bencher.

That being made worse by the fact he didn't have the issue Sarah Palin had with the constant ethics challenges being filed against her, which gave Palin at least a half-plausible reason as to why she quit (she was losing money by staying).

They already have more rights than flesh & blood people -- they can't be thrown in prison (or executed) no matter what they do, their financial liabilities for even the most egregious tort are limited, their officers can asset-strip when a bankruptcy seems imminent and there's no recourse by creditors...

It's only by an act of government that they can exist at all; they're forbidden by law to have a conscience (obligatory sociopathy), in that they're required to put profit-to-their-stockholders above all other considerations.

The reason corporations are required to put shareholder value first is to prevent shenanigans. It would be easy to use the idea of "doing right" to hide unproductive investments that mostly served to enrich the company's executives. That still happens sometimes, but changing the rule would make it worse.

So many cons are the government-dependent dupes they claim the rest of us are. The government minted them who and what they are.

This is because of a wide-spread misunderstanding of what government is. A lot of people only recognize as government the types of government they like best ("official governments", for instance, failure to recognize that de iure status is not of primal relevance) or least ("secular, liberal government", i.e. the type that simply does not favor them above others).

The problem is one of balance. Communists want to abolish private property and through that usually end up abolishing all property rights. Anti-communists want property rights to trump all other human rights and through that usually end up abolishing property rights for most, to the point where the difference to the communist outcome is hardly worth mentioning.

I am not sure what you are saying. You do not want "universal input" but want a "supra" (?) governing body to "consider" (not decide on?) policies which benefits all? Seems contradictory, unless the body works under strict guidelines decided upon by a more democratically elected body (kind of like the judiciary works under laws passed by the legislative).

Why not dare more democracy? I think especially in municipal budgets, popular referenda might be the way to go. The fiasco with Alabama's Jefferson County might have been avoided if the general population had gotten insight and input on the financial doings.

More Switzerland, please.

Think Electoral College.

AFAIK the electoral college distorts the popular vote by giving States more power than people, as seen in the United States presidential election of 2000. In essence, it means that some people's votes mean more than other people's votes. I think it's intrinsically unfair.

Imperfect, but it works.

I think the whole debt ceiling debacle showed some serious stress test failures.

It is a delicate balance in a democratic society. For better or worse, both consumers and producers manage to come to terms. Capitalism takes care of that.

You are right to note my erroneous use of the word 'consider'- it should have been 'decide.' Theoretically, that is what Congress is for but that has long since given way to their own self serving interests and dealings and horse trading.

Now, on the municipal level there is a lot to be said for your argument for more democracy. The outrageous excesses of Bell, California come to mind and beyond that there are plenty of county financialo shenanigans as well. More transparency would probably work.

That said, in larger centers, there are strong competing interests that can result in disastrous local policies. See this about the 're-segregation' of schools. This is a huge local issue (my part of the world).

And this is a vibrant academic community that counts Duke, UNC, NC State and other colleges are within a few miles of each other.

Some of the healthiest, (economic wise), Countries are well educated and have relatively low population. Having economic accountability close to home seems to work. The farther away, the more layers there are between Citizens and those making decisions affecting the Country as a whole only make it easier for people to act not in the best interest of the Country.

Now many will say those thoughts are anti capitalism, Communism even. But what is wrong asking a corporation that benefited from their home Country's healthy society to focus on giving back instead of pure economic gain?

I don't think so. States simply won't matter. The people will.

You could argue that more populous centers of the country will beat the sparsely populated ones, somehow. But that is already the case within States as it is.

That said, the opponents to raising the debt ceiling did manage to bring uncontrolled spending to the fore- and helped to highlight a highly dysfunctional Congress, out of control lobbying and dirty dealing in DC.

I don't know if that is what they did. Foremost they brought about a downgrading of the US credit rating. And they deceveived the public about what raising the debt ceiling meant: In their narrative, increasing the limit on new spending, when it actually was just authorizing the payment of bills that would have come due anyways because of obligations already authorized.

This touches on the "uncontrolled" aspect of spending. Is it really uncontrolled or just inevitable? Is the kind of "control" the GOP told the public about not just fictitious at best and fiscally dangerous at worst?

I don't think a serious, popular debate about this has even begun. If anything, the GOP has prevented it from happening. That's not to say that the Democrats have been of any help, either.

