Yon: A Mortar at Night

Images • Views: 2,904

Michael Yon (who may soon be filing a lawsuit against Michael Moore) forwarded this striking photograph from Afghanistan as an LGF exclusive:

I thought you might want to see our folks in action. This nighttime shot is from my days with a tiny unit of U.S. soldiers in Afghanistan. We were 2 days drive from nearest paved road, and very deep in Taliban country. In case of serious attack, the nearest backup was probably too far away to matter.

I won't. I will, however, observe that the early scene in Paris has the very pleasing touch of a cobblestone street in which the cobbles are croissants. There is so little quiet wit in most films today.

You referring to this? He doesn't want to get in the way of the economic stimulus package, but is considering reintroducing the draft resolution.

Only Democrats push this nonsense. It's not about improving military preparedness, because the military is opposed because it means spending on training of people who aren't interested in being in the military. The US military is at its best when you have highly motivated people who want to be in the military. Rangel and his Democrat cohorts want to undermine all that.

Good point. They want the military full of people who will cause disciplinary problems, and not do a good job, so we cannot count on them, or need even more troops than with a well-trained volunteer force.

This makes me ill.

The Elephant in the Room: McCain may be Obama's secret weapon

A desire by both men to secure their places in history might forge an unlikely pairing.

Still, Obama and the GOP moderates will not produce the kind of post-partisan harmony that Obama promised and the public now expects.

But I believe Obama has an ace in the hole among Senate Republicans. This unlikely ace can deliver not only the GOP moderates needed to break a filibuster, but also the stamp of bipartisanship: the 2008 GOP standard bearer, John McCain.

McCain was once the mainstream media darling, back when he joined Democrats on a host of issues. He prized his maverick moniker and used it to propel himself onto the national scene in the 2000 Republican presidential primary. Early in the Bush years, he shored up his status as the media's favorite Republican by opposing Bush on taxes and the environment.

But this love fest came to a halt when McCain became the front-runner for the GOP nomination. First he began to sound more like a conservative by altering his stands on immigration, the environment and taxes. Then he named Sarah Palin his running mate. It was too much for a media that had fallen head over heels for Obama. The media had a new darling.

In McCain's mind, however, losing the presidency will not be the final chapter of his life story. He knows the path to "Big Media" redemption. Working with the man who vanquished him in November will show them all the real McCain again.

Leopards do not change their spots, my friends.

We're going to hear the "ten year" argument about developing our own resources until the price goes back up over roughly $50.00.

I'll take the lower prices while they last. You'll get your wish of higher prices Oil Price.netbefore too long, IMO. When the economy recovers, the price of oil will likely bonce back strong.

It depends on whether Yon registered the image at the proper time (before infringement, or within 3 months of first publication); then it depends on how the damages are calculated.

Sadly, Moore probably has enough money to be able to defend against the suit, pay whatever damages and attorney's fees are assessed against him, and still have plenty left over for the daily pallet delivery of Devil Dogs.

It's true that money can beat just about anything in court, but I don't believe it's true that registering an image has anything to do with it.

Copyright is automatic with authorship.

House Democrats ready $825 billion stimulus bill
GOP offers own plan as price tag of Democrats' package rises

WASHINGTON (MarketWatch) -- House Democrats, with the blessing of President-elect Barack Obama, are preparing a massive $825 billion economic stimulus bill loaded with federal spending and tax cuts, a more expensive package than initially estimated that is likely to face Republican criticism.
The bill contains $550 billion in federal spending and $275 billion in tax cuts, but the numbers are subject to change. Read a summary.
Democrats are seeking to spend $90 billion on highway, transit and other public-works projects, which they say will spur job creation.
The bill also contains $102 billion aimed at helping workers find new jobs and retaining employer-provided healthcare.
It also preserves a $500-per-worker and $1,000 per working couple tax credit, a key priority of the incoming Obama administration. Read a summary of the tax provisions.
House Majority Leader Steny Hoyer said Wednesday that House committees will begin work on the stimulus bill next week. Obama and Democrats want Congress to approve a bill by mid-February.

