Florida GOP: Still Living in the 19th Century?

Florida Republicans take their cultural crusades very seriously. Like Republicans everywhere they’re opposed to gay marriage, but the Floridian GOP takes it one step farther into crazyland; they’re opposed to repealing a 19th century law that criminalizes unmarried “cohabitation.”

“Cohabitation” of unmarried people is currently a second-degree misdemeanor, punishable by $500 or up to 60 days in jail. The same penalty applies to cheating husbands and wives — though only to opposite-sex couples.

The laws have been on the books since the late 1800s, but are rarely enforced. …

Now, Rep. Ritch Workman, R-Melbourne, is on a mission to repeal the statutes penalizing adultery and cohabitation, as well as other laws he finds outdated, like a requirement that all bicycle riders keep one hand on the handle bars. He filed the adultery bill last week — it’s HB 4021 — though he hasn’t returned phone calls about it for the past two days. …
Nobody else much wants to talk about it either.

Asked how Gov. Rick Scott felt about the measure, spokeswoman Amy Graham replied simply, “This isn’t an issue the governor is focused on.”

The bill has no Senate counterpart. And given the almost-certain opposition of social conservatives who lobby hard on “family values” issues, it’ll face tough sledding in an election year.

Consider the response of State Rep. Dennis Baxley, R-Ocala, who previously headed the Florida chapter of the Christian Coalition: “I’m not ready to give up on monogamy and a cultural statement that marriage still matters,” he said.

Unmarried cohabitation:
Six states continue to make it a crime for an unmarried man and a woman to cohabit together: Florida, Michigan, Mississippi, North Carolina, North Dakota, Virginia and West Virginia fall into this category. Arizona and New Mexico decriminalized unmarried cohabitation in 2001. North Dakota repealed its law in 2007. The validity of the North Carolina law is questionable due to a trial court ruling in 2006 declaring it unconstitutional.

Fornication:
Seven states and the District of Columbia make it a crime for a man and a woman to engage in consensual intercourse in private: Idaho, Massachusetts, Minnesota, South Carolina, Utah, Virginia, West Virginia, and D.C. fall into this category.

Gov. Chris Christie signed legislation last week that repeals outdated and obsolete laws, including two that embodied sexist attitudes toward women, report NJ.com and the New Jersey Law Journal.

One law provided that a wife forfeits her marital property rights if she is unfaithful. In the words of the statute, a wife gives up rights to “jointure or dower” if she has consented to “being ravished”—unless the husband voluntarily reconciles and permits his wife to live with him.

The other law gave a man arrested for raping or having sex with an unmarried woman the right to an immediate marriage license, provided the would-be husband consents. The law waived the traditional 72-hour waiting period.

Thing is, I doubt there’s any more rush to see this law enforced than there was before it was brought up. Hell, I doubt that any of those objecting to seeing it done away with were even aware it was on the books before this bill.

As noted above, there’s a slew of pointless and outdated laws still on the books across the country. Why do so many remain? Because people either don’t know about them or see absolutely no reason why they’d waste the time to do away with them.

Friend of mine comes from an old Utah Mormon family. Her great-great-etc.-grandfather went to prison for having three wives. I bring the up, because apparently they referred to this as ‘doing time for your cohabs’.

(I wish she was one of these people who wants to write a sprawling epic novel about family history, because frankly, this many-times grandfather had a fascinating life. English born, came out to Utah as a young convert, along with his first wife. Interesting man.)

To be honest, I can’t get too upset about this. It’s an archaic law on the books, and sure, someday those should be cleaned up. But it’s not enforced. Should it be removed? Absolutely. Laws that aren’t enforced are embarrassments to the legal system. But I also can’t get too angry when politicians, in this soundbite-driven era, don’t want to take an action that gives opponents an easy attack - nobody wants to be the guy that ‘legalised vice’, regardless of the actual facts of the matter.

It doesn’t sound like anyone’s being harmed by this archaic law. If they were, not taking action would be another thing entirely.

This is one of many of the dumb laws on the books in FL, and now we know that even dumb laws like this still have their supporters who keep them on the books.

Among the FL whoppers:
800.02 Unnatural and lascivious act.

A person who commits any unnatural and lascivious act with another person commits a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083. A mother’s breastfeeding of her baby does not under any circumstance violate this section.

Similarly, here’s the text of the law in question:

798.02 Lewd and lascivious behavior.

If any man and woman, not being married to each other, lewdly and lasciviously associate and cohabit together, or if any man or woman, married or unmarried, engages in open and gross lewdness and lascivious behavior, they shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

As if there were not already obvious connections to same sex marriage prohibition, another “on the books but (supposedly) not enforced” anti-miscegenation law from 1913 came oozing out of the woodwork in MA when same sex marriage was legalized.

Wasn’t repealed until 3 years ago.

Yeah, I can commiserate. Both of my parents have been sucked in by Fox, and if I even try to refute any of it the yelling match begins! Any my folks haven’t yelled at me like that since I was 18! It was quite a shock for me to see my normally sensible parents suddenly start yelling at me over the B.S. being spewed on a bogus news channel! Now I absolutely refuse to discuss anything with them that they heard on Fox News. *face palm, sigh*

What I’ve noticed is that they tend to leave Fox News on all the time, even when they’re not home. It’s like they’re trying to brainwash the furniture while they’re out.

Iran, interestingly enough, is OK with gender reassignment. Homosexuality is a criminal offense, but sex changes they appear to be able to handle.

Also, there was a piece in the Daily Fail about a guy who became a woman, decided it wasn’t quite working, and became a guy again. He is now engaged. All I could think of was the interview I once read with a woman who came out as a lesbian after divorcing her husband of many years. Her ex wished her well and told her he hoped women worked out for her, ‘because you’re running out of options’.

Gender and sexuality is one of those things that would be funnier if people were not made to suffer quite so much over it.

The Chaz Bono thing I liked was that April over at Regretsy went to a Halloween party with her husband, she dressed as Chastity, and he as Chaz. Then someone told them they were being insensitive, and she felt bad, but I thought it was clever.

After watching the CNN video shouldn’t the headline read “Florida GOP fights to decriminalize ‘cohabitation’”? When people do the right/smart thing they should get credit for it.
