Excellent News: Supreme Court Affirms NC Racial Gerrymandering Case

Law • Views: 37,649

We have a bit of potentially excellent news for the 2018 midterm election, as the Supreme Court affirms that the Republican Party in North Carolina deliberately used gerrymandering to marginalize black voters in North Carolina. The congressional map they put together in 2011 is now invalid.

The Supreme Court has issued this 5-3 opinion in Cooper v. Harris. Justice Kagan wrote the opinion for the Court, with Justice Thomas making the fifth vote for affirmance. Chief Justice Robert and Justices Alito and Kennedy dissented. That is an interesting lineup, to be sure.

There is a lot of detail but here is my bottom line: This decision by Justice Kagan is a major victory for voting rights plaintiffs, who have succeeded in turning the racial gerrymandering cause of action into an effective tool to go after partisan gerrymanders in Southern states. That Justice Kagan got Justice Thomas not only to vote this way but to sign onto the opinion (giving it precedential value) is a really big deal.

Texas got hit with this in March…three congressional districts were invalidated. Also just had our voter ID law struck down. Again.

I think the courts have had enough.

This map is startling & probably sealed the deal.

Not just Southern states.

Pennsylvania. Wisconsin. Michigan. Even when Democrats pull more votes statewide, the Republicans end up with filibuster-proof majorities in the state legislature.

BlueGrl21  May 22, 2017 • 11:53:15am

And I try to avoid tin foil hat territory, but with Sessions wanting to go back to minimum sentencing and getting tough on drug charges….that will just end up disenfranchising more minority voters. The whole “getting tough on crime” thing looks like a “getting tough on minority votes to help Republicans” thing to me.

Hell, even Rand Paul gets it.

Justice Roberts cares a great deal about his own reputation (and the Court’s).

When the VRA was eviscerated, he gave a bunch of speeches about how outdated it was, we don’t need that anymore, states aren’t like that anymore… now they’ve gone and made a liar out of him. This is not the legacy he wanted.

Easy to fix. Make a rule that all congressional districts must be polygons. I believe it is Iowa that all congressional districts must be presented as polygons. Nothing of this FL shit where a district snakes in and out of areas to garner a winning percentage of voters.

SCOTUS notched a win. I still hold my breath though when a case comes up for corporate or religious liberty (which will screw the everyday person).

I like what we’ve done in California - we created a commission to draft legislative boundaries, fairly nonpartisan (nobody in elected office can be on it, certain number of independents and third party reps have to be included, etc), ordered to make districts as competitive as possible.

It was all sculpted as one piece. All they did was remove the primary unit, placed it back in cold storage, then mounted the yarmulke model.

That’s pretty significant in a couple of ways.

1) They didn’t assert privilege. Either this batch of documents doesn’t implicate them, or they’re already working with investigators and have a deal in works. That’s as compared to Flynn, who refused to turn over info on 5th Amendment grounds.

2) Manafort and Stone are longtime members of Trump’s cabal of cronies, so they probably have a wealth of info about Trump and his dealings and what the investigators are looking for.

3) Manafort’s far more disciplined than Trump and his current advisers (Stone is less so, but both Stone and Manafort worked together for years, so there’s that).

It diluted the impact of said votes by that intent though, by herding them into a small amount of districts so as to take them out of the equation elsewhere.

Yeah, it’s worth reminding people that the holiest spot in Judaism is the Temple Mount (specifically where the former Temples were located before they were each destroyed). Since Jews do not know the precise location of the Holy of Holies (Aron HaKodesh), and can’t perform the proper rituals for purification, the closest that an observant Jew can get is the Kotel (Western Wall) or a spot along the Western Wall (which is actually a retaining wall for the Temple Mount) that was revealed during the excavations of the Western Wall Tunnel that is near where archeologists believe the Holy of Holies was located.

As a supposedly observant Jew (convert or otherwise), Ivanka would know this.

I think a better way of describing the effect is that the African American vote was circumscribed, geographically, away from as many Congressional districts as possible, by concentrating said vote into as few Congressional districts as possible.

However, even if the courts order NC to draw more reasonable districts, it is not clear to me that the NC Congressional delegation will improve. Maybe. NC seems to be teetering on the edge, between atavistic lost causers, and those who want a more modern society.

