Some Words on the Sentencing of Barrett Brown

Barrett Brown, who occasionally posted in our LGF Pages section a few years ago, was sentenced today to 63 months in prison for transmitting threats, being an accessory to hacking charges, and interfering with a search warrant.

There’s already an outcry against this from the libertarian “hacktivist” community, who are trying to paint Brown as a hero of free speech, unfairly imprisoned by the government.

I knew Barrett Brown through phone conversations and email before he got involved with the hacking of Stratfor, and for a while I thought of him as a friend — but man, was I ever wrong.

Long story short, some of the things he posted at LGF were criticized by our commenters and Barrett went absolutely nuts about it, in a classic ultra-narcissist reaction. He blamed me for the criticism (ironically, one of the comments he was most upset about said he was risking getting in trouble with the FBI), and began a secret campaign to hack Little Green Footballs (causing a DDoS attack at one point) and poison my reputation by revealing private emails between him and me to none other than far right anti-Islam blogger Pamela Geller.

For the record, the emails he outed to Pamela Geller were asking him for the IP address of a commenter at a site for which he wrote an article; that commenter is an obsessed right wing loon who’s been stalking me all over the Internet for many years. It wasn’t about some random person who just criticized me. And to make things even worse, Brown subsequently went to the website of this crazed stalker and revealed more of my emails to them. He basically went on a crusade to assassinate my reputation, and used some of the worst people on the Internet to do it.

Barrett Brown is no hero of free speech. He’s a vindictive, vengeful thug.

I don’t wish ill on Brown, despite the horrible shit he pulled on me. But it makes me sick to see him praised as a free speech icon, when he plotted to out my private information and hack my website. That’s the real Barrett Brown, not the glamorized image his followers are trying to push out there.

I liked Barret a lot at first. Didn’t always agree but he had a way with words. Man though did he ever let Killgore push his buttons. Rarely have I seen someone fly so far off the handle over some petty bullshit and ridiculous needling.

He also got himself tossed off of League of Ordinary Gentlemen by revealing private information about someone who commented on one of his stories.

In the end he was amazingly insecure for someone with such an undeniable talent for writing.

He was talented, but had emotional problems either leading to or caused by the opiate addiction. That was never going to turn out well.

“This breaks down to uploading YouTube videos that contained unfortunate statements, efforts to redact sensitive e-mails that had been procured by hackers, and hiding laptops in a kitchen cabinet.”

Clearly, all the Gamergate folks need to do in order to get the free speech advocates on their side is claim that the rape and death threats are just unfortunate statements, now.

If ‘freedom’ is an excuse for bad behaviour what makes it different from any other ideology? Freedom should include a system of ethics and people like Brown don’t seem to care much for ethics.

The trial was poised to become an important First Amendment test case until those charges were dropped in 2013, leaving Brown to face just two charges for accessory after the fact and for obstructing the execution of a search warrant. Brown was also facing charges in a separate case related to threats he made against an FBI agent in a YouTube video. In the video titled “Why I’m Going to Destroy FBI Agent Robert Smith Part Three: Revenge of the Lithe,” Brown threatened to “dox” FBI Agent Robert Smith by posting his address and other details online. Brown was charged with making internet threats, conspiracy to make publicly available restricted personal information of a federal employee and retaliation against a federal law enforcement officer. He pleaded guilty to making the internet threat. That case was combined with the Stratfor case for purposes of sentencing.

Under the accessory-after-the-fact charges in the Stratfor case, authorities say Brown tried to help the Stratfor hacker avoid apprehension by creating confusion about his identity “in a manner that diverted attention away from the hacker,” according to court documents. This included communicating with Stratfor employees after the hack in a way that authorities say drew attention away from the hacker. The hacker is not named in court documents filed in Brown’s case, but Anonymous hacktivist Jeremy Hammond was sentenced in 2013 to 10 years in prison over the Stratfor hack.

