Repeat from downstairs:

Unless state Democratic parties can start flipping Senate seats in Red/Purple states then the right wing agenda will continue unchecked.

Don’t depend on us out here on the left coast. We can’t make the change happen.

The harder we try the louder the resentment becomes against “Hollywood” etc.

The Senate is the fundamental problem in US politics. 26 red state Republican-ruled shitholes is enough for a permanent GOP majority, no matter how many people flee the resulting state-level disasters, and they are way too close to that goal.

You can. You can call from centers to other States to tell them how to register.
Where to go, when to do it, &c. We can all do it. I certainly will, and although it seems hopeless in Texas, it isn’t.

Yes.

If I write a futuristic story about the US I think I’ll have to go with the Star Trek version of the 21st century.

I don’t seen how anything but badness can come from the anti-democratic nature of the US Senate. It’s happened before (see War of the Rebellion.)

Well, the Fugitive Slave Act “worked” because slaves were not considered citizens and the property of someone else. Allegedly women are considered citizens and not property. It’s possible that they might draft a law that could *possibly* pass muster, especially with a Supreme Court happy to rubberstamp anything coming down the pike. I am not offering suggestions as to how they might go about it.

What effect does bilingualism have on the brain?
There are a lot of studies that suggest that real bilingualism has a positive impact on the language ability of both languages and general intelligence, such as the ability to classify new information.
It is because of these surveys that home language teaching has been prioritized in Swedish schools.

I’ve thought long and hard about Republicans, and the only conclusion I can come up with is that they are the fourth most evil major political party of a major world power, ever. And they are diligently seeking to raise their rank.

The peer parties for the GOP are Nazis, Soviet Communists and Chinese communists.

Yeah, nuclear war… won’t be pretty.

I just get the feeling that Biden is trying to be what a young Lincoln was.

Lincoln knew slavery was wrong but he wasn’t going to try and outlaw it across the nation.

Only when there simply wasn’t any other option did Lincoln go for the Emancipation Proclamation.

Biden thinks he can good-ol-boy the Senate into an agreement that won’t make the Senate go nuclear (in this case that’s a metaphor.)

There’s a pretty good argument to be made that Lincoln should have done a lot more to shut down and clean out the remnants of the Confederate South.

We’re still dealing with that more than two centuries later.

Now we have to do the thought experiment of what would have happened if Trump entered the Capitol with his goons and started hurting or killing our elected officials (remember the GOP guys who said to Dems “you should take off your pin, but I’m good). Would the military have raided the Capitol and slaughtered the Proud Boys and Oath Keepers and lots of other random people or would Trump’s flunkies in DoD, etc. tell them to stand down and accept the Presidency of Trump? Then there really would be riots around the country.

Lincoln had an optimistic view of how reconstruction would go, and was murdered before he had the chance to learn from experience how foolish that was.

After that, Andrew Johnson was such a disaster (i.e., Confederate appeaser) that Congress eventually stepped in to try to do a better job. But that only lasted until 1877.

Yeah, and my patience is wearing thin. This particular goddist is a follower of James White, who is an elder at that church near my house where they want to execute women who get abortions. So I felt obliged to tell him that he’s a fanboy of a guy who is a wannabe murderer.

He was planning to but, y’know, they killed him in April 1865. The week after Lee surrendered to Grant. 2 months before the first Juneteenth. Two months after the 13th Amendment passed congress.

President Johnson was pretty sympathetic to the Confederates, he wanted as little of Reconstruction as he could possibly manage; Lincoln’s supporters had a hard time constraining him.

austin_blue  Jun 29, 2022 • 7:04:52pm

Ok, checking out the USGS site, the epicenter was 1.2 miles below the surface. It was a 3.6, not a 5.0. It appears to be a growth crack, not anything active-fault related. In other words, rivers in SC keep sending silt to the coast. Eventually it builds up to the point where it snaps inland to relieve the pressure of the overburden.

Some of us just want to lord it over others. By slavery when they could. By guile when they must. By politics as possible. The trick is to keep these bully boys at bay. Foolish me, I thought this done already when I was young. The King of Jordan discussed this in the context of extremist Muslim terrorists. The idea was stamp them out as necessary. It’s not a “one and done” thing. The idea comes up every generation. Extremism. Christian, Communist, or Muslim. Seen them all. The result has always been more tears than accomplishments.

