There are reasonable arguments for a death penalty, but one argument against it is that it leads to a system where prosecutors seek to collect "brownie points" for sending the most convicts to death row, they think it looks good on their record.
And if someone is cleared after the fact, that's yesterday's news...

Ice Weasel and I covered the death penalty issue yesterday. The gubner of Illinios halted all executions a while back for that reason. But if you're talking about the DC sniper, well at least he was asked if he had any last words (he didn't). Unlike his victims who got nothing of the sorts.

I am from the 'States. I have just been living here in Old Europe since 1988. I was getting fed up with the place and was ready to leave in 1989, but then suddenly got very interesting around here, and I decided to stick around and see how they turned out.
I am an expatriate, not an ex-patriot. Right now, I live here because it's where my family is, I intend to stick around.

After getting complaints, the state decides a Florida man's license plate is objectionable and yanks it.

But to the state of Florida, the tag is "obscene or objectionable," according to a letter Miles received last month from the Department of Highway Safety and Motor Vehicles. That puts the personalized plate on the department's blacklist, right up there with epithets, expletives and words describing certain body parts.

There is a fine disctinction between religion in general (and its role in America's history) and the state favoring a particular religion or church. I have no great problem with "One Nation Under God" or even "In God We Trust".
The Supreme Court ruled as such over a deptiction of the Ten Commandments at the US Capitaol, which showed them in the context of their role in developing the law in history.
And we cannot ignore or deny the role that Christianity played in our nation's development, but at the saem time, we must continue to stress that freedom of religion and separation of church and state are among the cornerstones of our democracy
The bit with the Muslim woman's picture ID is, in my assessment an example of where the law trumps religious convictions: if she has trouble with it then she has the option of just staying at home.

The reasoning was quite simple: the state's right to be able to identify the license bearer trumped whatever religious right existed to remain covered. Driving is a privilege, not a right, and the state was under no obligation to modify it's requirements when the simple alternative of not driving was an option.
It was also pointed out that in all countries where women are allowed to drive, they are required to carry a license feauring their bare-faced portrait. This included majority Muslim countries like Saudi Arabia. In short, there was no evidence that Islam required such covering under the circumstances in question.
There have been similar skirmishes over Muslim women being required to remove their veils while testifying in court. I don't think any of these have proceeded all the way to trial yet, but it is generally felt that it is the judge's prerogative to have the faces of those giving testimony visible.

Last I heard, the woman involved was griping about it, and it was working it's way through the appeals process, with the initial hearings favoring the judge.

Germany is rather progressive in that it offers state-subidized day care for all children above three, but it is generally only half-day, the notion being that if a mother is going to work, then she should keep it part-time.
And the entire tax, insurance and benefits system is based on the model of one partner working a "career" job and the other (i.e., the mother) staying at home or working only part time.

My best friend comes from a miltiary family also, dad retired as a colonel. My buddy enlisted as an E1 and qualified on his own for just about every specialized combat training you can imagine. He just spent the last few years being an infantry drill sergeant at Benning. Last month his oldest boy followed in his footsteps over his dads suggestion that he join something safer, more educational, and all around cleaner. He's obviously very proud his boy ignored him. I'm betting your dad was too.

NEW YORK, Nov 11 (Reuters) - Russia became the sixth U.N. mission in New York to receive a letter containing white powder, police said on Wednesday after an envelope was found at the diplomatic post on Manhattan's Upper East Side overnight.
The U.N. missions of Austria, France, Britain, Germany and Uzbekistan all received letters containing white powder over the past two days. More than 40 people were decontaminated as a precaution after the letters were found.
The powder in the letters received by the missions of Austria, France and Uzbekistan was identified as flour, a New York Police Department spokesman said. Authorities are still waiting for test results on the powder sent to the missions of Britain, Germany and Russia and investigations are continuing.

Man charged with statutory rape in ‘marriage’ to 14-year-old girl
Vincent Mosby signed a marriage contract and paid a dowry in a religious ceremony in August, police said.
Mosby, 23, of Kansas City didn’t legally wed his 14-year-old bride, however, because Missouri law won’t allow it without a judge’s order. Police said she was pressured into the union because her mother and stepfather thought she was going to be sexually active with a boy her age.
Although the bride’s stepfather arranged the “marriage,” according to court records, other relatives frowned upon the union and told police in late August. The relatives also took the girl to protect her from further sexual abuse, according to court records.
A relative told police that Mosby called and threatened violence if family members didn’t “give me back my wife in 72 hours,” according to court records. Two days later, on Sept. 9, someone fired three shots into the Kansas City home of the girl’s aunt. No one was hit.
...In Islam, boys and girls are considered adults based on when they hit puberty, and people in some parts of the world do marry young, said Mahnaz Shabbir of Stilwell, a past president of the Heartland Muslim Council.
However, she said, Islam also says followers should live by the laws of the land.

