Last week, a kid up in Burnett County, NW of Austin got together at his dad’s house with a couple of buddies (the dad is a Constable) and dropped acid. Things got a little sideways and the son went out to his dad’s car, opened the trunk, pulled out his dad’s AR, loaded it up up, and shot his two friends because they were “acting weird”.
No shit, Sherlock. You were peaking. Everything is weird.
Question:
Why does a Constable in a rural county in Texas who may see a SWAT situation once in his career have an AR in the trunk of his car? Shouldn’t battle rifles be kept at the Cop Shop in the armory until needed?

Most of the police cruisers around here carry some kind of rifle now, but they are kept in a locked gun box bolted to the trunk floor. I suppose that doesn’t help much if you leave the keys around where your kid can take them though.
I was told that the police are forbidden to have the gun box key on the same ring with the cruiser’s ignition key at least. Too many police cars have ended up being taken for joyrides/short lived escape attempts by perps.

The problem is that cops used to be protectors and now see themselves as warriors against the very people they were trained (back in the day) to protect and to serve.
Their default attitude is to intimidate and suppress. The entire relationship between the police and the policed has gone topsy turvy. If you have body armor and battle rifles, the temptation is to use them to respond to any situation where any cop, in any possible situation, could be at risk.

The problem is the reality of the likely makeup of the jury pool - and there are two of them to get through, including the grand jury where the testimony will be sealed and the prosecutor in question has made statements that could be construed as supporting the police in this case.

Baden said one bullet, which was likely the fatal shot, entered in the top of Brown’s skull. Another hit just above his right eye, exited near the eye, re-entered his face, exited near his jaw and then ended up in Brown’s upper chest or shoulder. Brown suffered four other gunshot wounds to his right arm and palm.
Still means that Michael’s head had to be tilted down at slightly more than a 90 degree angle (as if you were looking down at your toes) when the bullet struck. I dont think being on his knees is at all necessary for the trajectory as it was described as a “slightly forward angle.”

When the Feds get done with their autopsy, they will find that the bullet that entered the top of Brown’s head and exited his eye socket struck the pavement and entered his right jaw. The entrance wound on his head will be circular. The entrance wound on on his jaw will be a “spang” wound with a central core surrounded by fragments.
The bullet that exited his eye blew his eyeball out according to the coroner’s drawing (at least appears so, that dashed line with the dangly bit usually means exactly that). And if he was rushing the cop, where is the first bullet that entered his head? It didn’t exit? Where is it?
Again, the salient factor is that the FPD didn’t file a report and the shooter is in the wind.

His head was down for whatever reason, be it that he was charging, bent over, falling over, or simply looking down. The bullet struck his forehead above his eyebrow on an angle almost parallel to the front of his skull. The bullet entered his skin, went under his eyebrow exited the top of the eye socket, entered his cheek, exited his jaw, and then struck and came to rest in the shoulder/chest near the base of his neck.
The line connects the holes to show the path of the bullet, just like the line from the upper arm wound to the side of the chest does the same thing there.
The bullet that hit the top of his head DID NOT exit!
(where is it? In evidence after being removed by the county coroner)

Well, Texas does have feral hogs and big pigs can be dangerous. There can also be coyotes, in this case the animal. The human form of the word ‘coyote’, meaning someone who smuggles in people, can also be a threat near the border.
Lastly, there is the fact that a rural cop who gets caught in a bad situation may have to hold out for a good while before help arrives. For that reason, he may well need a semi-auto rifle to be available.

They can also act as a deterrence, someone who is barricaded in a house or car and sees a shotgun or assault rifle pointed in their direction might think twice before doing something stupider.
One police officer that I know has made the pointed repeatedly about how intimidating the racking of a shotgun can be and how it can deescalate a situation quickly.