The obstruction charge relates to an attempt by Brown and his mother to hide a laptop from authorities during a search of her home in March 2012. Brown’s mother was separately charged with obstruction and given six months probation.

I will agree to some extent that the prosecution over sharing a single link is somewhat troubling, and would call for further review …if that is what the sentence was for.

A lot of the folks I’ve seen disagreeing with this decision are also ones who are against the whole Gamergate mess, which sees a lot of issues with threats towards women online, etc. I was snarky about it above, but really: how do you reconcile being okay with threats against the FBI made online but standing against threats made against women online? Both are wrong. Both should have consequences. That one is rarely enforced does not mean that the other should be ignored - it means we need to do a better job on both.

The people who are going to show up in the court cases for this kind of thing are rarely going to be likable, which is something that I try to keep in mind - just because someone is a jackass, they have not sacrificed their right to free speech. As a case overall I have somewhat mixed feelings because the charges he ended up facing probably came about as a result of the scrutiny he was under for sharing a link. That one link, however, was to people’s personal information that he had no right to share. It’s a complicated case, and a lot of people want to simplify it down into one black and white issue. It’s not. I imagine that for a lot of people, their opinion might change if the personal information he linked to was their own.

I don’t know, just some thoughts on this I guess.

My earlier comment meant that I’m often aligned politically with the EFF (I believe strongly in Net Neutrality, free speech, Intellectual Property reform), but I hung up my EFF hat and stopped donating when they started cuddling up with the Tea Party. I find myself agreeing with dudebro political positions for carefully considered reasons, but I also find myself annoyed at prominent people on that end of the spectrum for being no more capable of nuance than anyone else.

He also doesn’t share our bias against Brown because he hasn’t seen what an ass he is, and has bought the Libertarian narrative on this, so he’s just reacting against prosecution for sharing a link, which on its own would be wrong. That last paragraph roughly describes me. And despite the EFF being professionally important to me, I refuse to believe that the Tea Party’s theocratic bent is at all in line with the EFF’s mission. Exactly. I personally don’t feel terrible about Brown going to jail, but I worry about the trumped up hacking charges. The copy/paste thing is a problematic precedent. But acting as the messenger to Stratfor for Hammond does seem like a real crime. (And of course: all the threats and whatnot look like pretty reasonable charges.)

(EDIT: I haven’t gone back over everything to see which charges were dropped, I think the copy/paste related charges were last year.)

Here’s the thing: people change. Opinions change.

We’ve all seen friends of ours in meatspace go off the rails, to the point where we can no longer tolerate them in our lives. Sometimes it’s substance abuse. Other times, bad relationships. Much of the time, it’s just bad choices and the CPU in their cerebral motherboard frying out.

The web makes the natural process of winnowing out People We No Longer Wish To Associate With from our lives, particularly hard to deal with, because it offers a really, really easy way of going to Teh Googles and dredging up links, comments, likes, etc. We need a better way of dealing with this - perhaps a “DISAVOWED” button we can click on in all our social profiles?

This is definitely true, but the gray area is that Hammond was the one who did the actual hacking, and in technical terms, what Brown did was not really different than Google indexing torrent sharing sites (I know you know this :). Again, Brown caused real problems with this, and he’s not a hero, but the information was already on public servers. So, hacking charges were the wrong legal tool to use against him.

Yes - that’s why the charge was dropped. It was an ill-advised charge, but the point behind it was valid, and Brown knew very well what kind of damage it would cause. He was basically doing the same thing to Stratfor that he did to me.

That’s where this is complex and I haven’t sorted out how I feel about the whole thing - compounded by not enough knowledge of all the twists and turns of the case and no real desire to spend my time picking through various sources.

His time here well pre-dates mine so for me this is just looking at a news story same as any other. I know that’s not the case for a lot of Lizards though.

Strange. Parallel to Watergate, where it wasn’t the penny-ante robbery that brought down Nixon, but the crazed crimes committed to cover it up.