Again, get ready for inflation.

I refer to McCain as a "Scoop Jackson Democrat" not because of the Boeing thing, but because McCain is reasonably concerned about national defense (as Jackson was), and somewhat conservative in some things. In other words, McCain resembles the conservative Democrats of 30-odd years ago more than he resembles the hate-America moonbat gang that controls the Democrats today.

True, who besides Joe Lieberman is in that wing of the party now?

re: #149 buzzsawmonkey

You are wrong.

Copyright being "automatic with authorship" merely means that you don't lose the copyright if it's published without registration, as was the case prior to 1978. No copyright can be enforced unless it is registered; the registration is your ticket into court. The half-truth that you don't need to register for the copyright to (merely) exist has been responsible for many, many authors losing out on their remedies.

Whether you can claim statutory damages and/or attorney's fees, or are limited to claiming provable actual damages and the infringer's profits from the infringement depends on when the copyright was registered. If you register prior to infringement, or within 3 months of first publication (if that was a legitimate, not an infringing, publication), you can claim statutory damages and/or attorney's fees; if you register post-infringement, you are barred from claiming statutory damages or attorney's fees, and are limited to actual damages and profits.

Yes, that's true about statutory damages. But copyright registration is an aid to collecting damages -- handy proof, basically -- but does not define copyright, and is not a condition of copyright. Copyright is fixed when the work itself is fixed in some way -- to paper, to digital file, to tape, etc.

Yon could still claim enormous actual damages, if he proves his case -- plenty enough to cause pain to Moore.

re: #189 Cognito

Yes, that's true about statutory damages. But copyright registration is an aid to collecting damages -- handy proof, basically -- but does not define copyright, and is not a condition of copyright. Copyright is fixed when the work itself is fixed in some way -- to paper, to digital file, to tape, etc.

Yon could still claim enormous actual damages, if he proves his case -- plenty enough to cause pain to Moore.

What part of "Before an infringement suit may be filed in court, registration is necessary for works of U.S. origin." do you not understand? It's a prerequisite for filing an infringement claim.

17 USC 411:

) Except for an action brought for a violation of the rights of the author under section 106A(a), and subject to the provisions of subsection (b), no action for infringement of the copyright in any United States work shall be instituted until preregistration or registration of the copyright claim has been made in accordance with this title. In any case, however, where the deposit, application, and fee required for registration have been delivered to the Copyright Office in proper form and registration has been refused, the applicant is entitled to institute an action for infringement if notice thereof, with a copy of the complaint, is served on the Register of Copyrights. The Register may, at his or her option, become a party to the action with respect to the issue of registrability of the copyright claim by entering an appearance within sixty days after such service, but the Register's failure to become a party shall not deprive the court of jurisdiction to determine that issue.

You have to register the work to file an infringement suit.

That doesn't mean that you don't have copyright protection, but registration is a necessary precondition to file suit to protect your claim. The timing of when you file the copyright determines what damages and compensation you can claim.

A perfect example of a different mind set from some on the right and left. I liked both McCain and Obama for both saying that they'd try for what's they feel is good for the country, and not care from which side the idea came from.
A idea is not automatically bad if it come from the other party, be they Republican or Democrat. I know that's a radical concept to some on the far left and right, but not to the middle.

Depends on a lot of things, and I would recommend you bounce this off a professional adviser you trust, who will need more detail about your finances/tax situation than you of course want to go into here.

I assume the house is to be used as your principle residence and not as income producing property.

Assuming that is correct, I would buy the house with the fixed rate deal that suits you best, as long as it has a provision for you to be able to make overpayments without penalty. Keep your cash as when inflation hits you will want to be able to roll that over repeatedly in something that will go up with inflation over time, to preserve your wealth.

If I am following this the point could be that if you have an unregistered copyright it means that the other guy can't get away with suing for damages over it. Say you wrote something and it is know to 20 people, then one of them who saw it on a blog, publishes it under their own name claiming it was their wit and wisdom and then the NY Times uses it without attribution. You have real damages against the first thief for the money they made from your idea but not punitive damages because it wasn't registered. If they sue the times they have no standing because they didn't really own it, the Times may owe you or you could sue to get anything the Times paid the first thief. Am I right?

