Anti-Choice Group Center for Medical Progress Begs Supreme Court For Emergency Stay of Discovery - UPDATE: Denied

Desperation
US News • Views: 51,337

The Center for Medical Progress, in what seems like an act of desperation, is begging the Supreme Court to overrule the Ninth Circuit Court and grant an emergency stay of discovery to prevent the National Abortion Federation from learning the names of their co-conspirators.

Here’s their filing:

Nothing would make my holiday season sweeter than for the Supreme Court to tell these losers “NOPE.”

It looks like Kennedy is the justice that will decide whether or not to grant an emergency stay of discovery.

Kennedy is unreliable on choice, so it could go either way.

I guess it all depends on what Roger Ailes wants. Personally I doubt it very much.

Michele Fiore thinks cancer is a fungus:

If you have cancer, which I believe is a fungus, and we can put a pic line into your body and we’re flushing with, say, salt water, sodium cardonate [sic-it’s “bicarbonate”] through that line and flushing out the fungus. These are some procedures that are not FDA-approved in America that are very inexpensive, cost-effective.

Reposting

From the filing:

CMP conducted a three-year undercover investigation
of tissue-procurement practices in the late-term abortion industry.

That’s a fact error.

Meanwhile, back on the campaign trail,

Trump picked stock fraud felon as senior adviser

A man he named as a senior business adviser in 2010 was convicted in a Mafia-linked stock fraud scheme

Courts record show the presidential candidate knew of Felix Sater’s background

Trump said that he recalled only bare details of Sater

Damn media is being unfair to The Trump again.

Mkay first thing that stands out is CMP keeps referring to their people as “supporters” who are entitled to confidentiality, as if they’re just donors or volunteers, whereas NAF is trying to find out who else might be involved in, you know… committing an actual crime.

Second… Citing an appeal that was certiorari dismissed? Doesn’t smell like good lawyerin’.. Edit: fixed a word… Never mind, if they’re citing the reason for dismissal as their support, I guess it makes sense. I should read slower!

The key issue here is the disclosure of the identities of CMP’s supporters.

Jeb! just doesn’t get it:

When we get closer to this…the decision will be made by voters really on the following things: Do you have ideas that will make my life better? Do you have the fortitude, the leadership skills to make it happen?…Do you care about me?” he said in Iowa “Do you care about the condition that I’m in? And, look, my life experience is 32 years in business, eight years as a reform minded governor. I think overtime that, that kind of skillset that I’ve acquired through my life experience will be helpful to me for sure.

Republican primary voters don’t really seem to care about that kind of stuff any more. They want a license to hate, and that is what Trump is giving them.

34

The discovery order violates Petitioners’ First Amendment rights to freedom of association by requiring Petitioner The Center for Medical Progress (“CMP”) to disclose the confidential identities of its supporters, thereby putting those supporters at serious risk of retaliation for backing CMP.

yeah, let us know when somebody like Robert Dear shows up at your place of business.

Martin Shkreli really needs to come down with some painful and debilitating condition where the only supply of effective medicine for keeping him alive is held by his political enemies.

Let’s see how much he likes his precious “capitalist rules” then. If I were pricing his medication, it would be 100% of his wealth for the first day’s dose, then he could die the day after.

So, someone questions that a significant percentage of guns recovered in crimes in NYC comes from states with lax gun laws. They think that there’s somewhere out there that can actually counter the number of guns recovered and the source of said guns.

And for the record, it’s 2/3 of the guns recovered that come from lax gun states - VA, AL, GA, SC and PA. So, it’s a bit more than a significant percentage.

Since they can’t define a thing, they can’t fight a thing - unless radical Islam is code for plain old Islam, in which case they’re talking clash of civilizations and taking on a billion people.

Personally as a gun owner & shooter, I’d LIKE to know more about these problems. Data is good. Where do Joe Wifebeater and Jimmy Streetpunk really get all their guns? I remember watching an episode of COPS in NYC once, where they took a big, shiny .357 magnum off of a kid on the street, and the gun had markings on it from a police department in California. Internal arms smuggling is a problem. It should be studied.