The inheritence tax isn't "punishing heirs" -- if you want to leave your daughter enough to live an upper middle-class lifestyle for 50 years without working a day of it, that's still well below what the exclusionary limit for inheritence tax has *always* been. Less than 2% of estates are large enough for there to be an inheritence tax, and at its highest it was half of what's above the exclusionary sum.

The purpose is to prevent the rise of a hereditary aristocracy. No one's bothered that Bill Gates is the richest man in America, we recognize that his ideas/creations/efforts earned that wealth -- but there'd be something very wrong if his great-great-great-great-grandchildren are the richest people in America without any of the succeeding generations having done anything productive in the meantime.

Conincidentally, if you do focus on economic issues, they do not even differ that much from neoliberals.

The Founding Fathers tended to agree with you.

With Thomas Jefferson taking the lead in the Virginia legislature in 1777, every Revolutionary state government abolished the laws of primogeniture and entail that had served to perpetuate the concentration of inherited property. Jefferson cited Adam Smith, the hero of free market capitalists everywhere, as the source of his conviction that (as Smith wrote, and Jefferson closely echoed in his own words), "A power to dispose of estates for ever is manifestly absurd. The earth and the fulness of it belongs to every generation, and the preceding one can have no right to bind it up from posterity. Such extension of property is quite unnatural." Smith said: "There is no point more difficult to account for than the right we conceive men to have to dispose of their goods after death."

The question is: What's "control" supposed to mean? Does it mean being able to arbitrarily decide which obligations not to honor anymore? Is the control at some point in time not just one simply over default versus further debt to avoid default? How were these contracts that resulted in the debt to begin with concocted? And why are some corporations (e.g. municipalities and other government bodies) held responsible for this while other corporations (e.g. banks and hedge funds) are not?

The portion of American families living in middle-income neighborhoods has declined significantly since 1970, according to a new study, as rising income inequality left a growing share of families in neighborhoods that are mostly low-income or mostly affluent.

The study, conducted by Stanford University and scheduled for release on Wednesday by the Russell Sage Foundation and Brown University, uses census data to examine family income at the neighborhood level in the country’s 117 biggest metropolitan areas.

The findings show a changed map of prosperity in the United States over the past four decades, with larger patches of affluence and poverty and a shrinking middle.

In 2007, the last year captured by the data, 44 percent of families lived in neighborhoods the study defined as middle-income, down from 65 percent of families in 1970. At the same time, a third of American families lived in areas of either affluence or poverty, up from just 15 percent of families in 1970.

There is no status any property has irrespective of its relationship to its owner. So, property may have been earned by a person. But the moment he dies and passes it on to an heir, it becomes unearned because he is not the owner anymore, his heir is. And his heir does, at the moment of inheritance, not have any relationship of having earned it (with the exception of e.g. heirs that take part in managing property of their parents in their old age, but all of that is stuff going on that could concern anyone, not just heirs, and is not a neccessary aspect of being an heir). It's really simple.

If it's that important to him to pass it on, he's certainly free to do so before he dies. It wasn't earned by the person he's passing it to.

If your estate is likely to be less than $5 million, inheritance tax does not apply. At all. If your estate is likely to be more than $5 million, it's not taking food from your children's mouths to assess a tax on the amount over $5 million.

The government claims it because that puts it back into the economy -- money, like water, needs to circulate for the system to be healthy. It's not good to let it pool in too few places and stagnate.

I do feel that $5 million is rather small. Especially if that value is tied up in family land, (farms, ranches etc), or a family business. Forcing a child that expected to take over the the family business to sell and thus most likely, cause the business to close, and have more people out of work, does not make sense. $5 million might have been lots years ago, not so much now. What I feel is dangerous is the level of wealth that is creating a new aristocracy. Much like obscene porn, you know it when you see it.

Much like obscene porn, you know it when you see it.

That's a connection that may be worth exploring.

"Pornography" as defined today - as visual representations of graphic sexual acts, is not that old of an idea in Western Civilization. Some attribute it to the Victorians (when the word was defined in the modern sense.)

My thinking is that the emergence of the concern over pornography is contemporaneous with the industrial revolution and the first accumulation of the wealth from such, into the hands of a few.

Until the invention of techniques that could reproduce in mass the visual images of sexual activity there wasn't "pornography". Likewise, without the ability to reproduce goods on a large scale with (relatively) little human labor one didn't have an "upper class" that was outside the family lines of nobility (which themselves were often started by victors of previous military campaigns.) IOW, while there were always a few leaders at the top in civilizations (kings, noblemen), they were indeed few. With industrialization came many more people with "wealth", and then the hoarding of such wealth.