An observant Jew would never turn his or her back to the Kotel. It is customary to walk at least 3 steps backward after prayer. She clearly didn’t know this and the entire Kotel Plaza was emptied for the Trump entourage.

This feels like the moment when we look back on this fiasco in a decade or two when we say “that’s when the wheels started to really come off“…

“Just so you understand, I never mentioned the word or the name ‘Israel’,’” Trump told reporters in Jerusalem. “Never mentioned it during that conversation. They were all saying I did. So you had another story wrong. Never mentioned the word ‘Israel’.”

The story was never that he disclosed that the source of the intel was Israel, just that the source was likely Israel. The first thing you explain to a client when they’re going to be deposed is that you answer only the question asked, nothing more, nothing less. The reason is simple, you’re more likely to get yourself in trouble by mentioning stuff that wasn’t even in the realm of interest for the questioner.

That’s the dilution, though - they now get fewer representatives.

Depends. There are competing interests when drawing district lines. For example, you can draw minority majority districts which will tend to lead to minority representatives; but it could also concentrate votes for a particular party in that district. Or, you can divide minority populations between districts that create a situation where the district populations reflect the general population. That’s more likely to lead to less minority representation in office because you’ve diffused the vote of a particular party.

The truth is, there are countless ways to draw district maps that have fairly equal populations. The question is what the partisan, gender, and racial/ethnic make up of those districts will look like.

It has been stated by some before, but to repeat here - by 2050 the Pacific will be in permanent (or near permanent) “El Niño” state, by the definition we use today.

Huffington Post is reporting on a study noting likely migration patterns from the coasts in the next ninety years inland.

huffingtonpost.com

Some commentators are trying to make the argument that inland states might “man the barricades” to prevent the influx of climate refugees. That’s not how it works though. It’s not like a hundred million people are all going to pack up their cars on the same day and move inland.

The migration would be gradual, over many decades. (I doubt the “inland coast,” the Nebraska Sandhills, will become a beach though.)

The article includes charts of expected migration patterns from each coastal county and where they might wind up. It has a lot of speculation of course, but in general the study’s authors (printed in Nature) argue migrants would seek out cities (job opportunities, &c). I’m not entirely sure (but I am not a population specialist or climate scientist), because not everyone migrating would be from cities in the first place, or want to move to one.

If two people moved to my town tomorrow, no one would consider it a big deal. But two today, three next month, two more the month after that, &c means over several years there would be a fundamental shift in the village. Couple that with the majority of people here being elderly, that shift might come quicker.

They note that inland areas would do well to start thinking about long-range plans.

It is common to try and rush things… changes in society often happen slower than people expect.

Yet it will be true that as sea levels rise, millions of Americans (will they still be called that?) will have to move away from the coast.

A bigger problem, though, is that the southern US, and that includes TX, will become quite warm and humid during half the year, more so than now. If you think it is unbearable in Houston now without air conditioning, in a couple of centuries it (well, a few miles inland, the new land areas) will be even more so.

As I noted - the rich will adapt. They will spend their wealth moving, and buying real estate that is liveable.

The poor - are not so well off.

From the link:

Scientists are predicting a 6-foot global sea-level rise by the end of the century …

That is a bit of an outlier, though. More likely the rise at the end of the century will be between 2 and 3 feet.

Still, the time picked is arbitrary. We use “2100” because we like round numbers.

The thing about climate change is that this is a really big picture problem. It encompasses the whole planet, for an indefinite time frame going forward. Given likely positive feedbacks, melting of the icecaps will continue for centuries. The sea levels are never static, but the change on a decadal basis could be rather large here or there in centuries future.

Previous studies looking at local climate change have discovered that in as little as a half a century, some spot can go from woodland to grassland, or from being a lake to being dry.

All of us here will be dead before even a small fraction of the change will have manifested. Some of us may live to a time when New Orleans is flooded worse than Katrina, or a great drought turns the plains into a dustbowl worse than the fabled years of the Grapes of Wrath. Some of us will definitely live to see the lowest island-nations enter emergency status and relocate en-masse to another country.

