Obama to Nominate Elena Kagan to High Court

NBC News is reporting that, as expected, President Obama is going to nominate U.S. Solicitor General Elena Kagan to serve as an associate justice on the U.S. Supreme Court — an appointment that is oddly drawing more ire from the left than from the right, because even though Kagan’s a pretty solid liberal in most ways, the left doesn’t like her views on the treatment of terrorist detainees.

The rage of the GOP base does not allow for stepping back. Their ODS tends to impel them to Rush forward to confront Obama like a band of Knights Templar. Obama, by contrast, can use a nomination like the wily Sala-al-Din (Saladin); keeping his distance and letting their fury lead them to fight him on ground of his choosing.

The Times Square bomb failed. What will we do when the next bomb works?

On Christmas Day, a 23-year-old Nigerian engineering student allegedly tried to destroy an airplane flying into Detroit. One week ago, an American citizen of Pakistani origin allegedly attempted to detonate a car bomb in New York’s Times Square. Neither effort succeeded — not because U.S. authorities intercepted the attackers, but because the bombmaking skills of the wannabe terrorists were lacking.

In both instances, much of the subsequent debate has centered on how the attacks were able to get as far as they did. The unfortunate fact is that such cases represent a kind of terrorism that is virtually impossible to disrupt. These attempts will continue, and from time to time one of them will succeed, with many dead and injured. The more relevant question, therefore, is: How will we respond when that car bomb does go off?

The reason such attacks are hard to stop is rooted in the identity of the attackers. They often seem to be successful or well-educated members of society, uninvolved in any form of radicalism. But then, the drip-drip of terrorist propaganda — either on the Internet or circulated through friends — has its effect. They quietly make contact with radical groups overseas, perhaps even traveling abroad for training and indoctrination. They throw away the life they have made in the West and agree to stage an attack. Faisal Shahzad, the alleged Times Square terrorist, fits that profile, as have others in the United States and Europe.

In a not completely unrelated topic:

Grayson’s challenger, Rand Paul, the son of former presidential candidate Ron Paul of Texas, has the backing of tea party activists, as well as former Alaska Gov. Sarah Palin, former GOP presidential candidate Steve Forbes and – after a switch last week – evangelical leader James Dobson.

Seems to me the RR is wanting hard to hitch their wagons to horses that look like winners. Dobson’s excuse for withdrawing his previous endorsement of Paul’s opponent is that the GOP leaders lied to him about Paul.

That is about as slippery of an excuse one can come up with.

The RR has fantasized about a Christian Supreme Court for years, as if Roe v. Wade is just sitting there waiting to be overturned. It’s been a no-win situation for them in the past 30 years of trying, and I doubt that they’ll be able to get what they want in 2010, or 2012.

In the mean time, along with the Libertarian Fundamentalists, Dobson et. al. has succeeded in winnowing down the GOP to such a small base that it would be foolish for any non-JBS, non-RR politician to associate with the GOP even if that hopeful leader might otherwise find herself in sympathy with some traditional Republican ideas.

I like 20 years. The whole point of a life-long seat on the court is that one doesn’t have to worry about getting re-elected. You know, they can avoid making decisions to keep voters/congress happy.

But it’s outdated. Back when they cam up with this idea, people rarely lived past their 60’s. Nowadays, you can have someone on the court for five decades.

So, 20 years and you can’t be reappointed. You are there long enough to make an impact, and since you can’t be reappointed, there is no desire to make anyone happy.

I’ve read some of what my liberal friends are saying about Dean Kagan, and how she isn’t nearly as progressive as they would like. They seem disappointed that President Obama is proposing a moderate liberal rather than someone from the far left.

It’s as if everyone has bought into the idea that President Obama is actually the über-liberal that the McCain campaign and the Republicans tried to make him out to be during the election.

Some of these folks wouldn’t believe a Republican if he told them that water was wet. But they believed the spin about (then) Candidate Obama, and are angry that he is exactly what he claimed to be.

So apparently one of the voting machines at the nearby precincts broke down. While it’s off at the Election Comission Headquarters for repairs, their line got rerouted to MY precinct.