If we look at art we can see artists representing the society around them, whether purposefully or not. Many ancient civilizations created sexually explicit works of art, yet they were not "pornography" to them, as sex was simply part of life.

Likewise "capital" first took meaning with the advent of agriculture and the storing of seed grain, and "private ownership" of land with the exclusive right to farm a certain piece of land. However, it is interesting to note that private ownership of land was always tenuous - an invading tribe/group/nation could always take that from you.

Thus we have another parallel - determining what is pornography or not in today's society is often about walking a fine line (say between a fully erect penis and only a partially erect penis); and, determining how much "private" property (not just land) can or cannot be kept by a person/family likewise is walking a fine line - when does government become tyrannical vs. when is society doing what is just to all.

The reason corporations are required to put shareholder value first is to prevent shenanigans. That still happens sometimes, but changing the rule would make it worse.

Corporations are not actually required to put shareholder value first. This is a myth. A corporate charter can include that the company will always focus on sustainability above profit, or some other ethical goal.

My first, and only, divorce was one of the best things that ever happened to me. My thought at the time was the same as your response. I didn't want to wake up a decade later realizing I had just wasted 10 years of my life.

re: #326 Decatur Deb

Sci-Fi reference?

Shadowrun is a role-playing game set in a near-future fictional universe in which cybernetics, magic and fantasy creatures co-exist. It combines genres of cyberpunk, urban fantasy and crime, with occasional elements of conspiracy fiction, horror, and detective fiction.

[…]

In the Shadowrun setting megacorporations control the lives of not only their employees, but command entire armies (the 10 biggest corporations in the world have extraterritoriality, such as now enjoyed by foreign heads of state). Technology is highly advanced and cyberware and bioware (cybernetically enhanced body parts or augmented parts grown in a vat then implanted in place of natural organs) are common. The computer crash of 2029 and various conflicts and plagues have reshaped the political and financial landscape of the world. Now when conflicts arise the corporations, governments, even wealthy individuals, and organized crime subcontract their dirty work to specialists, those who then perform "shadowruns" or missions undertaken by deniable assets without identities or those that wish to remain unknown. The most skilled of these specialists, called shadowrunners, have earned a reputation for getting the job done. They have developed a knack for staying alive, and prospering, in the world of Shadowrun.

Cool, and telling that I didn't even consider gaming as a form of literature. Watching the military from the inside for the last 30 years really made me feel uneasy. Some of the bright new ideas have immense downsides that are papered over by economics and technology. We might not have a post-Modern military, but it's definitely going post-Homeric.

Arizona telemarketers defrauded nearly 5,000 people, many of them elderly, of $6.3 million in a scam that used victims' credit-card limits to determine how much to charge them for setting up a "web mall" from which they allegedly would get commissions, the Arizona attorney general says. Telemarketers exchanged notes on their victims such as "'Old dude, has no clue' and 'living on social security,'" according to the complaint.

Four Arizona LLCs and 11 Arizonans who live in or around Phoenix are the defendants. Christopher Lewallen and James Lewallen Jr. are the lead individual defendants. They ran defendants Solid Ad Solutions, Solid Tech Solutions, Freedom Billing, and E-Web Financial.

They should get serious jail time as well as fines and restitution.

Christmas present idea for snorers...

Robotic bear pillow stops your snoring by gently mauling your face (video)

Looking to stop snoring? What you need is Jusui-Kun, a robot bear that paws your face while you're sleeping. Okay, it's more of a "gentle tickling," according to the bear's creators. The key is to get the snorer sleeping on the pillow to move his or her head from side to side. Jusui-Kun has a built-in mic to detect the sleeper's snoring, while an equally cuddly hand monitor detects blood oxygen levels, letting the bear know when to issue one of its loving face swipes. Video after the break.

Keith Olbermann Reports Rep. Allen West ‘Boasts’ About Being Member Of White Supremacist Biker Gang

On Monday night’s Countdown, host Keith Olbermann gave Rep. Allen West (R-FL) top honors in his “Worst Persons” segment, ostensibly for “admitting” (and even “bragging”) that he was a member of a white supremacist motorcycle gang, after denying any connection to such a gang for the past year or so.

