One of the most striking things about all this brutality is that the cops are doing this in full view of many cameras. They know they’re being recorded, and it has no effect on their behavior.

Maybe they sense that this is their last big chance to yet their ya-yas out…

They’re doing it because they know they can hide behind the badge. If their superiors won’t defend them, then their union will. That the system is so rigged in their favor that prosecutors willing to ruin their careers to put a cop on trial have to move Heaven and Earth to get a jury to convict while all the defense has to do is say “He felt threatened.” The reality in this country is that city governments feel it is cheaper to just pay off victims than to discipline their cops.

Well, we can post back what we said after Ferguson, or Eric Garner, or any of the other hundreds of incidents where an unarmed black man was killed by cops. Or brandishing a toy gun in an open carry state. Or brandishing a bb gun in an open carry state.

All while the right wing couch commandos are able to sling their AR-15s, storm state capitol buildings and send legislators and governors scrambling for safety without anyone arresting anyone. Cops show a shit-ton of restraint there, but a black guy already on the ground and handcuffed has to be murdered and the refrain will be “I feared for my life”.

Qualified immunity has got to go. That odious doctrine underpins some of this too. As does politicians who refuse to hold cops accountable for crimes - that too is law and order.

Trump is exhibit A of lawlessness. He is the opposite.

You answered your own question.

It’s the racism. And qualified immunity means that cops can get away with murder.

Holding cops accountable when they commit crimes *is* law enforcement. It’s the bare minimum.

And frankly we need to change the standards of care for policing in the US.

It needs to be a higher standard of care, not one that gives cops an easy out.

Nothing in that letter surprises me at all, because we’ve seen similar sentiments from police union presidents across the land. They never see deescalation or peace-keeping as their mission, their only answer to push-back or protest is to grind the boot down harder. I wouldn’t be surprised if Donny has heard from one or more of these assholes in recent days, hence his viewpoint that the governors are to blame because they’re “weak.”

Renaissance_Man  Jun 1, 2020 • 10:54:33am

I can’t remember if I’ve told this story here before, but it seems apropos.

Almost 15 years ago my best friend came to visit me in the US. He was, at the time, a cop, and went to the local PD in the Midwest suburb I lived in at the time to talk to them and see about a ridealong. They said sure, hop on.

The first thing they did was hand him a shotgun and say, here, use that if anything comes up.

That’s not the attitude of a policeman. That’s the attitude of an occupying soldier, someone who expects that his job is to get into firefights with armed insurrectionists. I lived in a quiet Midwest suburb, not Somalia. They didn’t verify his credentials. Even if they had, they had so little regard for the use of lethal force that they expected that someone who wasn’t even a US citizen and not even in uniform should be able to shoot someone without repercussions. What if he had? What if he’d cracked and used it on a cop? That never occurred to them - they just figured that he was a white man and a cop somewhere, so he should be able to shoot someone just like them if the opportunity arose.

In any other civilised country, simply giving a firearm to someone who isn’t authorised to use it would be grounds for instant dismissal and possibly criminal charges. But America doesn’t have police, it has garrisons. And the purpose of those garrisons is to keep the second-class citizens in line. And a little indiscriminate killing works wonders for that.

Hence the term “less-than-lethal.” There’s been documented cases of people suffering cracked skulls or worse from being shot in the head with bean bag rounds. Hell, a sharp enough blow to the sternum can knock a person’s heart out of rhythm or (if hit at just the right moment) stop the heart altogether.

If things haven’t come to a close by week’s end, Donny may just decide to do as he’s done before, openly violate laws that have stood for decades/centuries, and then dare Congress to do something about it knowing that there’s no way Senate Repubs will endanger their own campaigns by voting to remove him from office.

See, the trick is to ask a direct question.

For example, “Can you answer why President Trump is such a psychopathic piece of shit? Also, why are such a lying twat? Do you suffer from some profound psychological disorder? Don’t you believe the American people deserve an answer as to why the Trump administration is such a colossal failure?”

This audio not only indicates that Trump’s engaging in tax fraud, but potentially voter fraud. Saying he lives in Manhattan when he’s claimed he’s moved to Florida raises all kinds of questions, not the least of which is is he senile or just a liar, and does it matter when the tax authorities go after him for the taxes owed as a NY domiciliary. Claiming to not be a domiciliary in NY while claiming to be NY resident isn’t a good look when you’re potentially facing tax evasion in NY.

There’s a long and storied list of people who’ve claimed they don’t owe NY taxes b/c they don’t live there, but they got shot down repeatedly.