Senior Official: More Hasan Ties to People Under Investigation by FBI
Alleged Shooter Had "Unexplained Connections" to Others Besides Jihadist Cleric Awlaki
A senior government official tells ABC News that investigators have found that alleged Fort Hood shooter Nidal Malik Hasan had "more unexplained connections to people being tracked by the FBI" than just radical cleric Anwar al Awlaki. The official declined to name the individuals but Congressional sources said their names and countries of origin were likely to emerge soon.

Texas, an hour before a memorial service for the Fort Hood victims, four FBI agents showed up at the Killeen mosque where Hasan prayed and searched a trash bin outside. The mosque president was clearly upset when he had to return from traveling to the service to sign a document handed to him by agents, apparently authorizing the search.
The FBI would not comment on what the agents were looking for at the mosque a full five days after the shooting, but motivation remains the focus.
"Obviously, the key is did he act alone," former senior FBI official Brad Garrett told ABC News. "And secondarily is, what evidence might potentially be in the dumpsters or at the mosque."
"We're concerned any time a house of worship is searched in this fashion," said Ibrahim Hooper, national communications director for the Council on American-Islamic Relations, a Washington, D.C.-based civil rights group. "And we would follow up to see if there was probable cause for the search and if it was carried out in the appropriate and legal manner."

The other day I was wearing a sweat shirt with a vaguely semi-military-looking motif and a gushy lady at the lunch table thanked me profusely for my service in protecting her and her family. I wasn't in a mood to explain my brief, inglorious six monhs in the peacetime Army Reserve or the 100% civilian provenance of the sweat shirt, so I tried to look heroic and mumbled something to the effect of "You're welcome." Bless her heart, but it was embarrassing. Here's to the real veterans.

On one hand, we do hve to be especially solicitious of religious fredom in our country, but our Constitution overrides any sort of religious convictions.
When the Catholic Church was being reticent about assisting investigations about child abuse allegations among priests, the Attorney General said that they would simply start treating the church as a criminal organization involved in a conspiracy.
And that is the strength of Speraration of Church and State in our country: even if it is a religious organization, if it engaged in illegal activities, then it can be trated as a criminal organization, regardliess of its religious status.

In other cases, federal money that recipients already receive annually - subsidies for affordable housing, for example - was reclassified this year as stimulus spending, and the existing jobs already supported by those programs were credited to stimulus spending. “There were no jobs created. The federal stimulus report for Massachusetts has so many errors, missing data, or estimates instead of actual job counts that it may be impossible to accurately tally how many people have been employed by the massive infusion of federal money. Massachusetts is expected to receive an estimated $1 billion more in stimulus contracts, grants, and loans.

PRINCETON, NJ -- Republicans have moved ahead of Democrats by 48% to 44% among registered voters in the latest update on Gallup's generic congressional ballot for the 2010 House elections, after trailing by six points in July and two points last month.

In the latest poll, independent registered voters favor the Republican candidate by 52% to 30%. A prominent Columbia architecture professor punched a female university employee in the face at a Harlem bar during a heated argument about race relations, cops said yesterday.
Police busted Lionel McIntyre, 59, for assault yesterday after his bruised victim, Camille Davis, filed charges.
McIntyre and Davis, who works as a production manager in the school's theater department, are both regulars at Toast, a popular university bar on Broadway and 125th Street, sources said.
The professor, who is black, had been engaged in a fiery discussion about "white privilege" with Davis, who is white, and another male regular, who is also white, Friday night at 10:30 when fists started flying, patrons said.
McIntyre, who is known as "Mac" at the bar, shoved Davis, and when the other patron and a bar employee tried to break it up, the prof slugged Davis in the face, witnesses said.
"The punch was so loud, the kitchen workers in the back heard it over all the noise," bar back Richie Velez, 28, told The Post. "I was on my way over when he punched Camille and she fell on top of me."
The other patron involved in the dispute said McIntyre then took a swing at him after he yelled, "You don't hit a woman!"
"He knocked the glasses right off my face," said the man, who would only give his first name as "Shannon." "The punch came out of nowhere. Mac was talking to us about white privilege and what I was doing about it -- apparently I wasn't doing enough."

I asked a similar question the other day, on a local community blog, with a lot of progressives on the blog... I asked if Hasan was not military, and if he was subject to the standard public laws, whould hate crimes charges be added to his list of alleged crimes.
Crickets... not one single answer. They didn't want to touch that one. It didn't fit their model.