While West’s courtship of motorcycle clubs like The Outlaws is still worthy of scrutiny, the fact is that he made no such admission.

DC Shooting Suspect Could Be Threat to Obama, Police Say

ABC News has learned authorities are increasingly concerned that a man sought in connection with a bizarre shooting incident on the Washington Mall last week may pose a threat to President Obama.

The Secret Service now suspects that a bullet fired in this incident may have hit the White House after a bullet round was found in a White House window, though the round had not yet been conclusively linked to the incident. The round was stopped by ballistic glass behind the historic exterior glass, while an additional round has been found on the exterior of the White House.
...
It’s unclear whether Ortega is capable of launching a sophisticated attack, but police are still fearful of what he might do next.

Authorities suspect Ortega has been in the area for weeks, coming back and forth to the Washington Mall. Before the shooting, he was detained by local police at an abandoned house. U.S. Park police say Ortega may have spent time blending in with Occupy D.C. protesters.

Yikes!

Man accused of exposing self at Occupy Austin

A man has been accused of exposing himself to a 16-year-old girl at the Occupy Austin encampment.

Twenty-year-old Jarod Smith, arrested on Sunday, is charged with indecency with a child. He was being held in the Travis County correctional complex on Tuesday on $15,000 bond. The jail did not have attorney information for him.

According to an arrest affidavit, the teen told police she saw the suspect masturbating at about 6 a.m. Sunday while looking at her in the amphitheater at City Hall Plaza, home to the Occupy Austin encampment.

One of 10,000+ reasons I hate GEMA, the German equivalent of the RIAA:

Music Rights Group Claims Money From Creative Commons Event

German music rights group GEMA is known for its strict copyright regime, but sometimes they take things too far. The group recently claimed money from the organizers of a dance event where only Creative Commons music was played. The organizers informed GEMA beforehand about their royalty free status, but the group suspects foul play and demands cash.

ccMusic royalty collection agencies are known for going to extremes as they go about their business and the practices of Germany’s GEMA are a good example of just how far these merciless outfits can go.

The group recently sent an invoice to the organizers of a dance event where only Creative Commons licenced music was played.

The organizers of the event had informed GEMA beforehand that they would only play royalty-free CC music, but the music rights group isn’t buying this ‘excuse’.

After inspecting the list of tracks that were played, GEMA sent a 200 euro invoice to the organizers. The group claims that some of the artists on the list are very familiar to “pseudonyms” that are also registered with GEMA.

Since German case law dictates that the burden of proof lies with the people who hosted the event, the organizers now have to prove that these artists are not associated with GEMA. This is a problem, since these netlabel artists are often hard to trace, and some are not even known publicly by their full names.

An absurd, unworkable and totally outdated situation.

Morning, Lizards!

If anyone thinks that Rick Perry is a credible candidate for POTUS, they should be afraid. He wants to turn Congress into Texas:

Despite housing the second largest population and economy in the nation, the Lone Star state’s legislature meets only once every other year and its members are paid a small annual stipend of $7,200. While a number of states also feature low-paid, part-time “citizen legislators,” most are smaller and more rural with less complex governments to oversee.

“The Texas situation is not one you’ll find anyplace else,” Peverill Squire, a political science professor at University of Missouri and senior editor at Legislative Studies Quarterly, told TPM.

But deliberately reducing the state legislature’s role in running the government means that someone has to step in and fill the void. In Texas, its the various state boards and commissioners who end up with outsized power. And while the governor is traditionally a relatively weak executive, if they hang around long enough to install their favored appointees — like Perry has — they can accrue an impressive amount of influence.

“It’s just really hard for the legislature get things done withen your government is run by a hundred boards and commissions appointed by a governor who has next to no voice in the legislature,” Bob Stein, a professor of political science at Rice University, told TPM.
“They give the governor a lot of power. Even with Republicans with large majorities, the chairman of finance couldn’t move anything without the governor’s blessing.”

In addition, Squire says that legislators who work part-time tend to have lower levels of relevant information about the relevant issues when they the legislature is in session. The result is that they’re even more reliant on help from outside groups, a situation that good government advocates won’t necessarily be thrilled to hear.

Government entirely by bureaucrat and lobbyist, on an even greater scale than exists now, and with a Legislature that would only meet every other year? Thanks but no.

BBC drops Frozen Planet's climate change episode to sell show better abroad

British viewers will see seven episodes, the last of which deals with global warming and the threat to the natural world posed by man.

