Well, the Fugitive Slave Act “worked” because slaves were not considered citizens and the property of someone else. Allegedly women are considered citizens and not property. It’s possible that they might draft a law that could *possibly* pass muster, especially with a Supreme Court happy to rubberstamp anything coming down the pike. I am not offering suggestions as to how they might go about it.

Lincoln had an optimistic view of how reconstruction would go, and was murdered before he had the chance to learn from experience how foolish that was.

After that, Andrew Johnson was such a disaster (i.e., Confederate appeaser) that Congress eventually stepped in to try to do a better job. But that only lasted until 1877.

He was planning to but, y’know, they killed him in April 1865. The week after Lee surrendered to Grant. 2 months before the first Juneteenth. Two months after the 13th Amendment passed congress.

President Johnson was pretty sympathetic to the Confederates, he wanted as little of Reconstruction as he could possibly manage; Lincoln’s supporters had a hard time constraining him.

Ok, checking out the USGS site, the epicenter was 1.2 miles below the surface. It was a 3.6, not a 5.0. It appears to be a growth crack, not anything active-fault related. In other words, rivers in SC keep sending silt to the coast. Eventually it builds up to the point where it snaps inland to relieve the pressure of the overburden.

An observation about Ms Hutchinson and her sworn testimony: Trump, while publicly disparaging her, hasn’t - thus far - threatened to sue her for libel. Trump is notoriously litigious; he’s been a plaintiff in something like 1,900 lawsuits.

IIRC, in 2006, he sued a writer for libel for $5 billion dollars because the writer noted in an article that Trump was “only” worth around $250 million or something like that. I’m trying not to spiral down a hole of despair today. So much to process:

3. Women having to take pregnancy tests just to get health care.

Honestly, #3 is really doing a number on me. I’ve never had any major health care needs (either with drugs or surgeries) but have had a couple of out patient procedures with anesthesia and x-rays. Every single time I’ve been asked if there is a possibility I’ve been pregnant, I have said no and that’s it. We move on to treatment. There are no executive actions Biden can take to address the Court. None.

Can he make statements indicating support for expanding the Court? Sure. Can he pressure Manchin and Sinema to go along with court expansion? Yeah. Will those two listen?

Nope.

There’s value signaling and benefit to Biden going out and saying, we intend to expand the court to match the number of circuits. There’s benefit of saying that we intend to change how the Court is comprised. There’s a political one and a party one. It shows you intend to do something. You’re signaling to the base that you intend to fight on multiple fronts.

But what Biden can actually do is quite limited here. Separation of powers and all - and Congress holds the cards - they write the laws setting the Court’s composition and jurisdiction.

The EPA decision is one that eliminates any kind of consistency and reliability. It inserts the courts into every aspect of the administrative state, and if a right wing extremist doesn’t like something, they can get a right wing judge to strike it down, claiming that it wasn’t explicitly directed by Congress - even as Congress gave agency broad power to administer that area of the economy.

It’s an awful decision, a gross expansion of the judiciary’s power, and tramples over the separation of powers among the branches.

If you are going to carve out a filibuster exception for reproductive rights, a better use of a carve out would be to change the size of the Supreme Court to the number of circuit courts.

Mitch McConnell already made a carve out for Supreme Court confirmations. This would be a direct corrective for that.

If this Court rules, it’s to further an explicit political agenda, and they don’t care what the facts, history, or the law says. They’ll just invent details to support their ruling.

All of the broken clock Supreme Court Justices are either on the right side in a unanimous opinion, or when not writing on a unanimous opinion, on the right side at least occasionally.
