Tonight in the Shitshow: Trump Threatens to Sue Steve Bannon for Defamation

This is really getting good now: Trump attorney sends Bannon cease and desist letter over ‘disparaging’ comments.

Trump attorney Charles Harder said in a statement, “This law firm represents President Donald J. Trump and Donald J. Trump for President, Inc. On behalf of our clients, legal notice was issued today to Stephen K. Bannon, that his actions of communicating with author Michael Wolff regarding an upcoming book give rise to numerous legal claims including defamation by libel and slander, and breach of his written confidentiality and non-disparagement agreement with our clients. Legal action is imminent.”

In the letter to Bannon, Harder, writes, “You [Bannon] have breached the Agreement by, among other things, communicating with author Michael Wolff about Mr. Trump, his family members, and the Company [the campaign], disclosing Confidential Information to Mr. Wolff, and making disparaging statements and in some cases outright defamatory statements to Mr. Wolff about Mr. Trump, his family members.”

In the letter, Trump’s attorney says that “remedies for your breach of the agreement include but are not limited to monetary damages” though no dollar amount is disclosed.

Actually, the book can’t be blocked. That’s prior censorship and is almost completely inimical to the First Amendment. There is an argument which could be made about national security, but I don’t think this book qualifies. Plus, that horsie’s out of the barn; some of the press have the book already. (Note: If you work or worked for a three-letter agency, one of the conditions of your employment includes review of your books, but that’s not prior censorship.)

I’m personally wondering if the non-disclosure agreement Bannon signed with “Donald J. Trump for President, Inc.” is void as a matter of public policy? Also, the letter talks about libel but fails to note that Trump is the quintessential public figure and would have to demonstrate “actual malice” to be able to win any damages. (Which is nearly impossible to do.) Also, considering how awful Trump is (and this can be demonstrated on the record), I’m thinking it’s literally impossible to libel the guy.

I’ve asked one of my more astute lawyer buddies in New York about the NDA but it will be tomorrow before I hear back from him, I’m thinking. Just as a side note, one of our Republican (!) Arizona legislators filed a bill for consideration in our “meth lab of democracy” to make NDAs for sexual harassment illegal.

So, now Trump can fret about two things: the Mueller investigation and the Wolff exposé.

Hollywood Reporter’s got a piece by Michael Wolff this morning. Holy crap.

There was some effort to ascribe to Trump magical powers. In an early conversation — half comic, half desperate — Bannon tried to explain him as having a particular kind of Jungian brilliance. Trump, obviously without having read Jung, somehow had access to the collective unconscious of the other half of the country, and, too, a gift for inventing archetypes: Little Marco … Low-Energy Jeb … the Failing New York Times. Everybody in the West Wing tried, with some panic, to explain him, and, sheepishly, their own reason for being here. He’s intuitive, he gets it, he has a mind-meld with his base. But there was palpable relief, of an Emperor’s New Clothes sort, when longtime Trump staffer Sam Nunberg — fired by Trump during the campaign but credited with knowing him better than anyone else — came back into the fold and said, widely, “He’s just a fucking fool.”

Part of that foolishness was his inability to deal with his own family. In a way, this gave him a human dimension. Even Donald Trump couldn’t say no to his kids. “It’s a littleee, littleee complicated …” he explained to Priebus about why he needed to give his daughter and son-in-law official jobs. But the effect of their leadership roles was to compound his own boundless inexperience in Washington, creating from the outset frustration and then disbelief and then rage on the part of the professionals in his employ.

The men and women of the West Wing, for all that the media was ridiculing them, actually felt they had a responsibility to the country. “Trump,” said one senior Republican, “turned selfish careerists into patriots.” Their job was to maintain the pretense of relative sanity, even as each individually came to the conclusion that, in generous terms, it was insane to think you could run a White House without experience, organizational structure or a real purpose.

So, with the Bannon book revelations I figured I’d tune in to Morning Joke to see what Joke and his guests had to say about it.

They pretty much say the book is true. Joke reveals they have heard much of this since March of ‘17. Bannon and others have been saying this stuff about the chaos in the White House and how much of a dunderhead Trump really is.

Here is the opening of the show. It’s good stuff, even if I don’t like Joke, it’s good to know he and other Republicans seem very aware of the issues.

I hope this forces the Republican congressfolk who all know it too, to stop covering for it. It’s in the public now and there will be no more cover.

Here is an interesting article arguing that the GOP tax bill isn’t as bad as it looks, especially since the tax cuts for the middle class which are suppose to be temporary probably won’t be. Though that doesn’t change the fact that it should have had more relief for low income Americans, and less for the 1%. I’ve never believed the deficit hawks argument that the US is dangerously in debt, and I agree that in reality US budget deficits play a valuable role in the world economy by providing an ultra-safe investment in the form of US Treasury Bonds. And when Democrats come back to power they should realize they can borrow to help low and middle income Americans, just as Republicans borrow to help the rich.

The legal notice — addressed to author Michael Wolff and the president of the book’s publisher — said Trump’s lawyers were pursuing possible charges including libel in connection with the forthcoming book, “Fire and Fury: Inside the Trump White House.”

The excerpts from the Wolff book confirm my suspicions expressed here several times, that Trump did not expect to win and did not really want to win. I spent part of the weekend watching a series of doom-and-gloom financial videos by a gold-bug. He’s one of those Austrian economics fans, but I have to admit that his charts showing the boom-and-bust cycles of the financial markets are compelling. He noted that regulators and financiers learned absolutely nothing from the 2007-8 bust, and went back to business as usual as soon as the government bailed out the big banks.

Regardless, bull markets do not continue indefinitely. There will be a correction, perhaps while Trump is still in office.

There really should be visible snow on our mountains. There is none. I can shirtsleeve drive to ski resorts near Los Angeles. Mt Baldy, Mt Wilson etc. In this pattern, look out for February and March rains here. Can be a threat to burn areas. Of which we had a lot. Record breaking lot. The patterns are changing to the more robust or extreme side. wet, dry, hot or cold. Scary in it’s own “climate” way, but of course not life threatening like the cold zones.

Yes. Stock market up? Where is that money coming from? Has to come from somewhere, its not just laying in the street to be picked up. Bailing out of bonds? Okay, borrowing will get more expensive, rates go up, business borrowing gets expensive, banks get squeezed. Borrowing against real estate to buy stocks? What can go wrong when real estate is over leverage? Look out if overall margin requirements get lowered. Wealthy tax cut money being used to buy stocks? Aside from the fact that they don’t have it yet, a big chunk of that money is from increasing the deficit which means increased interest rates which affect housing prices which squeezes people who borrowed against equity to buy stocks. Always remember, the sharks are ALWAYS in the water, like Goldman shorting the very stocks they were pushing clients to buy. If you aren’t a shark, you’re the chum.

I also think he’s more shocked now than he’s ever been in his life. He’s spent more than 50 years describing himself as “the smartest person on the planet” and having his specially-selected toadies repeat it. Now that he’s president, he’s finding out how many, even his closest friends, really feel about him, and he’s freaking out and trying to change the subject to his non-existent economic success. The tool and the 1st Daughter seem to think that tweeting about the stock market reaching a new high means every citizen will suddenly have more money appear in their bank accounts/paychecks.

For a time I worked at a meat packing plant on the White Castle line. Nothing illegal but they’re the cheapest of the cheap when it comes to the piss poor grade of meat they used. Made McD’s look like prime cuts. I’d not willingly eat at one of their stores.