However, viewers in other countries, including the United States, will only see six episodes.

The environmental programme has been relegated by the BBC to an “optional extra” alongside a behind-the-scenes documentary which foreign networks can ignore.

Campaigners said the decision not to incorporate the episode on global warming as part of the main package was “unhelpful”.

They added that it would allow those countries which are sceptical of climate change to “censor” the issue.

One of the problems with the NYS legislature is that it's technically a part-time legislature, and everyone seems to have a job on the side (no-show or otherwise). Money is free-flowing and the potential conflicts of interest are endless. Yet, these same legislators are getting paid as though it's a full time gig- $79k base, plus all kinds of lulus (committee assignments, party positions, etc.) that can raise salaries into the 6-digit range.

Not bad if you can get into politics (but the local political machines make that exceedingly difficult).

Turning Congress into that would be even worse than the current bad situation.

Still think that the best way to improve responsiveness is to limit political donations to only those corporeal persons who live in the districts represented - raise the dollar limit, but someone living in TX-12 shouldn't be able to donate to someone running in NY-23 (or vice versa).

Man accused of exposing self at Occupy Austin

Occupy L.A.: 5 charged with crimes including lewd conduct, battery

Five people at the Occupy L.A. encampment have been charged with separate crimes, including a man who allegedly exposed himself and commited a sex act in front of a child, officials said Tuesday.

Angele Chaidez, 21, faces one count of lewd conduct and one count of indecent exposure for allegedly exposing himself and masturbating in front of several people, including children, Friday on the south steps of City Hall, said prosecutors with the L.A. city attorney's office.

That same day, Zachary Isaac, 21, allegedly entered a woman's tent and called her “Satan.” After the woman asked Isaac to leave, he allegedly punched her in the face with a closed fist. Prosecutors charged him with one count of battery resulting in injury.

Robert Holland Jr., 31, allegedly waved a knife at another person on Halloween, then resisted arrest, prosecutors said. He was charged with one count of assault with a deadly weapon, one count of brandishing a deadly weapon, one count of disturbing the peace and one count of resisting arrest.

Michael Howard Thomson, 51, was charged with two counts of battery and one count of resisting arrest after getting into a physical altercation with a parent over a child, prosecutors said.
Thompson is accused of approaching a man in a tent Oct. 11 and pushing him while attempting to grab a 2-year old child, prosecutors said.

Another person tried to intervene and Thompson punched him in the face, prosecutors said. When police arrived, Thompson allegedly refused to cooperate and violently resisted officers’ efforts to detain him.

Farid Ahntab, 24, faces one count each of possession of a deadly weapon, brandishing a deadly weapon, assault with a deadly weapon and resisting arrest following three separate incidents at the camp.

He allegedly brandished a knife at officers Oct. 29, tried to light a food vendor on fire with a lighter Nov. 4 and resisted arrest Nov. 11.

Discovery Channel To Cut Climate Change Episode From Groundbreaking Series

For the past few weeks, we've had to wait patiently while our friends across the Atlantic enjoy the BBC's seven-part Frozen Planet series on life at the poles, which won't air in the U.S. until the new year.

This sequel to Blue Planet and Planet Earth -- two of the greatest programs to have ever come through my television -- took four years, dozens of cameramen, 28 helicopters and 2 ice-breaking ships to make. The effort has been described by producer Vanessa Berlowitz as perhaps "our last chance to record these astonishing wildernesses that have existed untouched by humans for millennia and that, within a century, may change beyond recognition."

Series narrator Sir David Attenborough, who has previously been reluctant to discuss the human environmental footprint in his films, spends the final episode "on location, talking to the camera in his own measured words about shrinking glaciers, warming oceans and the threat posed by man-made global warming," according to The Guardian.

But now we learn that after earning "massive ratings" from Planet Earth and collaborating with BBC to produce the sequel, the Discovery Channel will not air the climate change episode of Frozen Planet in the U.S. due to a "scheduling issue."

House Republicans are at it again. I guess that since declaring ketchup as a vegetable in the 1980s didn't fly too well with people, they decided to modify their strategy.

By again declaring pizza sauce as a vegetable.

Congress pushes back on healthier school lunches

WASHINGTON (AP) — Congress is fighting to keep pizza and french fries on school lunch lines, picking apart an Obama administration proposal to make school lunches healthier.