1) A cop SHOULD be functioning and held to a higher standard than those they are supposed to be serving and protecting. So, where the hell was this guy when his kid and friends were dropping acid and acting stupid? Anyone who leaves any firearm within such easy reach of anyone else is too much of a fool to own a weapon. Seriously, on acid the kid would have had to have already known how to access that weapon, I’d guess it wasn’t the first time. It’s just that this time two people are dead.
2)My grandfather was a cop in a rural town for 30 years. He was also a hunter. He had no less than a dozen different types of firearms in his home the entire time I was growing up. He had 14 grandkids. NEVER was there a firearm within reach of one of us the entire time I was growing up. NEVER. Unless one of us went hunting with him. And even then, there was a big freaking set of rules to follow. Break the rules, your ass was in trouble and you never went with him again. Period.
3)That small town my grandpa was a cop in also never had one incident where he needed an AR or anything similar. For feral animals he used a shotgun, just like every other farmer around him did. There were coyotes and bears around, and no one ever was hurt by one of them.
This need to arm ourselves to the teeth is based on fear and in some cases fear and anger. When you’re scared and pissed off there’s no way in hell you make good decisions. I don’t care how manly or “together” you think you are.

There does not have to be proof of racism by Wilson: the key issue is whether it was a justified shoot or non-sanctioned shooting. Motive is supplemental. If there is institutional racism that had a hand in Brown’s death, that does not need to be proven for Wilson to be found guilty of Brown’s death.
The real institutional racism was the repeated and compounding actions of the Ferguson PD in the immediate aftermath, hours, and days after the shoot.

I suspect that Wilson may have some anger issues. Maybe there was a touch of racism but two key points:
1. Wilson allegedly said ‘get the fuck on the sideway’ when he drove up on Brown and Johnson.
2. Wilson allegedly fired at Brown as Brown was running away, and continued firing at Brown as he was stopping and allegedly yielding.
This applies to character and a rage based motive. Proving racism as a motive is probably futile but proving rage or anger is very plausible.
This is my current opinion that may change with further information. Hopefully the facts of the case will all come out.

The act of Brown being shot is probably not institutional racism though it may have contributed. But that doesn’t need to be and probably can’t be proven in a court. Institution racism doesn’t need to be proven for Wilson to be found guilty of Brown’s non-justified death.
However, just about every other thing the Ferguson PD and right wing media has done since the moment Brown died reeks of institutional racism. That case will be held in the court of public opinion. I hope justice is served there.

Aside from any problems with the shooting, it’s standard police procedure to handcuff any incapacitated (or dead) suspect who is shot by police, simply to eliminate any possibility of the suspect only having been stunned or possibly having been wearing body armor, etc.

The federal civil rights actions will likely involve Wilson, the police department, and possibly the elected officials, depending on what the investigators find at each step of the process.
If they find systemic problems with civil rights violations in Ferguson, the options may be a lawsuit (which most jurisdictions simply can’t afford to defend) or they’ll force the town to agree to a consent decree, which gives the federals oversight on reforming the department, rules, practices, etc.
Reform is clearly needed in Ferguson. The question is whether the reform must include essentially removing everyone from the chief on down.
A separate question, and separate investigation, should also be addressing the actions of the STL County Police, whose officers were those in the riot gear and riding the armored vehicles in the early stages of the protests, and some of whose officers have shown a stunning lack of respect for the protesters, and who had no issue aiming their loaded rifles at unarmed protesters - both to intimidate and to threaten.

Even if FPD didn’t assume the investigation, and it was going to be done by the STL County Police, there should be records of the FPD incident report.
You know, indicating the who, what, when, where, why, and how of the incident, and that it was indeed transferred.
That they can’t even produce this basic information is quite telling. It also explains the stonewalling previously - that they didn’t even engage in basic police work.
It also fits in with the investigation into a shooting that occurred during the protests. No one can seem to find any of the evidence that was gathered, let alone the police reports. The police are unconcerned about a shooting that occurred during the protests injuring a protester. Ferguson PD haven’t bothered to interview her, and the local media hasn’t gotten any better response from the police either:
Aaten-White has since been sent home. Her attorney apparently hasn’t been able to find out anything about the incident either. He told the paper there doesn’t even seem to be a file or a report on record with the Ferguson police department. And the Riverfront Times had no better luck at getting answers.