And if all the pro-gun arguments are true, then they should stand up to scrutiny, right?

re: #158 EPR-radar

It had to be quick because CMP is under orders to provide discovery today.

I’m re-reading the appeal and it seems their Strateegery hinged on directing the Court’s attention away from the facts that they’re accused of something a bit more serious than just having a controversial opinion, and that wrongdoing on their part may still be ongoing.

Por ejemplo:

21. Moreover, NAF cannot satisfy the “exacting scrutiny” of the “more demanding heightened relevance standard” (id. at 1164), or even show any legitimate need for the disclosures it demands. The requested identities have no relevance to whether NAF can obtain a preliminary injunction against Petitioners, the sole purpose for which the district court authorized discovery. See D.Ct. Doc.27; see also D.Ct. Doc. 5. The identities also are not relevant to the legal arguments at the heart of the disputes over NAF’s motion for preliminary injunction. And NAF has not articulated any plausible theory for injunctive relief against CMP’s supporters, who indisputably did not execute any confidentiality agreements with NAF, did not conduct any undercover recordings at issue in this case, and received only a general and limited disclosure about the nature of the project. Thus, NAF plainly has failed to satisfy its burden under Perry and is not entitled to the
unredacted documents that the district court ordered CMP to produce.

Unmitigated gall is bolded. They have a “supporter” who helped them violate the TRO, for fuck’s sake.

The problem is that the crowd who says gun control won’t totally end gun crime think their own solutions, i.e. just give more people guns and do away with “gun free zones,” will lead to the perfect situation. And if they don’t? “Don’t let the perfect be the enemy of the good.”

Ugh, no thanks.

I pieced together a really nice clone of an East German MPi AK-74N a few years ago. The genuine Commie Bakelite purple furniture and orange mags were kind of cool, and it was fun as hell to shoot, but the sights sucked. People shoot AK’s because they can’t afford anything better.

I actually sold it to a cop in California. Gun laws in California aren’t just restrictive, they’re also a convoluted and selectively applied mess. As near as I could tell, basically if you ever worked in law enforcement, you can do whatever the fuck you want. Somebody can ship a rifle to your door if you like. I still went the safe route and found independent proof that the buyer was a policeman, and I still had it sent to his nearest FFL to be on the safe side.

The problem isn’t just what the laws say, it’s where and how they’re applied.

Then, when I checked LGF again, I found I was right. Double hah!

But, we won’t get to see the immediate results of the discovery moving ahead, because the names demanded will be for ATTORNEYS EYES ONLY. The 9th Circuit noted this more private way of divulging the demanded information as one reason to deny CMP’s appeal. The denial’s reasoning was sound, so there was no reason for SCOTUS to bother with it.

What I think we need is for news divisions to be separated from the profit/entertainment segments of networks, as they used to be. All Trump does is tap one particular demographic and repeat their pet hates back at them. It’s actually really easy.

“Mexicans? They come in, I’ll send them out! Starting with that one in the corner. Go on, GET OUT, Mexican! Hur hur! Now we’ll build a wall!”
“We all know those Mooslims are trouble and that they bomb us! So let’s cause them trouble, and bomb them!”
“We know that black people are loud! I’ll make them shut up! Go on there, kick that loud black guy in the crowd, he deserves it!”
“That thing you hate? I hate it too, and I’ll make your revenge fantasy happen!”

Do that enough, and people develop a devotion. The WANT to believe. My own father was somehow convinced that Trump had been in the USMC, not because of any facts, but because my dad associates the Marines with great things. He wanted Trump to be a Marine, so he was, until my mother set him straight.

Hate is a religion all its own. Mr. H with the funny mustache understood this well.

I don’t really do peat, except for Laphroaig which is freaking amazing. I prefer younger, hotter flavors. Appearing on my regular shelf, in alphabetical order:

Auchentoshan 12 - Xmas in a bottle!
Glendronach 12 - Fruity (a replacement for the Macallan Sherry Oak 12 which I’ve heard has been discontinued)
Laphroaig 10 - Undisputed king of campfire-in-a-bottle flavor :D
Oban 14 - Nice peppery hot mustard
Talisker 10 - Just an all-around great IMO

There’s also Old Pulteney 12 which I’m not sure I’ll keep in stock. I really like how it turns oceanic with a drop of water, but it doesn’t stand out much otherwise.