Somehow, I think Obama knows more about where he wants the court to go than you do.

A President should be criticized, we shouldn’t just assume that it’s all good, he must know what he’s doing.

I’m not saying I will not vote for Obama, of course. I just don’t get why he didn’t choose someone with a history closer to Stevens’ profile. Was that, in your opinion, too much to ask? It would have left the SC basically as it is today.

But no one follows it, anyway, and it’s very rare that the SEC comes down on retail traders for violating it.

OT: I got my Census thing about a month ago. Worried that I might be sent to the FEMA camps if I didn’t fill it out (or was it that I would be sent to the FEMA camp if I did fill it out?) I sent it back pretty quickly.

I got two additional mailers politely asking that I fell out my Census form. Since I already did, I ignored them.

Friday afternoon, I came home from work and saw a slip on my door saying that a Census worker came to my apartment because I didn’t fill it out. I called the guy and he said “our records don’t reflect that.”

I have no beef with the Census, but I’m not surprised a government run program is making such simple mistakes.

Speaking of heretics, NatGeo has “The Witch Hunter’s Bible” on. Its a good show to remind you of how someone with bad convictions can do great harm and how hysteria spreads. It’s good to see such things to be reminded to stay calm in the crisis and think objectively.

Finally, he wrote the decision in Chevron v. Natural Resources Defense Council, siding with Chevron and the Reagan EPA and overturning the lower court ruling. Not liberal. Not at all. (Although it was probably a well reasoned decision, all things considered.)

If you want to dispute the widely held view that Stevens is the most liberal justice (a minority would put him in 2nd place behind Ginsberg), go right ahead. No justice’s voting record is, of course, ideologically completely orthodox - that’s why people take the entire record into account instead of cherry-picking a few cases.

And the Bush v. Gore insinuation is just absurd. Do you have any idea of the number of 5-4 rulings made by the SC? Do you dispute that they mostly favored the conservative position, with Kennedy occasionally siding with the liberal wing?

Belief systems by definition cloud your judgment sometimes. I was born Methodist, became a rabid evangelical, educated myself into being agnostic, leaped into being a rabid atheist, got burned out on that and had a kinda crisis of the soul.

I decided to be a Christian again. (but in my own “reformationist” kinda way). So you can say that “I was for it, before I was against it, before I was for it again”…

/It does help a lot when debating the poorly informed from either side though, I spent years verbally assaulting people online from both sides of the argument. :(

The left needs to calm down. When campaigning Obama made it quite clear that he wanted to be everyone’s president, not just liberals’. Despite vicious rebukes from the right, he has tried to live up to this. He deserves credit.

Maybe Limbaugh, Hannity, et al. will respond reasonably tomorrow and say that Kagan is a choice they can live with. But I doubt it, as their “loyal opposition” thus far has been reflexive and mindless.

When has the Left ever calmed down? They, like their partisan counterparts on the Right, live to complain, bitch, moan, and rag. Nothing is ever enough their way, nothing is good enough, no one is ever ideologically pure enough, the idea of gradual progress is anathema, every one of theirs who gets into power “sells out”, and pragmatism is verboten.

I would listen to Limbaugh and watch Hannity today to see if they’d “respond reasonably”, but (a) I don’t think they know how, (b) “reasonable” doesn’t get good ratings or sell crappy books, and (c) it would mean I’d have to listen to Limbaugh and/or watch Hannity.

I know little about Kagan (but intend to find out), but the idea that both the left and right wings may loathe her is a good sign.

Side note - Those maternal mortality numbers are for the United States, from a 2007 CDC report, and yes they are appalling. Canada’s rate is 8 per 100,000, while Japan manages to reduce that to 6.

On the other hand, I’ve actually bothered to read Roe v. Wade (it’s not that long and is written in plain English), and as such, realize that most of the folks (on both sides) arguing about it haven’t.

Once that broke, if you go to my twitter page, you’ll see that I called for 1129 to be the next level - we closed on Thursday @ 1128.83. You don’t get much closer than that.

Maybe it’s just me, but I think having experience on the bench would be a requirement for being on the court.
