Haven’t heard at all from fishfolk or any of my conservative friends on this yet. I have no doubt I’ll get an earful from my best friend on Saturday (it’s his birthday and we’re cautiously gathering a small group of friends). Correct. The 25th Amendment is intended to give the government a safeguard in case a President has a legitimate mental and/or physical breakdown requiring a hand-off of power to the Vice President. Once the term ends, he is free to go as a former President of the United States, with all the rights and benefits thereby conferred.

I think of the three scenarios (25th, impeachment, self-pardon), I think the third is the likeliest. I’d even propose a fourth, which is the one that’s been discussed in the past: Trump resigns just before the inauguration and Pence issues a pardon as part of the bargain.

There’s no damn way Pence will pardon Trump now. There was a chance earlier, but after this week, Trump despises Pence and has made no secret of it, and Pence, while he isn’t willing to take calls on the 25th Amendment, is not about to give Trump a free pass.

I can see the 25th being invoked in any of those cases, either as a temp or a permanent fix.

But if none of those are true, and the Prez doesn’t want to leave, we are pretty much stuck with her/im unless his Cabinet chucks her/im out, which would require them to decide he is *mentally* unfit to continue. Which would mean they would have to say he’s not sane.

And that couldn’t help a Civil or Criminal prosecution.

Insanity is a very specific legal defense to criminal charges, and isn’t the same thing as being incapacitated for purposes of the 25th Amendment, which hasn’t been carefully defined because there has been no need to do so.

And yes, I know Walsh’s point is that the cops themselves didn’t kill BLM protesters (*citation needed*), but the cops were gladhanding with Rittenhouse and let him walk right on by after killing people.

It also glosses over the fact that the Capitol Hill police opened the gates for the insurrectionists to enter the building. It also glosses over that the Capitol resembled a scene from V for Vendetta in anticipation of BLM protests, while security yesterday was at a level whose most charitable explanation involves Hanlon’s Razor. It glosses over the fact that cops were taking selfies with insurrectionists inside the building and that the vast majority of people were simply allowed to walk away.

Last but not least, no BLM protesters were armed and invading a federal building. I still don’t fully know the circumstances of the shooting, but she was in the midst of an armed incursion into the Capitol building. That’s the kind of shit causes LEO to start firing. A fair chunk of time, BLM protesters were getting run down, beaten, maced, etc. by police with tactical gear. People aren’t always going to sit back and take a boot to the chest.

We need her in the national DNC chair, really, but she’ll be useful and powerful wherever she goes.

One of the arguments that Lincoln Project made for not working within the national DNC is that it takes to long to get anything done. On their own, they could have an ad out slamming a politician before s/he was even done with their speech. I think that one of the reason’s that Stacey has been so effective is that she can call the shots without having to deal with a huge bureaucracy. I wish her well for whatever office she wants to run for, but I hope she doesn’t become anything more than a well-heeded consultant for the DNC. Fair Fight can go national on it’s own.

Not that I know of, but they are a private citizen and can be charged with crimes like any other citizen, and guess what: That includes crimes committed in office for which the statute of limitations has not yet run out.

they would presumably have to be impeached because otherwise I have no idea how they aren’t entitled to a library, secret service protection, a pension, etc.
