Video: Joe Miller’s Thuggish Security Guards on Camera

Wow. The Anchorage Daily News has posted a video of the incident in which reporter Tony Hopfinger was handcuffed and detained by Tea Party candidate Joe Miller’s security guards, showing some astonishingly thuggish behavior as other reporters tried to interview Hopfinger.

This is seriously bad craziness. Tea Party candidates aren’t just running away from reporters now — they’re setting thugs on them.

Maybe. I went to a corporate christmas party at a highschool my company rented for the night, so I guess it’s possible. Don’t recall any serious security being there, but it was an invitation only event.

That particular vest lacks the plate most modern body has to prevent penetration from heavier rounds. It will guard well enough against shrapnel but not bullet proof by a long shot.

Campaigns are pubilc events, and when something is billed as a “town hall meeting” and public facilities are used, it cannot after the fact be called a ‘private event’…if Miller wanted to have a private event, he could have rented a meeting room at the Holiday Inn Express (free bagels!).

I do think that Obama’s inept approach to these issues has made the American public more fearful than it was under Bush, and as a result, more anti-Muslim. The polls certainly demonstrate this shift, and it’s hard for me to see what else would account for it. When people trusted Bush to keep them safe, they weren’t scared. They don’t trust Obama to keep them safe, so they’re more scared. As the President himself suggests, when people are scared, they tend to lash out… .

1. Hire security guards who look like skinheads.

2. Rent a building that is normally public for a private event. This confuses the public. If it had been held at a private home, nobody would have thought it odd to deny entrance to any uninvited person. They might have been within their legal rights, but it looks funny.

Its all about the intent of the event.

A church is only open to certain people, a cub scout meeting is only open to the scout and their family…

This event on the other hand was an event open to the public.

So the public has a write to be there you can’t trespass at a public event if you’re a member of the public.

The above incident aside, I do not see why not. I’d like to see the link that shows a law declaring a a public room as utterly public despite being rented by a private party.

if I rented a public room (school or library) after hours for a invitation only “public” (not just jewelers)jewelry event it would be private and trespassers would certainly be barred as security risks. Without any legal worries at all.

Actually, I’d be interested in knowing if the SCHOOL knew it was supposed to be a “private event”. I’ve worked in a few places - schools and libraries - where rooms and areas could be lined up, but they’ve all got strings that are almost always “must be public” since the facility is a taxpayer funded facility.

Why not? What makes a Public school public after hours? I have rented a “public” room for private purposes. And had security ready top prevent or remove trespassers. My event was a wedding reception. We could have barred anyone but a peace officer or fireman.

I think it might, but I don’t know all the details. As others have related from experience here, they have either organized or attended events that are exclusive, closed to the public (i.e.: private), on rented public grounds.

Doesn’t matter what the cop said if the function was open to the public, IMO…if if was open to the public, Miller and his jackbooted thugs can’t just say it’s private with no notice in order to justify squelching people they don’t like.

As I said downstairs a couple of threads ago, in Tennessee, a private security guard only has the power of arrest if they either witness or have overwhelming evidence that a felony has occurred or is occurring, in which case they can hold someone for the cops…otherwise they have no more police powers than a “civilian”. If Alaska’s laws are similar to ours here in TN, the Drop Zone fucks might have bought themselves charges and/or a suit for false arrest, no matter if the function was private or public, because what Hopfinger did was what might be considered simple assault or battery (a misdemeanor in most places) when he pushed whoever it was that he pushed, at worst.

Fulton said that as a security guard he is familiar with state law, and he believes he has the legal authority to police “private events” no matter where might take place. He refused to answer how exactly a member of the public attending Miller’s town hall meeting at a public school was supposed to know it was a private event, but said the Joe Miller sign outside was the giveaway.

The meeting was open to the public. There were no names taken at the door. Reporters were not asked to apply for credentials.

The event really does not sound like it was a private event.

As for the bathroom part, Hopfinger’s version of it is that he exchanged pleasantries with Miller while they were in the bathroom. I really don’t get how following someone into the bathroom would be so amazingly over the line, either.