OT: I saw several people last night criticizing the St. Louis police officers for handcuffing the dead suspect whom they had shot, but didn’t get a chance to respond to the multiple comments before going to bed.
Aside from any problems with the shooting, it’s standard police procedure to handcuff any incapacitated (or dead) suspect who is shot by police, simply to eliminate any possibility of the suspect only having been stunned or possibly having been wearing body armor, etc.
I was one of those people. Thanks for clearing that up.
It doesn’t make me feel any better, though.

I understand where you are coming from. I was lying low over the last week or so myself. Sometimes the real truth of what is going on can be overbearing.
You know what really has me concerned. How do all of these police killings against African Americans, hating on illegal immigrants, messing with gay issues and the like look to the rest of the world?
I think it further erodes our moral standing as the beacon of how to do it all the right way. We lost a lot when we invaded Iraq (a sovereign nation). Now we are seen as terrorizing and killing our own citizens.
Maybe it is time for America to shut-the-fuck-up about everyone else’s human rights issues and fix our own.
Besides, as many have joked, we have our own Taliban here with the crazy Christians and TeaParty folks.
We need to get over ourselves a bit and get back on the correct path.
(And no, I am not a revolutionary…just concerned we are going the wrong way.)

I’m glad to see that SSM is practically a non issue to people my age for instance but OTOH I will read internet comments where people describe African Americans in ways that they were described in the Jim Crow era. So far we’ve come and yet so far to go. It’s strange to say but I am actually more disillusioned under Obama’s presidency than I was under Bush’s. That’s not a slight on Obama himself who has tried to and done a lot of good but the fact is that we still have a long way to go and there’s still a lot of people out there who haven’t even conceded defeat in the Civil Rights movement battles let alone our present ones.

In looking at the previous thread’s topic, I noticed that Hoft claims his eye-socket story was confirmed! by two sources: the prosecutor’s office, which appears to be his original source; and the STL county police.
That sort of adds a new wrinkle to this whole thing. I know Charles has written to the prosecutor’s office to ask them about their being a source for Hoft. It will be interesting to hear if they respond. Be interesting to hear what the STL county cops have to say as well.

ARGH. I have to try and put together a writing sample for a potential employer and it’s giving me fits. It’s something so basic I don’t know why this is such a problem. I have to go to their site, summarize who they are, the challenges they address and “how you think we can help address these challenges”.
It’s ONE page tops. One. Fucking. Page. And it feels like I’m being asked to write a dissertation. WTF? The position requires writing these things after each call/meeting with a client, so this is obvious stuff. It shouldn’t be this hard.
You’re stressing too, maybe because you want the job so much. Relax. Deep breaths. Forget why you are doing it and just be assured of yourself. You write well around here, so you should have no problem.
Now, go out there and show ‘em how it is done!

Sigh. Went to get the kid, got home to find giant puddle of dog pee right in front of the door. Stepped in it. Cleaned up dog pee. Also, I have inlaws coming for the weekend. And they’re bringing their dog, which is going to be an issue because my dog loses her shit for the first 24 hours around a new dog. And they know this and INSIST on bringing the dog anyway. Sigh again. Also, I just found out more inlaws will be here next weekend. When I was planning on having a cookout/gathering for all the people after the memorial service and stuff is done. Somehow we have to also find time for dealing with this whole hospice thing and the impending memorial before that. AND taking the kid back to school Sunday, AND then going back to get him next Friday because I forgot it’s a holiday weekend next weekend and school is closed.
Anyone who says a full time mom doesn’t do anything is getting a kick in the groinocological region. Also, too, I may just say fuck it and start drinking. I’d kill for some weed right now.
