I was (and still am ) living in Germany. We were moving a piano. When I first heard of a plane crashing into the Pentagon, I assumed it was a crackpot in a Cessna, as had happened before with the White House.
Then the other reports started coming in and we turned on the TV.
Next day, my three-year-old daughter asked if we were going to watch that show again where they fly planes into buildings.

Probably the same thing that’s happening now: The department would have covered for Guyger’s ass by turning over his apartment to look for “contraband” or “evidence of unlawful acts” while she sat in the corner to sober up. Or they would have let him go with an “apology” and then made up excuses for why a cop broke into his apartment in the dead of night.
For all we know, he did and she killed him anyway.

The aim is to have nothing on paper until they know what evidence the DA is going to bring before a grand jury, at which time they’ll start piecing together a final version of events that leaves enough “doubt” to tie the grand jury’s hands. If they can blunt efforts by the DA to bump up the charge to murder, then they’re already half-way to an acquittal.
I hate to throw a lot of politics in this, and I hope she keeps them out, but the DA, Faith Johnson, is a Democrat appointed by Abbott who is running for election. And Dallas is heavily Democratic.

The more I read into the Jean case, the more convinced I become that the charge of manslaughter is not just them giving her a wrist-slap, it’s a strategy to lower the bar for the jury to hop over. There reportedly are two witnesses who heard a verbal exchange before the shots, which is probably why she suddenly charged her story from “saw intruder and shot” to “shot intruder after he refused lawful orders.”
If she’d simply shot him, they could spin it as “She feared for her life and took immediate action” and beat a murder charge. She spends a few weeks going through post-shooting therapy and retraining while riding a desk before getting her gun back.
But if she’s yelling “Get on the ground!” and he’s yelling back “This is my apartment!,” there’s enough time for her to realize her mistake and safe her weapon. So now they have to say “Well, it was a total mistake,” hence the massaging of her story to say she didn’t realize she had the wrong apartment until 9/11 asked for her address. But even that story is hard to believe, considering she lived 3 stories above him, their apartments are not going to be furnished in the exact same fashion, and (most importantly) she has a dog that wasn’t making a shitload of noise at this “intruder.” If she wasn’t impaired (which would be a no-no if she was in uniform), then she should have been clearheaded enough to recognize at least one of those facts before she shot him.
Yep. As far as I can tell, no one is buying her story because it’s absolutely outrageous. I mean, two weeks ago, I accidentally hung my magnetic door screen up on the door next to mine in the apartment building because I got so involved in hanging the damned thing that I never looked off to one side and said, “Hey, I’m hanging this on the wrong damned door.” But even if I were armed, if someone on the other side had come through the door, I would have figured out without having to shoot somebody that I was probably doing something wrong.

I’m not a lawyer, but if I were, I would point out the first day of the trial that the officer was in someone else’s apartment without a warrant and without invitation. No order she could have given at that point would be “lawful.”

One aspect of the killing of Mr. Jean that keeps bugging me is the differing reports on the state of the door to his apartment. The cop in her statement claims it was unlocked, and slightly ajar. Meanwhile, there are reported witnesses that say they heard her knocking, and demanding entrance.

Actually, I think she SHOULD have noticed that bright red half circle mat in front of the door of the apartment, and come to the conclusion she wasn’t at her home.
Dallas, with it’s large minority population, has had to deal with a lot of tension between the citizens and the police. Lots of profiling by police, and then, when the cops and citizens tried to show their support for each other, someone used it as an opportunity to kill police members. And the police targeted the guy who was open carrying for days after.
The DA has a very narrow path to walk with this.

First-degree murder requires premeditation. Second-degree does not, just “malice aforethought.” The former requires evidence that the act was planned, the latter only requires that the perpetrator acted with an intent to kill or seriously injure the victim. Which is probably why she leans so heavily on the “I thought he was a burglar” excuse, because then her attorney can argue that it was not a willful act to kill but a voluntary act of “self-defense.”
I mean this seriously, not as a political dig.

Murder, typically, requires premeditation. Manslaughter requires “heat of passion”. I’m not sure what Texas law is on premeditation, but from the facts we’ve heard thus far, manslaughter (a) seems like the correct charge; and (b) would be easier to prove.