Somebody on FB posted this nonsense:

I pointed out that most of those who died, died fighting AGAINST that flag. I said you could honor their service and sacrifice without glorifying their flag, much as you could honor the German dead of WWII without glorifying the Nazi flag.

The response was nonsensical shit about how the KKK changed the meaning of the flag.

WHAT?!? So, it WAS the flag of rebellion, the flag of racism. How did the KKK change THAT?

Then someone else chimed in that it was the flag of men who actually helped abolish slavery.

HOW?!? By LOSING?!?

So I posted that THIS is the flag of the men who actually helped abolish slavery:

I am perpetually amazed at the people - white, or course - who aren’t willing to accept that the Civil War was about slavery, at least for the people who started it, and that we shouldn’t ‘erase history’ by taking it down.

OANN (One America News Network) is owned by Herring Networks.

Herring Networks, Inc., an independent and family-owned national video programming company owns and operates OAN and sister channel AWE (formerly WealthTV; the initialism being an acronym for “A Wealth of Entertainment”). When the network began in 2013 it had a limited partnership with The Washington Times.[citation needed]

In July 2014, OAN relocated its news and production studios out of The Washington Times Building to its new location at 101 Constitution Avenue NW, near the United States Capitol. The move ended OAN’s relationship with The Washington Times, which provided news & analysis,[8] as well as a lease space arrangement, for the network. While its Washington Bureau was previously located within the Times building, OAN remains solely owned and operated, including all editorial control, by Herring Networks, Inc.

Charles Herring, in an interview in CPAC, said “Fox is a great platform, a lot of conservatives like it, it gets outstanding ratings. There is nothing wrong with Fox. The problem is that if you take the channel lineup, the sources of national news tend to lean to the left…and all we have is Fox.”[9]

1) A massive up-front retainer.

The time for poorer people (and sane people) who live on the coasts is to move now, while land prices inland are still relatively inexpensive.

I have no doubt that the wealthy will be busy buying up property in places like Nebraska and Kansas.

One advantage for liberals is they generally accept the theories of climate science. They therefore have an advantage in property markets inland.

The four finalists:

Robert J. “Bob” Giuffra Jr. currently is a partner of Sullivan & Cromwell LLP in New York and head of the Firm’s Securities Litigation practice

Reid Weingarten is widely recognized as one of the nation’s top white-collar criminal defense lawyers

Marc Kasiwitz regularly serves as national trial counsel in complex litigation in the areas of bank finance, fraudulent conveyance, RICO, corporate governance, antitrust, securities, mass tort, product liability, environmental, breach of contract, and other commercial cases

Ted Olson harder to pin down, but the other three seem to follow a pattern…

The three most damaging paragraphs from the revelation about Trump pushing back against the FBI

A senior intelligence official said that Trump’s goal was to “muddy the waters” about the scope of the FBI probe at a time when Democrats were ramping up their calls for the Justice Department to appoint a special counsel, a step announced last week.

Current and former officials said either Trump lacks an understanding of the FBI’s role as an independent law enforcement agency or does not care about maintaining such boundaries.

Trump’s effort to use the DNI and the NSA director to refute Comey’s statement and to say there is no evidence of collusion echoes former President Richard Nixon’s “unsuccessful efforts to use the CIA to shut down the FBI’s investigation of the Watergate break-in on national security grounds,” said Jeffrey H. Smith, a former general counsel at the CIA. Smith called Trump’s actions “an appalling abuse of power.”

Considering that the right wingers lose their collective shit every time there’s a terror attack and stand by and do nothing despite the numbers killed by mass shootings and the easy availability of firearms in the US, there’s a serious misallocation of resources and a gross misjudgment of risk.

You’re far more likely to be gunned down by someone you know than be caught up in a terror attack.

Stats are beyond the right wing, and the threat.

Mind you, if this was indeed a terror attack, it was yet again occurring in a European nation, not covered by Trump’s Muslim bans (and it’s still too early to tell who perpetrated).

The wife just sounds impersonal.

I never use “the wife.”

When talking to my sister I will refer to her spouse as “your wife” or by her name, depending on the context.

Observer Art and I both very much remember the Who concert in 1979.
