Frank Gaffney: Muslims Practicing Sharia Should Be Prosecuted for Sedition

Here’s Frank Gaffney of the anti-Muslim Center for Security Policy, calling for Muslims who practice any version of sharia law to be arrested and prosecuted for “sedition.”

Gabriel: But a lot of people say that Sharia law is a religious practice, and maybe it should be protected by the First Amendment. Can you please tell us, is it compatible with the Constitution? Should it be protected by the First Amendment as a religious practice?

Gaffney: It is the law of the land in Saudi Arabia and Iran, and anyone who thinks that what life is like in either of those two countries is the same as life in America obviously doesn’t know anything about either Saudi Arabia or Iran. In fact, it is absolutely antithetical, Sharia is, to our Constitution, and the pursuit of it as you said in your comment, Brigitte, is incompatible with the Constitution’s Article VI, and therefore, far from being a protected religious practice, it is an impermissible act of sedition, which has to be prosecuted under our Constitution.

We have laws that limit what one would call "religious practices". One example might by polygamy. They're prosecuted on face value with regards to the practical application of the law. Polygamy for example wouldn't be considered a seditious act no matter how much people would consider it a threat "to the moral foundation and the future of America". The same is true with whatever Sharia practice that may run counter to American laws. The whole notion of Gaffney's "brain fart" is beyond absurd.

There is a hidden undertone to all this that is not at all funny: the fundamentalist religious right sees our nation as being favored by God because our laws reflect God's law (or at least their interpretation of it) and by allowing Allah's laws to creep in would move us farther from God's grace and eventually cause our downfall.

We have changed and amended the US Constitution before, but changes/amendments have to be ratified by two-thirds of all the states, I believe.

We have changed and amended the US Constitution before, but changes/amendments have to be ratified by two-thirds of all the states, I believe.

Not that I favor Huckabee's goals, at least he is not just for ignoring or violating those laws he does not agree with because he does not find them in accordance with his concept of "God's laws".

He doesn't have to be interested in breaking the law to be the wacko that he is. Amendments to the Constitution aren't taken out of the Bible. I mean, there may be things there that are part of our law that are based on the 10 commandments (murder, thievery, etc.). There's probably not such a fine line between justice and morality, but it's not a road we should go down and anyone who throws religion into the mix in this country should be eyed very skeptically.

Also, I distinctly remember seeing that alot of the Theological friction in the Muslim World is between the Hanafi's (the light Green on the map, there's alot of it, and the Salafi's (Concentrated in the Arab areas, especially the Peninsula). Suffice to say, I'm on the Hanafi side of the issue.

I should probably make it clear, it's not a Christian thing for me. I wouldn't want any religion in my politics, even my own (Jewish).

Occasionally I hear some nutter whining about "sharia compliant finance," in other words, a way to structure a financial deal that doesn't involve interest. Since it still involves the financier making a profit and getting collateral, I then ask the nutter what the problem is. And I don't get an answer, other than muttering, in response.

Slightly off-topic: Last year I mentioned the JIDF's ties to the JDL on Twitter and how that was a major reason why I stopped supporting them. Sure enough, "David Appletree" e-mailed me, claiming I was engaging in "Twitter defamation" and denied any support for Meir Kahane/the JDL.

Funny how they have quite a few Kahane quotes on their website...
