AP sources: Pentagon extending benefits for gays

The military is poised to extend some benefits to the same-sex partners of service members, U.S. officials said Tuesday, about 16 months after the Pentagon repealed its ban on openly gay service.

Defense Secretary Leon Panetta has not made a final decision on which benefits will be included, the officials said, but the Pentagon is likely to allow same-sex partners to have access to the on-base commissary and other military subsidized stores, as well as some health and welfare programs.

Panetta must walk a fine, legal line. While there has been increased pressure on the Pentagon to extend some benefits to same-sex partners, defense officials must be careful not to violate the 1996 Defense of Marriage Act, or DOMA. The federal law forbids the federal government from recognizing any marriage other than those between a man and a woman.

All the more reason DOMA needs to be tossed.

We are home from St. Louis, it was snowing when we got closer to Chicagloland. The dogs are home from overnight camp. While walking into the doctor’s office this am, I got a call from the nurse where my Mom lives. I couldn’t talk and cut her off. I called back and found they took her to the hospital on a non-emergency basis for an evaluation (she was dizzy and may have lost consciousness).

Everyone I’ve talked to is saying she is very forgetful, which is a new thing. Now I have to figure-out if I have to move her to an assisted living facility or keep going as we are with additional nursing check-ins.

I’m dazed and confused.

It’s probably because I am who I am and spent so much time in the Montessori world that I’ve never met a homeschooler who did it because of religious reasons. Usually because they had a child whom the local school district couldn’t properly education and they couldn’t afford or find a private school that could.

My one friend refused to join a homeschool group because they all seemed to have “rules” of some sort or another she couldn’t agree with. One did have a “I will not say the word Evolution around my children” pledge that had to be signed by both parents. HA!

Reminds me of a long ago conversation I had with my grandmother (Missouri Synod Lutheran) when I was in 4th grade. Somehow we got onto the subject of evolution, and I was a science-geeky kid without an ounce of diplomacy.

As I recall, I was a bit bemused by the whole conversation, since I couldn’t imagine anyone taking such fabulous tales seriously. My parent were appalled when they heard the story (by my lack of diplomacy more than anything else).

I agree that the drones aren’t going to be flying like mayflies in the US, but the idea that in a basically perpetual war, enemies of the state can be put onto a kill list without judicial oversight is a problem.

That poses problems under the Confrontation Clause in the 5th Amendment, which the current Supreme Court tends to take fairly literally, the dominant view on the Court on the matter being Mr. Justice Scalia.

Yeah. It’s a minority opinion. Most Americans are in the center and realize that Anwar al-Awlaki had it coming. He had a chance to turn himself in. I don’t think people understand the gravity of the threat. Would these same people have been screaming had OBL been assassinated?

I’ve basically been assuming ever since I heard the news that OBL was assassinated. I have no problem at all with that state of affairs.

That argument can be made, but the judges needed to oversee such a trial are bound by Supreme Court jurisprudence.

There is a difference between sending a terrorist suspect a helpful note saying “We’ve put you on the list, if you use your cell phone you’ll die.” and setting forth the general policies under which people can be put on the kill list.

Just because I tend to trust the judgment of the administration I just re-elected, doesn’t mean this is an acceptable precedent. Some day the Ashcrofts and Cheneys will be back.

From the DOJ memo, it appears that the three elements needed are 1) a high level US official determines that the target poses an imminent threat, 2) capture is infeasible, and 3) operation conforms to applicable laws of war.

To put it crudely, if a high level US official decides “the bastard had it coming”, the operation can proceed, so I don’t really see a straw man here.

Since there is no apparent non-executive oversight, this is unsatisfactory on its face (see e.g., Star Chamber in England). This cannot reasonably be viewed as being due process of law.

Agreed. I think it would be best to get the judiciary involved somehow, despite the difficulties of trial in absentia. It is not helpful for the issue of due process to become a political football, especially with the level of polarization we presently have.

The last thing we need is for paranoids on both extremes of the spectrum to have their ravings about US assassinations and lawless behavior supported in part by real due process/civil liberties concerns.

That’s an interesting point. The legal history of piracy is also a possible source of inspiration —- many of the issues there were similar, such as pirates being surreptitiously backed by nation-states, being able to disguise themselves as honest shipping, etc.