Similar to when Apple sued Microsoft but it turned out the ideas were really from Xerox.

No copyright can be enforced unless it is registered

Before an infringement suit may be filed in court, registration is necessary for works of U.S. origin.

These are 2 different statements. You can "enforce" the copyright without going to court - cease and desist, negotiation, settlement, arbitration(maybe).

Plus the same site you reference says

registration is not a condition of copyright protection

Registration may be made at any time within the life of the copyright.

I agree that registration is helpful.

You pay 100% of the interest due and get 20% of it back in tax refunds? Why not just save it all?

What do you suggest?

Well, there is no perfect answer to that. Some like gold, but that is very volatile and there can be some heavy carry costs to that.

Personally, I am keeping a certain portion of my nest egg fairly liquid right now, and then will put it in a ladder structure of insured CD's as the rates start ratcheting up.

For anybody who put their money in Treasuries as a safe haven, be ready to either move it quick of hold on to maturity, cause once rates start up the market value of those Treasuries will drop like a rock.

1) Forgo buying a house and rent an apt
2) Buy the smallest house I can afford to pay in cash
3) Get a 15 years mortgage with fixed rates
4) Get a 30 years mortgage with fixed rates

(Gonna sell my house this spring to capture the equity)

Boomer,

A totally separate reason for not paying cash if you can get a good low interest loan for part of the principle has shown up in So. Cal. the last few years with the big fires.

If you have no mortgage company to threaten the insurance company when your home burns in the wildfire - the insurance company just won't pay. They figure they have more lawyers than you do. Sad but I know at least 3 people who have faced this.

Depends on your tax situation and your opportunity cost of other options.

Right now, you can borrow money for record low rates. I'd be doing that and preserving my cash. That way you can make interest on the earnings and write off part of the borrowing cost. That is likely to turn into a legal arbitrage when rates jump back up.

336 Cognito  Thu, Jan 15, 2009 10:35:18am

re: #301 buzzsawmonkey

No, you can't "register the work the day before you walk into court," because you need the certificate as an exhibit on the complaint. It can take the Copyright Office anywhere from 4 weeks to 6 months to process an application, depending on the examiners' workload, unless you pay a hefty sum for special handling, in which case you can get the registration back in about a week. But you need the certificate for the complaint.

More to the point, if registration occurred after infringement, unless it was done within the magic 3-month window following the date of first legitimate publication, the delay in registering means, as I said above, that you cannot claim either attorney's fees or statutory damages, but are limited to provable actual damages and the infringer's profits.

Statutory damages--particularly statutory damages for willful infringement, which can go up to $150,000 per infringed work--can often be more than actual damages and profits, so losing that remedy reduces the recovery substantially.

The real loss, however, is the ability to claim attorney's fees, because if one cannot recover attorney's fees from the infringer the costs of litigation can quickly eat up the lion's share of a potential recovery.

Wow. Dude.

1) You're being a bit literal about registering before court. I think you know what I mean: Whether it's a day or a week, registration only must be made before bringing the case to court. Not before violation. Not before publication. Et cetera.

2) Yes, as noted long ago, we agree on statutory damages. My point has never been about statutory damages. Merely that registration is not a prerequisite to valid copyright.

Copy?

Right?

He's Nyarlathotep, the messenger of the Elder Gods.

Seems to be fairly accurate

Nyarlathotep's first appearance is in the eponymous short story by Lovecraft (1920), in which he is described as a "tall, swarthy man" who resembles an Egyptian Pharaoh. In this story he wanders the earth, seemingly gathering legions of followers through his demonstrations of strange and seemingly magical instruments, the narrator of the story among them. These followers lose awareness of the world around them, and through the narrator's increasingly unreliable accounts the reader gets a sense of the world's utter collapse. The story ends with the narrator as part of an army of servants for Nyarlathotep.

You pay 100% of the interest due and get 20% of it back in tax refunds? Why not just save it all?