On the cheap side, I keep Jameson and Johnny Walker Black handy. I refer to JWB as “Thinkin’ fluid” due to my habit of having some while writing for enjoyment. ;) And Jameson is my go-to for making Irish Coffee. Cheap, plentiful, tasty.

However, they are also under order to produce the required documents today, so they probably don’t get another chance for a SCOTUS intervention at this time.

Instead they either comply with discovery, or piss off a Federal judge by not complying. Pass the popcorn.

re: #255 wheat-dogghazi-mailgate

It comes as no surprise that Chuck has an “analysis” of the California shooting, but nothing similar for the Colorado Springs shooting, other than to blame Planned Parenthood for it.

Chuck just happens to be parroting the rest of the right wing when it comes to the blame game.

There have been about a dozen cases of rightwingers on killing sprees during the past several months, and in EVERY case they have blamed the victims of those acts of violence, whether it be a Planned Parenthood clinic, a Black Lives Matter march, or a church in South Carolina. All of this being egged on by what can only be described as neo-Fascists bent on one-upmanship on the Republican campaign trail.

After the events in San Bernardino this week, from what I am witnessing, they are in a murderous froth, and I do not doubt for one moment that before the year is out there is going to be a revenge-inspired attack - one that will either target a large number of people, or an attempt against a political leader who they perceive as their enemy. I can only hope that they will be stopped before they can carry it out.

I’m pretty much convinced that a Hillary victory will trigger something like a Civil War Lite. There will be towns that go Sovereign Citizen, armed posses, probably shootouts with militia types. Multiple Greenwood-style “riots” (read: attacks on non-white neighborhoods). Most of the GOP front-runners will be in there looking to get famous. I expect a couple of mini-religious kingdoms to be declared in the Confederacy too.

And of course Texas will probably try to split off entirely. I don’t want to be here for that because after Abbot takes care of the brown, his kind of people will be after the unbelievers and the Democrats next. It’s a long-ass drive to the borders and I’d rather not die out here.

I think fertilizer has been regulated since the OKC attack. The point I’m going to go with is that we did implement regulations on automobiles and planes at a time when accidents from those two were common. And while we obviously did not eradicate car crashes and plane crashes, we have cut down on them dramatically. The problem really is the gun lobby having politicians by the balls and intimidating anyone who doesn’t share their view. I’m sick of anyone sensible on gun issues being made out to be a “gun grabber” or some stupid slur like that from some asshole who has never seen the horrible effects of gun violence on their community.

Just finished a book called _Fields of Blood: Religion and the History of Violence _ by Karen Armstrong.

The linked review covers it better than I can.
NY Times Review

My one additional observation is that the book points out that many of the religion-based reactions against states or their religion have had a basis that the religion or state in question was ignoring the tenets that the religion is heavily based upon caring and supporting others, especially the poor and disadvantaged. Reform movements start in order to take things back to basics - and then they seem to get derailed.

There is also a sort of base point that civilization developing (agrarian societies) are dependent on the creation of an underclass that is exploited to produce the surpluses that allow for the creation of the artisan, warrior, and aristo (patron) classes. And that this is a sort of requirement as well. True, but I don’t know what sort of alternative there ever might have been.

I had my weekly gin and tonic early in the evening. Might need some more soon.

No more for me tonight since I did the big glass of the wine (sadface) but I am thinking a good solid one tomorrow with the Fever-tree tonic. Need to decide on the gin though.

After confirming that the San Bernardino was an act of terrorism, the ‘debate’ should have moved to how many tons of bombs we’re going to have our B-52s drop on Raqqa and how many Russian bombers can we get Putin send for a second wave. Pleading to disarm one’s own citizens after being attacked by the enemy is an act of insanity. the question sohlu d be instead about what sort of weapons we’re going to use on the enemy.