As for the security guard’s saying they were required to be hired:

“He was contractually required to have us there,” Fulton said. “In their contract with the school district, they’re required to have security.”

But spokespeople for Murkowski and Democrat Scott McAdams each told RealClearPolitics that they had held several events at Anchorage public schools and have never had to provide their own security guards.

“Senator Murkowski last year during the health care debate held town halls where there were hundreds of people there at public schools in the Anchorage school district, and she was never required to have security, nor did we hire security,” Murkowski spokesperson Steve Wackowski said. “They just had to have a security plan.”

Should be easy to check up on.

This is the story the Alaska Dispatch has been trying to get. Apparently Joe got on other office mate’s computers and cast votes for himself for the head of the Alaska Republican Party.

Joe Miller tells CNN he was disciplined for misuse of borough computers, was “during my lunch hour.” [Link: bit.ly…]

And then he quit 2 years later the day before being fired for something else. He won’t say what.

Well, no, not really. The event is very clearly not private, if no names are taken at the door. It’s open to the public. It’s public.

That doesn’t mean that the people running the event have no right to ask people to leave, of course— a private event mainly means you can restrain people from entering in the first place. But for someone to be ejectable from a public event, they actually have to be causing a disturbance or a nuisance— unless AK law is very, very different than other states.

It also means that they would have to be given adequate time to comply with the instruction to leave. And if they refuse, a limited amount of force can be used to eject them, but restraining them for a trespass is really not an option. A trespass is a misdemeanor; there is no way that restraining someone for a misdemeanor offense is legal for a non-LEO.

There are really two separate questions:

1) Do they have the right to ask the reporter to leave?
1a) Do they have the right to use force to do so?
2) Do they have the right to restrain the reporter?

It is possible that they have the right to ask the reporter to leave— I mean, they can ask, of course, but to insist on it.

It is also possible they have the right to use a very limited amount of force to do so.

It is nearly impossible that they have the right to restrain the reporter for a misdemeanor.

That’s why I’m a little cautious over this story. I think his security is a little overzealous and Poorly trained. His story keeps changing. The Alaska media had been asking Miller difficult questions about his personal life, including the possibility that he quit his job as an attorney for the Fairbanks North Star Borough under threat that he was about to be fired. One of the main problems is that the security people never identified themselves to Hoflinger, apparently. In order to enforce any sort of order to leave property, you need to actually be an authority, and cite yourself as such.

All this is coming from my time as a bouncer and a doorman, by the way. If the person you’re asking to leave is not drunk, when you’re a bouncer, and not violent, there is very, very, very little you’re allowed to do to get them to leave. You really do just have to call the cops on them. You certainly can’t cuff them to a chair. If they get at all physical with you, you can respond with equal or lesser force; you are not allowed to escalate unless they have committed a felony crime.

Now, if that’s true for a clearly-identified bouncer, an employee of an actual business, at a very obviously private bar, I really doubt that it’s legal for a security guard who failed to identify himself has the right to detain a reporter at a public event.

Er, in case I mislead anyone, law does vary by state, and in many, but not most, states, bouncers are allowed to take you by the arm or put a hand on your shoulder, whatever minimal force they can apply, to move you out of the bar. Depending on the state, it may or may not be illegal for them to do so— after they’ve clearly identified themselves and informed you that you have to leave and given you time to comply.

They cannot bounce you off a wall and then cuff you to a chair.

I just put them on something flat on a few sheets of paper and try to get them so they’re not touching other. Then I place some apples amongst them and cover everything with a few sheet of paper just set on top. Some will rot so you just have to check regularly and remove the ones that do.

She continues to caucus with the Republicans. If I’m not mistaken, they let her keep her committees last month even though she was running against their official candidate. Even aside from the “protect your own” feeling in the Senate, there must have been a good few people there who figured she’d be able to pull off a write-in against Miller. So her bridges aren’t burned in the Senate, not at all.

IIRC she never said anything negative about her fellow Republicans in the Senate. Her “beef” is with the Tea Party folks and with her family’s enemy Palin. I’d love to see her win and team up with the rest of the Alaska delegation in Congress to make sure Wasilla gets absolutely no federally-funded projects—ever.