Also, you are talking about the fringe of the fringe.

There’s a pretty good argument to be made that Lincoln should have done a lot more to shut down and clean out the remnants of the Confederate South.

We’re still dealing with that more than two centuries later.

Well, except that he was, you know, dead.

An observation about Ms Hutchinson and her sworn testimony: Trump, while publicly disparaging her, hasn’t - thus far - threatened to sue her for libel. Trump is notoriously litigious; he’s been a plaintiff in something like 1,900 lawsuits.

IIRC, in 2006, he sued a writer for libel for $5 billion dollars because the writer noted in an article that Trump was “only” worth around $250 million or something like that. Trump didn’t expect it to go to court, so he was caught off-guard when it did and he lost the case (and the appeal) because he couldn’t provide a single shred of evidence that he was worth even one billion.

Ukrainian forces say they have pushed Russian forces from Snake Island, a strategic Black Sea landmass off the southern coast near the city of Odesa.

Ukraine’s reported recapture of the island weakens any potential plans Russia may have for a future land attack on that stretch of coastline.

Russia’s ministry of defence stated that it had completed its assigned tasks and was tactically withdrawing to allow for grain exports from Ukraine’s Black Sea ports.

Russia’s withdrawal from Snake Island has been confirmed the Russian Ministry of Defense. They’re claiming they’re doing it as “goodwill gesture”.

Russian gas giant Gazprom (gazp.mm) has decided not to pay dividends on last year’s results, the first time it will not pay out since 1998, sending its shares plunging 27%.

“The shareholders decided that in the current situation it is not advisable to pay dividends based on the 2021 results,” Deputy CEO Famil Sadygov said.

He added that Gazprom would rather focus on Russian regional gasification, preparation for the heating season and paying increased taxes.

Gazprom shares plunged by more than 27% on the decision, which reversed a board recommendation to pay a dividend of 52.53 roubles per share in what would have been its biggest payout.

Or to spill your guts in exchange for immunity from prosecution for seditious conspiracy.

Cipollone knows that everything Trump did was illegal, and did nothing to stop it. He didn’t go to the press to announce resignation and throw up red flags that Trump was engaging in illegal conduct, knowing full well the election results were sound and certifiable.

Instead, he let it go. That violates his oath, and should be disbarred as well.

The tweets by @disabledDoctor are one thing… the responses are infuriating and just begin to skim the surface of how badly women are treated by the medical profession. Reproductive care is just one aspect of women’s health, but it spills over into every kind of contact a woman has with the medical profession. The question of pregnancy is one that drives nearly all aspects of care.

I’m trying not to spiral down a hole of despair today. So much to process:

1. Trump can’t be held accountable because he throws away the evidence (not quite what happened but part of my process is hyperbole).

2. Joe and Mitch making some double-pinky-swear pact about women’s rights.

3. Women having to take pregnancy tests just to get health care.

Honestly, #3 is really doing a number on me. I’ve never had any major health care needs (either with drugs or surgeries) but have had a couple of out patient procedures with anesthesia and x-rays. Every single time I’ve been asked if there is a possibility I’ve been pregnant, I have said no and that’s it. We move on to treatment. My personal experience creating blinders that women can’t afford for me to have right now.

re: #169 Dr. Matt

What did Hunter Biden do?

Tried to profit from the name Biden? Is that different from what any of the Trumps did?

Actually, yes.

Hunter was *never* part of the US Government. Ivanka and Jared were, and they steered taxpayer money to their businesses. Trump steered taxpayer money to his businesses.

That’s criminal conduct.

Hunter lobbied for business in a foreign nation? Wait, Ivanka did that with China to get trademarks, and Jared cut a deal with the Saudis for $2 billion bailout of his real estate holdings.

Yeah, it’s all a distraction and deflection from actual Trumpworld criminal conduct. If you’re claiming Hunter’s actions were crimes, then every last “rule of law” GOPer should be insisting felony indictments against Trumpworld, but they’re not because they’re partisan hacks who know none of the claims against Hunter hold up against scrutiny, while Trump openly committed crimes daring people to hold him accountable.