Yes - that’s why the charge was dropped. It was an ill-advised charge, but the point behind it was valid, and Brown knew very well what kind of damage it would cause. He was basically doing the same thing to Stratfor that he did to me.

It was his obstruction of the investigation about the hack and his threatening the FBI Agent which screwed him.

Also, to be clear, it was that his obstruction was active. He didn’t act like a journalist and simply clam up, refusing to identify confidential sources. He attempted to alter and obfuscate stolen data. He threatened an investigator.

In the end his sin was that he got way too deep, lost sight of both journalistic ethics and best practices. He chose to become a spokesperson for Anonymous instead of a reporter with only the thinnest patina of separation or impartiality.

By the way here’s the video that really got Barret in trouble.

I think absent that, and other videos, most juries would have either turned a blind eye to his shit or just given Browna slap on the wrist. If he’d stuck to the medium he was really good at, writing, he probably would have been fine. Unfortunately he was in love with the sound of his own voice, and his drug use stuffed twenty pounds of crazy into a ten pound brain, resulting in the the rest leaking out all over the camera.

The laptop camera was not his friend, and freeform monologging is almost never a good idea.

Damn internet security issues!

I’ve spent the entire afternoon screwing around with the techs at Comodo with regards to a security license (SSL) for a small web store I administer, etc. I had to do some software updates a few days ago and noticed that when you hovered a mouse over the Comodo Secure logo it said there were no credentials available for the site. WTF?

So around noon I called the techs and was told it would be taken care of in an hour. An hour goes by and nothing. So, I call again…now I need to speak to second level techs. I wait for 15 minutes and then get cut off. Call back telling them I got cut off…back to waiting for second level tech…10 minutes later a voice mail message…”please call back in 10 minutes…all techs are busy.”

So, I cool off for a bit (now 3 hours have passed) and call again. I get second level techs…”oooo, you have a special problem, you need to speak to the validation department.”

Validation gets the whole thing wrong and tell me everything is fine. I say no it is not. “Oh, what is your order number again? Oh, sorry I wrote it down wrong! Now I see the problem, you need to speak with our techs in the US.”

Wait again…now I have a tech from the US (…I can actually understand). Guess what…”we have had some bad data and the credentials were not updated and this occurred in December.” Why I ask? “Don’t know…you must have done something in December.” No I have not touched it, it was working fine…and it was good for a year (Sept ‘14 to Sept ‘15) so no reason to do anything.

“Hmmm. Well, this has happened before. I’ll need to get this to our critical tech department, they will fix it within 24 hours. Have a nice day!”

Me….burning! Blame it on me, and then say you’ve seen this before.

Sometimes I hate having to deal with the ‘net. Damn You Al Gore!!!

Thanks for letting me vent. I am pretty sure some others around here have been through this rodeo a few times or too many more.

Oh yeah…ask me how much I get to make on this bullshit? Zippo! How do you charge your client?

So per the whole deflated balls mess, one thing I was unaware of but which provides a little more insight is that each team uses the balls that they provide when they are on offense. The balls were tested at halftime and found to be underinflated, and swapped for backup balls apparently. I don’t know if the backup balls were also found to be underinflated.

The balls for the Colts, which were exposed to the same conditions, were not found to be underinflated at the halftime test.

I wasn’t aware of that. I was trying to yank RWC’s chain…. I used to live in St. Louis, and I remember with Bill Bidwell and the Cardinals. He was “I love St. Louis, have no intent to move the team.”, until Phoenix flashed the cash.

I’m glad that St. Louis, perhaps among other cities, is finally wising up, that the oft mentioned benefits of having a NFL team just don’t really play out. I know that Nashville cut a hell of a deal to get the Titans (Oilers) to move here.

It’s the same way that every NFL owner screams “We’re losing money hand over fist”, but at the same time, when a team sells, it’s always setting a new record price. Lets face it, you don’t buy an NFL (or any other pro franchise) because you’re trying to make money from it, you buy it because it shows you have the biggest pockets in the world.