GrandDaughter1 sent this about yesterday’s demo in her small KY town:

In case tonight gets violent in the Etown square, I need to say IT WAS NOT THE ORIGINAL PROTESTERS OR PROTEST ORGANIZERS!
A handful of people dressed in all black with back packs came in a little over an hour in to join the protest. There were some that held signs saying “Blue Lives Murder” and “Fuck pigs”. These were also white people. I even heard a couple of the original protesters politely asking them to just remain peaceful so that we could continue to let our voices be heard.

I joined the protest from the beginning and it was peaceful. We even had a moment where two protests (ours and one from a church) merged into one big protest for a prayer circle.
We chanted. We stood together. It was beautiful and peaceful.

I am hoping with everything that I am that nothing escalates, but in case it does, I need it to be known before anything comes of it, that was NOT US! Do not let the media try to tell you that Elizabethtown, Kentucky has been doing anything shy of a beautiful job at remaining vocal AND peaceful!

Edit: I’ve heard a few rumors of an incident happening towards the end of the protest, but haven’t found any kind of news coverage on it so far. I’m glad there was no insane rioting, but more importantly whatever negative things may have happened last night, there is no one twisting the narrative to make the peaceful protesters look bad!
For anyone continuing to go and protest, please stay safe!

I know there’s enormous deference to the current president. When the economy was collapsing in late 2008 after the election, Obama had to remind people that he wasn’t the president yet and people needed to look to Bush.

I’m thinking we’re in a situation right now where the current resident of the White House is a complete mess. I am thinking that at this point it is up to other elected leaders, like governors, to basically step up and wrest control away from the tangerine tyrant. I KNOW we’re going to have problems in some states (mine included) because my governor (Doug Ducey) is a butt kissing Trump supporter.

Note that I’m not suggesting that Biden set up any sort of quasi-government. I’m just saying governors and mayors need to push back HARD on this crazy and assert their inherent authority.

I don’t suppose it has much legal force to just say he lives in NY, but I think if you claim a place as your legal residence while temporarily residing elsewhere for a legit reason (the White House because you are president, for example) you’re a legal resident of that place. You just can’t claim to be a resident of a low tax state while spending most of your time in another place.

MAGA “life coach” and proudly amoral right-wing broadcaster Brenden Dilley said during his livestream program today that he and millions of other gun-loving Americans are just waiting until President Donald Trump “gives us the green light” to take to the streets and start gunning down activists who have been protesting all over the country following the killing of George Floyd.

“Someone should politely explain to Antifa [that] the most violent Americans, the most violent and willing Americans, haven’t even left the couch yet,” Dilley said. “The most violent and ready to go, the most tactically trained, haven’t even got off the couch yet. So you better pray to God, and I mean this literally—or whoever the fuck it is you pray to—that Donald J. Trump, President of the United States, and Attorney General Barr clean this up lawfully.” Right Wing Watch

Good piece - and, FWIW, spot-on in its recommendations. Though it’s probably not worth very much, because Lopez’s article misses one salient point. As did Barack Obama’s thoughts on the matter, as I commented on over at Balloon Juice

Impressive (as usual) commentary from President Obama*, but unfortunately, I think he misses one vital point in his call to political action. IMHO, the biggest obstacle to “criminal justice system reform” isn’t the institutional politics that nominally “run” the system, but the fact that forty or so years of “tough on crime” rhetoric and policies have led to all too many law-enforcement personnel coming to regard themselves as a “Warrior Caste” - the Blue Tribe whose principle loyalty is to The Tribe and the Tribal Code: and the public/elected officials to whom they are nominally subject are all-too-often seen as merely ephemeral annoyances

It’s something that permeates our politics. The need to be “tough”. We have to be tough on crime. Tough on terrorism. Tough on whatever. We have to fight! Of course, that sort of toughness and fighting isn’t usually meant to accomplish anything because they are stupid and emotional responses. Because that’s not how you actually get shit done.

You want to get shit done, you need to do the work. You got to take responsibility and do the damn work. You have to actually talk to people, and more importantly, listen to them. You need to hold actual people accountable, not in some vague bullshit way but with real actions and real consequences. And on top of all of that, you have to be intelligent enough to know what you don’t know.

I really wish that we would get over this “tough” on everything and declaring “war” on everything bullshit, and replace it with being smart and/or effective on issues.

We also need to get over the idea that revenge (or whatever euphemism they try to use to hide that) has any place in the justice system or national policy anywhere.