A spending bill released late Monday would unravel school lunch standards proposed by the Agriculture Department earlier this year, forcing USDA to pull back an attempt to limit potatoes on the lunch line, delaying limits on sodium and delaying a requirement to boost whole grains.

The spending bill also would allow tomato paste on pizzas to be counted as a vegetable, as it is now. The department's proposed guidelines would have attempted to prevent that.

The changes had been requested by food companies that produce frozen pizzas, the salt industry and potato growers. Some conservatives in Congress have called the push for healthier foods an overreach, saying the government shouldn't be telling children what to eat.

[...]

A group of retired generals advocating for healthier school lunches also criticized the spending bill. Mission: Readiness has called poor nutrition in school lunches a national security issue because obesity is the leading medical disqualifier for military service.

"We are outraged that Congress is seriously considering language that would effectively categorize pizza as a vegetable in the school lunch program," Amy Dawson Taggart, the director of the group, said in a letter to members of Congress before the final plan was released. "It doesn't take an advanced degree in nutrition to call this a national disgrace."

A new national survey from Public Policy Polling (D) finds public opinion souring pretty quickly on the Occupy Wall Street movement.

The poll asked: “Do you support or oppose the goals of the

In the previous poll from a month ago, when the protests were fairly new and public opinion had not yet had the chance to set in, the result was a very close 35% support, to 36% opposed.

This is main part of the story Killgore linked:

CALGARY — Two people suffered minor burns to their hands overnight after a tent caught on fire in Olympic Plaza, where Occupy Calgary protesters are camping.

The injured men, ages 19 and 20, were taken to hospital with minor burns on their hands from grabbing the molten tent material, according to EMS spokesman Stuart Brideaux.

One man is believed to be the sole occupant of the tent, and the other man was a bystander, who reached in to pull him to safety.

If this hadn't occurred at Olympic Plaza, it wouldn't have even made the newspaper. Tent fires occurring during camping aren't that uncommon, and minor (first-degree) burns? You have got to be kidding me.

Another question: “Do you have a higher opinion of the Occupy Wall Street movement or the Tea Party movement?”

The result: Tea Party 43%, Occupy Wall Street 37%. Last month, Occupy Wall Street had a narrow advantage of 40%-37%

The Tea Party got a 3% bump in the past month without doing anything. It's within the margin or error but it could also be that OWS made the Tea Party look more sane by comparison.

Are there issues with some of the OWS encampments involving illegal activities? Yes - but do they rise to the level of indicting the entire movement? No.

These encampments were open to anyone gathering within the umbrella of OWS so you can have unsavory types piggybacking on the OWS. Some crime can be attributed to these individuals preying on others at the encampments, but that's not the fault of the OWS movement.

Do these encampments threaten public health? It would have to be a case by case basis - and within Zuccotti Park (the one I'm most familiar with since I've frequently viewed it first-hand and not just from photos/video taken by others), there was some effort to keep things clean, but the numbers of tents and people made that increasingly difficult to do; the disposal of waste was especially problematic but not something that couldn't be overcome by better sanitation practices within the encampment. Local businesses do have legitimate gripes - and at least one restaurant I frequent here has suffered from the protests, including seeing human waste dumped among the regular refuse of the restaurant. That's a public health hazard despite the procurement of port-o-pottys nearby at the UFT headquarters a few blocks south on Broadway. Several other restaurants have shuttered their restrooms to paying customers because of damage done by protesters (and there are already too few restrooms in Lower Manhattan to service those visiting all the attractions here - and none are available at the 9/11 memorial).

Still, I wasn't all that inconvenienced by the protesters at the park - there were enough other places to go, but for those located closer to Wall Street and the NYSE, the protests meant far more inconveniences. The noise issues are overblown, and the drumming was nothing compared to the ongoing construction at the WTC and the steady stream of trucks bringing in equipment, materials, and personnel into the WTC site. I guess that's why I was so amused; the juxtaposition of the protesters complaining about Wall Street and financing, all while some of that same financing was helping get the WTC complex rebuilt and paying for the construction workers who would eat along the fringes of the park as the protest encampment grew to take over the entire park.

I continue to be bemused by the protests and am impressed by the level of media coverage they've gotten despite the fact that they haven't been successful at anything other than occupying open space/parks for a period of time. The pushback by conservatives is also amusing because they're throwing everything and the kitchen sink at the protest movement despite the incoherent messages.