So per the whole deflated balls mess, one thing I was unaware of but which provides a little more insight is that each team uses the balls that they provide when they are on offense. The balls were tested at halftime and found to be underinflated, and swapped for backup balls apparently. I don’t know if the backup balls were also found to be underinflated.

The balls for the Colts, which were exposed to the same conditions, were not found to be underinflated at the halftime test.

From what I understand, no problems were found with the backup balls, although I don’t know if that’s been officially confirmed or just generally assumed. Since the Patriots did most of their scoring in the second half, this would mean that the deflated balls weren’t a determining factor in the final result. (Of course this doesn’t mean the Patriots weren’t cheating, assuming that they deflated the primary balls on purpose - although, in that case, why not all 12? - but it does mean that they legitimately won the game.)

I’m not making any judgement calls on what effect this may have had on the game in any way - I just didn’t know that each team used their own balls on offense, and so I had assumed that the difference would be that one team was more used to practicing with the ball a certain way and that was where the potential advantage might lie.

It does provide a nice set of controls on the whole “field conditions caused the balls to deflate” hypothesis though.

Contingency plan? Abdullah had been passing off more responsibility to Salman in the past few years (Abdullah hasn’t exactly been in good health for some time). He’s been defense minister since 2011 and isn’t much younger than Abdullah either.

We knew that this was happening. The Saudi family knew this was happening. That was the contingency plan. And we know what to do when a foreign leader dies. We wait and see what the others in the government do; because someone might try for a coup or ignore lines of succession.

And we do have contingencies for some of those kinds of things - like securing military facilities, including the base where we operate drone missions from.

In recent weeks, a wifi hub thingy that apparently belongs to a neighbor of mine has been appearing, from time to time, as a device on MY network/LAN. By checking it’s properties, I’ve gleaned a MAC address, and by monitoring the nearby wifi signals, I’ve been able to determine which specific wifi signal it almost certainly belongs to, because the MAC’s match.

I would hope that you could understand why I’m very reluctant to approach my neighbor about the issue.

You aren’t going to build a desalination plant where there’s not access to salt water.

A whole bunch of planned plants haven’t been built, mostly because of the costs to power them. They are very energy intensive.

They’re crazy energy intensive, and the semi permeable membranes, seals and other components they depend on cost a shitload of money too. Santa Barbara built one a long time ago and it has sat unused for the last 19 years. They sold off half the equipment a while back but it sits in long term standby mode, still costing money just to maintain. They preliminarily authorized some money to refurbish it due to the ongoing drought, but won’t actually spend the money until the last minute. Next vote is scheduled for April of this year.

The facility was built because of a drought that lasted from 1986-1991, but by its completion in 1992, wet weather had returned. With sufficient freshwater supplies, the desal plant was placed in standby mode in 1994, and since then, some of its equipment has been sold off. As we enter year four of a historic drought ​— 𠂺 phenomenon likely to recur in the age of global warming ​— 𠂿reshwater supplies dwindle, and the water market grows fierce, the plant could be Santa Barbara’s savior.

One element of the City Council’s action was to authorize an expedited design-build-operate (DBO) bidding process in which one firm completes all of these tasks. (The typical process is design-bid-build). On Monday, the Public Works department took prospective bidders on a tour of the desal facilities.

The city would like to award a contract by April, waiting just long enough to allow for the possibility of a rainy winter. Should the city go ahead and award a contract, the hope is to have the plant operational by summer 2016 and producing 5,000 acre-feet of water by 2017. Reactivation will cost about $32 million, and ramping the plant up to its capacity of 7,500 acre-feet per year will cost $28 million more. That total of $60 million, many have noted, is about three times the number that city staff threw out when discussions of reactivation first got underway.

Heck, Santa Barbara already has a desalination plant. It has been mothballed for years because it is a very, very expensive way to get water. They are considering bringing back on line if the drought continues, but it is already sitting there. It’s not like they have to build a new one.