There shouldn’t be any trust in this SCOTUS. If Biden isn’t planning a “The Federalist society has made the law, now let them enforce it” moment, he’s a damn fool.

What would that look like?

173
lawhawk  Jun 30, 2022 • 6:01:42am

Want to change size of SCOTUS? You need Congress to pass a law.
Want to seat someone on SCOTUS? You need Senate confirmation.

GOP holds ace in the hole with 48/50/2 split and no way to end filibuster on changing the rules so long as Manchin and Sinema are against changing the rules. You know damned well GOP will do so moment they have a chance, because it would leave Democrats in a permanent disadvantage as the GOP agenda gets supercharged.

There are no executive actions Biden can take to address the Court. None.

Can he make statements indicating support for expanding the Court? Sure. Can he pressure Manchin and Sinema to go along with court expansion? Yeah. Will those two listen?

Nope.

There’s value signaling and benefit to Biden going out and saying, we intend to expand the court to match the number of circuits. There’s benefit of saying that we intend to change how the Court is comprised. There’s a political one and a party one. It shows you intend to do something. You’re signaling to the base that you intend to fight on multiple fronts.

But what Biden can actually do is quite limited here. Separation of powers and all - and Congress holds the cards - they write the laws setting the Court’s composition and jurisdiction.

The media would better serve the public if it followed two rules: First, unless they have new factual information that meet the standards for anonymous sourcing, respectable publications should not afford anonymity to those offering takes from Trump’s camp. Second, if a source is going to contest testimony under oath, the outlet should determine if the source already met with the Jan. 6 committee and consider the credibility and relevance of the source’s story (or testimony).

And that not insignificant point that when Texas tried independence, they failed because the debt was too high, so they sough entry into the US instead to pay off their debts.

The Alamo myth doesn’t stand up to scrutiny…

Quite right about the last bit: - and just typical that the fact that the slavery-based cotton-plantation economy was the main reason Texas was settled by Anglo/Americans in the first place has been pretty much erased from the “official” (i.e. romanticized/mythologized/whitewashed) histories.

Fact I gleaned from the invaluable book Forget The Alamo: to get around prohibitions on slavery in Mexico, Texian settlers would write up forms they would have their illiterate chattels put an “X” on so that they could claim that they were actually “contract workers”. Conveniently, VERY long-term contracts (as in, “for life”)

I doubt it’s going to come to that. I’d sooner guess that they’ll pass a Texas SB8-style bill that will let state citizens sue people who leave the state to get an abortion, along with anyone who “aided or abetted her in committing a felony under the laws of *insert state here*.”

So they won’t go after a woman who leaves the state and never returns? I would suggest that companies relocate their operations to non-fascist states but corporations have no morality, they are interested only in the bottom line.

The police, no. Ordinary citizens, yes. Basically, they’ll create a private right of action to let anybody sue anybody if they suspect an abortion happened, and there won’t be any provision for the person being sued having to live in the state where the suing is taking place, which is exactly what Texas SB8 does. So it won’t matter if the woman never returns; if she did live in the state at one time, and some citizen suspects she left the state and had an abortion, they can sue.

These agents, and the ones who have participated in the hookers and booze scandals, plus the ones that Biden felt he had to fire from his detail, plus the ones who took “gifts” from fake DHS agents, all had to go through the most rigorous Yankee White security clearance investigations. I don’t see how interstate commerce survives having checkpoints at every state border.

Just the states trying to enforce the bans. And for a large part these states have budgetary issues and probably would be heavily affected by their businesses having trouble getting goods out of the state.

And a state having jams getting goods into their state due to jackboot thug behavior I guess could decide to have a few troopers cause a jam for stuff trying to get into that state. But I have doubt about the effectiveness of such a tactic.

Atwood never definitively explains the source of infertility in the novel. It’s clear, however, that the pre-Gilead United States suffered some sort of environmental catastrophe that triggered mass infertility, and that the formation of Gilead was partly a response to this catastrophe.

In all seriousness: SCOTUS overturned Roe last Thursday. Biden left for the G7 on Friday. He might have had a few things to think about before getting to Roe.

Cassidy Hutchinson’s testimony BEGAN less than 48 hours ago. It doesn’t seem realistic to me to expect a finished operation from the Justice Department just yet. (And just by the way, I don’t think Biden can do much besides firing Merrick Garland if he doesn’t get off his ass pretty #@$& soon. Which I’d approve. Put Jamie Raskin in there.)