One of my Facebook friends linked a brilliant post, and I’m relating it to a comment I found on Fark: Our soldiers are grilled relentlessly every time they fire their weapons - IN COMBAT. Our doctors are placed on suspension and investigated when someone dies in their care, regardless of wrongdoing. But our police officers, we just… shrug, file some paperwork, and make it magically go away.

Really afraid we are on the verge of martial law and a possible massacre.

Still no proclamation on the White House proclamation site about “declaring antifa a terrorist organisation” like he claimed he would.

It is explicitly against Army and Navy doctrine to apply the rule of “no quarter” and has been since 1863. It is always a war crime and in the USA under the UCMJ is prosecuted as murder.

Any order to the military to violate the law would likely tear the military apart, and definitely turn civilians against it.

There are generals and admirals right now probably thinking “am I going to go down with this dipshit, or am I going to defend the Constitution?”

As far as I know, this is another one of those things that he can’t do but likes to think he can. The Posse Comitatus Act requires congressional approval to override. He’s not going to get that. State governors can use the National Guard without PCA issues, but only under certain circumstances. Addendum, ICC rules on Superior orders:

1. The fact that a crime within the jurisdiction of the Court has been committed by a person pursuant to an order of a Government or of a superior, whether military or civilian, shall not relieve that person of criminal responsibility unless:

(a) The person was under a legal obligation to obey orders of the Government or the superior in question;
(b) The person did not know that the order was unlawful; and
(c) The order was not manifestly unlawful.

2. For the purposes of this article, orders to commit genocide or crimes against humanity are manifestly unlawful.

Maybe. The Posse Comitatus Act only applies to the Army and Air Force. It does not apply to the Navy or Marine Corps, they only follow it to keep policy in line with the Army. The Coast Guard is expressly excluded, since they are a law enforcement agency. It also doesn’t apply if a state governor directly requests military aid.

The Insurrection Act of 1807 was last invoked during Hurricane Hugo and during the Los Angeles Riots following the beating of Rodney King.

It used to read:

[I]n all cases of insurrection, or obstruction to the laws, either of the United States, or of any individual state or territory, where it is lawful for the President of the United States to call forth the militia for the purpose of suppressing such insurrection, or of causing the laws to be duly executed, it shall be lawful for him to employ, for the same purposes, such part of the land or naval force of the United States, as shall be judged necessary, having first observed all the pre-requisites of the law in that respect.

It was amended in 2006 in the Defense Authorization Act to read:

The President may employ the armed forces … to … restore public order and enforce the laws of the United States when, as a result of a natural disaster, epidemic, or other serious public health emergency, terrorist attack or incident, or other condition … the President determines that … domestic violence has occurred to such an extent that the constituted authorities of the State or possession are incapable of maintaining public order

That part was repealed in 2012 to return the act to its original text.

Space Force is also exempt from the Posse Comitatus Act.

‘We came to riot:’ Man livestreamed lighting fires, throwing bombs at police officers in Minneapolis, charges say

Matthew Lee Rupert is charged with federal counts of civil disorder, possession of unregistered explosives and participating and organizing riots in Minneapolis and Chicago.

The live-streamed videos, cited as evidence by FBI investigators in the complaint, show his role in the riots on Friday night and early Monday, including distributing explosives and then announcing, “He’s throwing my bombs … they’re going to bomb the police with them.”

“Good shot, my boy,” he shouted after one of the explosions, according to the complaint. “We came here to riot,” he declared later.

Later in the night, Rupert asked for lighter fluid and entered a Sprint store, according to the complaint. “I lit it on fire,” he said, before entering an Office Depot and looting it.

He has no fucking clue about realitiy

He doesn’t care about reality.

He and people like him will let a lot of people die…and if given the chance, kill…rather than concede that they’re wrong.

He’s not ranting about “antifa” because he gives a shit about what Antifa actually is, it’s just a word that explains that everyone against him is the same kind of evil and deserves to be hurt.

This is the case for almost every emphatic word and statement Trump makes, but also the ones the circulate through US conservatism right now. They’re not using words like normal people…to describe things…they are trying to manipulation, deception and now violence to force people into accepting that “reality” is what they insist.

Given a choice between a fiction in which they’re strong and in control and right but people regularly die pointless, cruel deaths…and a world where they concede and less people die, they will choose the former. Other people don’t matter…even people that theoretically should matter to them, they concoct explanations for why they don’t. Hence why most Americans aren’t “real Americans” and thus deserve suffering and disenfranchisement. Hence why non-whiteness means you’re not only unequal under the law, but inherently criminal such that your life can be taken justly by a frightened white person.