Depending on what state you live in and your income it can be a lot more than 20% back. It can exceed 50% for some in high tax brackets in states with high taxes such as California. The argument is that you can invest the balance at a higher rate than the interested rate when adjusted for the tax deduction (i.e., if you are paying 6%, but get 50% back due to taxes, and can make more than 3% you are ahead).

Where is your cash?

I cannot fathom that this is what the George W. Bush presidency has left us with... Creeping socialism comes into the open... Once it is out, it will never be put back...

Razorbacker quoted Plato yesterday on something like this. George Bush didn't give us most of this mess. It came from years of people wanting something for nothing and politicians (tolerated/elected by the public) creating devices (CRA) to maintain their power.

"All forms of government destroy themselves by carrying their basic principles to excess. The democracies become too free, in politics and economics, in morals, even in literature and art, until at last even the puppy dogs in our homes rise on their hind legs and demand their rights...Disorder grows to such a point that a society will abandon all its liberty to anyone who can restore order."

1) Registration "need not be made before [infringement] or before publication", true; it only needs to be made before infringement, or within 3 months of first publication [regarding an infringement made within those 3 months], if you want to have a case that is worth pursuing at all. Most infringements do not carry sufficient damages to make the case worth pursuing, economically, if you cannot claim statutory damages or attorney's fees. Yes, you have "the right" to proceed--but that and two bucks gets you on the subway. Few people have the tens of thousands of dollars it takes to mount a copyright case in order to recover a few hundred, or a few thousand, dollars as a "matter of principle."

2) Again, an unenforceable "valid copyright" is like a car up on blocks; it looks pretty, but it doesn't go anywhere. Accordingly, if someone wants to enforce their valid copyrights they had best learn the various aspects of registration.

That's all fine. Again: My whole point, in its meager entirety, has been that copyright is automatic with authorship.

Not statutory value. Not cars on blocks. Not subway rides. Mere ownership.

Remember,

This has nothing to do with defending the nation. The donks will use this to say "Bush's policies forced us to enact this."

The Repubs have been quite silent in the face of some overt violations against this nation as brought on by the Dems. Pretty soon, they will be just as accountable if they don't stand up and FIGHT.

House is "currently appraised" at about $225 thousand.
House was purchased long ago at < $100 thousand
House has very small second, for remodeling.
Balance on house + second is about $65 thousand.

I'll keep the house.

Might want to consider putting the house into a trust.

Then it would be protected from bankruptcy, lawsuits, and Medicare/Medicaid. Have many family members that lost their home when they got old and had to go to nursing home. House had to be sold to reimburse the Feds.

True, and there isn't the societal pressure to go natural as there was when I was giving birth. My body just had no clue what to do doing labor. That's why mine was so long, even with the drugs to make the labor more regular--the drugs didn't work.

Good interview with Roberta Green Ahmanson author of Blind Spot: When Journalists Don't Get Religion,

It's religion, stupid!

You arrived in Israel a few days before Operation Cast Lead was launched. How do the events in Gaza tie in to the thesis of your book?

The events that led to the operation in Gaza illustrate how people are motivated by their religion. An organization like Hamas latches onto certain things that are deep within the history and teachings of Islam, and it uses them in the modern world - by shelling Israel, for example - because it believes that this land once was Muslim land, and it's its duty to take it back. Within the Muslim community, this is going to be part of the issue forever, because its goal, of course, is to have the entire world living under Islam.

And you are certain that the press doesn't really grasp that this is a religious conflict?

In the American media, you often see the conflict reduced either to land-ownership issues or to issues related to poverty - that people who call themselves Palestinians are poor, and that Israel is largely responsible for their plight. In this respect, it doesn't seem like the Western press grasps the real story.

Kid 1 - 2 hours
Kid 2 - 3 -3.5 hours (breech)
Kid 3 - about an hour - doctor waited until after his scheduled c-section to break my water thereby leaving me with 'cramps' for about two hours prior to real labor.
Kid 4 - 1/2 hour.

what those people in disdain do not realize. 2 labor pains to go from a 2 to a 10 is NOT painless.