SCOTUS approving the “independent state legislature” doctrine will basically doom any federal attempt to enforce voting rights. The Court will just say, “Yeah, but, we said state legislatures are the ultimate authority for anything election-related, so, struck down as unconstitutional.”

267
lawhawk  Jun 30, 2022 • 8:36:59am

The EPA decision is one that eliminates any kind of consistency and reliability. It inserts the courts into every aspect of the administrative state, and if a right wing extremist doesn’t like something, they can get a right wing judge to strike it down, claiming that it wasn’t explicitly directed by Congress - even as Congress gave agency broad power to administer that area of the economy.

It’s an awful decision, a gross expansion of the judiciary’s power, and tramples over the separation of powers among the branches.

Other than that, how was the play Mrs. Lincoln. /

For state level elections, yes. But doesn’t the 15th Amendment say that Congress has the authority over federal elections? Of course, with the Calvinball court, any outrageous dishonest decision is possible.

It’s aimed squarely at Presidential elections and the Electoral College, where the Constitution says that state legislators shall appoint electors “in a manner of their own choosing.”

As long as there is a Democrat in the WH or the Democrats hold at least one House, that’s not going to happen. However, my suspicion is that McConnell will not be eliminating the filibuster because he doesn’t want this legislation to pass. White supremacy yes, tax cuts for the wealthy yes, but this type of bill — no.

If you are going to carve out a filibuster exception for reproductive rights, a better use of a carve out would be to change the size of the Supreme Court to the number of circuit courts.

Mitch McConnell already made a carve out for Supreme Court confirmations. This would be a direct corrective for that.

Abortion and Hollywood: How TV and film stories went from hysteria to (mostly) accurateIn 1972, Beatrice Arthur starred in one of the most highly-rated and controversial episodes of American TV history on Norman Lear’s CBS comedy “Maude.” The title character of the “All in the Family” spinoff became pregnant and after some soul searching and deep family discussions, decides to have an abortion.

Fifty years after this landmark moment in popular culture, which predated a Supreme Court ruling that established a constitutional right to abortion, the current court overturned that 1973 Roe v. Wade decision in Dobbs v. Jackson Women’s Health Organization. Abortion rights are now decided by laws at the state level, and many outlawed abortion or severely restricted access to it immediately following the June 24 ruling.

Abortion has been a topic Hollywood writers have returned to repeatedly in film and TV: in sitcoms, drama series, teen shows, indie movies, blockbuster films and classics from “Grey’s Anatomy” to “Friday Night Lights” to “American Horror Story,” and from “The Godfather Part II” to 2021’s “Plan B.”

“Film and TV get abortion right when they recognize and highlight the diversity of abortion stories, and acknowledge that each one is informed by the lived experiences of the person seeking an abortion,” says Rebecca Reingold, associate director of the Health and Human Rights Initiative at Georgetown University. Reingold notes that how abortion plays out in popular culture influences how the greater public views it in real life.

Abortions in TV, film started with hysteria, then became (mostly) accurate. But what now? (USA Today via MSN because the story is paywalled at USA Today)

Justices to Review State Legislative Power in Elections
politicalwire.com

“The Supreme Court on Thursday said it will consider what would be a radical change in the way federal elections are conducted, giving state legislatures sole authority to set the rules for contests even if their actions violated state constitutions and resulted in extreme partisan gerrymandering for congressional seats,” the Washington Post reports.

Vox: “The case is perhaps the gravest threat to American democracy since the January 6 attack. It seeks to reinstate gerrymandered congressional maps that were struck down by North Carolina’s highest court because they ‘subordinated traditional neutral redistricting criteria in favor of extreme partisan advantage’ for the Republican Party.”

Rick Hasen: “Pause on that for a moment: the theory in its extreme is that the state constitution as interpreted by the state supreme court is not a limit on legislative power. This extreme position would essentially neuter the development of any laws protecting voters more broadly than the federal constitution based on voting rights provisions in state constitutions.”

“And this theory might not just restrain state supreme courts: it can also potentially restrain state and local agencies and governors implementing rules for running elections.”
