Probably the most remarkable part is that I was able to track him down in his office two days in a row.

At this point, any is good.
After not taking proper care of myself for too long, it caught up with me. Around thanksgiving, I started eating a lot healthier and paying a lot more attention to what, how much, and when I ate. Haven’t had a soda since November, eating a lot more whole grain, fresh fruits and vegetables, yogurt, and trying to restrict myself from eating meat more than once a day. I’m also not killing myself with guilt if I break my diet once or twice a week. Today was the first day I started going back to the gym, just hitting the ellipticals and rowing machines to work on cardio, weight loss, and getting my abs back in shape. I decided to risk it and hit the scales on my way out of the gym.

Well the argument goes for all Stand Your Ground defenses, so women shouldn’t be “more” likely to go to jail than a man, except inasmuch as there’s still some vestigial bias against women endemic to the system. If there’s no ability to prove intent to rape then there’s equally no ability to prove intent to cause bodily harm against a male shooter, except in both cases for the presence of any weapons on the person shot, their own prior history, etc.
The Marissa Alexander case was a travesty, but more than anything it demonstrates exactly how bad an idea it is to fire off a “warning shot.”

Twas in Florida last year, pretty much lost in all the coverage of the Martin case. Woman had gotten a restraining order against hubby for years of physical abuse, but chosen to try to patch things up and so invited him to visit her. He got violent while there, so she fled to her car to get her gun, since the keys were in the kitchen and he was between her and them. She brandished the gun and threatened to shoot him, but he was prepared to attack her while even facing down a gun. She fired a warning shot, and he beat feet with their kids in tow. Went to the cops and reported her for discharging the gun in the presence of the kids. Judge sentenced her to 20 years on the excuse that she could have fled from the garage, even though hubby admitted on the stand that the garage door was broken and he knew there was no exit between him and her.

However warning shots are intrinsically dangerous and society is right to treat them as such.

I do disagree with the specifics in Feinstein’s bill and don’t think anything she or Biden has brought to the table is going to do anything to reduce gun violence. For the most part though my criticism is that they are’t doing anything to target compact handguns, which are the one used in the vast majority of firearms crime.

Biden mangled that whole thing. Step out and show yourself with a gun? That is easily some of the most foolish, dangerous advice I have ever heard spoken. The shotgun thing is good advice for a person that wants something deadly and easy to aim and operate.
That discussion, like that same discussion with anyone looking at defensive options really needs to include highly trained and experienced defensive expert instructors. I happen to be a guy that went through the gamut from sophisticated electronic alarms to martial arts to simple weapons to firearms.
None of this distills down well to talking points. Not a bit of it.
In these pages I have seen so much crap that revolves around anger at crime, the NRA and the RWNJ. All well and good for blogging.
Well at some point the irrelevance of all that to actual personal choice has to be declared. Straw men, exaggerations, hyperbole. These are the things preventing rational intelligent discussion, reform and policy. The big stats are good to know. Like how unlikely it is to get hit by lightning. National Geographic says the odds are one in 1/775,000. Pretty safe. Unless maybe you golf in Tampa bay a lot. Now those odds are very different.
Those thinking about self defense need to look at their circumstances carefully.

While I could go with AOW, the main reason it won’t happen is those small handguns are the growth industry for gun makers. Just look at what’s being pushed on the Ruger or Smith & Wesson/Walther web sites. Fear doesn’t justify recklessness. What she did should have been a misdemeanor, a few weeks and a suspended sentence. If she’d shot the husband then it’s not a crime. Ask yourself if the genders were reversed if you’d be okay with an abused husband (and they do exist) inviting his estranged, abusive wife home, then firing a warning shot through a wall with children in the house?
I think it’s a kind of chauvinism to cut a woman greater slack for behaving recklessly in the face of fear. It plays into the same sexist argument used by those who don’t think they have a place serving in front line military units.

Our disagreement isn’t gender based. I certainly know that women can be threatening and abusive. I also know men who wouldn’t shoot the mother of his children even if she was coming at him with a weapon (I know in this case the man was unarmed) or was otherwise threatening, but might discharge a gun to scare her.
I think that if she was justified in killing him then she was justified in trying to scare him. Our disagreement comes from my background in criminal defense. If she had a self defense defense to killing him then she had the same defense to firing to scare him. Her choices were kill him, let him beat her, or try to scare him away. But if they’d offered the sentence you would impose I would probably have recommended she take it.

That bold portion is an excellent point. I’m not a gun advocate really I’m a self defense advocate. People need to have room to defend as they best can. Since we rightly punish excess force so much, we need to also be fair to those who try to use less force and make a mistake. Well said Majacita. BTW how did you choose that nic?
