Excellent News: Supreme Court Affirms NC Racial Gerrymandering Case

We have a bit of potentially excellent news for the 2018 midterm election, as the Supreme Court affirms that the Republican Party in North Carolina deliberately used gerrymandering to marginalize black voters in North Carolina. The congressional map they put together in 2011 is now invalid.

The Supreme Court has issued this 5-3 opinion in Cooper v. Harris. Justice Kagan wrote the opinion for the Court, with Justice Thomas making the fifth vote for affirmance. Chief Justice Robert and Justices Alito and Kennedy dissented. That is an interesting lineup, to be sure.

There is a lot of detail but here is my bottom line: This decision by Justice Kagan is a major victory for voting rights plaintiffs, who have succeeded in turning the racial gerrymandering cause of action into an effective tool to go after partisan gerrymanders in Southern states. That Justice Kagan got Justice Thomas not only to vote this way but to sign onto the opinion (giving it precedential value) is a really big deal.

Justice Roberts cares a great deal about his own reputation (and the Court’s).

When the VRA was eviscerated, he gave a bunch of speeches about how outdated it was, we don’t need that anymore, states aren’t like that anymore… now they’ve gone and made a liar out of him. This is not the legacy he wanted.

I like what we’ve done in California - we created a commission to draft legislative boundaries, fairly nonpartisan (nobody in elected office can be on it, certain number of independents and third party reps have to be included, etc), ordered to make districts as competitive as possible.

That’s pretty significant in a couple of ways.

1) They didn’t assert privilege. Either this batch of documents doesn’t implicate them, or they’re already working with investigators and have a deal in works. That’s as compared to Flynn, who refused to turn over info on 5th Amendment grounds.

2) Manafort and Stone are longtime members of Trump’s cabal of cronies, so they probably have a wealth of info about Trump and his dealings and what the investigators are looking for.

3) Manafort’s far more disciplined than Trump and his current advisers (Stone is less so, but both Stone and Manafort worked together for years, so there’s that).

As a supposedly observant Jew (convert or otherwise), Ivanka would know this.

I think a better way of describing the effect is that the African American vote was circumscribed, geographically, away from as many Congressional districts as possible, by concentrating said vote into as few Congressional districts as possible.

However, even if the courts order NC to draw more reasonable districts, it is not clear to me that the NC Congressional delegation will improve. Maybe. NC seems to be teetering on the edge, between atavistic lost causers, and those who want a more modern society.

The story was never that he disclosed that the source of the intel was Israel, just that the source was likely Israel. Depends. There are competing interests when drawing district lines. For example, you can draw minority majority districts which will tend to lead to minority representatives; but it could also concentrate votes for a particular party in that district. Or, you can divide minority populations between districts that create a situation where the district populations reflect the general population. That’s more likely to lead to less minority representation in office because you’ve diffused the vote of a particular party.

The truth is, there are countless ways to draw district maps that have fairly equal populations. The question is what the partisan, gender, and racial/ethnic make up of those districts will look like.

Huffington Post is reporting on a study noting likely migration patterns from the coasts in the next ninety years inland.

Some commentators are trying to make the argument that inland states might “man the barricades” to prevent the influx of climate refugees. That’s not how it works though. It’s not like a hundred million people are all going to pack up their cars on the same day and move inland.

The migration would be gradual, over many decades. (I doubt the “inland coast,” the Nebraska Sandhills, will become a beach though.)

The article includes charts of expected migration patterns from each coastal county and where they might wind up. It has a lot of speculation of course, but in general the study’s authors (printed in Nature) argue migrants would seek out cities (job opportunities, &c). I’m not entirely sure (but I am not a population specialist or climate scientist), because not everyone migrating would be from cities in the first place, or want to move to one.

If two people moved to my town tomorrow, no one would consider it a big deal. But two today, three next month, two more the month after that, &c means over several years there would be a fundamental shift in the village. Couple that with the majority of people here being elderly, that shift might come quicker.

They note that inland areas would do well to start thinking about long-range plans.

As I noted - the rich will adapt. They will spend their wealth moving, and buying real estate that is liveable.

Some of us may live to a time when New Orleans is flooded worse than Katrina, or a great drought turns the plains into a dustbowl worse than the fabled years of the Grapes of Wrath. Some of us will definitely live to see the lowest island-nations enter emergency status and relocate en-masse to another country.

Got that right. I still get chills thinking about that and how close I and my friends were to some of the victims. And we didn’t really find out the extent of the tragedy until we got back to Columbus and we heard it on the Columbus rock radio station.