Are they magazines or clips?

You do realize that the Syed Farook was a US citizen, right? How do you think bombing the shit out of a city in Syria is going to do anything to stop people like this? Has it occurred to you that you’re reacting exactly like the radical Islamists want you to react?

Latest reports are now saying Dae’sh are now using child soldiers on the battlefield-that’s how bad things have gotten for them. Taking back Raq’qa is best left to Islamic forces and not by us, Russia, France, or Germany.

The FBI is still investigating this case-even though they’re labeling it terrorism now, that could change as the investigation moves forward-so don’t be so ready to slam the US’s Armed forces dick on the table just because we can-If Reagan were alive today he wouldn’t even made it past the first debate.

The GOP must be stopped any any and all means necessary.

It has, but I believe that they’ve overstated their resilience and underestimate how hard we can hit them.

And I’m not planning a carpet bombing raid either. But I am thinking of raids designed to wreck every governmental building in the city, coupled with raids on power stations, fuel storage, and any bridges that are in the area. I want Raqqa to be unable to function as a city.

Fuck your cowardice.

What’s sad is your inability to see that your post wasnt just inflammatory and what the issue is that people have with your concept. Unfortunately, it’s across the board.

No one can change how you think. I find your thinking really sad. You want to kill random people. You think people don’t deserve to be able to buy health insurance. You see nothing problematic in allowing every Tom, Dick and Harry to buy as many guns as desired with no conditions. Killers are bad when they’re Muslim but Ok when they attack women!m’s health care centers.

Your thinking bums me out. It’s sad my fellow citizens are so blinded by hatred.

This is exactly why people like you shouldn’t be in charge of anything. And probably shouldn’t own firearms either. You’ve got the wrong temperament to deal with a crisis. Your response is emotional, retributive, over the top, and jingoistic. You simply want to kill because you’re pissed off, not because you have a coherent strategy in mind. Your fixation on weaponry is now predictable and nearly pathological. Not a pretty combination.

re: #258 goddamnedfrank

Fortunately it’s predominately the part that is getting old and dying. I’m not too worried, they’re still losing the demographic war, being replaced by younger generations less prone to revanchist white angst.

I remember Digby pointing out a while ago that the demographic shift looked like it was also in the Democrats favor back in the 1970s. Lo and behold we had a Republican in the White House throughout the 1980s and the Republicans took back Congress in the early to mid 1990s.

I think many liberals are lulling themselves into a false sense of security with the demographic shift. The Right Wing have made sure to destroy education specifically knowledge about civics, and have taken over our media. We now have right wing propaganda 24/7 on cable news, radio, and the internet. They have also taken over the political process making sure both parties are behold to the wealthy elites and corporations. They control 60% of the federal judges and 70% of the state governments. When all else false they still have gerrymandering, voter suppression and elections fraud as fail safe. All of those factors combined with the mainstreaming of radical evangelical Christianity with its megachurches, homeschooling and reality TV stars are going to counter-act the demographic shift we have in our favor. If current economic conditions continue we will have future generations as wage slaves unable to really focus on anything but survival.

I hate sounding doom and gloom, but it seems to me liberals are just passively waiting around for the demographic shifts instead of laying down work or actually having a plan that could capitalize on the demographic shift like the conservatives did back in the 1970s.

The average conservative may be a moron, but their leadership knows how to do long term strategic planning. While liberals are debating which candidate they should support for the presidency, some even concluding they won’t vote in the general unless their candidate wins and staying home during the mid-terms, conservatives are still going quietly go about their business. The GOP primary is a complete side show designed to distract. The GOP continue to take over school boards, the judiciary, state governments, defund the government with tax cuts and destroy regulatory agencies and laws. Even if we manage to elect more progressives they are still tied too conservative policies because tax cuts and deregulation have screwed up the normal way government is suppose to function in the long term.

re: #330 Feline Fearless Leader

Thanks. I’m going to get this soon based on your post and Fallows’ review. I learned a lot from “History of God.”