This is a wife beater lecturing his spouse about the sanctity of marriage.

re: #467 Backwoods_Sleuth

that whole speech he gave sounded like quotes mined from lots of other historic speeches.

I was waiting for him to say we’ll storm the beaches

It’s probably intentional. At some point a conversation about how to make it sound like a war speech was had. Since these people are stupid and incurious, they can’t do that via originality; instead they mimic the tone of existing texts.

It actually follows from my general statement that these people use words in a very specific, bullshit-centered way. Since everything is about calculating get what they want and what they want is not bound to anything but whim and want—no guiding philosophy that constrains them or demands things of them—all communication is theater. But since they’re trying to manipulate and coerce, the “performances” are built to pander rather than challenge the audience: as such, their messaging is always a salad of tropes…themes and patterns…so that the audience feels that it’s comfortable and familiar.

[Which, in all seriousness, ties into my preoccupation with how reactionaries tend to create incredibly shitty, mediocre art and literature, but also reactionary circles tend to attract mediocre, unsuccessful creatives; it’s a tell.]

More even than Reagan, Trump is skilled with shallow imagery and visual coding. I mean, he’s got his performance shtick, but throughout his career as a fake businessman he’s had consistent aesethetic sense…dictator chic with a side of 80s guy…and then playing a fake business man on The Apprentice and WWE he’s been directly involved in the creation of heightened-emotion, engagement-increasing spectacle that speaks to a set of lowbrow American populism.

The speech with the split screen is his idea of projecting strength… and the shot is very similar to speeches given in movies.

The scary part is…this kind of shit works, if you’ve got the pulse of your audience. People love spectacle, even cruel and ugly spectacle, as long as they empathize with the perps rather than the victims. And Trump is building atop a long-term cultural project of training Americans to enjoy cruelty and see it as normal and natural to inflict cruelty on a vague and ever-shifting set of bad and wrong people.

So, a little car protest parade is coming down our street. At least 100 vehicles. She Who Must Be Obeyed is playing her accordian for the parade. My neighbors are all out clapping. It’s mostly a BLM presence.

Oh by the way, she’s rotating “This Land Is You Land”, “The Eyes of Texas”, and “Amazing Grace”. Going on about 15 minutes, so far.

Sweet!

I’m breathing a slight sign of relief this evening because my enhanced drivers license finally arrived today. I applied for it at the end of February and I was afraid that it wasn’t going to come before my temp license expired. Now if things get so bad I have to bug out I have a proper ID. I think I can even use it to cross the border into Canada.

The border is closed by Canada except for people who live there and essential travel.

On the other hand, throwing yourself on the mercy of Border Services and applying for political asylum might work.

Look at this little pile of dogshit stepping in itself.

See, this is what I mean about these people living entirely within theater: they’re terrifying hollow shells of want that believe in nothing, cannot believe other people actual believe things, and therefore a staged event is just as meaningful an actual event.

The President of the United States had a protest gassed and driven away so he could walk down the street surrounded by an armed battalion…that’s context that diminishes the supposed point, but it doesn’t matter because both the creator and consumer of the image don’t care about context or meaning: reality is what you can get away with claiming, what you can produce a story or image of and present as “real.”

re: #548 The Ghost of a Flea

There are a lot people in this country who live entirely inside fictional settings where the consumption and wielding of symbols is substituted for the act of actual embodying the ideas and values symbolized. We have whole institutions that present that ideals and principles exist separate from their undergirding ideas, but rituals and objects that affirm identity are “true.”

To be pious I could live according to live to Bible, or I can join a church that tells me it is just as good to quote a few lines and purchase megachurch merchandise while not changing myself.

I can defend freedom by engaging deeply with the idea of personal courage and defense of liberty, or I can buy a rifle and tacticool accessories and hang around people who tell me I’m a hero.

I can be antiracist by engaging in self reflection and acknowledging the complex systemic nature of racism, or I can find a token person to bestow me with the label “not racist.”

Crazy thing is…this is exactly what the postmodernist philosophers were worried about: people do not have to engage with ideas sincerely to use ideas to justify their actions, and they don’t have to engage with reality at all even as they insist that they are reasonably and accurately viewing the world. And what makes me scared is that the people who thought about this pointed out that this kind of unreality is intoxicating: there’s no incentive to check back with the world, to admit that what actually is when the story is emotionally gratifying and allows one to evade the frustrating, existentially frightening task of self-examination and admitting your fallibility.