Muggers Return Wallet After Seeing Army ID
MILWAUKEE — A Milwaukee Army reservist's military identification earned him some street cred Tuesday, when he says four men who mugged him at gunpoint returned his belongings and thanked him for his service after finding the ID.
The 21-year-old University of Wisconsin-Milwaukee student said he was walking home from work about 1:15 a.m. Tuesday when he was pulled into an alley and told to lay face down and with a gun to his neck. Four men took his wallet, $16, keys, his cell phone and even a PowerBar wrapper from his pants pockets, he said.
But the hostile tone quickly changed when one of the robbers, whom the reservist presumed was the leader, saw an Army ID in the wallet. The robber told the others to return the items and they put most of his belongings on the ground next to him, including the wrapper, the reservist said.
"The guy continued to say throughout the situation that he respects what I do and at one point he actually thanked me and he actually apologized," said the reservist, who asked not to be identified Tuesday because the robbers still had his keys.
The reservist said he asked the men, who all had hoods or hats covering their faces, if he could get up and they said he could before starting to walk away.
"The leader of the group actually walked back, gave me a quick fist bump, which was very strange," he said.

Crickets... not one single answer. They didn't want to touch that one. It didn't fit their model.

Woman Discovers Swastikas In Wrapping Paper Pattern
ALTAMONTE, Fla. (NBC) -- A Florida woman says her Christmas wrapping is full of swastikas. Casey Lehman says she bought a roll of wrapping paper at a shopping mall in Altamonte, Florida in October.She said it looked innocent enough until she unrolled it this week and found the paper pattern contained swastikas.
When she showed the paper to her fiance, they agreed that the paper's design was inappropriate.
The mall manager said the wrapping paper at his store is made in China and he buys it from wholesale vendors in New York and Los Angeles.
The manager said he is making sure they no longer sell the paper.

Man, that sounds New England.
Boston it was. A great drink, if a little rough on the nervous system after the second one. Still, quite nice. Bar-keep wrote it down, since it was a little something I'd made up at home once from desperation, and he agreed it had a really nice, "old-time" flavor to it. Being somewhat husky myself, he affixed a suitably insulting name to the drink, and it became, briefly, THE thing to try.

I just found out my car work is going to cost around $1050. I guess that's what you get when you buy used and don't have a warranty. Still beats putting a couple or more thousand down on a new car.

Wounded soldier gives play by play of Fort Hood shooting
KILLEEN - Spc. Logan Burnette met with the media outside Metroplex Hospital Wednesday morning where he recanted the details of the shooting rampage on Fort Hood.
Burnette told the crowd that he did nothing more than any of the other soldiers there. He said he did not want to be called a hero because, "there's soldiers dying in Iraq and Afghanistan...they're the heroes."
Burnette remembers sitting in a room of about 30 chairs in the soldiers' readiness center when "one of the soldiers stood up, shouted 'Allahu Akbar' and opened fire into fellow soldiers"
He says soldiers immediately began fighting back against the gunman, some throwing chairs at him. Burnette was shot in the hip as he attempted to subdue the gunman. "I threw... a folding table at him...," Burnette said, "that's when I was hit in the hip."
The soldier then took cover in a cubical with three other soldiers until they decided to run for cover. "We could hear him on the other side of the building...he was a fast reloader."
Burnette then made his way to the door when he collapsed. "I threw my entire body weight against the door," he said. A fellow soldier then helped him to his feet and out the door.
Spc. Burnette says now he hopes to relax, he asked that phone calls "be less," so he and his family could relax.
Good to see they fought back against that islamic murderer.

The question of the hour (and of the day, week, month, and year to date) is who dropped the ball in the Hasan case. Finger pointing is already in vogue, and the DC 2-step is showing itself to be the top dance move as the FBI wants to blame the Army for dropping the ball, while the Army wants people to know that they were never informed b/c the FBI didn't want the Army to know.
President Obama is right to demand answers, but CYA is the order of business and he's got to get to the bottom of matters.
Why were emails to Awlaki ignored and treated as benign even though Awlaki was known to be an extremist with links to AQ and several of the 9/11 hijackers. The WSJ is also reporting that there are other emails to other extremists that will become known in the next few days and weeks. All this points to a growing mountain of evidence that there was something going on with Hasan, and yet the Army didn't know to even conduct an investigation into one of their own. The JTTF didn't do its job here - particularly in providing information on which members of the task force could use to act on to ferret out possible risks.
At a minimum, the increased scrutiny should have resulted in commanding officers to inquire about Hasan's actions at Walter Reed and whether there were issues with deployment.

I've got a Buddha with a swastika on his forehead, and he don't look like Charles Manson. Hindus, Buddhists, Taoists, Jainists - everybody uses that symbol, and always have.

My sister in law's sister is a Lab Tech at a local hospital. It's her day to work the ER. She's called but is told it is NOT an emergency. So she walks into the room where there is a teenager and her parents, gloves up, and looks at the patient chart before she begins.
The chart reads "Has not spoken to parents for past two days."
WTF? Donna, not wanting to step into the middle of a family problem, draws the blood and goes back to the lab. The blood is normal - a bit agitated, but normal!

The viewpoint I just lilnked to says the opposite, he was reloading like he was on the range. Slowly.
He starts reloading. He’s fiddling with his mags. Weirdly he hasn’t dropped the one that was in his weapon. He’s holding the fresh one and the old one (you do that on the range when time is not of the essence but in combat you would just let the old mag go).