When my daughter was born, the wife's older sister was the nurse assisting. Every time the wife whimpered, sis would hit her with painkillers.

Finally, the Doc turned and said, "Dammit P, stop that! I want to go home sometime tonight."

Kid was born not too long afterwards.

re: #198 broomer

I have a financial question here as I know this is a financial savvy group. If I were to buy a house this summer and there's a good chance of inflation, what's my best option?
1) Forgo buying a house and rent an apt
2) Buy the smallest house I can afford to pay in cash
3) Get a 15 years mortgage with fixed rates
4) Get a 30 years mortgage with fixed rates

(Gonna sell my house this spring to capture the equity)

It depends on why you are selling and what you want to do with money as an investment. Do you own just the one house? Do you have a retirement account and some diversified investments? Are doing this as a one time flip or as an eye to risky real estate flipping to make quick cash? Or are you wanting to just retire with no debt and downsize.

In general it's better not to sell real estate once you hold it and can afford the payments on it.

Buying a smaller house will incur a tax burden and agency fees from the sale and sales tax. The tax burden is less I believe if you have lived in your house for 5 years. Something like a $250,000 exclusion of the equity on the sale realized.

If you can't afford the current house and it's your only investment. Sell it use your tax exemption and buy a 4-plex somewhere and live in it. That will give you some inflation protection and some income over time. 2 bedroom units are better then one bedroom units. Pick a location close to employment centers but off the railroad tracks.

Usually selling a house to capture equity is not the best path unless you're are flipping. I am not sure today but usually you can pull equity out with a line of credit from a bank. Then you use that as a downpayment on another property.

If you don't want the hassle of being a landlord then the 30 year fixed or 10 year arm. You can make extra payments to make it perform like a 15 year loan.

Also, you want to inflation proof your capital and obtain something like a 6-8 percent return on the income you have to invest. Flipping properties and acquiring transaction fees will set you back quite a bit. Inflation proof yourself first.

10 percent = fun money, everything else goes into investing.

re: #61 lawhawk

You referring to this? He doesn't want to get in the way of the economic stimulus package, but is considering reintroducing the draft resolution.

Only Democrats push this nonsense. It's not about improving military preparedness, because the military is opposed because it means spending on training of people who aren't interested in being in the military. The US military is at its best when you have highly motivated people who want to be in the military. Rangel and his Democrat cohorts want to undermine all that.

Way late to the thread, but I believe that Rangle's motivations are a more PC oriented than anti-'Imperialism' Leftist oriented. He wants a draft to enforce racial quotas since apparently latinos are disproportionately represented in our military. The draft is needed to pick up the slack until every racial demographic is represented in a way that is consistent with their matching percentage of the overall population.

That is the "point" about "social" (which somehow translates to racial) inequality that Pelosi was squawking about in your link.

The best part, the local theater would not charge us for the movie.

602 CanadianBush  Thu, Jan 15, 2009 2:56:57pm

re: 45, 77, 600:

That green glow above the tube isn't the base of the mortar bomb (mortars throw bombs, guns fire shells).

It's actually caused by an internal reflection in the camera lens, of the muzzle itself. If you look at the flash upside down you can see it matches the expected muzzle pattern. It's green because of the high angle of incidence off an antireflection coating. It's inverted because it's bounced off the opposite side of some internal lens. You can see this same effect on video of Shuttle liftoffs where backwards rockets flames can be seen jiggling about in front of the shuttle, as the camera moves to track it.

But you're right though, mortar bombs are slow enough to be photographed and seen by eye, especially from near the tube (or the impact! :-)

The mortar is a 120mm - too big to be an 81mm, has a symmetrical bipod - and is undoubtedly a Finnish Tampella design made under license in Israel.

(former 81mm mortarman)

603 Clubsec  Fri, Jan 16, 2009 12:22:35am

Very good photo. Big tube. I believe it is a 120 as a size comparison of the gunners hands shielding his ears. Nice mortar pit though. Symetric sand bags all interlocked, shaped and groomed. Like high quality brick work, always to be admired by the dicerning eye. Built by folks who give a crap about their workmanship.