Perhaps Chuck wants to have fresh water from one of these plants piped to Fresno, thus adding the cost of pumping the water to the already expensive cost of production.

Anyone with “real life experience” and a bachelor’s degree would be able to get a teaching license in any subject as long as they pass a test proving they are knowledgeable, under a budget provision Gov. Scott Walker announced Thursday.

The proposal would expand the non-traditional routes available to become licensed without an education degree. But many details weren’t disclosed Thursday, including whether it would call for any preparation for teaching, which is required in many of the current ways to get a teaching license without attending an education school.

Under Walker’s proposal, people with experience in fields they intend to teach could get licenses as long as they have a bachelor’s degree and demonstrate “that he or she is proficient in the subject or subjects that he or she intends to teach,” according to Walker spokeswoman Laurel Patrick.

By checking it’s properties, I’ve gleaned a MAC address, and by monitoring the nearby wifi signals, I’ve been able to determine which specific wifi signal it almost certainly belongs to, because the MAC’s match.

I would hope that you could understand why I’m very reluctant to approach my neighbor about the issue.

It’s probably (my best guess) a “guest” wifi signal that is appearing (somehow) as a device on my LAN (occasionally), and its properties indicate that it’s offering me a connection by means of WPS protocols. I can bring up the window for entering an 8 digit code —which I’m not going to even try. I have tried blocking the device by MAC filtering in my (secondary) router, but that has no effect. I’ve also tried making my own wifi name longer, and using a longer wifi password (wps2/psk, AES), to no effect. The first half of the MAC indicates that it’s a Netgear router. I own no Netgear equipment at all, and never have.

Oh, that just sounds like someone with a WIFI signal that is close enough to your modem for it to be picked up. I have my neighbors WIFI displaying on my list of available networks all the time. If that’s it, I wouldn’t worry about it. Do make sure you password isn’t PASSWORD1 or something like that, because if you see theirs, they see yours. :-)

Oh, that just sounds like someone with a WIFI signal that is close enough to your modem for it to be picked up. I have my neighbors WIFI displaying on my list of available networks all the time. If that’s it, I wouldn’t worry about it. Do make sure you password isn’t PASSWORD1 or something like that, because if you see theirs, they see yours. :-)

The phantom wifi-Hub appears (occasionally) as a “device” in my Network and Sharing Center on my W7 laptop. I can right click on its icon, and examine its properties, among other things. The properties indicate a MAC address. You don’t get that sort of info from the Connect To thingy in the system tray, which merely lists the wifi names (BSSIDs) my laptop can detect. I’ve taken screenshots.

I’ve been saying that all along. Those pics of his wedding look like graduation pics…nothing like a wedding at all.

Ok, she had a white mini slip dress on. They’re wearing white on the red carpet, too.

That said, he may be a completely different person offline. There was a twitter exchange on DKos of this guy who was an incredible racist exchanging tweets with someone whom (I believe) was a black person. By the time the exchange was done the racist schmoe was saying how he was depressed and was posting stuff to get it out of his system so he wasn’t a jackass in real life. It was really an amazing exchange.

Perhaps Chuckie is like that.

Like I said, I suspect it’s a guest network of some kind offering a connection— specifically via WPS protocol, which invites entry of an 8-digit pin to connect. A wifi survey utility called inSSIDER shows a nearby wifi signal and the same MAC address that I’ve mentioned, and it indicates a Netgear device. However, with Comcast/xfinitywifi playing fast and loose with decades-old MAC conventions, my confidence in the “manuf” part of the MAC being legit is eroded. (Comcast/xfinitywifi fudges the leading two digits of their MAC, as a way of distinguishing their multiple extra nameless wifi signals from a single hardware device.)

I’m really glad that Barrett got jail time for the maliciousness that he did. I hope he is able to get clean and stay clean of his addictions. He is very smart, and if he chose to, could be a productive member of society.