Fact is that the NYPD clearing out the park may lead OWS into a new phase where they can accomplish more by pushing real policy changes - and taking the focus off the encampments and whatever problems are reported. Some within the OWS are actually looking towards this and even the Adbusters outfit is contemplating something similar.

Occupy Wall St. .............................................. 37%

Fox Cites Non-Existent Part Of The Constitution To Hype Argument For Kagan Recusal

Three glaring problems with this argument: The Constitution has no Article 28, has no Section 144, and does not contain the language quoted.

The Constitution actually contains seven articles, none of which have more than 10 sections. It also has 27 amendments, none of which contain anywhere near 144 sections.

The language Fox quoted from actually comes from a statute passed by Congress, Title 28 of the U.S. Code, Section 455. But that's the very statute legal ethicists have analyzed in finding that Kagan does not need to recuse herself because of the email.

Indeed. I thought that it might slow down if not stop. It hasn't and in fact it's increasing to a certain degree. It's also being framed in a very divisive manner. All of the threads, yes, all of the threads have been thread-jacked with anti-OWS trolling for almost 6 weeks now. They don't even respect the 100 comment rule and rarely use the acronym "OT" before posting yet another OWS concern troll post. I am also at my limit with having to deal with the emotional nature of this stunt.

Pervasive video recording of goddamn everything may help teens deal with bullying.

ACLU threatens lawsuit against Unioto

At a press conference Monday in Columbus, James Hardiman, legal director for the ACLU of Ohio, said the advocacy group would represent the family of Zach, a Unioto High School freshman who was attacked by a classmate Oct. 17, reportedly because he's openly gay.

Video of the attack, recorded with a cellphone by another student and later posted online, went viral on the Internet, drawing attention from observers worldwide.

Joined by Zach and his mother, Hardiman said he hopes to resolve the situation by way of an informal meeting with Union-Scioto administrators rather than through legal action. Hardiman requested the sit-down in a letter sent Friday to Union-Scioto Superintendent Dwight Garrett and Unioto High School Principal Jim Osborne.

"We have reached out to the school to make certain they understand and appreciate what we're trying to accomplish," Hardiman said. "We will not hesitate, however, if a response is not forthcoming, to take appropriate legal action."

Special Needs Student Films Teacher Going Psycho on Him

In hindsight, it's regrettable that nobody believed 15-year-old Julio Artuz when he told them he was being bullied and humiliated by one of his teachers. People believe him now, though, because Artuz used his cellphone-video machine to catch his orange-shirted teacher in the act.

Artuz, who attends Bankbridge Regional School in New Jersey, told NBC that his enraged teacher's comments made him "feel like I'm trash." So he used the technology that God gave him and collected himself some damning evidence. After watching his video, we get the feeling that his teacher—who has been placed on administrative leave pending action by the local education board—won't be in a position to swear and threat to kick his ass anymore:

LOL, Russian blogs are all abuzz with a video from one of the schools. A 15 y.o. boy wrote some derogatory remarks on a "United Russia" agitation placard and was called to the school principal. He was smart enough to record it, and it's a hoot (although it's also everything one would expect from "small officials" who don't give a damn and who do what the "people above" tell them).

That does tie in well with the analysis of the PPP poll....

....what the downturn in Occupy Wall Street’s image suggests is that voters are seeing the movement as more about the ‘Occupy’ than the ‘Wall Street.’ The controversy over the protests is starting to drown out the actual message.

Closing down the camps is doinf the movement a favor. It's saving them from their own poorly conceived plan and self defeating bad publicity.

Mississippi Woman Receives Three Year Prison Sentence For Feeding Her Family

Last week, a federal court in Mississippi sentenced a key figure in a $3 million mortgage fraud scheme to two and a half years in federal prison. Just a few days earlier, however, a Mississippi federal judge imposed a significantly harsher sentence on a woman who lied on her benefits applications in order to receive just $4,367 in food stamps to help feed her family...

Are corporations only limited to donating in the district their corporate headquarters is located in in this scheme?

(Though if it was I presume the immediate dodge would be organizing the interlocking shells and hierarchies of subsidiary corporations to give wider representation in any case.)

587 lawhawk  Wed, Nov 16, 2011 9:13:34am

re: #586 oaktree

Under my scheme, no corporate donations would be allowed - nonprofit, profit, etc. You would have to be a person to donate to a candidate.

Unfortunately, since so many lobbyists are out there - this would put them out of business. Hence, it wouldn't happen.
